About introduction of amendments to some acts of the Government of the Russian Federation concerning traceability of turnover of goods, subject to obligatory marking by means of identification

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning traceability of turnover of goods, subject to obligatory marking by means of identification.

2. Recognize to invalid:

paragraphs the seventeenth and eighteenth the subitem "o" of Item of 2 changes which are made to acts of the Government of the Russian Federation concerning marking of the goods which are subject to obligatory marking by means of identification, approved by the order of the Government of the Russian Federation of December 31, 2020 No. 2464 "About introduction of amendments to some acts of the Government of the Russian Federation concerning marking of the goods which are subject to obligatory marking by means of identification" (The Russian Federation Code, 2021, No. 3, the Art. 594);

paragraphs the hundred eighty fifth - hundred ninety third Item of 12 changes which are made to the order of the Government of the Russian Federation of February 28, 2019 No. 224, approved by the order of the Government of the Russian Federation of March 1, 2024 No. 259 "About modification of the order of the Government of the Russian Federation of February 28, 2019 No. 224" (The Russian Federation Code, 2024, No. 11, the Art. 1513);

the paragraph of the seventh of the subitem "b" of Item of 3 changes which are made to acts of the Government of the Russian Federation, approved by the order of the Government of the Russian Federation of November 26, 2024 No. 1630 "About introduction of amendments to some acts of the Government of the Russian Federation" (The Russian Federation Code, 2024, No. 49, the Art. 7606);

the paragraph of the thirty eighth of the subitem "k" of Item of 1 changes which are made to acts of the Government of the Russian Federation concerning turnover of goods, subject to obligatory marking by means of identification, approved by the order of the Government of the Russian Federation of November 30, 2024 No. 1680 "About introduction of amendments to some acts of the Government of the Russian Federation concerning turnover of goods which are subject to obligatory marking by means of identification" (The Russian Federation Code, 2024, No. 49, the Art. 7644).

3. This resolution becomes effective since March 1, 2026.

Changes which are made to acts of the Government of the Russian Federation concerning traceability of turnover of goods, subject to obligatory marking by means of identification

1. In Rules of marking by means of identification of tobacco and nikotinsoderzhashchy products and the organization of traceability of tobacco and nikotinsoderzhashchy products and raw materials for production of such products approved by the order of the Government of the Russian Federation of February 28, 2019 No. 224 "About approval of Rules of marking by means of identification of tobacco and nikotinsoderzhashchy products and the organization of traceability of tobacco and nikotinsoderzhashchy products and raw materials for production of such products and also about the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning tobacco and nikotinsoderzhashchy products" (The Russian Federation Code, 2019, No. 11, Art. 1117; 2022, No. 9, Art. 1344; No. 49, Art. 8690; 2024, No. 11, Art. 1513; No. 49, Art. 7606; 2025, No. 13, Art. 1502; No. 22, Art. 2882, 2911; No. 47, Art. 7188):

Item 2 after the paragraph of the thirty fifth to add 1) with the paragraph of the following content:

b) the global unique identifier of address object (the place of implementation of activities) in federal information address system.";

To add 4) with Item 30 (1) the following content:

"30(1). Since March 1, 2026 to the participant of turnover of tobacco and (or) nikotinsoderzhashchy products it can be refused registration in information system of monitoring in the following cases (in addition to the bases provided in Items 17 and 30 of these rules):

a) lack of the notification (notifications) on the beginning of implementation of separate types of business activity from the participant of turnover of tobacco and (or) nikotinsoderzhashchy products in the unified register of notifications;

b) discrepancy of information containing in the statement for registration in information system of monitoring, information on types of activity and type of the participant of turnover of the tobacco and (or) nikotinsoderzhashchy products specified in the notification (notifications) on the beginning of implementation of separate types of business activity;

c) discrepancy of data on the places of implementation of activities of the participant of turnover of tobacco and (or) nikotinsoderzhashchy products specified in the notification (notifications) on the beginning of implementation of separate types of business activity, to the data on places of implementation of activities provided by the participant of turnover of tobacco and (or) nikotinsoderzhashchy products to information system of monitoring according to these rules.";

Item 36 to add 5) with the subitem "c" of the following content:

"c) type, number and date of the allowing document for the tobacco and (or) nikotinsoderzhashchy products which are subject to assessment of conformity or data on lack of requirements about assessment of conformity (data on the allowing document are represented by the participant of turnover of goods respectively before submission of data according to the Section XII of these rules or submissions of data on import of tobacco and (or) nikotinsoderzhashchy products according to the Section XI of these rules).";

6) Items 38 and 39 to recognize invalid;

To add 7) with Item 40 (1) the following content:

"40(1). To the participant of turnover of tobacco and (or) nikotinsoderzhashchy products refuses in registration of tobacco and (or) nikotinsoderzhashchy products in information system of monitoring, in the presence of one of the following bases (in addition to the bases, stipulated in Item 40 these rules):

a) the allowing documents specified by the participant of turnover of tobacco and (or) nikotinsoderzhashchy products according to the subitem "c" of Item 36 of these rules are absent in the register of the issued certificates of conformity and the registered declarations of conformity;

b) in the register of the issued certificates of conformity and the registered declarations of conformity there are data on invalidity, suspension or cancellation (except as specified cancellation in connection with expiration of the allowing document) the allowing documents specified by the participant of turnover according to the subitem "c" of Item 36 of these rules;

c) the data on the registered tobacco and (or) nikotinsoderzhashchy products specified according to subitems "b", "zh", "i" and "m" - "п" Item 36 of these rules, do not correspond to information on tobacco and (or) nikotinsoderzhashchy products in the allowing document (in the presence of such information in the allowing document), data on which are provided according to the subitem "c" of Item 36 of these rules.";

To add Item 41 with paragraphs of the following content:

"In case of refusal in registration of tobacco and (or) nikotinsoderzhashchy products in information system of monitoring to the participant of turnover of tobacco and (or) nikotinsoderzhashchy products the notification on refusal goes to registration of tobacco and (or) nikotinsoderzhashchy products in information system of monitoring within 3 working days from the date of filing of application about registration of such products.

In case of the direction the participant of turnover of tobacco and (or) nikotinsoderzhashchy products of data on lack of requirements about assessment of conformity according to the subitem "c" of Item 36 of these rules the operator of information system of monitoring within 5 working days from the date of receipt of the statement for registration of tobacco and (or) nikotinsoderzhashchy products sends to the participant of turnover of tobacco and (or) nikotinsoderzhashchy products the notice of registration of tobacco and (or) nikotinsoderzhashchy products in information system of monitoring or about refusal to registration of such products.";

Since June 1, 2026 to the participant of turnover of tobacco and (or) nikotinsoderzhashchy products performing import of tobacco and (or) nikotinsoderzhashchy products to the Russian Federation from the territories of state members of the Eurasian Economic Union in addition to the cases provided by this Item refuses in entering into information system of monitoring of data, stipulated in Item 85 these rules, and the notification on refusal of introduction of data on import of the identification of tobacco and (or) nikotinsoderzhashchy products marked by funds from the territories of state members of the Eurasian Economic Union if the data on allowing documents provided according to Item 85 of these rules were not specified according to the subitem "c" of Item 36 of these rules goes.";

The subitem "d" of Item 87 to state 12) in the following edition:

a) the data on allowing documents provided in customs papers according to information obtained from the Single automated information system of customs authorities according to Item 94 of these rules were not specified according to the subitem "c" of Item 36 of these rules;

b) in the register of the issued certificates of conformity and the registered declarations of conformity there are data on invalidity, suspension or cancellation of allowing documents, data on which are provided in customs papers, according to information obtained from the Single automated information system of customs authorities according to Item 94 of these rules.";

The subitem "zh" of Item 89 to state 14) in the following edition:

"g) reason code of registration in the place of implementation of activities (it is not specified for individual entrepreneurs), the global unique identifier of address object (the place of implementation of activities) in federal information address system of the participant of turnover of tobacco and (or) nikotinsoderzhashchy products (division of the participant of the turnover of tobacco and (or) nikotinsoderzhashchy products) performing export of such products.";

To add 19) with Item 101 (1) the following content:

"101(1). Since March 1, 2026 to the producer of tobacco and (or) nikotinsoderzhashchy products, in addition to cases, stipulated in Item 17 these rules, refuses in entering into information system of monitoring of the data provided by the Section XII of these rules and the notification on refusal of introduction of data goes if the allowing documents submitted according to Item 100 (1) these rules concerning tobacco and (or) nikotinsoderzhashchy products, are absent in the register of the issued certificates of conformity and the registered declarations of conformity or there are data on invalidity, suspension or cancellation of the specified allowing documents.
