About approval of the Regulations on procedure for acceptance in operation by the completed construction of facilities of rail transport and the subways

For the purpose of introduction of single procedure for acceptance in operation completed by construction of facilities of rail transport, and also considering specifics of construction of facilities of rail transport and the subways, I ORDER:

1. Approve Regulations on procedure for acceptance in operation by the completed construction of facilities of rail transport and the subways it (is applied).

2. Public administration of rail transport of Ukraine (A. V. Slobodyan):

2.1. Register noted Provision in the Ministry of Justice of Ukraine in accordance with the established procedure.

2.2. Provide on the railroads, associations and the companies of rail transport of accomplishment of this Provision.

3. Consider the finished construction of facilities of rail transport and the subways which voided in the territory of Ukraine, "Acceptance procedures in operation", approved by the Ministry of Railways of the USSR GUKB/4007 of 11.09.81.

Regulations on procedure for acceptance in operation by the finished construction of facilities of rail transport and the subways

1. General provisions

1.1. Finished with construction (reconstruction, expansion, capital repairs, modernization) according to the approved project and the rail lines prepared for operation, others of track, the sites of the railroads transferred to electric draft, the subways, nodes and stations, bridges and tunnels, communication lines, arrangements of automatic equipment and telemechanics, automated control systems and computer centers, the plants of rail transport, office and technical, other structures and constructions of production appointment (further - objects) both on again constructed rail lines, and on the operating networks of the railroads, the subways, territorial associations of industrial rail transport and other companies which are part of Ukrzheldortrans are subject to putting into operation according to the procedure which is established by this Provision.

1.2. Objects can be put into operation only in case of fulfillment of requirements of the project concerning observance of sanitary and hygienic, fire-proof, radiation, ecological and architectural requirements, Rules of technical railway operation, Rules of technical operation of the subways.

1.3. Acceptance in operation of subjects of the state order is performed according to the Provision approved by the resolution of the Cabinet of Ministers of Ukraine of August 5, 1992 No. 449 "About procedure for acceptance in operation finished with construction of facilities of the state order".

1.4. New lines, the railway directions and sites on which works concerning strengthening were carried out (or reconstruction) the second track, the electrified railway districts, the subways, automatic lock-outs, centralized traffic control, semi-automatic blocking, development of nodes and the stations, the plants of rail transport and other subjects to production appointment are accepted in operation in separate queues, complexes, sites, stages, parks or колеям nodes, stations and workshops if it is provided by the approved project or start-up complex and the title list of structure.

At the same time acceptance in operation of the last queue of object, stage, the park, group by Kolya and the last workshop is performed along with acceptance of object in general or its last queue.

1.5. Acceptance in operation of objects concerning which with violation of established procedure changes are made to structure of the start-up complexes provided by the project is not allowed.

In exceptional cases before appointment of the state selection committees body which approved the project can it is brought changes in structure of start-up complexes. At the same time from structure of such complexes the buildings and constructions intended for sanitary consumer services, providing healthy and safe working conditions of workers, cleaning, neutralization and catching of harmful emissions in the environment, dumpings into water and soil and also access track with fronts of loading and unloading, the communication line, meliorative measures, systems of ensuring fire safety shall not be withdrawn.

2. Acceptance in operation finished with construction of facilities of rail transport

2.1. The objects of rail transport finished with construction and prepared for operation are subject to acceptance by the state selection committees.

2.2. For presentation of objects of rail transport to the state selection committees the working commissions which are appointed by the customer (builder) are created and shall check compliance of objects and the mounted equipment to projects;

compliance of accomplishment of installation and construction works to mandatory requirements of construction regulations;

results of complex testing of the equipment;

readiness of objects to operation;

accomplishment of measures concerning providing safe working conditions and production sanitation, environment protection, fire and radiation safety.

2.3. Acceptance by the working commissions of objects and the equipment is drawn up by the relevant acts (appendices 1, 2, 3) which are submitted the state selection committee.

2.4. The buildings finished with construction, constructions and rooms of production, auxiliary appointment which are part of object in case of requirement of their introduction in operation in the course of construction, are accepted by the working commissions with the following presentation of the state selection committee which accepts object in general. Date of Introduction in operation of such objects signature date of the act the working commission is (appendix 4).

2.5. The working commissions affirm (the order, the resolution) the chief of the railroad, the subway, territorial consolidation of industrial rail transport, heads of the companies which establishes, in coordination with the prime contractor, procedure for their work.

The working commissions are created not later than in five-day time after receipt of the written message to the prime contractor about readiness of object or the equipment for delivery.

2.6. The working commission customer representatives (builder), the prime contractor, the subcontract organizations, operational organization, general designer, bodies of the State sanitary and epidemiological surveillance on rail transport, bodies of the militarized fire protection of Ukrzheldortrans, the State ecological inspection and the Gosnadzor of labor protection on rail transport, the State inspectorate for energy saving (on under control objects), representatives of the trade-union organizations of the customer or the operational organization are included.

The customer representative (builder) is appointed the chairman of the working commission.

2.7. The prime contractor submits to the working commissions such documentation:

the list of the organizations which participated in accomplishment of installation and construction works with indication of types of the works performed by them and surnames of the engineering employees responsible for their accomplishment;

set of working drawings according to which the construction of the accepted object with the changes made to them in the course of construction in accordance with the established procedure was performed;

the documents testimonial of quality of materials, designs and products which were applied in case of accomplishment of installation and construction works;

acts for the hidden works and acts of intermediate acceptance of separate responsible designs;

certificates of proof of the mounted equipment, certificates of proof of technological pipelines, internal systems of cold and hot water supply, the sewerage and ventilation, outside networks of water supply, the sewerage, heat supply, gas supply and construction of drainage, acts of consolidation (sealing) of inputs and release of engineering communications in places of their passing through walls of cellars;

certificates of proof of internal and external electroinstallations and power supply networks;

certificates of proof of the equipment of installation of telephones, radiofication, television, alarm system and automation;

certificates of proof of the equipment of fire safety, explosion safety, lightning protection;

acts of radiation inspection of object;

acts of accomplishment of the antiseismic measures provided by the project for construction in seismic countries;

acts of accomplishment of actions in case of construction in the territories with soils which sink, underground developments, karsts;

magazines of performance of works, designer's service, materials of checks by state supervision bodies in the course of construction.

2.8. The working commissions have the right to allocate in case of requirement ad hoc commissions on work types (road bed, artificial constructions, the upper structure of track, contact network, traction substations, communication, depot, the subways, tunnel constructions, electrotechnical devices with systems of telecontrol, sanitary devices and escalators with systems of telecontrol, the organization of movement, economy of construction, fire safety), subcommittees on check of readiness of certain buildings and constructions, devices and arrangements.

The operating procedure of ad hoc commissions is determined by the chairman of the working commission.

2.9. The customer (builder) and the prime contractor shall provide to working selection committee documentation which is stated in Section 3.

All documentation after completion of work of the working commission is transferred to the customer (builder). Acceptance in operation of objects in the absence of proper technical documentation is not allowed.

2.10. Acceptance in operation finished with construction of facilities of rail transport is performed by the state selection committees which are appointed by the bodies which approved the design estimates.

Appointments of the state selection committees are performed not later than in 2 months prior to the due date of putting into operation in case of acceptance of objects of production nature.

2.11. Customer representatives (builder), operational organization, the prime contractor, the general designer, bodies of the State sanitary and epidemiological surveillance on rail transport, bodies of the State fire supervision on rail transport, the State ecological inspection and bodies of labor protection on rail transport, bodies of effective use of fuel and energy resources, executive bodies and local self-government in the territory of which the constructed objects are located are part of the state selection committee.

In case of acceptance in operation of production facilities of rail transport of the state selection committee the representative of the trade-union organization of the customer or the operational organization is included.

The state selection committees are appointed:

The ministry of transport of Ukraine on the biggest and important objects which design estimates are approved by the Ministry of transport of Ukraine. The list of such objects is determined in annual plans of economic and social development of rail transport on structures of production appointment (which begin again, and also transitional structures), which are financed with attraction of financial resources of the Government budget and budget loans.

Public administration of rail transport of Ukraine on structures of production appointment (which begin again, and also transitional structures), which are financed by fund of investment resources of Ukrzheldortrans and own means of the state companies with a settlement estimated cost more than 5 million UAH, to 5 million UAH - chiefs of the railroads and industrial associations of rail transport.

Chiefs of head departments of Ukrzheldortrans or their deputies, heads of the railroads, heads of the companies customers are appointed chairmen of the state selection committees.

2.12. The customer (builder) submits to the state selection committees documentation listed in Item 2. 7, and also:

the certificate of elimination of the defects revealed by the working commissions;

the approved design estimates and the certificate of the main technical and economic indicators of the object accepted in operation;

the list of the project, scientific and other organizations participating in designing of object which is accepted in operation;

documents for assignment of the parcels of land and permission of bodies of the state architectural construction supervision to accomplishment of installation and construction works;

documents on geodetic razbivny basis for construction, and also documents for the geodetic works in the course of construction performed by the customer;

documents on geology and hydrogeology of the building site, on results of testing of soil and analysis of ground waters;

geodetic scheme of the actual arrangement of engineering networks;

passports of the equipment and mechanisms;

acts on the acceptance of buildings, constructions and rooms, the mounted equipment constituted by the working commissions (appendices 1, 2, 3);

acts on acceptance of the buildings, constructions and rooms noted in Item 2.4;

certificates of the local and railway operational organizations that outside communications of cold and hot water supply, sewerages, heat supplies, gas supply, power supply and communication provide normal operation of object and are accepted by them on servicing;

the certificate of compliance of capacities which are entered (for initial stage of development of design capacities) to those capacities which are provided by the project;

the certificate of the actual cost of construction signed by the customer and the contractor;

the generalized materials of the working commission about readiness of object for acceptance in operation by the state selection committee.

2.13. In case of acceptance of object of rail transport with specific conditions of productions the state selection committee has the right to require additional documents concerning specifics of operation of object which is accepted in operation.

2.14. The state selection committees check elimination of the defects found by the working commissions, and readiness of object for acceptance in operation.

2.15. Transfer by the customer of the objects of external rail transport constructed in full the agreed project on balance of the railroad if it is provided by the project, is drawn up by the company customer and management of the railroad through Ukrzheldortrans in accordance with the established procedure.

2.16. In case of acceptance in operation of objects state commission has the right, irrespective of the researches conducted earlier, to appoint additional researches of separate constructions and designs, and also equipment in place for check of their quality, reliability, firmness and durability.

2.17. Acceptance by the state selection committees finished with construction of facilities in operation is drawn up by the act (appendix 5).

The act of the state selection committee of acceptance of objects in operation is signed by the chairman and all members of the commission. In the presence in members of the commission of objections the last shall be considered with the assistance of body which they represent.

Consideration of the act of the state selection committee of acceptance in operation of object, decision making by results of consideration of objections of certain members of the commission and approval of the act by body which appointed the commission are performed in time, not exceeding month after signing of the act concerning subjects to production appointment.

Without signing of the act by representatives of state supervision bodies of putting into operation of object it is not allowed.

Date of Introduction of object in operation is signature date of the act the state selection committee.

The reporting on commissioning of subjects to production appointment joins only objects on which acts of the state selection committee of acceptance in operation, in the presence of the warranty passport certificate of the object issued by the prime contractor are approved.

2.18. The state selection committee in case of detection of unfitness of object to operation draws the motivated conclusion about it in body which appointed the commission, copies sends to the customer and the prime contractor.

2.19. The chairman of the state selection committee shall give to body which appointed the commission:

the act of acceptance of object in operation;

the draft decision on approval of the act of acceptance of object in operation.

2.20. Powers of the state selection committee stop from the moment of approval of the act of acceptance of object in operation.

2.21. Chairmen and members of the state selection committees bear responsibility for the actions in case of acceptance of objects in operation according to the current legislation.

2.22. Documentation specified in Item 2. 7, after acceptance of object in operation should be stored at the customer (builder) or in the operational organization during all useful life.

2.23. In case of acceptance of objects in operation acts of the state selection committees which are appointed Ukrzheldortrans management are constituted in seven copies, and the commissions which are appointed the railroads, the subways, territorial associations of industrial rail transport separated by the companies in six.

3. Documentation provided by the prime contractor of the working commission

3.1. Concerning all construction objects

3.1.1. The list of the organizations which participated in accomplishment of installation and construction works, with indication of types of the works performed by them and surnames of engineering employees, directly actionees of these works.

3.1.2. Set of the working drawings on asset construction developed by the project organizations with texts about compliance of the works performed in nature to drawings or the changes made to them developed by persons, actionees of installation and construction works.

Noted set of working drawings is executive documentation.

3.1.3. Inspection reports of the hidden works and acts of intermediate acceptance of separate responsible designs (support and proginovy constructions of bridges, arches, the codes, retaining walls, the bearing metal and combined steel concrete designs).

3.1.4. General both special magazines of performance of works and magazine of designer's service, materials of inspections and checks of the state and departmental supervision by bodies.

3.1.5. The certificates, technical data sheets or other documents certifying quality of materials, designs, details which are applied in case of accomplishment of installation and construction works.

3.1.6. Acts of testing of the equipment which provides explosion safety, fire safety and lightning protection.

3.1.7. Sheets of check of gabaritnost of the equipment and constructions.

3.1.8. The description of the documents prepared by the prime contractor and executive documentation for transfer to the customer (builder).

3.2. Rather railroad road bed

3.2.1. Acts of delivery of road bed under laying of track with the sheet of control shooting on axis and brows of road bed, measurements of width of road bed on top, inclinations of drain prism and the steepness of slopes, inspection statements of extent of consolidation of soils at embankment.

3.2.2. Sheet of accomplishment of pressure head and drainage ditches, trays and other drainage devices (appendix 6).

3.2.3. Pokilometrovy sheet of strengthenings of slopes of road bed and drainage constructions (appendix 7).

3.2.4. Cross profiles of embankments and dredging which are constructed on individual projects, with drawing geological structure and the characteristic of soils, methods of dumping and consolidation of embankments.

3.2.5. The sheet of condition of automobile ways which are accepted in assignment strip, their arrangement concerning track axis, width and type of clothes.

3.2.6. The sheet of the additional permanent reference points established by the general contractor with indication of their location and marks (appendix 8).

3.2.7. The sheet of ballast and stone pits which are transferred to the railroad, with indication of capacity and the characteristic of the extracting materials (appendix 9).
