About approval of the Instruction on the organization of customs control and customs clearance of the international express departures which move (are sent) through customs border of Ukraine

According to Articles 3, of 11, of 58, of 81, of 152, 187 Customs codes of Ukraine and the resolution of the Cabinet of Ministers of Ukraine of 25.12.2002 of N1948 "Some Questions of Implementation of Customs Control of Goods and Other Objects Which Move (Are Sent) through Customs Border in International Post and Express Departures" (with changes) and for the purpose of creating favorable conditions for acceleration of goods turnover, enhancement of forms and methods of customs control and customs clearance of goods and other objects which move in the international express departures by express carriers, I ORDER:

1. Approve the Instruction on the organization of customs control and customs clearance of the international express departures which move (are sent) through customs border of Ukraine it (is applied).

2. To regional information customs (Koposov S.A.) for ensuring implementation of requirements of this Instruction:

develop the program and information complexes "Register of the Central Marshaling Yards, Regional Marshaling Yards", "Register of Movement of MEO on TsSS (RSS)", "Control of Movement of MEO on ETD", "Accounting and Execution of Customs Declarations M 16";

provide program interaction of the specified complexes among themselves and with the program and information complexes "The Automated System of Customs Clearance of Goods and Other Objects", "Inspector-2006";

approve data transmission formats between customs authorities and express carriers;

develop format of transfer of ETD from customs authority in TsBD EAIS of State Customs Service and make changes to the corresponding software.

3. To provide to department of the organization of customs control (Syomk S. M.) maintaining the Register of the central marshaling yards, regional marshaling yards.

4. To chiefs of regional customs, customs in which zone of activities the central marshaling yards (regional marshaling yards) are located:

4.1. The order of customs authority to determine divisions which officials will carry out customs control and customs clearance of goods and other objects which move in the international express departures.

4.2. Authorize officials who will carry out customs control and customs clearance of goods and other objects which move in the international express departures, to implementation of functions of control of delivery of the international express departures to customs of appointment and check of correctness of determination of their customs value.

4.3. Carry out in case of requirement redistribution of the number of staff and means of the computer equipment and communication between divisions of customs.

4.4. Set working hours of divisions which officials will carry out customs control and customs clearance of goods and other objects which move in the international express departures, depending on amounts and systematicity of receipt of such departures.

5. To chiefs of regional customs, customs to determine persons responsible for implementation of customs clearance of the international express departures and control of observance of terms of their storage by express carrier.

6. To provide to the chief of the Kiev regional customs accommodation of officials of division of customs to which competence control of movement of goods, in the locations of division which officials exercise customs control and customs clearance of goods and other objects which move in the international express departures is referred.

7. To chiefs of regional customs, customs to bring this order to staff permission, to inform subjects of business activity on requirements of this order by lighting it at evident information stands in the locations of divisions of customs and at check points through frontier of Ukraine and to provide its steady accomplishment.

8. Ceased to be valid according to the Order of the Ministry of Finance of Ukraine of 30.05.2012 No. 646

9. To department of the organization of customs control (Syomk S. M.) and Legal department (Not brother L.M.) provide submission of this order on state registration in the Ministry of Justice of Ukraine.

10. Determine that this order becomes effective in 30 days after its official publication, except Item 8 of this order and Sections 1, 4-9 Instructions on the organization of customs control and customs clearance of the international express departures which move (are sent) through customs border of Ukraine which become effective in 90 days after official publication of this order.

The instruction on the organization of customs control and customs clearance of the international express departures which move (are sent) through customs border of Ukraine

I. General provisions

1. Terms in this Instruction are used in such values:

the house transport document - the number shipping document on each separate international express departure (further - MEO);

local network of express carrier - component of worldwide network of tracking of delivery of MEO from the sender to the receiver which is set of divisions of express carrier: the central marshaling yards (further - TsSS) and regional marshaling yards (further - RSS), and also attorneys, and MEO created in Ukraine for provision of services on express transportation;

division of customs clearance (further - PTO) division of customs authority which officials perform customs procedures concerning MEO;

the representative of express carrier - the worker of TsSS or RSS, or the attorney;

the attorney - person who acts on the basis of the contracts of the order with express carrier or TsSS (RSS) also performs presentation of MEO to customs authority on the location of the receiver (sender).

2. The customs authority in which zone of activities TsSS (RSS) is located determines PTO responsible for implementation of customs procedures MEO, and the venue of these procedures is relative (taking into account the location of TsSS/RSS/).

TsSS (RSS) shall be brought in the List of places of arrival of motor transport according to the procedure, established by the order of State Customs Service of 21.11.2005 No. 1136 "About places of arrival of motor transport" registered in the Ministry of Justice of Ukraine 09.12.2005 for No. 1474/11754.

3. For storage of MEO which arrived on TsSS (RSS) the express carrier equips the place(s) of storage of MEO (specially certain and is equipped storage facility or the part of the room isolated by express carrier / the protected territory which excludes possibility of withdrawal of MEO out of customs control/, MEO intended for storage).

4. For implementation of customs control and customs clearance of goods and other objects (further - objects) the customs authority in coordination with express carrier determines on TsSS (RSS) of the customs control zone (further - ZTK).

In the storage location of MEO on TsSS (RSS) permanent ZTK is created.

ZTK are determined by customs authority after approval of the location of TsSS (RSS) by State Customs Service.

5. In case of application to objects which contain in MEO of measures of non-tariff regulation of foreign trade (licensing, certification and so forth) the relevant allowing documents are filed by the representative of express carrier or the receiver (sender) of MEO in PTO (in the location of TsSS (RSS) or the receiver/sender/) when implementing customs control and customs clearance of these objects according to the declared customs regime.

6. For possibility of declaring of objects which move to MEO the express carrier shall obtain the license for implementation of intermediary activities of the customs broker and have in the state of TsSS of persons authorized on declaring.

7. Vehicles of express carrier shall have the certificates on the admission of the road vehicle to transportation of goods under customs seals and seals issued according to the Procedure for realization of regulations of the Customs convention on international delivery of loads using the book of MDP approved by the order of State Customs Service of 21.11.2001 No. 755 and registered in the Ministry of Justice of Ukraine 14.12.2001 for No. 1036/6227 (with changes).

II. Approval of the location of TsSS (RSS)

1. For review the locations of TsSS (RSS) and its inclusion in the Register of the central marshaling yards, regional marshaling yards (further - the Register) the express carrier addresses to customs authority in which zone of activities it is planned to open TsSS (RSS), with the written application about approval of the location of TsSS (RSS) and inclusion of division of express carrier in the Register which form is given in appendix 1 to this Instruction. The statement shall contain reasons for requirement of creation of TsSS (RSS).

2. Notarially attested copies of constituent and registration documents (the charter, the foundation agreement, the registration certificate) business entity, and also certified by express carrier are enclosed to the application:

copies of documents which confirm the property right to objects (buildings, constructions, technical means and communications and so forth) on which floor spaces the arrangement of TsSS (RSS), or right to use is planned by them;

the copy of the agreement between the relevant foreign operator of express transportations who has worldwide network with system of the central and regional marshaling yards, and express carrier of Ukraine about exchange of MEO;

the list of TsSS (RSS) and attorneys who constitute local network of express carrier;

working schedule TsSS (RSS);

copy of the license for implementation of intermediary activities of the customs broker;

copies of documents which confirm availability in the state of TsSS (RSS) of persons authorized on declaring;
