About questions of procedure for realization of the vehicles which are in state-owned property

For the purpose of optimization of procedure for alienation of state-owned property, according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve Regulations on procedure for realization of the vehicles which are in state-owned property according to appendix.

2. Recognize to invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of methodical recommendations about value assessment of property of subjects to privatization" of March 19, 2003 No. 143;

2) the order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic of March 19, 2003 No. 143 "About approval of methodical recommendations about value assessment of property of subjects to privatization" of September 17, 2007 No. 414;

3) the order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic of March 19, 2003 No. 143 "About approval of methodical recommendations about value assessment of property of subjects to privatization" of July 2, 2008 No. 357;

4) Item 2 of the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of August 16, 2008 No. 463;

5) Item 1 of the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic regulating questions of privatization of state-owned property" of December 8, 2010 No. 309.

3. This resolution becomes effective after fifteen days from the date of official publication.

Regulations on procedure for realization of the vehicles which are in state-owned property

Chapter 1. General provisions

1. This Provision determines procedure and sales terms of the vehicles which are in state-owned property. At the same time vehicles are understood as all types of vehicles (not suitable for use for the purposes of activities of state bodies; which are subject to realization in connection with acquisition of new vehicles; with expired useful life), subject to realization according to this Provision.

2. Realization of the vehicles which are in state-owned property is performed by means of running an electronic auction, and also the different ways provided by this Provision.

3. The realization of vehicles is enabled on the principles of legality, publicity, equality of participants and ensuring the competition.

4. Any legal entities and physical persons can be buyers (acquirers) of the vehicles which are in state-owned property.

5. In this Provision the following concepts are used:

1) authorized state body - the authorized state body in the field of management of state-owned property providing coordination of questions of implementation of realization of vehicles;

2) the asset holder - organizations and the companies with the state pattern of ownership, including the state organizations, in economic maintaining or operational management of which are the state vehicles;

3) electronic auction - the biddings on the realization of the vehicle performed electronically with use of electronic trading platform;

4) the initial price - the vehicle cost established as initial (starting) at electronic auction;

5) bid increment - the allowance by which the starting price and each following price created by electronic trading platform raises during trading;

6) the guarantee fee - the sum of money granted by the applicant who showed willingness to participate in electronic auction for the purpose of acquisition of property right to the vehicle;

7) the electronic trading platform (ETP) - the information trade system placed on the Internet for the organization of electronic auction with possibility of remote participation of subjects of electronic auction by means of making of electronic procedures without the need for their physical presence;

8) regulations of ETP - set of the rules determining the operating procedure of electronic trading platform determined by authorized state body;

9) target realization - sale of the vehicle to certain physical person or legal entity;

10) the vehicle - the device intended for transportation across roads of people and loads or the equipment installed on it and also tractors and self-propelled technological machines.

6. Market value of the vehicle which is subject to realization is determined by results of independent assessment according to the legislation of the Kyrgyz Republic in the field of estimative activities.
