About additional measures for implementation of the Law of the Republic of Uzbekistan "About industrial safety of hazardous production facilities"

For the purpose of ensuring industrial safety of hazardous production facilities, increase in efficiency of data analysis on accident rate and injury rate, "About industrial safety of hazardous production facilities" the Cabinet of Ministers decides researches of the patterns and factors determining origins of accidents, accounting and identification of hazardous production facilities, forming and developments of system of examination of industrial safety, declaring of industrial safety, compulsory liability insurance of the organizations operating hazardous production facilities for damnification of life, to health and property of other persons and the environment according to the Law of the Republic of Uzbekistan:

1. Approve:

Regulations on procedure for identification of hazardous production facilities according to appendix No. 1;

Regulations on system of examination of industrial safety according to appendix No. 2;

The concept of forming and development of system of nondestructive control in the Republic of Uzbekistan according to appendix No. 3;

Regulations on procedure for development and submission of the declaration of industrial safety to state bodies, public associations and citizens according to appendix No. 4;

Regulations on procedure for obligatory civil liability insurance for damnification of life, to health and (or) property of other persons and the environment in case of accident on hazardous production facility according to appendix No. 5.

2. Determine that:

since July 1, 2009 positive experimental testimony of industrial safety of the project documentation of hazardous production facility is the obligatory document in case of registration of construction objects in bodies of the Glavgosarkhstroynadzor and issue of permissions to the beginning of construction installation works;

examination of industrial safety is performed based on the contract between the accredited expert organization and the organization operating (assuming operation) hazardous production facility;

the term of expertize of industrial safety shall not exceed three months from the moment of receipt of set of required materials and documents according to normative and legal and regulating technical documentation in the field of industrial safety and accomplishment of all other conditions of conducting examination.

3. To the state committee of industrial safety of the Republic of Uzbekistan:

provide implementation, functioning and development of system of examination of industrial safety, preparation and retraining of the specialists performing activities in the field of industrial safety;

in a month to develop in coordination with the Ministry of Finance of the Republic of Uzbekistan payment procedure for carrying out accreditation and inspection check-up behind activities of the expert organizations;

in three-months time to provide in accordance with the established procedure development and approval of rules of expertize of industrial safety, accreditation of the expert organizations in the field of industrial safety, carrying out inspection check-up behind activities of the accredited expert organizations, regulations on procedure for preparation and employee assessment of the organizations operating hazardous production facilities and also requirements to the expert organizations performing examination of industrial safety and to registration of experimental testimonies of industrial safety.

4. Make additions to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 6.

5. To the ministries and departments to carry out inventory count in a month and to bring the departmental acts regulating questions of industrial safety into compliance with this resolution and to register in the Ministry of Justice of the Republic of Uzbekistan in accordance with the established procedure.

6. To impose control of execution of this resolution on the Deputy prime minister of the Republic of Uzbekistan Shaismatov E. R.

Regulations on procedure for identification of hazardous production facilities

I. General provisions

1. This Provision according to the Law of the Republic of Uzbekistan "About industrial safety of hazardous production facilities" establishes procedure, the principles and conditions of identification of hazardous production facilities (further - OPO).

2. Identification of OPO is performed for the purposes of accounting of OPO in the State register of hazardous production facilities, and also civil responsibility insurances of the organizations operating OPO for damnification of life, to health and (or) property of other persons and the environment in case of accident on OPO.

3. Identification of OPO is performed by the organization operating OPO, or the expert organization within examination of industrial safety.

For the purpose of civil responsibility insurance of the organizations operating OPO for damnification of life, to health and (or) property of other persons and the environment in case of accident on OPO identification of OPO can be performed only by the expert organization.

4. Identification is the basis for accounting of objects in the State register of OPO.

5. Responsibility for correctness of identification of OPO is conferred on the organization performing identification.

II. The terms and determinations used in this Provision

Accident - destruction of the constructions and (or) technical devices used on OPO, uncontrollable explosion and (or) emission of dangerous substances.

The customer - the organization which addressed with the request for conducting examination.

Identification of OPO - the procedure of determination (identification) of set of signs of OPO for the purpose of their recognition as OPO and the subsequent accounting in the State register of OPO, and also civil responsibility insurance of the organizations operating OPO for damnification of life, to health and (or) property of other persons and the environment in case of accident on OPO.

The identification sheet OPO - the document reflecting set of signs, type and details OPO and also the organization exploiting him.

The expert organization - the organization accredited in accordance with the established procedure performing examination of industrial safety.

III. The main criteria of reference of objects to category and the OPO types

6. In compliance the Law of the Republic of Uzbekistan "About industrial safety of hazardous production facilities" belong the companies or their workshops, sites, platforms, and also other production facilities on which to the category OPO:

1) are used, made, processed, will be formed, stored, transported, the following dangerous substances are destroyed:

the substances capable to form the explosion-fire-hazardous circle;

the hazardous substances belonging on extent of impact on live organism to I, II, III classes of danger (extremely dangerous, highly hazardous and moderately dangerous), according to the approved standards;

explosives which in case of certain types of external impact are capable of very bystry self-extending chemical transformation with allocation of heat and formation of gases;

the production wastes containing substances in concentration, the person hazardous to health and the environment;

2) the equipment working under pressure of more 0,07 of megapascal or at temperature exceeding temperature of boiling of working liquid with normal atmospheric pressure is used;

3) stationary established heavy lift gears, escalators, ropeways, funiculars are used;

4) fusions of ferrous and non-ferrous metals and alloys on the basis of these fusions turn out;

5) mining operations, works on production and mineral processing, and also works in underground conditions are conducted.

7. Reference of object to category OPO is performed in the course of its identification based on establishment of signs of danger of object.
