Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming of the collection of the made provisional solutions of customs authorities of state members of the Eurasian Economic Union on classification of goods";

The description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming of the collection of the made provisional solutions of customs authorities of state members of the Eurasian Economic Union on classification of goods";

Procedure for accession to general process "Forming of the collection of the made provisional solutions of customs authorities of state members of the Eurasian Economic Union on classification of goods".

Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming of the collection of the made provisional solutions of customs authorities of state members of the Eurasian Economic Union on classification of goods"

I. General provisions

1. These rules are developed according to the following international treaties and acts constituting the right of the Eurasian Economic Union (further – the Union):

The agreement on the Eurasian Economic Union of May 29, 2014;

The agreement on the Customs code of the Eurasian Economic Union of April 11, 2017;

The decision of Board of the Euroasian economic commission of November 6, 2014 №200 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general processes";

The decision of Board of the Eurasian economic commission of January 27, 2015 №5 "About approval of Rules of electronic data exchange in the integrated information system of foreign and mutual trade";

The decision of Board of the Euroasian economic commission of April 14, 2015 № 29 "About the list of general processes within the Eurasian Economic Union and modification of the Decision of Board of the Euroasian economic commission of August 19, 2014 № 132";

The decision of Board of the Euroasian economic commission of June 9, 2015 №63 "About the Analysis technique, optimization, harmonizations and descriptions of general processes within the Eurasian Economic Union";

The decision of Board of the Eurasian economic commission of April 17, 2018 No. 58 "About approval of form of the provisional solution of classification of goods, procedure for its filling and modification (amendments) of such provisional solution";

The decision of Board of the Eurasian economic commission of November 15, 2022 No. 172 "About the Procedure for the direction in the Eurasian economic commission of information from provisional solutions on classification of the goods accepted by customs authorities of state members of the Eurasian Economic Union";

The decision of Board of the Eurasian economic commission of January 14, 2025 No. 6 "About approval of Rules of realization of general process "Forming of the collection of the made provisional solutions of customs authorities of state members of the Eurasian Economic Union on classification of goods".

II. Scope

2. These rules are developed for the purpose of determination of procedure and conditions of information exchange between participants of general process "Forming of the collection of the made provisional solutions of customs authorities of state members of the Eurasian Economic Union on classification of goods" (further – general process), including the description of the procedures performed within this general process.

3. These rules are applied by participants of general process in case of control of procedure for performing procedures and transactions within general process, and also during the designing, development and completion of components of the information systems providing realization of general process.

III. Basic concepts

4. For the purposes of these rules concepts which mean the following are used:

"interested person" – the participant of foreign economic activity or the other person interested in receipt of information necessary for classification of goods according to the CN FEA EEU;

"adjustment" – modification of the provisional solution about classification of goods based on Item 2 of Article 26 of the Customs code of the Union;

"the provisional solution about classification of goods", "provisional solution" – the provisional solution about classification of goods according to the CN FEA EEU made by customs authority of state member of the Eurasian Economic Union;

"the collection of the made provisional solutions of customs authorities of state members of the Eurasian Economic Union on classification of goods", "the collection of provisional solutions" – the general information resource containing information in anonymous form from provisional solutions about classification of goods;

"the central customs authority" – the state body of state member of the Eurasian Economic Union authorized in the field of customs affairs.

The concepts "single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union", "CN FEA EEU" are applied in the values defined by the Agreement on the Eurasian Economic Union of May 29, 2014.

The concepts "group of procedures of general process", "information object of general process", "contractor", "transaction of general process", "procedure of general process" and "participant of general process" used in these rules are applied in the values determined by the Analysis technique, optimizations, the harmonization and the description of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of June 9, 2015 № 63.

8. For goal achievement of general process it is necessary to solve the following problems:

a) provide realization of information exchange between the central customs authorities of state members of the Union and the Eurasian economic commission (further respectively – the central customs authorities, state members and the Commission) for the purpose of submission by the central customs authorities to the Commission of up-to-date and reliable information from provisional solutions about classification of goods;

b) provide automatic creation of the collection of provisional solutions on the basis of the data which arrived in the Commission;

c) provide placement of data from the collection of provisional solutions on information portal of the Union, and also provision to interested persons of access to these data.

2. Participants of general process

9. The list of participants of general process is provided in table 1.

3. Structure of general process

10. General process represents set of the procedures grouped according to the destination:

a) procedures of forming of the collection of provisional solutions;

b) procedures of representation to interested persons of the data containing in the collection of provisional solutions.

11. In case of execution of procedures of general process information exchange between participants of general process is performed.

Within performing procedures of general process forming of the collection of provisional solutions on the basis of data from the provisional solutions made by customs authorities on classification of goods, and also data on adjustment, on response and (or) on cancellation of such decisions sent by authorized bodies of state members to the Commission, and also submission of data by the Commission from the collection of provisional solutions to interested persons is performed.

When forming the collection of provisional solutions the following procedures of general process included in group of procedures of forming of the collection of provisional solutions are performed:

a) inclusion of data in the collection of provisional solutions;

b) change of the data containing in the collection of provisional solutions;

c) exception of the data containing in the collection of provisional solutions.

In case of submission of data to interested persons the "Receipt of Data from the Collection of Provisional Solutions through Information Portal of the Union" procedure included in group of procedures of representation to interested persons of the data containing in the collection of provisional solutions is performed.

Information exchange between authorized bodies of state members and the Commission, is performed with use of the integrated information system of the Union (further – the integrated system). Access to data from the collection of provisional solutions for interested persons is provided through information portal of the Union.

13. The procedure for performing procedures of general process, grouped according to the destination, including the disaggregated activity description, is given in the Section VIII of these rules.

14. For each group of procedures the general scheme showing bonds between procedures of general process and procedure for their accomplishment is provided. The general scheme of procedures is constructed with use of the graphical notation of UML (unified modeling language – Unified Modeling Language) and supplied with the text description.

4. Group of procedures of forming of the collection of provisional solutions

15. Performing procedures of forming of the collection of provisional solutions begins in case of adoption of the provisional solution by customs authority about classification of goods, in case of adjustment of the made provisional solution, in case of response or cancellation of such decision.

Within forming of the collection of provisional solutions by customs authority uniqueness of registration numbers of provisional solutions about classification of goods is provided.

In case of adoption of the provisional solution by customs authority about classification of goods the authorized body of state member creates and represents to the Commission in the automatic and (or) automated mode in terms, stipulated in Item 7 Procedures for the direction in the Commission of information from provisional solutions on classification of the goods accepted by customs authorities of state members, No. 172 approved by the decision of Board of the Commission of November 15, 2022 (further – the Procedure), data from the provisional solution made by customs authority which effective period did not expire which was not changed, was not withdrawn and which is not terminated (further – data for inclusion in the collection of provisional solutions). In case of representation of state member by authorized body in the Commission of the specified data the "Inclusion of Data in the Collection of Provisional Solutions" procedure is performed (P.GC.02.PRC.001).

In case of adjustment of the provisional solution made by customs authority about classification of goods the authorized body of state member creates and represents to the Commission in the automatic and (or) automated mode in terms, stipulated in Item 10 About, data on adjustment of the provisional solution made by customs authority from which data are included in the collection of provisional solutions, including data on the old provisional solution which is terminated in connection with adjustment, and on the new provisional solution (further – data for modification of the collection of provisional solutions). In case of representation of state member by authorized body in the Commission of the specified data the "Change of the Data Containing in the Collection of Provisional Solutions" procedure is performed (P.GC.02.PRC.002).
