About approval of Licensed conditions of implementation of economic activity on provision of services on transportation of passengers and loads by road transport according to the work types determined by the Law of Ukraine "About road transport"

According to Articles 5, 6 and 9 Laws of Ukraine "About licensing of certain types of economic activity" and article 9 of the Law of Ukraine "About road transport" we ORDER:

1. Approve Licensed conditions of implementation of economic activity on provision of services on transportation of passengers and loads by road transport according to the work types determined by the Law of Ukraine "About road transport" (are applied).

2. To department of licensing of the State committee of Ukraine concerning regulatory policy and entrepreneurship (Ivanchenko O. B.), the Main state inspection on road transport (Logutov K. V.) provide in accordance with the established procedure submission of this order on state registration in the Ministry of Justice of Ukraine.

3. The main state inspection on road transport (Logutov K. V.) provide the publication of this order in mass media.

4. Declare invalid the order of the State committee of Ukraine concerning regulatory policy and entrepreneurship, the Ministry of transport of Ukraine of 18.12.2003 N 136/985 "About approval of Licensed conditions of implementation of economic activity on provision of services on transportation of passengers and loads by road transport public (except provision of services on transportation of passengers and their baggage by taxi) and Licensed conditions of implementation of economic activity on provision of services on transportation of passengers and their baggage by taxi" registered in the Ministry of Justice of Ukraine 30.12.2003 for N 1259/8580 (with changes).

5. To impose control over the implementation of this order on the vice-chairman of the State committee of Ukraine concerning regulatory policy and entrepreneurship to M. I. Attack and the deputy minister of transport and communication of Ukraine Sergienko L. G.

Licensed conditions of implementation of economic activity on provision of services on transportation of passengers and loads by road transport according to the work types determined by the Law of Ukraine "About road transport"

1. General provisions

1.1. These Licensed conditions are developed according to the Law of Ukraine "About licensing of certain types of economic activity" and the Law of Ukraine "About road transport".

1.2. Licensed conditions determine organizational, technical and qualification requirements to implementation of works which types are determined by the Law of Ukraine "About road transport", when implementing economic activity by provision of services on transportation of passengers and loads by road transport.

1.3. These Licensed conditions are obligatory for accomplishment by subjects of managing who provide services in transportation of passengers and loads by road transport according to the work types determined by the Law of Ukraine "About road transport", and subjects of managing which have current licenses on provision of services on transportation of passengers and loads by road transport public (except provision of services on transportation of passengers and their baggage by taxi) and on provision of services on transportation of passengers and their baggage by taxi (further - licensees).

1.4. In these Licensed conditions terms and determinations are used in the values provided by the Laws of Ukraine "About licensing of certain types of economic activity" and "About road transport".

1.5. Body of licensing of economic activity on provision of services on transportation of the passengers and loads by road transport according to work types determined by the Law of Ukraine "About road transport" is the Main state inspection on road transport (Glavavtotransinspektion).

Territorial authorities of Glavavtotransinspektion in areas, the Autonomous Republic of Crimea, Kiev and Sevastopol (daleeterritorialny managements) provide implementation of functions on preparation of documents for issue and renewal of licenses, issue of duplicates and copies of licenses, recognition invalid and cancellations of licenses and submit them Glavavtotransinspektion.

1.6. For receipt of the license, the copy of the license, the duplicate of the license or in case of renewal of the license the subject of managing personally or through the body authorized by it or person submits to Glavavtotransinspektion or the relevant territorial administration the statement according to appendix 1.

Documents which list is stipulated in Clause 10 Laws of Ukraine "About licensing of certain types of economic activity" and Item 39 of the List of the documents enclosed to the application for licensing for the separate type of economic activity approved by the resolution of the Cabinet of Ministers of Ukraine of 04.07.2001 of N 756, in form according to appendix 2 are enclosed to the application.

1.7. The decision on issue of licenses for implementation of economic activity on provision of services on transportation of passengers and loads by road transport according to the work types determined by the Law of Ukraine "About road transport" or refusal in its issue is accepted by Glavavtotransinspektion no later than 30 calendar days from the date of receipt by it or in the relevant territorial administrations of the statement for licensing and the documents attached to it in time.

1.8. The license is granted for implementation of economic activity on provision of services on transportation of passengers and loads by road transport on the following work types:

provision of services on domestic transports of passengers by buses;

provision of services on domestic transports of passengers by taxi;

provision of services on domestic transports of passengers cars by request;

provision of services on domestic transports of loads by cargo vehicles, trail cars and semitrailer trucks;

provision of services on international carriages of passengers by buses;

provision of services on international carriages of passengers by taxi;

provision of services on international carriages of passengers cars by request;

provision of services on international carriages of loads by cargo vehicles, trail cars and semitrailer trucks.

1.9. The license for implementation of economic activity on provision of services on international carriages of passengers or loads grants the right to the licensee to provide services in domestic transports of passengers or loads.

1.10. On each automotive vehicle one licensed card is applied to the license.

Licensed cards are issued by Glavavtotransinspektion and the relevant territorial administrations.

The licensed card is the form of the strict reporting in which registration these licenses and the automotive vehicle are introduced.

2. Organizational, technical and qualification requirements to implementation of works on provision of services on domestic transports of passengers by buses

2.1. The licensees providing services in domestic transports of passengers by buses shall observe the following organizational requirements:

2.1.1. Transport passengers according to the signed agreement on transportation according to the Civil code of Ukraine and articles 31 and 35 of the Law of Ukraine "About road transport".

2.1.2. Transport passengers according to the Rules of provision of services of passenger road transport approved by the resolution of the Cabinet of Ministers of Ukraine of 18.02.97 N 176.

2.1.3. Provide maintaining route sheets.

2.1.4. Provide realization to passengers of tickets (receipts) for transportation.

2.1.5. Provide the transport driver with necessary documents for transportation of passengers and observance of accomplishment of the obligations assigned to them provided by the Law of Ukraine "About road transport" and the Rules of provision of services of passenger road transport approved by the resolution of the Cabinet of Ministers of Ukraine of 18.02.97 N 176.

2.1.6. Transport passengers on long-distance routes with obligatory provision of places by it for sitting in the quantity provided by technical characteristic of the vehicle and determined in registration documents on this vehicle.

2.1.7. Transport standing passengers on suburban and city routes by buses which on the design have places for standing passengers in the quantity provided by technical characteristic of the vehicle and determined in registration documents on this vehicle.

2.1.8. Transport passengers on bus routes public according to the signed contract with executive bodies and local government bodies according to requirements of the Law of Ukraine "About road transport".

2.1.9. Conclude with the bus stations which are on traffic route, agreements concerning provision by bus stations of the services connected with departure and arrival of passengers (when implementing regular transportations, except city transportations).

2.1.10. Perform departure or arrival of buses of suburban, long-distance bus routes public only from bus stations, and in case of their absence - from the stops provided by the schedule of movement.

2.1.11. Send to flight of two drivers when implementing passenger traffic on bus routes more than 500 km long.

2.1.12. Use the automotive vehicles certified and permitted for use.

2.1.13. Provide conducting check of technical condition, maintenance and repair of vehicles according to Articles 22, of 23, 25-27 Laws of Ukraine "About road transport" and instructions of the manufacturing plants of road vehicles and according to the Regulations on maintenance and repair of road vehicles of road transport approved by the order of Ministry of Transport of Ukraine of 30.03.98 of N 102, registered in the Ministry of Justice of Ukraine 28.04.98 for N 268/2708.

2.1.14. Keep buses in the rooms which are specially adapted for this purpose, garages, on platforms, parking provided with means of protection.

2.1.15. Provide holding training and instructing of drivers in safety of motor transportations, in labor protection and in fire safety with maintaining the relevant magazines.

2.1.16. Provide control of conditions, operating mode and time of rest of drivers according to the Regulations on working hours and time of rest of drivers of vehicles approved by the order of the Ministry of transport of Ukraine of 17.01.2002 of N 18, registered in the Ministry of Justice of Ukraine 04.02.2002 for N 97/6385.
