About modification and amendments in some orders of the Minister of Finance of the Republic of Kazakhstan

I ORDER:

1. Approve the enclosed list of some orders of the Minister of Finance of the Republic of Kazakhstan to which changes and additions are made (further – the List).

2. To provide to department of the legislation of public procurements and purchases of the quasi-public sector of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan after day of its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. Determine that the paragraph the ninety ninth Item 5 of the List since January 1, 2026 is effective in the following edition:

"If on the goods placed in the national catalog any order in electronic shop was not drawn up, the first order through electronic shop for such goods is drawn up by the preorder, except for goods on which the decision of the Government of the Republic of Kazakhstan establishes withdrawals from national treatment.".

4. This order becomes effective after ten calendar days after day of its first official publication, except for paragraphs of third, fourth, fifth, sixth, seventh, eighth and ninth Item 1 of the List, paragraphs of the sixty fifth, the sixty sixth, hundred fifteenth, hundred sixteenth, hundred seventeenth, hundred eighteenth, hundred sixty fifth and hundred sixty sixth Item 5 of the List which become effective since January 1, 2026.

1. 4) excesses of cost of the goods placed in electronic shop of goods to the planned amount of the goods which are purchased by the customer.

Intermediate payments to the Subcontractor which is in the register of the Kazakhstan producers are paid with the Contractor no later than 5 (five) working days from receipt date of intermediate payments from the Customer on the settlement account of the Contractor, taking into account pro rata deduction of earlier paid advance payment.

Payment for the performed Works is made by the Customer by money transfer on the settlement account of the Contractor <payment term> no later than 30 (thirty) calendar days from signature date by the Parties of the act of the performed Works created and signed by means of the electronic and digital signature in information system of authorized body for architectural, town-planning and construction activities of the Republic of Kazakhstan.

Payment for the performed Works to the Subcontractor which is in the register of the Kazakhstan producers is made by the Contractor no later than 5 (five) working days from receipt date of payment from the Customer on the settlement account of the Contractor.

In case of performance of works within one financial year the Customer pays to the Contractor the remained 5 (five) percent from the Agreement amount in the amount of <amount>, within 30 (thirty) calendar days after completion of works and signing of the acceptance act of the Object in operation according to the legislation of the Republic of Kazakhstan on architectural, town-planning and construction activities.

If the term of performance of works with term over one financial year, the Customer pays to the Contractor the remained 5 (five) percent from the Agreement amount in the amount of <amount>, within 30 (thirty) calendar days after completion of works and signing of the acceptance act of the Object in operation according to the legislation of the Republic of Kazakhstan on architectural, town-planning and construction activities in the last year of completion of construction.".

2. Bring in the order of the Minister of Finance of the Republic of Kazakhstan of September 10, 2024 No. 613 "About approval of the list of separate goods, works, services in case of which public procurements to potential suppliers and suppliers additional requirements can be established" (it is registered in the Register of state registration of regulatory legal acts at No. 35054) the following change:
