About approval of Industrial safety rules in metallurgical industry

According to the Law of Ukraine "About labor protection" I ORDER:

1. Approve Industrial safety rules in metallurgical industry (further - Rules) (are applied).

2. With entry into force of the order to consider not applied in the territory of Ukraine "The general safety rules to the companies and the organizations of metallurgical industry" approved by Gosgortekhnadzor of the USSR 13.05.87.

3. To the head of department of the organization of the state supervision in metallurgy, power, construction and Ivanchenko V. I. boiler inspection. in accordance with the established procedure to provide submission of this order on state registration in the Ministry of Justice of Ukraine.

4. To the head of department of normative and legal and legal providing Prokhorov V. V. to include this order in the State register of regulatory legal acts on labor protection.

5. To the assistant department head of personnel, clerical work and special work Kravtsu V. Yu. provide publication of the order in mass media.

6. To impose control over the implementation of this order on the Acting First Deputy Chairman of Gosgorpromnadzor Dengin A. P.

Industrial safety rules in metallurgical industry

I. Scope of application

These Rules extend to all workers who carry out designing, construction, reconstruction, production, installation, adjustment, repair, inspection, technical diagnosing and operation of the equipment at the metallurgical companies and in manufacture workshops.

Rules are obligatory for all subjects of managing which use the wage labor connected with designing, construction, reconstruction, production, installation, adjustment, repair, inspection, technical diagnosing and operation of the equipment at the metallurgical companies and in manufacture workshops of all subindustries of ferrous and non-ferrous metallurgy.

II. Designations and reducings

The PCS - automatic management system engineering procedure;

PDVK - maximum permissible explosive concentration;

Maximum allowable concentration - threshold limit value;

PDU - maximum permissible level;

GOST - the interstate standard;

DBN - the state construction regulations

DSN - the state sanitary standards;

The COMPUTER - the electronic computer;

III. General requirements

1. General provisions

1.1. Designing, construction and reconstruction of the metallurgical companies (workshops, sites, departments) and their equipment, development of new technologies and means of production, means of collective and individual protection of workers shall be made according to the existing regulatory legal acts on labor protection, sanitary and construction standards, and also regulations of process design.

Designing of construction objects, reconstruction and technical retrofitting of the metallurgical companies and workshops shall be performed with obligatory participation of the general designer.

1.2. Acceptance in operation of the metallurgical companies and workshops completed by construction (reconstruction) needs to be performed according to requirements of the Procedure for acceptance in operation completed by construction of facilities, the Cabinet of Ministers of Ukraine approved by the resolution of 08.10.2008 N 923.

Commissioning of the new and reconstructed objects, production and transfer to production of samples of new machines, mechanisms and the equipment and other means of production, implementation of new technologies shall conform to requirements of the existing regulatory legal acts.

1.3. Make changes to design of the operating capital equipment, industrial buildings, and also to their project parameters (pressure, temperature), to technological schemes or to processes which can lead to education of explosive or toxic environment without approval of the main project organization or the manufacturing plant, and also without approval of relevant organs of the state supervision it is not allowed.

The project organizations shall exercise designer's service of accomplishment of the project decisions on labor protection during construction of facilities of architecture designed by them according to the Procedure of designer's service during architecture asset construction approved by the resolution of the Cabinet of Ministers of Ukraine of 11.07.2007 N 903.

1.4. On the operating productions the territory of factory and auxiliary buildings and rooms, warehouses and constructions of general purpose, floor of building constructions; heating, ventilation and air conditioning, lighting, internal plumbing and sanitary of buildings, outside sewer networks and constructions, industrial transport and technological pipelines shall conform to requirements of the existing regulatory legal acts and ND.

1.5. Working conditions on workplace, safety of engineering procedures, operation of machines, mechanisms, the equipment and other means of production, condition of means of collective and individual protection, and also sanitary living conditions of work shall conform to requirements of the existing regulatory legal acts.

The worker has the right to refuse the charged work if the production situation dangerous to his life or health, or for people who surround it, or for the production circle or the environment was created. He shall report immediately about it directly to the head or the employer.

1.6. Machines, mechanisms, the equipment, vehicles which take root at the companies of metallurgical industry shall have the certificate of conformity if they are subject to obligatory certification according to the List of products which are subject to obligatory certification in Ukraine, the approved order of the State committee of Ukraine concerning technical regulation and consumer policy of 01.02.2005 of N 28, registered in the Ministry of Justice of Ukraine 04.05.2005 for N 466/10746.

1.7. At each company of metallurgical industry according to requirements of the Standard regulations on security service of the work approved by the order of the State committee of Ukraine on supervision of labor protection of 15.11.2004 of N 255, registered in the Ministry of Justice of Ukraine 01.12.2004 for N 1526/10125 (further - NPAOP 0.00-4.21-04), the security service of work shall be created.

1.8. At the companies, in organizations and the organizations, irrespective of patterns of ownership and type of economic activity, or in their branches, representations, other separate divisions, and also physical persons entrepreneurs who according to the legislation use wage labor need to organize investigations and to record accidents, occupational diseases and accidents according to requirements of the Procedure for the investigation and accounting of accidents, occupational diseases and accidents on production approved by the resolution of the Cabinet of Ministers of Ukraine of 25.08.2004 N 1112 (further - NPAOP 0.00-6.02-04).

1.9. On all productions shall be developed based on standard provisions and the following instructions are approved by the employer:

on labor protection for workers of each profession and on work types;

technological;

on maintenance and operation of the equipment, including electric equipment;

on repair and cleaning of the equipment;

on fire safety;

on safe operation and repair of objects of gas economy with the obligatory scheme of intershop gas pipelines and their distribution between workshops.

1.10. In each structural division of the company the list of instructions for labor protection and fire safety shall be approved by the employer.

1.11. Instructions for labor protection are constituted according to requirements of the Law of Ukraine "About labor protection", the Regulations on development of instructions for labor protection approved by the order of Committee on supervision of labor protection of the Ministry of Labour and Social Policy of Ukraine of 29.01.98 of N 9, registered in the Ministry of Justice of Ukraine 07.04.98 for N 226/2666 (further - NPAOP 0.00-4.15-98), the Procedure for development and approval of the regulations by the owner about labor protection existing at the company, the State committee of Ukraine on supervision of labor protection approved by the order of 21.12.93 of N 132, registered in the Ministry of Justice of Ukraine 07.02.94 for N 20/229 (further - NPAOP 0.00-6.03-93), the Fire safety regulations in Ukraine approved by the order of the Ministry of Ukraine concerning emergency situations of 19.10.2004 of N 126, registered in the Ministry of Justice of Ukraine 04.11.2004 for N 1410/10009 (further - NAPB A.01-001-04).

1.12. Instructions for labor protection shall have references to the existing regulatory legal acts and ND based on which these instructions are developed.

1.13. Technological instructions shall contain requirements which observance will provide conducting engineering procedures, safe for workers, according to GOST 3.1120-83 "to ESTD. General rules of reflection and execution of safety requirements of work in technological documentation".

1.14. Constant control behind fulfillment of requirements of instructions and instructions of rather safe methods and working methods is performed responsible or the official to who accomplishment of these obligations or functions is assigned.

1.15. According to the List of hard work and works with harmful and dangerous working conditions on which application of work of women is forbidden, the approved order of the Ministry of Health of Ukraine of 29.12.93 N 256, registered in the Ministry of Justice of Ukraine 30.03.94 for N 51/260, is not allowed to use work of women in all main productions of ferrous and non-ferrous metallurgy.

1.16. According to the List of hard work and works with harmful and dangerous working conditions on which application of work of minors is forbidden, the approved order of the Ministry of Health of Ukraine of 31.03.94 N 46, registered in the Ministry of Justice of Ukraine 28.07.94 for N 176/385, minors is not allowed to work at any works of all productions of ferrous and non-ferrous metallurgy.

1.17. According to article 17 of the Law of Ukraine "About labor protection" the employer shall organize carrying out preliminary (during employment) and periodic (during labor activity) medical examinations of workers which are engaged at hard work, works with harmful or dangerous working conditions, and also annual survey of persons aged till 21 year. The list of persons which are subject to medical examination the term and procedure for its carrying out is determined according to the Procedure for performing medical examinations of workers of certain categories approved by the order of the Ministry of Health of Ukraine of 21.05.2007 of N 246, registered in the Ministry of Justice of Ukraine 23.07.2007 for N 846/14113.

1.18. The employer shall according to article 5 of the Law of Ukraine "About labor protection" acquaint workers behind the personal signature about working conditions at the company, availability on workplace where they will work, dangerous and harmful production factors which are not eliminated, and possible effects of their influence on health, and also about their rights to privileges and compensations for work in such conditions.

1.19. For briefings in workshops of the metallurgical companies necessary conditions shall be created.

1.20. The officials and employees of the companies occupied with designing, production, installation, adjustment, repair, reconstruction, diagnosing and operation of the objects, performance of works caused by these Rules shall have training according to requirements of the Standard regulations on procedure for carrying out the training and examination concerning labor protection approved by the order of the State committee of Ukraine on supervision of labor protection of 26.01.2005 of N 15, registered in the Ministry of Justice of Ukraine 15.02.2005 for N 231/10511 (NPAOP 0.00-4.12-05).

1.21. Workers of workshops of the metallurgical companies which work is connected with train service and shunting works shall take examinations for knowledge of the existing regulatory legal acts and instructions regulating rail activity in the commissions in case of railway workshops. The list of these workers, frequency of checks and amount of knowledge which are checked shall affirm the employer.

1.22. At the company in each workshop there shall be list of gas dangerous places and gas dangerous works approved by the employer.

1.23. Works with the increased danger need to be performed according to the work permit of the established form. The work permit which is issued to the executive in charge of works before works of the increased danger shall be drawn up according to requirements "Regulations on application of work permits in case of works of the increased danger at the companies and in the organizations of the Ministry of metallurgy of the USSR", the USSR approved by the Ministry of metallurgy 20.06.90 (further - NPAOT 27.0-4.02-90). To place of employment person responsible for performance of works of the increased danger or the representative of the contractor shall accompany crew. On site works it is necessary to hang out the plate "Work here".

In the work permit issued on work of the increased danger the complete amount of organizational and technical measures which acceptance will provide safe work in specific conditions shall be specified.

The list of positions of heads and specialists who have the right to issue work permits shall affirm the authorized officer of the company.

1.24. At each company plans of localization and liquidation of emergencies and accidents according to the Regulations on plan development of localization and liquidation of emergencies and accidents approved by the order of Committee on supervision of labor protection of Ukraine of 17.06.99 of N 112, registered in the Ministry of Justice of Ukraine 30.06.99 for N 424/3717 shall be constituted (further - NPAOP 0.00-4.33-99).

2. Providing with individual protection equipment

2.1. The employer shall provide all workers with overalls, special footwear and other individual protection equipment, and also safety devices according to requirements of Regulations of free issue of special clothes, special footwear and other individual protection equipment to workers of metallurgical industry approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of 27.08.2008 of N 187, registered in the Ministry of Justice of Ukraine 01.10.2008 for N 918/15609.

2.2. The procedure for providing with individual protection equipment of workers is performed according to the Regulations on procedure for providing workers with special clothes, special footwear and other individual protection equipment approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of 24.03.2008 of N 53, registered in the Ministry of Justice of Ukraine 21.05.2008 for N 446/15137 (NPAOP 0.00-4.01-08).

IV. Territory of the company. Buildings and constructions

1. Territory of the companies

1.1. The territory of the metallurgical companies which are effective are under construction and reconstructed, shall conform to requirements of the existing regulatory legal acts.

1.2. The territory of the company, and also the building, construction, the room shall be ensured by the corresponding signs safety according to GOST 12.4.026-76 "SSBT. Colors alarm and signs of safety" (further - GOST 12.4.026-76).

1.3. It is not allowed to encumber the territory of the company with materials, the equipment, waste, etc. For their storage it is necessary to allocate the special platforms opened and the closed storage facilities equipped with transport and heavy lift gears and devices which are intended for movement of all types of loads.

1.4. At the metallurgical companies under construction and those which are reconstructed ground storages it is necessary to have the dominating directions of winds alee.

1.5. The companies, buildings and constructions with engineering procedures which are followed by allocation to the environment of hazardous substances shall have sanitary protection zones according to requirements of the State health regulations of planning and building of the settlements approved by the order of the Ministry of Health of Ukraine of 19.06.96 of N 173, registered in the Ministry of Justice of Ukraine 24.07.96 for N 379/1404 (further - chipboard 173-96).

1.6. In the territory of the company there shall not be opened and not protected holes, ditches, wells, trenches. It is necessary that all of them were protected with barrier at least 1 m high, and were lit at night.

1.7. Pools in the territory of the company which have no embankment need to be protected with handrail height of at least than 1 m.

1.8. Earthwork in the territory of the company is allowed to be performed only according to the work permit with the written permission of the employer and with the consent of the project organization. 2. Improvement of the territory

2.1. In the territory of the company for safe and convenient movement of workers sidewalks or transitional galleries shall be arranged.

2.2. About checkpoints of the company and in all workshops (departments) schemes of pedestrian movement on the territory of the company and workshops, and also schemes of pedestrian movement shall be hung out during accidents and emergency situations.

2.3. In places of mass transition of people through railway tracks transitional bridges or tunnels shall be equipped. On other transitions the floorings laid in ровень with head of rails, equipped with the corresponding barriers and signals shall be equipped.

Transition of people in ways in unspecified places is not allowed.

2.6. The vacant territory needs to be planted trees and shrubs and planted with bushes and trees which have bactericidal properties: birch, poplar, white acacia, oak, pine, elder, etc. Places of short-term rest for workers shall be arranged and equipped with outside lighting. Outside lighting shall be also along highways, sidewalks, on moving. Illumination shall conform to requirements of GOST 12.1.046-85 "SSBT. Construction. Regulations of lighting of building sites" (further - GOST 12.1.046-85).

3. Buildings and constructions

3.1. Factory, auxiliary buildings and premises of the metallurgical companies shall conform to requirements Construction Norms and Regulations 2.09.02-85 * "Factory buildings", Construction Norms and Regulations 2.09.03-85 of "Construction of industrial enterprises" (further - Construction Norms and Regulations 2.09.03-85), Construction Norms and Regulations 2.09.04-87 "Office and household buildings" (further - Construction Norms and Regulations 2.09.04-87), NAPB A.01-001-04, DBN B.1.1-7-2002 Fire protection. Fire safety of construction objects (further - DBN V.1.1-7-2002), DBN V.1.1-5-2000 of the Building and construction in the waterlogged territories and the sinking soil.

3.2. Categories of rooms and buildings shall be determined by fire and explosion and fire risk according to requirements of regulations of process design.

3.3. It is not allowed that in designs of elements of buildings in which the productions using hydrogen are located congestive zones and sites which are not ventilated could be created.

3.4. It is necessary to inspect the bearing building constructions of buildings (column, beams, etc.) at least once in three years according to requirements of the existing regulatory legal acts.

At the companies it is necessary to make inspection of buildings and constructions on their compliance to requirements of existing rules and rules, to check the bearing capability and strength characteristics of designs with assessment of their technical condition and to draw conclusions concerning their further operation according to requirements of Rules of inspections, assessment of technical condition and certification of the factory buildings and constructions approved by the order of the State committee of construction, architecture and housing policies of Ukraine and the State committee of Ukraine on supervision of labor protection of 27.11.97 of N 32/288, Ukraine registered in the Ministry of Justice 06.07.98 for N 423/2863 (further - NPAOP 45.2-1.01-98).

3.5. Change of load of building constructions of buildings is allowed only after check of calculations and approval of changes by the general designer.

3.6. All building constructions of buildings and constructions which are under the influence of aggressive environment shall be protected from corrosion.

3.7. Platforms of oven, casting and foundry runs and mixing departments which are located in zone of release of the melted and heated products from furnaces and mixers shall be heat-insulated.

Columns and other building constructions of buildings in places of possible prikasaniye to the melted product shall have fire-resistant protection.

3.8. Production rooms shall be kept clean. In each workshop the procedure for cleaning of floor and building constructions, the equipment, working platforms, ladders, passes, drives shall be determined and approved by his head.

3.9. It is not allowed to encumber workplaces, passes, exits from rooms, accesses to the fire-fighting equipment, fire extinguishing means and bonds.

Details of the equipment and materials need to be warehoused in the places allocated for this purpose and only in assigned amount with observance of rules of their storage.

3.10. Walls, ceilings and other internal building constructions of workshops and departments shall have the plain (processed) surface which is not interfering with effective cleaning them from dust.

3.11. Accumulating of dust on walls, designs and the equipment is not allowed.

In rooms where flammable powder materials and their mixes are made and used in engineering procedures, it is necessary to remove dust with observance of actions for safe performance of works.

3.12. Finishing works of internal rooms of factory buildings shall be carried out according to requirements of GOST 12.3.035-84 "SSBT. Construction. Works painting.", for dusty oven and gas-generating rooms once a year suffices safety requirement, for other rooms - once in two years suffices.

It is necessary that during wet cleaning building constructions conformed to the following requirements:

floor, walls, metalwork shall have covering which gives opportunity to make such cleaning;

open openings in overlappings shall have boards height of at least 0,14 of m;

for assignment of drains from the floor located on soil it shall have bias to trays;

for assignment of drains from floor of upper floors ladders shall be provided;

floor shall have bias towards ladders.

3.13. For access to surfaces which coloring shall be resumed periodically the devices providing safe carrying out such works shall be provided in projects of buildings.

3.14. All shutters of the opening windows and lamps shall be equipped with reliable devices by means of which they shall open and be established easily in necessary provision.

3.15. All glazed surfaces need to be cleared of dirt. It is necessary to use special devices and devices to their cleaning and repair (the platform, suspended cradles, balconies, etc.) which will provide convenient and safe accomplishment of the specified works.

3.16. Purification of glass in rooms with considerable release of dust needs to be carried out in process of pollution, but once in two months suffices.
