About approval of Rules of certification of operators
For the purpose of enhancement of the procedure of certification of operators, according to article 5 of the Air code of Ukraine, and also according to the Presidential decree of Ukraine of July 15, 2004 and in execution of the order of the Cabinet of Ministers of Ukraine of December 22, 2004 of N54412/1/1-04 I ORDER to N803 "About Public Service of Ukraine on Supervision of Safety of Aircraft":
1. Approve Rules of certification of operators (further - Rules) (are applied).
2. (Makovy V. V.) to provide to legal management this order in accordance with the established procedure on state registration to the Ministry of Justice of Ukraine.
3. Bring Rules to all interested organizations registered in the territory of Ukraine which perform operation and maintenance of civil aircrafts, use of airspace and servicing of air traffic, training of aviation specialists in accordance with the established procedure.
4. I reserve control over the implementation of this order.

1.1. These rules extend irrespective of patterns of ownership and departmental accessory to all operators of civil aviation (further - operators) registered in the territory of Ukraine as legal entities and performing operation of civil aircrafts (further - AF), and are obligatory for them. Rules extend also to operators of other aircraft used for commercial purposes.
1.2. Rules establish certified requirements to operators of civil aircrafts, and also procedures of certification of operators and supervision of them.
1.3. Rules are used for development of the operational procedures necessary for the organization of work of operators, for the purpose of safety of aircraft and accomplishment of flights.
1.4. These rules are not applied to the operators performing operation of civil aircrafts (airplanes) for the purpose of accomplishment of commercial transportations and are certified according to rules of certification of the operators performing operation of civil aircrafts (airplanes) for the purpose of accomplishment of commercial transportations agrees requirements of OPS 1.
2.1. In these Rules such terms and determinations are used:
Aviation works - flights of AF during which AF is used for providing specialized work types in such industries as agricultural industry, photography, survey, construction, medical care, supervision and patrol, search and rescuing, air advertizing, suppression of wildfires and other.
Cancellation of the Certificate - the official procedure in system of State aviaservice of Ukraine which determines the Air operator certificate invalid by certain reasons then recovery of the Air operator certificate is made according to those procedures which are provided in case of receipt of the Certificate for the first time.
Vertical echeloning - the interval established between AF in the vertical plane for prevention of collision.
Refusal of the Certificate - the official procedure according to which the certificate holder at own will refuses the activities specified in the Certificate.
Producer - the organization which bears responsibility for production, delivery and ensuring compliance of each copy of the aircraft equipment of the approved standard design made by it.
Operational specifications - the legal document which is integral part of the Air operator certificate in which the rights and restrictions concerning activities of the operator are caused. Operational specifications are used for amendment of general provisions of the Air operator certificate and are not acting separately from it (operational specifications, unlike SEP, are surely attached to the Air operator certificate during its issue).
Quality assurance - all planned systematic actions necessary for creation of sufficient confidence that products or service will conform to the established quality requirements.
The statement for the termination of accomplishment of flights - the official procedure according to which the operator declares temporary impossibility of accomplishment of flights for certain reasons. Recovery of action of the Air operator certificate is made after implementation of additional inspection.
The request for carrying out certification - the official address of the applicant in the corresponding form in State aviaservice of Ukraine concerning obtaining or prolongation of action of the Air operator certificate or modification of special operational provisions.
The applicant - the legal entity or physical person which submitted the application for carrying out certification.
Outside service station - the linear station of the organization for maintenance which is located outside country of incorporation of this organization.
Zone navigation (RNAV) - navigation method which gives opportunity to AF to carry out flight on any desirable trajectory within the action area of radio beacon-type navigation aids or in the limits determined by opportunities of autonomous means or their combinations.
The inspector - the highly-skilled employee of State aviaservice of Ukraine to whom appropriate authority on check of activities of the operator is conferred and who has the corresponding certificate of State aviaservice of Ukraine.
The category II ICAO (CAT II) - exact landing approach and instrument landing with the relative height of decision making less than 60 m (200 feet), but is at least 30 m (100 feet) and in case of visibility range on the runway at least 350 m.
Category IIIA ICAO (CAT IIIA) - exact landing approach and instrument landing:
a) with the relative height of decision making less than 30 m (100 feet) or without restriction of relative height of decision making;
b) with visibility range on the runway 200 m there are at least.
Category IIIB ICAO (CAT IIIB) - exact landing approach and instrument landing:
a) with the relative height of decision making less than 15 m (50 feet) or without restriction of relative height of decision making;
b) with visibility range on the runway it is less than 200 m, but it is at least 50 m.
Category IIIC ICAO (CAT IIIC) - exact landing approach and instrument landing without restriction of relative height of decision making and visibility range on the landing strip (LS).
The management on accomplishment of flights - the document which is developed by the operator and contains information concerning policy, procedures and instructions of the operator for use by the personnel performing the organization and accomplishment of flights.
The management on regulation technical obsluzhivaniyadokument which is developed by the operator and is instructive material for the personnel which are engaged in maintenance.
The commission - the permanent commission of State aviaservice of Ukraine appointed by the chairman of State aviaservice of Ukraine who prepares the decision on issue or cancellation of the Air operator certificate and submits it for approval to the chairman of State aviaservice of Ukraine.
Computer information and analytical system of State aviaservice of Ukraine - the local computer network established in divisions of State aviaservice of Ukrainyi which contains information on operators, AF, personnel of the air transportation of Ukraine and other.
The linear service station - the division of the organization for maintenance created out of the place of dislocation of the main production base for term is at least three months.
Necessary navigation characteristics (RNP) - the indicator of accuracy of observance of navigation characteristics necessary for accomplishment of flights within the established airspace.
The regulating document - the document which contains regulations, rules, the general principles, procedures or characteristics concerning different types of activities or their results.
The organization for maintenance - the organization registered in accordance with the established procedure one of the main activities of which is maintenance of the aircraft equipment and which has the Certificate on the right of accomplishment of the corresponding work types. Both the independent companies, and operators and the airports can act as the organization for maintenance.
Lease of AF - the urgent paid use of AF necessary for the lessee for implementation of business and other activity based on the agreement.
The main list of the minimum equipment (MMEL) - the list constituted by developer for the AF specific type which affirms the state of developer and determines equipment components, defect of one or several of which does not interfere with the beginning of flight. In the main list of the minimum equipment special operational conditions, restrictions can be provided or governed.
The list of the minimum equipment (MEL) - the list providing operation of AF in certain conditions in case of refusal of specific component of the equipment which is constituted by the operator according to the main list of the minimum equipment for the AF this type or more strict requirements.
Flights of the increased range (ETOPS) - flights by airplanes with two engines along routes where flight time at the recommended speed in case of refusal of one engine to the nearest reserve airfield suitable for landing, exceeds 60 minutes.

PASOP - search and rescue ensuring flights.
PSOP - search and rescue ensuring flights.

SEP - special operational provisions to the Air operator certificate.
