About approval of the Procedure for customs clearance of goods which move through customs border with use of books (cornets) of A.T.A.

For the purpose of issuance of books (cornets) of A.T.A. in Ukraine according to provisions of the Convention on temporary import made in Istanbul on June 26, 1990 based on Article 187 of the Customs code of Ukraine and in pursuance of Item 2 of the resolution of the Cabinet of Ministers of Ukraine of 29.11.2006 No. 1654 "About approval of the Procedure for issue of books (cornets) by A.T.A." I ORDER:

1. Approve the Procedure for customs clearance of goods which move through customs border with use of books (cornets) of A.T.A., it is applied.

2. To department of declaring and customs regimes (Naumenko V. P.) and Legal department (Not brother L.M.) provide submission of this order on state registration in the Ministry of Justice of Ukraine.

3. To department of declaring and customs regimes (Naumenko V. P.) in a month after state registration of this order in the Ministry of Justice of Ukraine to develop also tax on approval to the Chairman of Service the draft of the regulatory legal act directed to settlement of features of application of customs regimes for goods which move through customs border with use of books (cornets) of A.T.A.

4. To regional information customs (Koposov S.A.) before entry into force of this order to develop the software for realization of provisions of the Procedure for customs clearance of goods which move through customs border with use of books (cornets) of A.T.A., approved by this order.

5. To department of customs payments (Dzhigalov S. O.), to Management of financial accounting and reporting (Okolit M. V.), Department of declaring and customs regimes (Naumenko V. P.) and Legal department (Not brother L.M.) before entry into force of this order to develop together with Chamber of Commerce and Industry of Ukraine as the guaranteeing organization which performs issue in Ukraine of books (cornets) of A.T.A., the mechanism of unconditional receipt of funds in the Government budget in the cases of the violations connected with use of noted books (cornets) of A.T.A determined by the current legislation.

6. To chiefs of customs authorities to determine officials, representatives to perform customs clearance of goods which move through customs border with use of books (cornets) of A.T.A.

7. Determine that this order becomes effective since March 1, 2008.

Procedure for customs clearance of goods which move through customs border with use of books (cornets) of A.T.A.

I. General provisions

1. The Nastoshchy Procedure is developed according to Article 187 of the Customs code of Ukraine, the Convention on temporary import made in Istanbul 26.06.90 (further - the Istanbul convention), resolutions of the Cabinet of Ministers of Ukraine of 12.12.2002 N 1855 "About the admission of goods to movement through customs border of Ukraine in temporary import regime (export)" and of 29.11.2006 N 1654 "About approval of the Procedure for issue of books (cornets) by A.T.A.", the Agreement on cooperation between the State Customs Service of Ukraine and Chamber of Commerce and Industry of Ukraine, signed 22.02.2007 in Kiev.

2. This Procedure determines features of the mechanism of application of customs regimes of temporary import (export) and transit to goods which move through customs border of Ukraine according to provisions of the Istanbul convention with use of books (cornets) of A.T.A.

3. In this Procedure terms are used in the values given in the Istanbul convention and the Customs code of Ukraine.

4. The international customs paper - the book (cornet) of A.T.A. (further - A.T.A's book.) it is used as the customs declaration when moving through customs border of Ukraine of goods according to provisions of the Istanbul convention and Appendix B. 1 - B.9 and D to it in customs regimes of temporary import (export) and transit, and also as guarantee of payment of the amounts specified in Article 8 of Appendix A to the Istanbul convention.

5. A.T.A's book. consists from:

covers;

additional sheets to the general list (optionally);

set of detachable documents;

set of continuous documents (roots).
