About approval of Rules of marking of caviar sturgeon and calves salmon (red caviar) means of identification and the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning caviar sturgeon and calves salmon (red caviar)

The government of the Russian Federation decides:

1. Approve the enclosed Rules of marking of caviar sturgeon and calves salmon (red caviar) by means of identification.

2. Determine that participants of turnover of caviar sturgeon and calves salmon (red caviar) (further - caviar) according to the Rules approved by this resolution:

a) give to the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), the statement for registration in information system of monitoring since April 1, 2024, but no later than 7 calendar days from the date of emergence of need of implementation by the participant of turnover of caviar of the activities connected with input in turnover and (or) turnover, and (or) conclusion from turnover of caviar concerning which the input prohibition in turnover, and (or) turnover, and (or) conclusion from caviar turnover not marked by means of identification (except for the participants of turnover of caviar falling under action of provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation" is established. At the same time the specified participants of turnover of caviar perform registration in information system of monitoring within 30 calendar days from the date of emergence of need of implementation of the activities connected with input in turnover by them and (or) turnover, and (or) conclusion from caviar turnover);

b) provide no later than 15 calendar days from the date of registration in information system of monitoring readiness of own software and hardware for information exchange with information system of monitoring and send to the operator of information system of monitoring the request for passing of testing of information exchange electronically;

c) for work on ensuring readiness of own software and hardware for information exchange with information system of monitoring and for passing of testing of information exchange electronically after registration in information system of monitoring send electronically to the operator of information system of monitoring the request for provision of remote access to the issue registration device placed in infrastructure of information system of monitoring;

d) pass test of information exchange of own software and hardware and information system of monitoring according to the procedure posted on the official site of the operator of information system of monitoring on the Internet concerning the transactions connected with marking of caviar, its input in turnover, turnover and conclusion from turnover according to the Rules approved by this resolution no later than 15 calendar days from the date of readiness of own software and hardware for information exchange with information system of monitoring and the direction of the request according to the subitem "b" of this Item.

3. Determine that:

a) participants of turnover of the caviar relating to codes of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union 1604 31 000 0, 1604 32 001 0, 0302 91 000 0, 0303 91 100 0, 0303 91 900 0, 0305 20 000 0 and to codes of the All-Russian Product Classifier by types of economic activity 10.20.26.111, 10.20.26.112, calves performing input in turnover, put funds of identification for packaging and represent to information system of monitoring of the data on drawing means of identification and input in caviar turnover according to the Rules approved by this resolution since May 1, 2024;

b) the participants of turnover of caviar performing conclusion from caviar turnover (as in case of conclusion from turnover when implementing calculations using the control and cash equipment, and different ways), represent to information system of monitoring of the data on conclusion from caviar turnover according to the Rules approved by this resolution since April 1, 2025;

c) the participants of turnover of caviar performing caviar turnover represent to information system of monitoring of the data on caviar turnover according to the Rules approved by this resolution since April 1, 2025;

d) participants of turnover of caviar have the right to put funds of identification for caviar and to represent to information system of monitoring of the data on drawing means of identification, input in turnover, about turnover and about conclusion from caviar turnover according to the Rules approved by this resolution since April 1, 2024.

4. Determine that in the territory of the Russian Federation input in turnover of caviar of the types specified in the subitem "an" of Item 3 of this resolution without drawing on its packaging of means of identification and representation in information system of monitoring of data on marking of caviar is allowed by means of identification till May 1, 2024.

Release by customs authorities for internal consumption or reimport of the unmarked caviar acquired before May 1, 2024 is allowed till May 31, 2024.

In case of availability (as of May 1, 2024) in the territory of the Russian Federation the unrealized caviar made or imported on the territory of the Russian Federation before the specified date realization of caviar not marked is allowed by means of identification before the termination of expiration date of this caviar.

5. Registration in the information system used for the purpose of carrying out experiment according to the order of the Government of the Russian Federation of April 14, 2023 No. 598 "About carrying out in the territory of the Russian Federation experiment on marking by means of identification of caviar sturgeon and calves salmon (red caviar), packed into consumer packaging" (further - experiment), legal entities and individual entrepreneurs who as of March 31, 2024 were participants of experiment is equated to registration in information system of monitoring according to the subitem "an" of Item 2 of this resolution.

If the data provided within the experiment by participants of turnover of caviar to information system in which information support of carrying out experiment is performed do not meet the requirements of the Rules approved by this resolution, participants of turnover of caviar represent to information system of monitoring missing and (or) urgent data till May 1, 2024.

6. Determine that the operator of information system of monitoring provides:

a) provision to participants of turnover of caviar of remote access to the issue registration devices placed in infrastructure of information system of monitoring on the conditions provided by the Rules approved by this resolution no later than 30 calendar days from the date of obtaining from the participants of turnover of caviar registered in information system of monitoring, the request for provision of remote access to the issue registration device electronically;

b) the organization of testing of information exchange of software and hardware of participants of turnover of caviar and information system of monitoring no later than 30 calendar days from the date of obtaining from the participants of turnover of caviar registered in information system of monitoring, the notification of the readiness to information exchange with information system of monitoring.

7. Operation of this resolution does not extend to caviar on which according to the Rules approved by this resolution, and international treaties of the Russian Federation requirements to obligatory marking by means of identification do not extend.

8. Determine that since May 1, 2024 provision to the participant of turnover of caviar of the codes of marking necessary for forming of means of identification, is performed by the operator of information system of monitoring on paid basis according to the Rules approved by this resolution.

According to the decision of the participant of turnover of caviar provision to it the codes of marking necessary for forming of means of identification, can be performed by the operator of information system of monitoring till April 30, 2024 (inclusive). Such codes of marking are provided by the operator of information system of monitoring free of charge. At the same time the participant of turnover of caviar who received free codes of marking provides their transformation to means of identification and submits in information system of monitoring the report on drawing means of identification and data on input in caviar turnover till April 30, 2024 (inclusive). The operator of information system of monitoring enters into information system of monitoring information on drawing means of identification specified by the participant of turnover of caviar in the report on drawing means of identification after receipt of the specified report. Such service is recognized the information system of monitoring rendered by the operator at the time of entering of information system of monitoring by the operator into information system of monitoring of information on drawing means of the identification specified by the participant of turnover of caviar in the report on drawing means of identification.

If the participant of turnover of caviar who received free codes of marking did not provide their transformation to means of identification and did not submit in information system of monitoring the report on drawing means of identification and data on input in caviar turnover till April 30, 2024 (inclusive), such codes of marking are paid by the participant of turnover of caviar or cancelled according to the Rules approved by this resolution.

9. This resolution becomes effective since March 1, 2024.

I. General provisions

1. These rules determine procedure for marking of caviar sturgeon and calves salmon (red caviar), the subject obligatory marking by means of identification, the requirement to participants of turnover of caviar sturgeon and calves salmon (red caviar), procedure for information exchange of participants of turnover of caviar sturgeon and calves salmon (red caviar) with the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), characteristics of means of identification, and also procedure for representation by participants of turnover of caviar sturgeon and calves salmon (red caviar) the data in information system of monitoring on input in turnover, about turnover and about conclusion from turnover of caviar sturgeon and calves salmon (red caviar).

2. The concepts used in these rules mean the following:

"validation of means of identification" - quality evaluation of transformation of code of marking to means of identification and its drawing regarding compliance of its structure to requirements of these rules;
