According to Item 2 of the resolution of the Cabinet of Ministers of Ukraine of 07.11.2007 N 1294 "About ordering of structure and conditions of cash cover of the military personnel, faces of the private and the commanding structure" I ORDER:

1. Approve the Instruction about payment procedure of cash cover by the serviceman of the Public special service of transport which is applied.

2. Administrations of the Public special service of transport (Malkov M. I.) provide submission of this order on state registration in the Ministry of Justice of Ukraine.

3. Recognize invalid orders of the Ministry of Transport and Communications of Ukraine of 06.09.2005 N 526 "About approval of the Instruction about procedure and conditions of payment of the monthly allowance for continuous service by the serviceman of the Public special service of transport", registered in the Ministry of Justice of Ukraine 19.09.2005 betweenN and of N 1034 "About distribution on the military personnel of the Public special service of transport of procedure and conditions of payment of the cash cover determined for the military personnel of the Armed Forces of Ukraine", registered in the Ministry of Justice of Ukraine 18.12.2006 for N 1318/13192.

4. Determine that this order is applied since January 1, 2008.

The instruction about payment procedure of cash cover by the serviceman of the Public special service of transport

I. General provisions

1.1. The instruction about payment procedure of cash cover by the serviceman of the Public special service of transport (further - the Instruction) determines payment procedure of cash cover by the serviceman of the Public special service of transport (further - State special transservice), and also payment procedure it the one-time monetary assistance in case of dismissal from military service.

1.2. In this Instruction terms are used in such value:

structural divisions - the divisions of State special transservice specified in article 4 of the Law of Ukraine "About the Public special service of transport";

position assignment - appointment to established post in structural division of State special transservice;

dismissal - release from established post of structural division of State special transservice.

Other terms are used in values which are determined by the legislation.

1.3. Cash cover of the military personnel of State special transservice is determined depending on position, military rank, duration, intensity and conditions of military service, qualification, scientific degree and academic status and consists from:

official pay rate, salary on military rank;

monthly additional types of cash cover (increase in official pay rate, the allowance, surcharge, remuneration which have permanent nature, awards);

one-time additional types of cash cover.

1.4. The sizes of official pay rates on the main (standard) positions, salaries on military ranks, monthly and one-time additional types of cash cover are established according to requirements of the current legislation.

1.5. Cash cover according to this Instruction is paid to the military personnel who:

are appointed to established posts in structural divisions of State special transservice;

are enlisted in the order of the Head of administration of State special transservice.

1.6. Cash cover by the serviceman is paid on the duty station only within the assignments approved by profit and loss budgets on cash cover of the military personnel of State special transservice.

1.7. For service over the established working hours, in days of rest and holidays cash cover by the serviceman in addition is not paid.

According to article 10 of the Law of Ukraine "About social and legal protection of the military personnel and members of their families" to the military personnel of State special transservice who carried out service duties during week-end festive and non-working days, appropriate time for rest is provided by commanders (chiefs) of structural divisions who by the Head of administration of State special transservice are granted the appropriate rights, as a rule, within the next week.

1.8. The amount of cash cover which is necessary to the serviceman not for complete month and for several days, is determined proceeding from the number of calendar days this month.

In case of origin at the serviceman of the right (increase in the size) to one of types of cash cover the specified payments are performed taking into account the specified changes from the date of acquisition of right by person of such right.

1.9. The cash cover paid according to the procedure and on regulations which were effective at the time of payment is not subject to return if the right to it fully or partially is lost further by the serviceman.

1.10. Cash cover which is necessary to the serviceman and timely is not paid to it or paid in smaller, than it was necessary, the size, is paid for the entire period during which the serviceman had the right to it.

Payment of one-time additional types of cash cover is performed from the date of emergence of the right to their obtaining.

In cases when the periods of service which were not brought in personal records are documented, cash cover in the new established sizes is paid from the date of receipt of the relevant documents in personnel division or provisions by the military personnel of the documents confirming the periods of service (work) which are not considered earlier.

1.11. Indexation of cash cover of the military personnel of State special transservice is performed according to the procedure and the sizes established by the legislation.

1.12. Payment of cash cover by the serviceman is performed once for current month during the period from 13 to 25 numbers.

In the same time cash cover on recalculations in connection with assignment of the next military rank, appointment to other position, change of the size of length-of-service allowance and so forth is paid.

1.13. The military personnel who decreases in business trip or leave if they return to the duty station after payment due date of cash cover, is allowed to perform payment of cash cover of earlier fixed term, including for the next months. Proper cash cover in case of departure in business trip or leave can be paid not earlier than in 7 days prior to day of departure in business trip or leave, disregarding days off and holidays, but not later than day of departure in business trip (leave).

II. Salaries on military ranks

2.1. The salary on military rank is paid to the serviceman from the date of signing of the order on assignment to it the corresponding military rank.

To faces of ordinary, sergeant and foreman structure which pass military service under the contract and the serviceman of compulsory military service discharged from military service with assignment of officer ranks, salaries on military ranks of officers are not paid.

2.2. The serviceman accepted on military service in structural divisions of State special transservice, salaries on military ranks are paid from the date of transfer in lists of staff.

2.3. To the faces of officers accepted on military service from inventory, to the faces of officers which are called up for military service after receipt of the higher education and which had military training according to the program of training of reserve officers in military educational institutions to the faces of ordinary, sergeant and foreman structure accepted on military service under the contract (except the military personnel of compulsory military service who is accepted on military service under the contract), salaries on military ranks are paid from day of transfer in lists of staff of structural division. In this case payment of salaries for military ranks is performed on ranks which they had before acceptance (appeal) on military service under the contract.

2.4. Salaries on military ranks are paid to the military personnel who during passing of compulsory military service is accepted on military service under the contract from day of contract signature, but not earlier than day of appointment to the corresponding positions.

2.5. In case of assignment of the next military rank during service the salary on military rank is paid to the serviceman from the date of the publication of the order on assignment of this rank.

III. Official pay rates of faces of officers, faces of the private,

sergeant and foreman structure which serve under the contract, the military personnel of conscription service

3.1. Official pay rates of faces of officers.

3.1.1. Official pay rates are paid to faces of officers on posts in the sizes provided in staff (staff list) of structural division.

3.1.2. To the faces of officers appointed to military positions, salaries on these positions are paid from the date of the publication of the order on position assignment or day of the position assignment specified in the order about day of dismissal inclusive (taking into account Item 6.2 of this Instruction).

3.1.3. The official pay rate provided on primary standard officer position "the commander of platoon" is paid to the faces of officers accepted on military service in State special transservice from the date of transfer in lists of staff about day of position assignment (taking into account Item 6.2 of this Instruction).
