About approval of the Procedure for provision by Administration of State frontier service of Ukraine of Ministry of Labor of information access about crossing by citizens of Ukraine of frontier of Ukraine
For the purpose of settlement of procedure for provision by Administration of State frontier service of Ukraine of Ministry of Labor of data on crossing by citizens of Ukraine of frontier of Ukraine and according to the laws of Ukraine "About obligatory national social insurance on unemployment case", "About government assistance to families with children", "About the government public assistance to needy families", "About information", "About information security in information and telecommunication systems", "About the State Border Service of Ukraine", the resolution of the Cabinet of Ministers of Ukraine of December 12, 2006 N1703 "About Simplification of Procedure for Provision to the Population of Subsidies for Expense Recovery for Payment of Housing and Communal Services, Acquisition of the Liquefied Gas, Solid and Liquid Oven Household Fuel", orders of the Cabinet of Ministers of Ukraine of March 20, 2006 to N357 "Some Questions of Obligatory National Social Insurance on Unemployment Case" and of May 30, 2007 N365-r "About carrying out experiment on implementation of exchange of information between Ministry of Labor and Administration of State frontier service of Ukraine concerning persons who during receipt of the state social and insurance payments crossed frontier or were outside the country", we ORDER:
1. Approve the Procedure for provision by Administration of State frontier service of Ukraine for Ministry of Labor of information access about crossing by citizens of Ukraine of frontier of Ukraine (further - the Procedure) which is applied.
2. To provide to department of the state social protection of the population of Ministry of Labor provision of this order in the Ministry of Justice of Ukraine for state registration.
3. To department of the state social protection of the population, the State jobcenter, Administration of Ministry of Labor and Department of protection of frontier of Administration of State frontier service of Ukraine to carry out work on creation and implementation of subsystem of the remote access from the automated workplaces of officials of the relevant structural divisions of Ministry of Labor to information on crossing by citizens of Ukraine of frontier of Ukraine which is stored in the central storage of data of the central subsystem of the integrated information and telecommunication Metal system of the State Border Service, in accordance with the established procedure to perform providing certain divisions with the corresponding program technical means and their maintenance.
3. To impose control of execution of this order on the first deputy the Minister of Labour and Social Policy of Ukraine Drozdova L. M. and First Deputy Chairman of the State Border Service of Ukraine Shisholin P. A.

1. This Procedure determines procedure for granting Administration of State frontier service of Ukraine of access of Ministry of Labor to information on crossing of frontier of Ukraine by citizens of Ukraine during experiment during the period from June 1 to September 30, 2007 concerning implementation of system of interdepartmental exchange of information concerning citizens of Ukraine who during receipt of the state social and insurance payments crossed frontier or were outside the country.
2. Information on crossing of frontier of Ukraine by citizens of Ukraine is provided by Administration of State frontier service of Ukraine in the presence of it in the accounting database "2.1 Information about persons which crossed frontier of Ukraine" (further - the database of persons) the central storage of data (further - TsHD) the central subsystem of the integrated information and telecommunication system (further - IITS) "Metal" of the State Border Service of Ukraine by the organization of the remote access to this database from the automated workplaces (further - automated workplace) officials of Department of the state social protection of the population and the State jobcenter of Ministry of Labor (further - officials of Ministry of Labor) with use of "request" files, "answer" and "receipt" (further - the remote access).
Rules of forming of the specified files are approved by Administration of State frontier service of Ukraine and Ministry of Labor.
3. Information is provided by the principle "request answer" according to details which are applied.
Each description contains data on one or several events concerning crossing of frontier by citizens of Ukraine.
Forming of the answer is performed on time of receipt of request.
Requests and answers are created in Ukrainian.
4. The remote access to officials of Ministry of Labor to the database of persons of Administration of State frontier service of Ukraine is provided with subsystem program technical means "Access of Ministry of Labor" which is created till July 1, 2007 by Administration of State frontier service of Ukraine.
5. Ministry of Labor provides establishing the remote access by means of city telephone communication, provision of 2-3 local PEVM and analog modems from calculation one modem and one PEVM for one automated workplace, operation of these automated workplaces to destination with use only of certain telephone numbers without access to computer networks of Ministry of Labor and the Internet, and also their anti-virus protection.
6. The query about crossing by citizens of Ukraine of frontier of Ukraine (further - request) in TsHD of the central subsystem of IITS "Metal" is performed by means of automated workplaces which are established in the respective service premises of Ministry of Labor, the State company "Data processing center" and State jobcenter.
7. The structure of the automated workplace software and hardware shall meet the following requirements:
Class PEVM not below R-433 with the hard drive at least 10 GB,
the modem for the two-conductor switched line,
uninterruptible power supply unit,
MS WINDOWS NT 4.0/2000/XP OS and anti-virus software,
The Internet Explorer web browser of the version is not lower than 5. 5,
anti-virus software.
8. Reply to the request which is performed with automated workplace of the official of Ministry of Labor is implemented by means of screen forms which are displayed on the automated workplace monitor.
Replies to the requests are created by the special software (further - SPO) subsystems "Access of Ministry of Labor" on the corresponding server of Administration of State frontier service of Ukraine.
On this server the following folders are created:
"import" - for information processing from "request" files;
"export" - for information processing from "answer" files;
"kvit" - for information processing from "receipt" files.
Synchronization of system hours of automated workplace is performed by certain officials of Ministry of Labor in the telephone mode weekly or, in case of need, after reset of the PEVM operating system on which the automated workplace SPO is established.
9. Requests and answers in TsHD of the central subsystem of IITS "Metal" are unclassified and are performed with use of open channels of communication of city telephone network.
10. All requests in TsHD of the central subsystem of IITS "Metal" are fixed and stored in the online magazine without possibility of unauthorized viewing and change of data concerning request object.
11. The admission of officials of Ministry of Labor to viewing of information obtained from the database of persons is provided by the administrative document of Administration of State frontier service of Ukraine based on the list which is drawn up on the form signed by the Minister of Labour and Social Policy of Ukraine or his deputy and is sent to Administration of State frontier service of Ukraine. In the list surnames, names, middle names, positions of specialists and telephone numbers from which the remote access to the database of persons will be provided are entered. Further on all changes in these Administration of State Frontier Service of Ukraine lists it is informed in writing.
12. Right and primary passwords of access to subsystem "Access of Ministry of Labor" are provided by the TsHD administrator of the central subsystem of IITS "Metal" of the State Border Service of Ukraine. Primary passwords of access to the server are sent by mail in sealed envelopes to certain officials of Ministry of Labor with indication of in the magazine of registration of passwords of TsHD of the central subsystem of IITS "Metal" of the State Border Service of Ukraine. Further primary password changes the official to whom the remote access is provided.
13. In requests the following obligatory details are specified: surname and name of person, birth date, series and passport number of the citizen of Ukraine (in the presence of data), the period of crossing of border, since January 1, 2007, and also file number with documents on the appointed social or insurance payments.
14. The reply of Administration of State frontier service of Ukraine is created according to the available information taking into account the details determined in Item 13 of this Procedure. In addition to details also the name of the check point through frontier of Ukraine, date, time and the direction of crossing (entrance or departure) of frontier of Ukraine request object, and also type, series and number of its passport document is specified.
15. In case of failure, accident or carrying out scheduled works from Administration of State frontier service of Ukraine the person on duty on the ACS center of the Central communication center of the State Border Service of Ukraine immediately informs on it the responsible person of Ministry of Labor by phone.
Failure the stop in functioning of subsystem for up to 30 minutes is considered. The stop in functioning of subsystem more than 30 minutes is considered accident. The party from which there was failure or accident immediately informs another on its reasons, and also on measures which are taken for maintenance. The notification is carried out by the automated workplaces corresponding administrators, and in case of their absence - duty operators.
In case of failure or accident from Ministry of Labor the automated workplace administrator addresses the person on duty on the ACS center of the Central communication center of the State Border Service of Ukraine by phone.
16. On renewal period of operability of subsystem "Access of Ministry of Labor" provision of information is performed by written requests in connection therewith Rather.
17. Performing request about crossing by the citizen of Ukraine of frontier and providing access to the database of faces, Ministry of Labor and Administration of State frontier service of Ukraine are guided by the Constitution of Ukraine, regulatory legal acts of Ukraine and this Procedure.
18. Information which contains in request of Ministry of Labor and information provided by Administration of State frontier service of Ukraine is used only during check of justification of social or insurance payments and implementation of investigations of insured events. The specified information is not subject to distribution and transfer to the third party without written consent of Administration of State frontier service of Ukraine.
19. Officials of Ministry of Labor bear responsibility for violation of the legislation on information of rather illegal disclosure of information obtained from the database of Administration of State frontier service of Ukraine.
