About approval of the Standard regulations on use of public water systems and sewerage

(as amended of the Order of the Government of the Republic of Moldova of 13.11.2007 No. 1288)

According to article 8 of the Law on drinking water (The official monitor of the Republic of Moldova, 1999, Art. N39-41, 167) DECIDES: the Government of the Republic of Moldova

1. Approve Standard regulations on use of public water systems and the sewerage it (is applied).

2. Recommend to bodies of local public authority to develop the regulations on use of utility systems on the basis of the approved Standard provision, approving them without fail with the central industry body of public management.

Standard regulations on use of public water systems and sewerage

I. General provisions

1. Regulations on use of public water systems and the sewerage (further - the Provision) govern the relations between service providers on water supply and the sewerage and users of these services.

2. This provision is developed on the basis of the Law on drinking water, the Marine life protection act of the consumer, the Law on condominiums in housing stock, the Law on power, the Law on privatization of housing stock, the orders of the Government of the Republic of Moldova N463 of May 16, 1997 and N634 of July 5, 2000.

3. In this provision the following concepts are used:

industrial sewage - the sewage received as a result of production engineering procedures of industrial enterprises;

water folding column - the outside device for intake of water is direct from consumer water supply system;

the consumer - the physical person or legal entity using services in water supply and the sewerage on the basis of the agreement signed directly with the supplier (operator);

the distributor - physical person or legal entity which provides to consumers on the agreement services in water supply and the sewerage and is intermediary between the supplier and the consumer;

measuring equipment - the system of installations intended for measurement of consumption of water and amounts of sewage in networks or taken to sewer networks or in natural receivers;

the supplier - the economic agent releasing to consumers drinking water or accepting sewage on centralized systems which he operates;

water consumption limit - the maximum amount of water established for each consumer separately at the level of rational requirement in a definite time (days, month, quarter);

connection to water supply system - complex of constructions by means of which connection of internal water supply system of houses and buildings with general central water supply system is performed;

unauthorized connection - the connection performed without the consent of the supplier or before acceptance by the supplier of works on connection and also use of systems and installations without the relevant contract for leave of water and acceptance of sewage;

outside water water supply system and sewerages - the part of water supply system and the sewerage which is outside buildings, houses, barriers and the territories of the companies and the organizations (before the established differentiation);

water supply system - complex of the installations and constructions used for water intake from natural sources for processing (cleaning), transportation, accumulating and giving to consumers of water of required quantity and quality;

system of the sewerage - complex of channels, auxiliary engineering constructions, pumping points for collection, transportation, cleaning and removal of sewage in receivers;

the subconsumer - physical person or legal entity which uses under the agreement services on water supply and water disposal provided by the supplier whose networks and constructions are connected to networks of water supply and the sewerage of the main consumer.

4. This provision establishes:

service conditions of water supply systems and sewerage of municipal services;

methods of calculation of amounts of the distributed water and amounts of acceptance and removal of sewage;

methods of calculation and payment of the rendered services;

rights and obligations of contracting parties.

5. Action of this provision extends on all legal entities and physical person providing services of water supply and the sewerage irrespective of form of their property.

6. The supplier provides continuous supply of water and acceptance of household and industrial sewage on the basis of the agreement signed with the user and according to the conditions established by the existing regulations.

7. Operation, content, repair, expansion or change of systems and installations of water supply and the sewerage are performed according to the existing standard rates, provisions and standards.

8. Rates for services of water supply, acceptance and sewage treatment are established according to the current legislation.

9. The relations between the supplier and the consumer on rendering and fee on water supply and the sewerages which are not stipulated by this provision are established in addition in the agreement signed between them.

10. The disputes between contracting parties which arose in connection with application of this provision are permitted according to the current legislation.

II. Conditions of use and functioning of water supply systems and sewerage

11. Degree of responsibility for technical condition and content of water supply systems and the sewerage is specified in the relevant protocol which is drawn up by contracting parties.

12. For residential buildings border of differentiation of installations of water supply outside part of wall of the respective building, and for systems of the sewerage - viewing well, the first from the building, is considered. In other cases the border is established based on legislative and regulations and it is specified in the agreement.

13. The connection well, including shutoff valves on network of water supply, is on balance of the supplier.

14. The transit water supply systems passing through basements of buildings are under authority of the supplier who incurs expenses on their lease.

15. The construction of new transit networks through buildings and constructions is forbidden.

16. Placement of transit networks in the territory of certain owners is performed only from their written consent. In the relevant agreement certain conditions which shall be observed in case of construction, operation and repair of transit networks are established.

17. The distribution network to which several consumers are connected is operated it by the distributor or the owner on whose balance there is distribution network.

18. Owners of buildings or the parcels of land through which there pass transit networks shall preserve them and resolve performance of works on content, repair and replacement of pipelines, having the right to compensation of the caused damage.
