About approval of Changes in the Procedure for development of the project documentation on construction of facilities

According to part ten of article 31 of the Law of Ukraine "On regulation of town-planning activities", the paragraph of the two hundred ninety fifth subitem 20 of item 4 of the Regulations on the Ministry of the development of communities and the territories of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of June 30, 2015 No. 460 (in edition of the resolution of the Cabinet of Ministers of Ukraine of December 17, 2022 No. 1400),

I ORDER:

1. Approve the Change in the Procedure for development of the project documentation on construction of facilities approved by the order of the Ministry of Regional Development, Construction and Housing of Ukraine of May 16, 2011 No. 45, registered in the Ministry of Justice of Ukraine on June 01, 2011 at No. 651/19389 (in edition of the order of the Ministry of Regional Development, Construction and Housing of Ukraine of March 23, 2012 No. 122) which are applied.

2. To submit to department of pricing, economy and organization of construction this order in accordance with the established procedure on state registration to the Ministry of Justice of Ukraine.

3. To provide to the sector of external communications promulgation of this order on the official website of the Ministry of development of communities and the territories of Ukraine.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the deputy minister Natalya Kozlovskaya.

Changes according to the procedure of development of the project documentation on construction of facilities

1. In the paragraph the fifteenth Item 1 of the word "" about electronic confidential services "" shall be replaced with words ""About electronic identification and electronic confidential services"".

2. In Item 3:

paragraph one after the words "" to add basic data on designing with words", including, in case of creation of estimate part of the project documentation of construction object, the budgetary funds realized with attraction, at the expense of own means of the state and utility companies, organizations and the organizations, and also the loans granted under the state guarantees - the list of material resources and their price in investor estimate documentation. Such list is confirmed by the customer by imposing of the qualified digital signature.";

add Item with the new paragraph of the following content:

"The customer provides reliability of the documents submitted for development of the project documentation on construction.".

3. In subitem 4.1 of item 4:

the paragraph one after the words "affirms the customer" to add with words "by imposing of the qualified digital signature,";

in the paragraph the second to replace the words "it can be created" with the word "is created";

after the paragraph of third to add with the fourth paragraph of the following content:

"The design assignment containing information on which operation of the Law of Ukraine "On the state secret" expatiates and also for warlike situation in Ukraine and within one year from the date of its termination or cancellation concerning objects of critical infrastructure, subjects to defense appointment on which the signature stamp "For office use" is appropriated to data is developed in paper form.".

With respect thereto the fourth and fifth to consider paragraphs paragraphs the fifth and sixth respectively;

"9.1. The project documentation on asset construction which according to the Law of Ukraine "On regulation of town-planning activities" is developed and created only in electronic form with observance of requirements of the Law of Ukraine "About electronic documents and electronic document management" shall be with the imposed qualified digital signature of the contractor (services) having the qualification certificate in the directions of professional certification connected with creation of objects of architecture, the general designer (designer), GAPA and/or Gip. Separate Sections or parts of the project documentation on asset construction are signed by persons who developed them, by imposing of the qualified digital signature of the contractor (services) having the qualification certificate in the directions of professional certification connected with creation of objects of architecture.

On the Section or parts of the project documentation on technical actions of civil protection the qualified digital signature of persons responsible for their development is imposed, confirmation of project solutions of the Section or part of the project documentation on technical actions of civil protection is performed ГАПом and/or ГИПом by imposing of the qualified digital signature. On copy of the project documentation on asset construction the qualified digital signature of the responsible persons having the qualification certificate and signing the project documentation with use of software of electronic system is imposed.

The project documentation on asset construction affirms the customer with use of the Register of construction activities by imposing of the qualified digital signature. If the project documentation on construction is subject to examination, such project documentation affirms after receipt of the positive expert report on results of examination of the project documentation on construction.

The project documentation on asset construction, the requiring approval by the administrative document or joint decision, is considered the qualified digital signature of the head of the customer or person authorized by the customer approved from the moment of imposing. Such qualified digital signature is imposed on the project documentation on construction with use of the Register of construction activities in day of the edition of the relevant administrative document or joint decision.

9.2. The general designer (designer) loads the project documentation, including data on coordinates of rotary points of borders of contours of construction objects, their altitudes, data on calculation of class of effects (responsibility), data on technical and economic indicators of construction object, the master plan of construction object on topographical basis, through electronic office of Electronic system into the Register of construction activities according to Procedure for maintaining Single state electronic system in the field of the construction approved by the resolution of the Cabinet of Ministers of Ukraine of June 23, 2021 No. 681.

Accuracy of the data makes sure by imposing by person under the direction of which the project documentation on construction, the qualified digital signature is developed.

The project documentation containing information that according to the Law of Ukraine "About the state secret" is the state secret and also for warlike situation in Ukraine and within one year from the date of its termination or cancellation concerning objects of critical infrastructure, subjects to defense appointment on which the signature stamp "For office use" is appropriated to data, is not entered in the Register of construction activities.".

7. To state subitem 13.2 of Item 13 in the following edition:

"13.2. The project decisions which are subject to approval are developed with the maximum disaggregation necessary for reliable determination of estimated cost of construction that will allow to realize the construction project at this cost. At the same time for the construction objects realized with attraction of budgetary funds at the expense of own means of the state and utility companies, organizations and the organizations, and also the loans granted under the state guarantees, the summary requirements statement on the project shall contain codes according to the Codifier of construction products in the main material resources, for ensuring project implementation at the determined cost.".

8. To state subitem 15.5 of Item 15 in the following edition:

"15.5. The project documentation on construction object is developed according to construction regulations, sanitary regulations, national standards and codes of past practice which obligation of application is established by the legislation in the field of town-planning activities, acting on the date of receipt of the expert report.

Modification of the approved project documentation on construction should be performed:

in case of entry into force of new construction regulations or modification in acting except for the case provided by the paragraph the tenth this subitem;

in case of change of the main project decisions, amounts of the construction works which arose owing to circumstances which could not be provided in designing time and cannot be executed within the approved project documentation, technical and economic (technical) indicators leading to change;

in case of loss of relevance of estimate part of the approved project documentation on construction object realized with attraction of budgetary funds at the expense of own means of the state and utility companies, organizations and the organizations, and also the loans granted under the state guarantees for date of procedures of purchases;

in case of exhaustion of the limit of means provided by summary estimate calculation of construction cost, or reasonable value addition of the labor and material resources necessary for accomplishment of remaining balance of project works, being on implementation phase if such increase cannot be compensated for the account of funds for covering of the additional expenses connected with inflationary tendencies for the objects realized with attraction of budgetary funds, own means of the state and utility companies, organizations and organizations, and also the funds raised under the state guarantees.

In other cases, according to the decision of the customer, taking into account requirements of the legislation in the field of town-planning activities.

Changes in the approved project documentation on construction are developed according to this Procedure.

Change during construction of the customer of construction is not the basis for adjustment of the project documentation on construction of facilities.

In case of asset construction concerning which the right to accomplishment of construction works is acquired modification of the project documentation on construction on the bases determined by the paragraph third this subitem is performed according to the decision of the customer.

In case of state registration of special property right or encumbrance of the corporeal rights for benefit of persons who paid partially the price of future real estate object, adjustment of the project documentation on construction in the cases determined by part twelve of article 31 of the Law of Ukraine "On regulation of town-planning activities" is performed with the consent of the corresponding person.

If the changes made to the approved project documentation on construction led to change of class of effects (responsibility) of object with insignificant (CC 1) on average (CC 2) or considerable (CC 3), from average (CC 2) on considerable (CC 3) class of effects (responsibility), such project documentation on construction is subject to obligatory examination according to the Approval procedure of construction projects and the conducting their examination approved by the resolution of the Cabinet of Ministers of Ukraine of May 11, 2011 No. 560.

In the project documentation the data determined according to the Procedure for maintaining Single state electronic system in the field of construction approved by the resolution of the Cabinet of Ministers of Ukraine of June 23, 2021 No. 681 are specified construction.

In case of modification of the approved project documentation on construction the project documentation on construction with automatic assignment of registration number by it in electronic system is entered in the Register of construction activities:

1) in case of submission of the project documentation on construction for conducting examination;

2) before filing of application about state registration of changes in data on the right to accomplishment of construction works which contain in the Register of construction activities (if expertize of such project documentation was not carried out according to the Approval procedure of construction projects and the conducting their examination approved by the resolution of the Cabinet of Ministers of Ukraine of May 11, 2011 No. 560).".

9. In the paragraph the second subitem 16.1 of Item 16 of the word "it is signed according to the requirements established by estimate norms and standard rates concerning pricing." shall be replaced with words "it is constituted and signed according to the requirements established by estimate norms of Ukraine concerning pricing in construction.".

10. In Item 21:

third to state the paragraph in the following edition:

"Results of environmental impact assessment are applied to the project documentation on construction for the objects which are subject to environmental impact assessment according to the Law of Ukraine "About environmental impact assessment".".
