About some questions of consumer protection

According to article 4 of the Law of the Republic of Belarus of July 8, 2008 "About entering of amendments and changes into some laws of the Republic of Belarus concerning consumer protection" the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve enclosed:

Regulations on procedure for conducting examination of goods (results of the performed works, the rendered services), accuracy of the information about goods (works, services);

Regulations on procedure for realization of separate nonfoods, service life and (or) storage duration of which expired (except medicines).

2. Make changes and additions to the following resolutions of Council of Ministers of the Republic of Belarus:

2.1. in the resolution of Council of Ministers of the Republic of Belarus of June 14, 2002 No. 778 "About measures for implementation of the Law of the Republic of Belarus "About consumer protection" (The national register of legal acts of the Republic of Belarus, 2002, No. 71, 5/10637):

2.1.1. in word preamble "the paragraph the fifth article 50 of the Law" to replace with the word "Law";

2.1.2. in Item 1:

state paragraph two in the following edition:

"Regulations on procedure for provision to the consumer for repair or replacement of consumer durables gratuitously in temporary use of similar goods;";

the fourth to state the paragraph in the following edition:

"The inventory of long-term use, including components and components of the main product which after certain term can pose hazard to life, health, heredity, property of the consumer and the environment which service life the manufacturer shall establish;";

2.1.5. To be reworded as follows the list of the nonfoods of proper quality which are not subject to exchange, approved by this resolution it (is applied);

2.2. ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 16.07.2014 No. 686

2.3. ceased to be valid

2.4. ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 22.07.2014 No. 703

2.5. ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 23.03.2026 No. 134

3. To the Ministry of Health to determine procedure for approval of data on indications to application by separate age groupes of the population of dietary supplements to food, alcoholic products, beer, low alcohol drinks, soft energy drinks, products for baby, clinical, treatment-and-prophylactic and dietary food in a month.

4. No. 935 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 22.12.2018

5. This resolution becomes effective in 10 days after its official publication.

Regulations on procedure for conducting examination of goods (results of the performed works, the rendered services), accuracy of the information about goods (works, services)

1. This Provision is developed according to the Law of the Republic of Belarus of January 9, 2002 No. 90-Z "About consumer protection" and governs the relations on conducting examination of goods (results of the performed works, the rendered services) (further – examination) in case of origin between the consumer and the seller, the manufacturer, the supplier, the representative of manufacturer, the seller, the supplier (further – the representative), the contractor of dispute on goods quality (the performed work, the rendered service), reliability of provided information about goods (work, service), and also for the purpose of protection of the rights of uncertain circle of consumers.

This Provision does not extend to the relations on conducting judicial examinations.

2. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus "About consumer protection" and also the following terms and their determinations are applied:

the applicant - the person who submitted the application and (or) signed the contract for conducting examination;

commission examination - examination in which several specialists in conducting examination of one specialty participate;

complex examination - examination in which several specialists in conducting examination for use of different industries of knowledge or different scientific disciplines within one industry of knowledge when carrying out researches participate;

object of examination - goods, result, stage of the performed work, the rendered service, other things and documents concerning which experts make researches (testing, the analysis, assessment);

state bodies on consumer protection - the Ministry of anti-monopoly regulation and trade, local executive and administrative organs, and also other state bodies authorized by the legislation on implementation of the state protection of the rights of the consumer;
