About approval of Fire safety regulations on rail transport

For the purpose of accomplishment of the Law of Ukraine "About fire safety", ensuring proper level of fire safety on objects and in railway vehicles of rail transport I ORDER:

1. Approve Fire safety regulations on rail transport with appendices (are applied) and to enact them since January 1, 1998.

2. To the First Deputy Minister of Transport - the CEO of Ukrzheldortrans A. V. Slobodyan:

2.1. Register in accordance with the established procedure noted Rules in the Ministry of Justice of Ukraine.

2.2. Bring these Rules to permission of the railroads, the companies, the organizations and organizations of rail transport.

2.3. Together with chiefs of the railroads to organize studying of these Rules by workers of rail transport and to carry out unplanned fire-proof instructing.

3. To consider the fire safety regulations on rail transport approved by the Ministry of Railways of the USSR of 27.12.1978 such which are not applied in the territory of Ukraine.

4. Of 27.04.97 N 146 "About approval of Fire safety regulations on rail transport" to consider the order of the Ministry of transport of Ukraine such which did not gather action.

5. To impose control over the implementation of this order on the First Deputy Minister of Transport - the CEO of Ukrzheldortrans A. V. Slobodyan.

Fire safety regulations on rail transport

1. General requirements of fire safety to objects and railway vehicles

1.1. General provisions

1.1.1. Fire safety regulations on rail transport (further - Rules) are developed according to requirements of the Law of Ukraine "About fire safety" and Fire safety regulations in Ukraine which are approved by the order of the Ministry of Internal Affairs of Ukraine of 22.06.95 N 400 and are registered by the Ministry of Justice of Ukraine 14.07.95 for N 219/755. Rules determine the main requirements of fire safety on objects (buildings, constructions, processing lines and so forth) and in railway vehicles of rail transport and are obligatory for accomplishment by the companies, organizations, organizations and associations of Ukrzheldortrans, and also other companies, organizations, the organizations and citizens who use services of rail transport.

Requirements of fire safety for departmental apartment houses, office and public buildings and other objects which belong to Ukrzheldortrans which were not included into these Rules are determined by Fire safety regulations in Ukraine.

1.1.2. For ensuring fire safety on objects of Ukrzheldortrans it is necessary to be guided by standards, construction regulations, the rules of installation of electroinstallations (RIE), regulations of process design and other regulations on this matter.

1.1.3. Control over the implementation of Rules is exercised according to the current legislation.

1.1.4. Officials and citizens who are responsible for violation of these Rules bear the administrative, criminal or other responsibility according to the current legislation.

1.2. Organizational measures concerning ensuring fire safety

1.2.1. Ensuring fire safety of the companies, organizations, organizations and associations (further - the companies) Ukrzheldortrans is assigned to their heads and the faces authorized by them if another is not provided by the relevant agreement.

1.2.2. Owners of the companies or the bodies authorized by them, and also lessees shall:

- develop complex measures concerning ensuring fire safety, implement achievements of science and technology, positive experience;

- according to regulations on fire safety to develop and approve provisions, instructions, other regulations existing in borders of the company, to exercise constant control behind their observance;

- provide observance of fire-proof requirements of standards, regulations, rules, and also accomplishment of instructions and resolutions of bodies of the state fire supervision (SFS) and the departmental militarized protection (DMP);

- organize for the engineering employees (EE), employees and workers special training, instructing and examination concerning fire safety according to the appendix N 1 to these Rules;

- in case of absence in regulations of the requirements necessary for ensuring fire safety to take adequate measures, approving them with bodies of GPN and Eastern Military District;

- contain in good repair means of fire protection and communication, the fire fighting equipment, the equipment and stock, not to allow their use not to destination;

- organize the voluntary fire team (VFT) or the voluntary fire brigade (VFB), the fire and technical commission (FTC) on object and to ensure their functioning according to relevant provisions, to provide object with fire extinguishing means according to the established regulations;

- create in case of need according to established procedure of division of fire protection and material and technical resources, necessary for their functioning;

- supply upon the demand of fire protection with the information and documents on condition of fire safety of objects;

- in time to inform fire protection on defect of the fire fighting equipment, fire protection systems, water supply, and also on closing of roads and drives in the territory;

- perform measures concerning implementation of automatic means of identification and clearing of the fires and use for this purpose of production automatic equipment;

- make office investigation of cases of the fires.

1.2.3. The director shall determine obligations of officials concerning ensuring fire safety, to appoint certain buildings, constructions, rooms, sites, railway vehicles, the processing and engineering equipment, responsible for fire safety, and also for condition and operation of technical fire protection systems.

Obligations concerning ensuring fire safety, content and operation of means of fire protection shall be displayed in the relevant official documents (functional obligations, instructions, provisions and so forth).

1.2.4. At each company taking into account its fire risk the corresponding fire prevention regime shall be set by the order (instruction), namely shall be determined:

- place of use of naked flame, use of household heating appliances;

- procedure for carrying out temporary fire-dangerous works (as well welding);

- rules of journey and parking of vehicles;

- the storage location and amount of raw materials, semifinished products and finished goods which can be in placements and on the territories at the same time;

- procedure for cleaning of dust and production wastes, storages of the oiled overalls and rags, cleanings of air ducts of ventilating systems of combustible deposits;

- procedure for shutdown of electric equipment;

- inspection routine and closings of rooms after completion of work;

- procedure for passing by officials of training and examination concerning fire safety, and also carrying out with workers of fire-proof instructing and classes in fire technically minimum with appointment of persons responsible for their carrying out;

- procedure for the organization of operation and servicing of available means of fire protection (fire-water supply, pumping points, installations of fire extinguishing, alarm system, smoke removal, fire extinguishers and so forth);

- procedure for carrying out scheduled preventive maintenance, surveys of electroinstallations, ventilating, processing and other engineering equipment;

- actions of workers in case of the fire;

- procedure for collection of members of DPD and responsible officials in case of the fire, challenge at night, in festive and the days off.

Employees of the company shall be informed of these requirements on instructing, during passing of fire and technical minimum. Statements from rules (orders, instructions) with the main requirements and provisions need to be hung out on foregrounds.

1.2.5. The division managers and officials responsible for fire safety in railway vehicles or certain rooms (the isolated workplaces), shall:

- provide observance of the set fire prevention regime, fire safety regulations and instructions concerning actions of fire safety;

- not allow to work of persons who did not undergo special training, instructing or examination concerning fire safety;

- perform periodic inspections of the territory, buildings, production and service premises for the purpose of control of content of ways of evacuation, fire-proof barriers, gaps, entrances and roads, fire extinguishing means (hydrants, internal fireplugs, fire extinguishers) and to take urgent measures for elimination of the found violations and shortcomings;

- provide content in technically serviceable condition of installations of fire extinguishing, the fire alarm, communication;

- watch operability of devices of heating, ventilation, electroinstallations, processing and production equipment and to take measures for elimination of the found defects;

- know fire risk of engineering procedures, processing and production equipment, category of rooms of production and warehouse appointment on fire and explosion and fire risk, and also requirements of fire safety to storage, application and transportation of explosive and flammable substances and materials;

- monitor timely cleaning of rooms and workplaces;

- in case of the fire immediately to report about it in fire protection, to inform heads of object and to start its liquidation, being effective according to requirements of Section 8 of these Rules, and also instructions concerning ensuring fire safety in railway vehicles of rail transport.

1.2.6. Responsibility for ensuring fire safety of locomotives, motorvagonny railway vehicles and refrigerator sections (trains) which are in operation is born:

- drivers - for the locomotives accepted by them, diesel - or electric trains;

- chiefs (mechanics) - for the refrigerator sections (trains) accepted by them;

- chiefs of depot - for locomotives, motorvagonny railway vehicles and refrigerator sections (trains) which are attributed to depot.

They shall fulfill requirements of item 1.2.5 of these Rules, and also the existing instructions concerning ensuring fire safety on locomotives, motorvagonny railway vehicles and refrigerator sections (trains).

1.2.7. Responsibility for ensuring fire safety in passenger trains is born:

- chiefs (mechanics) - for the trains accepted by them;

- conductors, distributors of baggage, freight forwarders of mail vans, directors of dining-cars, managers of compartment buffets, the senior mechanics-dizelisty of cars diesel power plants - for the cars accepted by them;

- persons allowed to servicing of cars with video salons;

- chiefs of car repair sheds (sites, directorates) - for the railway vehicles attributed to depot (the site, directorate), and that which is under repair, irrespective of the place of addition.

Marked-out persons shall fulfill requirements of item 1.2.5 of these Rules, and also the existing instructions concerning ensuring fire safety in cars of passenger trains.

1.2.8. Responsibility and obligations of persons concerning ensuring fire safety in transit of loads are regulated by the Charter of the railroads and Rules of transportation of goods.

1.2.9. At the companies of Ukrzheldortrans where 50 and more persons work, for the solution of labor collective the fire and technical commission (FTC) is created. Its robot needs to organize according to Standard regulations on the fire and technical commission which affirms the Ministry of Internal Affairs of Ukraine.

1.2.10. For the purpose of employees engagement to actions for prevention of the fires, the organizations of their clearing, at the companies of Ukrzheldortrans are created voluntary fire teams (teams) which activities shall be performed according to Regulations on voluntary fire teams (teams) which affirm the Ministry of Internal Affairs of Ukraine.

1.2.11. At each company the instruction about actions of fire safety according to the appendix N 1 to Fire safety regulations in Ukraine shall be developed.

1.2.12. At each company the procedure (system) for the notice of people on the fire with which it is necessary to acquaint all workers shall be established. In rooms on the noticeable place, near phones, it is necessary to arrange plates with indication of phone number for challenge of fire protection and the address of this object.

1.2.13. In buildings and constructions (except apartment houses) which have two floors more, in case of simultaneous stay on the floor it is more than 25 persons, plans (schemes) of evacuation of people for fire case shall be developed and hung out on foregrounds.

1.2.14. Employees of the companies of rail transport shall:

- to accurately nobility and carry out statutory rules of fire safety, not to allow actions which can lead to the fire;

- to strictly fulfill requirements of production schedules (instructions) concerning ensuring fire safety in engineering procedures and in case of operation of railway vehicles;

- not allow use of defective tools, devices, the equipment, to conform to safety rules during their operation, and also to follow instructions of the heads and persons responsible for fire safety;

- carry out cleaning of workplaces and switch-off electric equipment after completion of work;

- be able to apply available fire extinguishing means;

- in case of the fire or identification of its signs immediately to report in fire protection, and in railway vehicles during movement - to the chief (the mechanic, the foreman) of the train or the driver of the locomotive and to take measures concerning liquidation of the fire and evacuation of passengers, being effective according to requirements of Section 8 of these Rules, and also the existing instructions concerning ensuring fire safety in railway vehicles.

1.3. Content of the territory, buildings, constructions and rooms

1.3.1. Content of the territory

1.3.1.1. The territory of the companies shall be kept constantly clean and be cleared systematically of production wastes, garbage, the fallen-down foliage, dry herbs, poplar down and so forth. The oiled cleaning cloths and other fire-dangerous production waste shall be stored on specially allotted sites in metal boxes which are closed. Production wastes which are not subject to utilization need to be removed and exported regularly from the territory of the company.

1.3.1.2. Ways, drives and passes to buildings, constructions and sources of fire-water supply, and also approaches to fire stock, the equipment and fire extinguishing means shall be always free.

1.3.1.5. In parks of stations and depot it is necessary to do special moving through ditches, ditches and railway track for journey of fire trucks. Width of moving shall be at least than 6 m. For relay stations and small objects of the railroad width of traveling covering for journey of fire trucks is allowed by at least 3,5 of m.

1.3.1.8. The administration shall equip places where use of naked flame for burning of garbage is authorized, with ballot boxes from nonflammable materials and place them not closer than 15 m to buildings and constructions.

1.3.1.9. Gate of entrances on the object territory which are opened by means of electric drives shall have devices for otvoreniye them manually.

1.3.1.10. The territory of objects in night-time shall be lit for ensuring bystry identification of fire step-ladders, fire-proof stock, sources of water supply, entrances to buildings and constructions.

1.3.1.11. Booths, tents and other shoddy constructions shall be located at distance at least than 10 meters from other objects, except cases when according to construction regulations it is necessary to have bigger fire-proof gap or when they can be placed near external wall without openings which meets the requirements which are imposed to fire-proof wall.

1.3.1.12. The parking of vehicles in through passages of buildings at distance is less than 10 meters from entrance gate on the object territory, it is less than 5 meters from fire hydrants, intakes of the water supplying network, the fire equipment and stock, on turning platforms of deadlock drives it is forbidden. In noted places the corresponding signs of prohibition shall be arranged (to be hung out).

1.3.2. Content of buildings, constructions and rooms

1.3.2.1. All buildings, constructions and rooms shall be permanent in purity and be cleared timely of production wastes and combustible garbage. Terms of cleaning are established by production schedules or instructions.

1.3.2.2. In case of re-planning of rooms, change of their functional purpose, use of new processing equipment it is necessary to follow fire-proof requirements of the existing regulating documents of construction and process design.

1.3.2.3. Fire-proof systems, the equipment and the equipment of buildings, constructions and rooms (antismoke protection, fire automatic equipment, fire-water supply, fire-proof barriers, etc.) shall contain constantly in working order.

1.3.2.8. 1.3.2.9. Fire protection systems of buildings of the increased number of storeys shall be permanent in capable condition.

1.3.2.12. Not used during working shift of LVZh and GZh shall be taken out to shop storage rooms or be stored in metal boxes (cases). 1.3.2.16. In factory, office, store and auxiliary buildings of object it is forbidden:

- change functional purpose of buildings and rooms without approval of bodies of fire supervision;

- have on the ways of evacuation production equipment, furniture, cases, safes and other objects;

- clean rooms using gasoline, kerosene and other LVZh and GZh;

- leave the household electric equipment which is switched on in the power supply network which use indoors is authorized bodies of fire supervision and power supervision after completion of work;

- decorate walls of rooms with the combustible materials which are not processed by fireproof substances;

- carry out warming of the frozen pipes of various systems by blowtorches, any other means using naked flame.

1.3.2.17. Smoking in the territory of object, in factory, auxiliary and office buildings is allowed only in specially allotted (approved with fire protection) the places equipped with ballot boxes and reservoirs with water. Places shall be for this purpose designated by the corresponding signs.

1.3.2.18. In basements and on first floors of factory and office buildings application and storage of explosives, cylinders with gas under pressure, movies, plastic and other materials which have the increased fire danger is forbidden.

1.3.2.19. Storage of material values on attics, technical floors and in cellars is forbidden.

1.3.2.20. Attics, technical floors and cellars shall contain shut. On doors of these rooms it is necessary to specify the storage location of keys. Windows of attics, technical floors, cellars shall be glazed and shut.

1.3.3. Content of evacuation ways and exits

1.3.3.1. Evacuation ways and exits shall contain free, to be encumbered with nothing and in case of the fire to ensure safety during evacuation of all people who stay in rooms of buildings and constructions.
