4. Declare invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of the Regulations on licensing of activities for use of radio-frequency range" of November 17, 2017 No. 754;

2) the order of the Government of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic "About approval of the Regulations on licensing of activities for use of radio-frequency range" of November 17, 2017 No. 754" of November 12, 2019 No. 601;

Regulations on licensing of activities of operators of telecommunications

Chapter 1. General provisions

1. This Regulations on licensing of activities of operators of telecommunications (further - the Provision) regulate procedure:

1) issues, renewals, suspensions, renewals, the terminations and cancellations of the license for activities of the operator of telecommunications (further - the license) and carrying out licensed control;

2) issues, renewals, suspensions, renewals, the terminations of the decision on assignment of radio frequencies to radio-electronic means and high-frequency devices (further - permission).

2. The body authorized on making of the actions specified in Item of 1 this provision, except for cancellations of licenses is the industry regulator of telecommunications (further - the Licensor).

3. Physical persons or legal entities, irrespective of legal forms and patterns of ownership, shown willingness to perform activities of the operator of telecommunications and (or) to use radio-frequency range, shall obtain the corresponding license and (or) permission.

4. Receipt of permissions for operation of radio-electronic means and high-frequency devices is not required:

1) low power, intended for the purposes of exchange of information or management working with output capacity less than 100 MW whose level of collateral radiations shall not be more value 56+101og (P) or-40 дБн, depending on what value conforms to less strict requirements specified in appendix 7 to this Provision;

2) systems of wireless access of the Wi-fi standard in all territory of the Kyrgyz Republic without use of portable antennas.

5. Recognition in the territory of the Kyrgyz Republic of the licenses granted by authorized bodies of foreign states is performed according to the procedure and the cases provided by the Law of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic".

6. The state fee for issue, renewal of the license and (or) permission, and also issue of their duplicates is levied according to the Code of the Kyrgyz Republic about the non-tax income.

7. The principles of licensing are:

1) transparency, openness of procedures of licensing and issue of permissions;

2) the equal bases and conditions of issue of licenses and (or) permissions for all physical persons and legal entities, irrespective of patterns of ownership, including foreign physical persons and legal entities;

3) prohibition on issue of the additional licenses and (or) permissions connected with the activities which are subject to licensing according to the Law of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic";

4) recognition of conscientiousness of the licensee if other is not proved and is not supported by the relevant documents;
