About rule-making activities

Forming of the constitutional state relies on the effective, oriented to achievement of economic and socially important result rule-making process which is implemented taking into account the Concept of legal policy of the Republic of Belarus. The made system solutions on enhancement of rule-making activities found fixing in the Law of the Republic of Belarus corrected in 2026 "About regulatory legal acts".

At the present stage there is also need for updating of approaches to preparation, acceptance and realization of regulatory legal acts. Priority value acquires improvement of quality of documents on the basis of their expert study, scientific justification and accounting of public opinion, and need of response to external and interstate challenges requires immediate adoption of the major legal decisions. For this purpose I decide:

1. Publish Regulations on procedure for preparation and submitting for examination of the President of the Republic of Belarus of drafts of legal acts (appendix 1).

2. Determine that:

The Ministry of Justice, head departments of justice of regional executive committees perform checks of observance in rule-making bodies of requirements to preparation and acceptance (edition) of regulatory legal acts on the basis of the general requirements provided by this Decree (appendix 2);

the procedure for functioning of the automated information system on ensuring rule-making process (AIS "Rule-making") determined by Council of Ministers of the Republic of Belarus is applied.

3. Increase efficiency of the scientific and advisory, expert forming (further - forming) operating under state bodies and the organizations, for what:

staticize their structures, having minimized availability of the same persons in the forming created by different state bodies and the organizations;

it is wider to involve the potential of experts, young scientists and specialists in work of forming;

create the agenda of meetings taking into account topical issues of development of the public relations, including emergence of new challenges and threats of homeland security, need of the advancing legal regulation;

to heads of state bodies and organizations to establish constructive cooperation among themselves for operational approval of provisions according to drafts of legal decisions.

4. Make changes to presidential decrees of the Republic of Belarus (appendix 3).

5. Recognize invalid presidential decrees of the Republic of Belarus (appendix 4).

6. This Decree becomes effective from the date of entry into force of the Law of the Republic of Belarus "About change of the laws concerning rule-making activities".

Regulations on procedure for preparation and submitting for examination of the President of the Republic of Belarus of drafts of legal acts

Chapter 1. General questions

1. According to this Provision are performed preparation by state bodies and organizations (further if other is not established, - state agency) and submitting for examination of the President of the Republic of Belarus of projects:

1.1. decrees and orders of the President of the Republic of Belarus;

1.2. laws, which:

are prepared and are submitted for consideration of the President of the Republic of Belarus according to its order, including for decision making about entering into the House of Representatives of National assembly of the Republic of Belarus;

are brought in the House of Representatives of National assembly of the Republic of Belarus by other persons of law of the legislative initiative if drafts of the laws on content disperse from decrees or presidential decrees of the Republic of Belarus or provide recognition voided decrees of the President of the Republic of Belarus (their structural elements);

are prepared for the purpose of implementation of the international obligations of the Republic of Belarus and according to legal acts are subject to submitting for examination of the President of the Republic of Belarus;

1.3. resolutions of Council of Ministers of the Republic of Belarus, which:

regulate questions of activities of state agencies, directly subordinate (accountable) to the President of the Republic of Belarus;

according to legal acts or orders of the President of the Republic of Belarus are subject to approval of it;

1.4. other legal acts which according to legal acts or orders of the President of the Republic of Belarus are subject to introduction for its consideration.
