About approval of Fire safety regulations on rail transport

According to the Laws of Ukraine "About fire safety", "About rail transport" and for the purpose of ensuring proper level of fire safety on objects and railway vehicles of rail transport I ORDER:

1. Approve Fire safety regulations on rail transport (are applied).

2. (Kostiuk M. D.) to provide to public administration of rail transport of Ukraine:

2.1. Submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

2.2. Bringing this order to data of workers of rail transport of Ukraine and control of its accomplishment.

3. Declare invalid the order of the Ministry of transport of Ukraine of 01.07.97 N 240 "About approval of Fire safety regulations on rail transport", registered in the Ministry of Justice of Ukraine 24.09.97 for N 440/2244.

4. This order becomes effective from 01.08.2010.

5. To impose control over the implementation of this order on the deputy minister Badagov V. F.

Fire safety regulations on rail transport

I. General provisions

1.1. Fire safety regulations on rail transport (further - Rules) are developed according to requirements of the Laws of Ukraine "About fire safety", "About transport" and the Fire safety regulations in Ukraine approved by the order of the Ministry of Ukraine concerning emergency situations of 19.10.2004 of N 126, registered in the Ministry of Justice of Ukraine 04.11.2004 for N 1410/10009 (further - NAPB A.01.001-2004). These Rules determine the main requirements of fire safety on objects (in buildings, constructions, on processing lines, etc.) and in railway vehicles of rail transport and are obligatory for accomplishment by the companies, organizations, organizations and associations Ukrzal? znitsa?, and also other companies, organizations, the organizations and citizens who use services of rail transport.

Requirements of fire safety for the departmental apartment houses, office and public buildings and other objects belonging Ukrzal? znitsa?, which were not included into these Rules, NAPB A.01.001-2004 are determined.

1.2. For ensuring fire safety on objects Ukrzal? znitsa? it is necessary to be guided by standards, construction regulations, regulations for electrical installation (further - PUE), regulations of process design and other regulations on this matter.

II. Organizational actions for ensuring fire safety

2.1. Ensuring fire safety of the companies, organizations, organizations and associations (further - the companies) Ukrzal? znitsa? it is assigned to their heads and persons authorized by them if other is not provided by the relevant agreement.

Obligations of the Parties concerning ensuring fire safety of leased property shall be determined in the lease agreement.

2.2. For the purpose of employees engagement to holding actions for the prevention of the fires, the organizations of their suppression at the companies are formed voluntary fire teams (further - DPD) and teams (further - DPK) which activities shall be performed according to the resolution of the Cabinet of Ministers of Ukraine of 25.02.2009 N 136 "About approval of the Regulations on voluntary fire team (team)".

2.3. At the company where 50 and more people work, for the solution of labor collective the fire and technical commission can be created (further - PTK). Activities of such commission are performed according to requirements of the Standard regulations on the fire and technical commission approved by the order of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash of 20.05.2009 of N 347, registered in the Ministry of Justice of Ukraine of 20.07.2009 for N 658/16674 (further - NAPB B.02.003-2009).

2.4. The procedure for the organization and briefing concerning fire safety (further - fire-proof instructing), special training, training and examination concerning fire safety are established by Standard regulations on instructing, special training and examination concerning fire safety at the companies, in organizations and the organizations of Ukraine, the approved order of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash of 29.09.2003 of N 368, registered in the Ministry of Justice of Ukraine 11.12.2003 for N 1148/8469 (further - NAPB B.02.005-2003).

2.5. At each company the procedure for the notification of people about the fire with which it is necessary to acquaint all workers shall be established. In rooms in a visible place near phones it is necessary to establish plates with indication of phone number for challenge of fire protection and the address of this object.

2.6. Obligations of persons concerning ensuring fire safety during transportation of goods are regulated by the Charter of the railroads of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of 06.04.98 of N 457, the Rules of transportation of goods in transport packets approved by the order of the Ministry of transport of Ukraine of 21.11.2000 of N 644, registered in the Ministry of Justice of Ukraine 24.11.2000 for N 874/5095.

2.7. Owners of the companies or the bodies authorized by them, and also lessees shall:

develop complex measures for ensuring fire safety, implement achievements of science and technology, positive experiment on this question;

according to regulatory legal acts on fire safety to develop and approve provisions, instructions on this question, to exercise constant control behind their observance;

provide observance of fire-proof requirements of standards, regulations, rules, and also accomplishment of instructions and resolutions of bodies of the state fire supervision (further - GPN) and departmental fire protection (further - VPO);

organize for workers special training, instructing and examination concerning fire safety;

involve workers of VPO in control of carrying out special training and examination on fire technically minimum;

in case of absence in regulatory legal acts of the requirements necessary for ensuring fire safety to take adequate measures, approving them with bodies of GPN and VPO;

contain in good repair fire protection systems, bonds, notifications about the fire and managements of evacuation of people, fire-water supply, the fire-proof equipment, the fire equipment, not to allow their use not to destination;

organize activities of DPD or DPK, PTK on object, to provide object with fire extinguishing means according to the established regulations;

create in case of need according to established procedure of division of fire protection and material and technical resources, necessary for their functioning;

provide upon the demand of fire protection the information and documents on condition of fire safety of objects, railway vehicles and products which is made by them;

to timely inform fire protection on defect of the fire fighting equipment, fire protection systems, water supply, and also on closing of roads and drives in the territory;

perform actions concerning implementation of automatic means of identification and suppression of the fires and use for this purpose of production automatic equipment;

make office investigation of cases of the fires.

2.8. The director shall determine obligations of officials by ensuring fire safety, to appoint certain buildings, constructions, rooms, sites, railway vehicles, the processing and engineering equipment, responsible for fire safety, and also for condition and operation of fire protection systems and the fire fighting equipment.

Obligations of officials concerning ensuring fire safety, content and operation of fire protection systems and the fire fighting equipment shall be displayed in the relevant documents (job descriptions, provisions, etc.) which are surely provided for acquaintance under the signature.

2.9. At each company taking into account its fire risk the corresponding fire prevention regime shall be set by the order (instruction), namely shall be determined:

smoking areas, use of naked flame, use of household heating appliances;

the storage location of reserve keys from administration, storage, auxiliary rooms and attics;

procedure for carrying out temporary fire-dangerous works (including welding);

rules of journey and parking of vehicles;

the storage location and amount of raw materials, semifinished products and finished goods which can be in placements and on the territories at the same time;

procedure for cleaning of dust and combustible production wastes, storages of the oiled overalls and rags, cleanings of air ducts of ventilating systems of combustible deposits;

procedure for switching off of electric equipment;

inspection routine and closings of rooms after completion of work with indication of in the magazine of survey of rooms before their closing of the name of the room, date, time and results of survey, surnames of persons performing inspection and assurance by their signatures;

procedure for the organization of operation and servicing of the available means of fire protection (fire-water supply, pumping points, fire extinguishing systems and the alarm system, smoke removal, fire extinguishers, etc.);

procedure for carrying out scheduled preventive maintenance, surveys of electroinstallations, ventilating, processing and other engineering equipment;

actions of workers in case of the fire;

procedure for the notification of members of DPD and responsible officials in case of the fire, challenge at night, in festive and the days off;

procedure for passing by officials of training and examination concerning fire safety, and also carrying out with workers of fire-proof instructing and classes in fire technically minimum with appointment of persons responsible for their carrying out.

Employees of the company shall be informed of requirements of fire safety on instructing, during passing of fire and technical minimum. Excerpts from rules (orders, instructions) with the main requirements and provisions need to be hung out on foregrounds.

2.10. The division managers and officials responsible for fire safety in railway vehicles or certain rooms (the isolated workplaces), shall:

provide observance of the set fire prevention regime, fire safety regulations and instructions concerning measures of fire safety;

not allow to work of persons who did not undergo special training, instructing or examination concerning fire safety;

perform periodic inspections of railway vehicles, the territory, buildings, production and service premises for the purpose of control of content of ways of evacuation, fire-proof barriers, gaps, entrances and roads, fire extinguishing means (hydrants, internal fireplugs, fire extinguishers) and to take urgent measures for elimination of the revealed violations and shortcomings;

provide content in technically serviceable condition of fire protection systems, the fire fighting equipment, communication;

watch operability of devices of heating, ventilation, electroinstallations, processing and production equipment and to take measures for elimination of the revealed defects;

know fire risk of railway vehicles, engineering procedures, processing and production equipment, category of rooms of production and warehouse appointment on fire and explosion and fire risk, and also requirements of fire safety to storage, application and transportation of explosive and flammable substances and materials;

monitor timely cleaning of rooms and workplaces;

in case of the fire immediately to notify on it fire protection, to inform heads of object and to start its liquidation, being effective according to requirements of the Section LXX of Rules, and also instructions for ensuring fire safety in railway vehicles of rail transport.

2.11. Are responsible for ensuring fire safety of locomotives, motorvagonny railway vehicles and refrigerator sections (trains) which are in operation:

drivers - for the locomotives accepted by them, diesel - or electric trains;

chiefs (mechanics) - for the refrigerator sections (trains) accepted by them;

chiefs of depot - for locomotives, motorvagonny railway vehicles and refrigerator sections (trains) which are attributed to depot.

Specified persons (within competence) shall fulfill requirements of these Rules, and also the existing instructions for ensuring fire safety on locomotives, motorvagonny railway vehicles and refrigerator sections (trains).

2.12. Are responsible for ensuring fire safety in passenger trains:

chiefs of trains (mechanics) - for the trains accepted by them;

conductors, acceptance inspectors of baggage, freight forwarders of mail vans, directors of dining-cars, managers of compartment buffets, the senior mechanics-dizelisty of cars diesels-power plants - for the cars accepted by them;

persons allowed to servicing of cars with video salons - for the cars accepted by them;

chiefs of car repair sheds (sites) - for the railway vehicles attributed to depot (site), and that which is under repair, irrespective of the place of addition.

Specified persons shall fulfill requirements of these Rules, and also the existing instructions for ensuring fire safety in cars of passenger trains.

2.13. At each company the instruction about measures of fire safety according to appendix 1 to NAPB A.01.001-2004 shall be developed.

2.14. In buildings and constructions which have two floors more in case of simultaneous stay on the floor more than 25 people shall be developed and hung out on foregrounds plans (schemes) of evacuation of people for fire case in which the directions of evacuation, the location of emergency firefighting equipment are specified, to telephone communication, emergency exits, manual fire annunciators. Plans (schemes) of evacuation of people for case of the fire are approved with VPO and shall contain text part about operations procedure on fire case according to requirements of NAPB A.01.001-2004.

2.15. All workers during acceptance for work and in the course of work shall undergo fire-proof instructing. Fire-proof instructing share on introductory, primary, repeated, unplanned and target.

Persons who are employed, connected with the raised fire risk shall previously (prior to independent performance of work) to undergo special training (fire and technical minimum). The workers occupied at works with the raised fire risk shall undergo examination of the corresponding regulatory legal acts on fire safety once a year.

2.16. Employees of the companies of rail transport shall:

to accurately nobility and carry out Rules, not to allow actions which can lead to the fire;

fulfill requirements of production schedules (instructions) concerning ensuring fire safety in engineering procedures and during operation of railway vehicles;

not allow use of defective tools, devices, the equipment, to follow safety rules during their operation, and also to follow instructions of the heads and persons responsible for fire safety;

remove workplaces and switch off electric equipment after completion of work;

be able to apply emergency firefighting equipment and individual remedies of respiratory organs;

in case of the fire or identification of its signs immediately to notify fire protection, and in railway vehicles during movement - the chief (the mechanic, the foreman) of the train or the driver of the locomotive and to take measures concerning liquidation of the fire and evacuation of passengers, being effective according to requirements of the Section LXX of these Rules, and also the existing instructions for ensuring fire safety.

2.17. The beginning of work of the newly created company, commissioning of the new, reconstructed production and other facilities, implementation of new technologies, transfer to production of samples of new fire-dangerous machines, mechanisms, the equipment and products, lease of any rooms without the permission of bodies of the state fire supervision is forbidden, except cases when conducting economic activity is possible by the declarative principle which is determined by the legislation on authorization system in the field of economic activity.

Issue of permission is performed according to the resolution of the Cabinet of Ministers of Ukraine of 14.02.2001 N 150 "About approval of the Procedure for issue by bodies of the state fire supervision of permission to the beginning of work of the companies and lease of rooms" (with changes).

2.18. Products of fire-proof appointment, and also products to which requirements of fire safety are established shall have the certificate of conformity.

2.19. Financing of works in case of new construction, reconstruction, restoration, capital repairs of buildings and other objects, expansion and technical retrofitting of the companies can be carried out only on condition of availability of the positive conclusion of complex state examination which shall contain surely the positive expert opinion of body of GPN as component of complex state examination.

The condition of observance of standard rates concerning fire safety of investing programs and construction projects is determined according to the resolution of the Cabinet of Ministers of Ukraine of 31.10.2007 N 1269 "About approval procedure of investing programs and construction projects and conducting their state examination" (with changes). In the course of complex state examination the observance condition in programs and drafts of standard rates of fire safety and other existing regulatory legal acts is determined.

Performance of works on these objects can be made only after receipt in accordance with the established procedure of construction licenses, accomplishment of construction works and other documents which are provided by the current legislation in construction industry.

2.20. Provision of services and performance of works of fire-proof appointment are performed according to the Licensed conditions of implementation of economic activity on carrying out testing for fire risk of substances, materials, building constructions, products and the equipment, and also the fire fighting equipment, fire and technical arms, products of fire-proof appointment to compliance to the established requirements approved by the order of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash of 25.12.2009 of N 886, registered in the Ministry of Justice of Ukraine 21.01.2010 for N 61/17356, and Procedure for control of observance by licensees of licensed conditions of implementation of economic activity on designing, installation, maintenance of means of fire protection and systems of heating, to assessment of fire-proof condition of objects and carrying out testing for fire risk of substances, materials, building constructions, products and the equipment, and also fire fighting equipment, fire and technical arms, products of fire-proof appointment to compliance to the established requirements approved by the order of the State committee of Ukraine concerning regulatory policy and entrepreneurship, the Ministry of Ukraine concerning emergency situations of 01.09.2004 N 98/34, registered in the Ministry of Justice of Ukraine 13.09.2004 for N 1146/9745 (with changes).

III. Content of the territory

3.1. The territory of the companies shall be kept constantly clean and be cleared systematically of production wastes, garbage, fallen leaves, dry herbs, poplar down, etc. The oiled cleaning cloths and other fire-dangerous production waste shall be stored on specially allotted sites in the closed metal boxes. Production wastes which are not subject to utilization need to be removed and exported regularly from the territory of the company.

3.2. In the territory of the company on foregrounds plates with indication of procedure for challenge of fire protection, signs of locations of emergency firefighting equipment, the traffic pattern of transport in which it is necessary to specify placement of buildings, of reservoirs, hydrants, piers and coolers shall be established (need of installation of such scheme at each specific company is determined by VPO). In parks of stations and depot it is necessary to do special moving through ditches, ditches and railway tracks for journey of fire trucks. Width of moving shall be at least 6 m.

3.10. The administration shall equip places where use of naked flame for burning of garbage is authorized, with ballot boxes from nonflammable materials and place them at distance not closer than 15 m to buildings and constructions.

3.11. Gate of entrances on the object territory which open by means of electric drives shall have devices for opening them manually.

3.12. The territory of objects in night-time shall be lit for ensuring bystry identification of fire step-ladders, the fire equipment, sources of water supply, entrances to buildings and constructions.

3.13. Booths, tents and other shoddy constructions shall be located at distance at least than 10 m from other objects, except cases when according to construction regulations it is necessary to have bigger fire-proof gap or when they can be placed near outside wall without openings which conforms to requirements imposed to fire-proof wall.

3.14. The parking of vehicles in through passages of buildings at distance of less than 10 m from entrance gate on the territory of object, less than 5 m from fire hydrants, intakes of the water supplying network, the fire equipment, on turning platforms of deadlock drives is forbidden. In the specified places the corresponding signs of prohibition shall be arranged (to be hung out).

IV. Content of buildings, constructions and rooms

4.1. All buildings, constructions and rooms shall be kept clean and be cleared timely of production wastes and combustible garbage. Terms of cleaning are established by production schedules or instructions.

4.2. In case of re-planning of rooms, changes of their functional purpose, use of new processing equipment it is necessary to observe fire-proof requirements of the existing regulations of rather construction and process design.

Decrease in project limits of fire resistance of designs and deterioration in conditions of evacuation of people is not allowed.

Start construction, reconstruction, technical retrofitting of rooms, subjects to production and other appointment, implementation of new technologies, it is allowed to release of fire-dangerous products only in the presence of project and other documentation which passed preliminary expert examination (check) on compliance to regulations on fire safety in bodies of GPN.

Performance of works on these objects can be made only after receipt in accordance with the established procedure of construction licenses, accomplishment of construction works and other documents which are provided by the current legislation in construction industry.

4.3. Fire protection systems of rooms, buildings and constructions (antismoke protection, fire automatic equipment, fire-water supply, fire-proof doors, valves, other protection devices in fire-proof walls and overlappings, etc.) shall contain in the serviceable working condition constantly.

4.4. Openings in fire-proof walls, partitions and overlappings shall be protected by fire-proof doors, windows, curtains, fireproof valves, water veils, etc.

4.5. The equipment which provides dense closing of doors of staircases, corridors, platforms, lobbies and halls (closers, sealant) shall be constantly operational.

It is not allowed to establish any devices interfering normal closing of fire-proof doors and also to remove devices for their self-closing.

4.6. In places of crossing by engineering communications of fire-proof obstacles and designs with the normalized limits of fire resistance it is necessary to apply special sealing diaphragms which prevent spread of fire and provide the normalized limit of fire resistance of design.

4.7. Wooden elements shall be processed by means of fire protection which provide the first group of fireproof efficiency according to GOST 16363-98 "Means fireproof for wood. Method of determination of fireproof properties".

After accomplishment of fireproof works by contract organization which has the corresponding license with the assistance of the customer the statement of the performed works shall be drawn up. After the termination of effective periods of processing (impregnation) and in case of loss or deterioration in fireproof properties processing (impregnation) needs to be repeated. It is necessary to perform condition of fireproof processing (impregnation) at least once a year with creation of the inspection statement.
