1. Approve the enclosed Rules of cost determination of electrical energy (capacity) delivered in the retail market at regulated prices (rates), payments of variations of the actual amounts of consumption from contractual and also expense recoveries in connection with change of contractual amount of consumption of electrical energy.

2. This order becomes effective in accordance with the established procedure.

I. General provisions

1. These rules of cost determination of electrical energy (capacity) delivered in the retail market at regulated prices (rates), payments of variations of the actual amounts of consumption from contractual and also expense recoveries in connection with change of contractual amount of consumption of electrical energy (further - Rules) are developed in pursuance of the order of the Government of the Russian Federation of August 31, 2006 by N530 "About Approval of Rules of Functioning of the Retail Markets of Electrical Energy during Transition Period of Reforming of Power Industry" (The Russian Federation Code, 2006, N 37, Art. 3876; 2007, N 30, Art. 3940).

2. These rules are applied when implementing calculations for the electrical energy (capacity) delivered in the retail market between buyers (producers) of electrical energy (capacity) and the guaranteeing suppliers by the being subjects of the wholesale market (further - GP), the guaranteeing suppliers not being subjects of the wholesale market (further - GP of the second level) which are power supplying with the organizations (further - ESO), the power sales organizations (далееЭСК) which buyers citizens consumers are among and (or) equated to them according to regulatory legal acts in the field of state regulation of rates of group (category) of consumers (buyers) (further - the population), in borders of subjects of the Russian Federation which territories are included in price zones of the wholesale market of electrical energy (capacity).

3. These rules provide:

3.1. Cost determination of electrical energy (capacity) delivered to buyers in the retail market at regulated prices (rates);

3.2 Cost determination of electrical energy (capacity) in case of variation of the actual amounts of consumption from contractual, and also in case of change of contractual amount of consumption of electrical energy;

3.3. Cost determination of electrical energy (capacity) acquired by GP at electric power producers (capacity) in the retail market proceeding from the amount of electrical energy acquired at regulated prices (rates).

3.4. Cost determination of electrical energy (capacity) acquired by the network organization at GP (GP of the second level, ESO, ESK) in the retail market for the purpose of compensation of losses of electrical energy in the power networks belonging to it.

II. Cost determination of electrical energy (capacity) delivered to buyers in the retail market at regulated prices (rates)

4. The cost of electrical energy (capacity) delivered to buyers in the retail market at regulated prices (rates) is determined proceeding from actually delivered amounts calculated according to Items 5 - 18 these rules, and rates (for the consumers who are calculated on two-part rate - the tariff charges) on electrical energy (capacity) established for the corresponding category of consumers following the results of settlement period (calendar month).

As actually delivered amount for the purposes of these rules it is understood determined according to the procedure, established by the agreement of power supply (purchase and sale of electrical energy), the quantity of electrical energy accepted and which is subject to payment by the buyer for the corresponding settlement period under the relevant agreement.

5. The cost of the electrical energy delivered at regulated prices to the population is determined as the work of the rate for this category of consumers established by executive body of the subject of the Russian Federation in the field of state regulation of rates and amount of all actual consumption of the population.

6. The cost of the electrical energy delivered to GP (GP of the second level, ESO, ESK) at regulated prices to buyers in the retail markets except the population, is determined as the work of the rate established by executive body of the subject of the Russian Federation in the field of state regulation of rates for the corresponding customer group (for the consumers who are calculated on two-part rate - the tariff charge for electrical energy) and the amount of electrical energy determined taking into account coefficient of distribution of the electrical energy delivered to GP (GP of the second level, ESO, ESK) in the retail market at regulated prices.
