About approval of Rules of information support of safety management system of flights of aircrafts of civil aviation of Ukraine
According to article 7 of the Air code of Ukraine and for the purpose of reduction of safety management system of flights in compliance with International standards and the Recommended practice of International Civil Aviation Organization (Appendix 6, of 8, of 11, of 13, 14 to the Convention on international civil aviation) I ORDER:
1. Approve Rules of information support of safety management system of flights of aircrafts of civil aviation of Ukraine (are applied).
2. Public aviation administration (Ovchinnikov O. V.):
2.1. Provide submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.
2.2. Bring Rules to the attention of the subjects of managing registered in the territory of Ukraine which perform operation and maintenance of civil aircrafts, use of airspace and servicing of air traffic, airfields, airports and training of aviation specialists in accordance with the established procedure.
3. Declare invalid the order of Public service of Ukraine on supervision of safety of aircraft of 14.11.2005 N 850 "About approval of the Procedure for collection and practical use of information of onboard systems of registration at the companies of civil aviation of Ukraine", registered in the Ministry of Justice of Ukraine 29.11.2005 for N 1433/11713.

1.1. These Rules are developed according to requirements of the Air code of Ukraine for the purpose of reduction of national aviation rules of civil aviation in compliance with requirements of International standards and the Recommended practice of International Civil Aviation Organization (further - ICAO) and their harmonizations with General aviation requirements (further - JAR) the Joint aviation administrations (further - JAA) which regulate activities in the field of information support of the State target program of safety of flights and safety management systems of flights (further - SUBP) aircrafts (further - AF) operators and suppliers of servicing (the company, organization and the organization for maintenance (further - THAT), operation of airfields, servicing of air traffic, training of personnel, development and production of the aircraft equipment).
1.2. These Rules determine tasks, the rights and obligations of subjects of management regarding creation and use of information and analytical base about events which pose threat or can pose threat for safety of flights, and establish requirements concerning provision of the obligatory report on events for safety and procedure for program implementation of information support of SUBP by results of control of functioning of subjects of aviation and transport system (далееАТС).
1.3. Analysis results of data on events on safety are used by officials of State aviaadministration, operators and suppliers of servicing during safety management of flights, the organization of accomplishment of flights, maintenance and repair of AF, air traffic management and airfield providing for the purpose of enhancement of safety of operation of AF and increase in professional skill of specialists of aviation and transport system.
1.4. These Rules are obligatory for all subjects of legal relations to whom operation of the Air code of Ukraine governing the relations in the field of civil aviation and use of airspace of Ukraine, in particular on the organization of all patterns of ownership and citizens who perform operation and repair of aircrafts, accomplishment and ensuring flights, developments, production and certification of aircrafts, training of aviation personnel, and also on divisions and bodies for investigation and the prevention of aviation events and incidents extends.
1.5. These Rules are used during certification of aircrafts, their operation, and also during investigation of aviation events, incidents and events on safety which happened to civil aircrafts of Ukraine.
1.6. In these Rules the following reducings are used:
ANS - service of air navigation.
AP - aviation incident.
APD - the analysis of flight data.
The EXPERT - emergency.
ASUP (AFCS) - system of automated management of flight.
AT - the aircraft equipment.
Automatic telephone exchange - aviation and transport system.
BP - safety of flights.
BR - the onboard registrar.
BSPS - onboard system of the prevention of collisions.
PANH - application of aircraft in the national economy.
ITS/P - technical structure / personnel.
RVP - management on accomplishment of flights.
RLE - management from flight operation.
KVS - the commander of the aircraft.
KS - catastrophic situation.
HP - flight service.
MPD - monitoring of flight data.
Department of Internal Affairs - servicing of air traffic.
Air traffic management - air traffic management.
PRAPIU - rules of investigation of aviation incidents and incidents with civil aircrafts in Ukraine.
PI - flight information.
PPI - division (company) of flight information.
AF - the aircraft.
CC - difficult situation.
SUBP - safety management system of flights.
Shopping mall - technological complex.
THAT is maintenance.
TS - technical service.
UUP - complication of flight conditions.
UNRAP - management of independent investigation of aviation incidents of State aviaadministration.
The Arab Republic of Egypt - operational inspection of the platform.
API - engineering inspection of the platform.
BSE - operational inspection of basic objects.
BSI - engineering inspection of basic objects.
CVR is the onboard registrar of sound information.
DME - the ranging equipment.
FDR is the onboard registrar of parametrical information.
GPWS - system of the warning of approach to the earth.
ILS - system of instrument landing.
MLS - microwave system of landing.
MOPS - the minimum technical requirements to operational characteristics.
MSAW - the warning of the minimum safe absolute height.
NAV - navigation.
RTE - inspection on route.
RTC - inspection of cargo cabin of AF.
RTP - inspection of the AF passenger salon.
SDCPS - system of collection and data processing about BP.
STCA - the short-term warning of the conflict.
VOR - radio engineering system of near navigation.
UTC - the world coordinated time.
1.7. In these Rules terms are used in the following values:
Aviation incident - the event connected with use of AF which takes place since the moment when any face is raised aboard with intention to perform flight to the moment when all persons which were onboard left AF and during which any face sustains bodily harms from the death or serious bodily harms or AF sustained damage or destruction of design.
Aviation incidents are divided into catastrophic crashes and accidents.
Catastrophic crash - AP with the human victims which led to death or disappearance without message of any of passengers, crew members or the third parties, and also in case of receipt of bodily harms by them from the death in time:
a) stays on this AF;
b) direct collision with any part of AF, including the parts separated this AF;
c) direct action of stream of gases of the jet engine;
d) disappearances without message of AF; AF is considered disappeared without message if official search was stopped and the location of elements of its design was not established. The decision on the termination of search of AF, missing, accepts authority of the state on investigation of AP in the territory of which there was AP;
?) also cases of death any of persons which were onboard in the course of their emergency evacuation with AF belong to catastrophic crashes.
Accident - AP without the human victims which led to damage or destruction of AF or serious bodily harm of passengers or crew members and the third parties, in case of which:
a) durability of design of glider of AF because of destruction of power elements is broken;
b) technical or flight characteristics of AF worsen and repair is necessary for their recovery or is excluded to recover its flight suitability. Do not treat accidents: for airplanes - cases of refusal or damage of the engine when only the engine, its cowls or auxiliary aggregates or when only air screws, extremities of wing, antennas, pneumatics, brake mechanisms, fairing or when in covering there are small dents or holes are damaged is damaged; for helicopters - destruction or damage of elements of the bearing and steering screws, ventilatory installation, reducer, covering, destruction or separation of transmission if they did not lead to damage or destruction of power elements of the fuselage or beams;
c) AF appears in such place where access to it and its evacuation from the scene are impossible;
d) any face sustains serious bodily harms.
The aircraft equipment - aircrafts and their components.
Aviation and transport system - set of elements (subjects) of system which are effective and interact for requirements satisfaction of society in aviation works and transportations. Subjects of automatic telephone exchange are AF with their crews, airlines, airfields and the airports, the organizations on THAT AF, the Department of Internal Affairs, State aviaadministration, bodies for investigation of aviation incidents, incidents and supervision of BP certified by State aviaadministration aviation educational institutions, etc.
Accreditation - the procedure during which competence of the legal entity or relevant organ on estimation of compliance documentary makes sure to carry out certain work types.
The analysis of flight data - process of the analysis of the registered flight data with the purpose of increase in the BP level.
Safety of flights - condition of automatic telephone exchange in case of which the risk of damnification to the person or drawings losses to property is reduced to acceptable level and is maintained at this or lower level by continuous identification of sources of danger and control of risk factors.
There are such BP levels:
accepted - which is accepted by society as such and the world community;
set - the minimum level of BP which is established normative by State aviaadministration taking into account the reached BP level of the AF park of automatic telephone exchange of Ukraine;
observed - the measured value of the BP level which was implemented.
The onboard registrar, onboard system of registration - the equipment of AF which is intended for record of parametrical and/or speech information for the purpose of use during investigation of AP and incidents, and also during implementation of the program of monitoring of flight data on BP.
Safety requirements of flights - the requirements established by legal acts, rules, installations, instructions, the specifications and technical documentation which accomplishment provides capability to carry out flights without threat for life and human health.
Reproduction of parametrical information which is registered, - process of establishment of physical parameter values by processing of records of onboard registrars (сигналограмм) on the set periods.
Variation in work of shopping Mall VS-ekipazh-sreda - the incident connected with operation of AF if the actual values of the determining parameters differ from their nominal rates which are specified in the specifications and technical documentation.
The variation in work of shopping Mall VS-ekipazh-sreda which is dangerous (dangerous variation), - variation which is connected with operation of AF and is characterized by quality degradation of functioning of complex and threatens or can threaten AF or persons which are in AF.
Variations in actions of crew during Vsdeystviya's exploitation which do not conform to requirements and recommendations of regulating documents. Variations are consequence of pilot error or failure to carry out (violation) of statutory rules of operation of AF by it.
Variation in procedural activities - violation of regulations or technology of accomplishment of flight task, rules of navigation and communication, wrong, untimely, inappropriate actions concerning management of AF and his functional systems.
Variation in sensory-motor activities - the wrong, untimely perception, imperception of information on space provision and orientation of AF, about parameters of its movement, work of functional systems, circle condition, untimely identification of dangerous situations.
Variation during decision making - untimely, wrong estimation of circumstances, opportunities of AF, onboard and land systems, significance value of the special situations which arose during flight, psychophysiological opportunities and features of stereotypes of actions of crew members of AF at this conjuncture of flight.
Reliability of control - measure of compliance of results of control to the valid condition of object of control.
Limiting restrictions - restrictions of the modes of flight which violation is inadmissible under any flight circumstances.
Diagnostic model - the formalized description of properties of object of control which is used during the solution of tasks of control.
Diagnostic sign - certain parameter or set of parameters which are used for estimation of quality of functioning of object of control.
The operator - person, the organization or the company which operates AF or offers the services in this industry also has the appropriate certificate issued by State aviaadministration.
Operational restriction - conditions, the modes and parameter values intentional exit out of limits of which is inadmissible during operation of AF.
Express-analysis - information processing of onboard registrars with use of algorithms of dopuskovy logical control.
Incident - any incident, except aviation incident, connected with use of AF which influences or could affect safety of operation.
The commander of AF - the pilot appointed the operator or the owner of AF to carry out obligations of the commander and to be responsible for safe accomplishment of flight.
Control - previously planned system of professionally reasonable actions of the inspection bodies of the executive authority directed to determination of condition of object of control concerning its compliance to the established requirements, regulations and standards, technologies of work for the purpose of quality assurance of products or provision of services in case of complete safety of people and the environment.
The maximum weight - the maximum certified take-off mass of AF.
Monitoring of flight data - collection, processing, generalization and the analysis of flight data which are performed regularly that provides establishment of the BP acceptable level for the AF park, determination of the actual and potential risks and preventive corrective actions for maintenance of the BP acceptable level.
The data carrier - physical body which is used during record for preserving in it or on its surface of signals of information.
Descriptor - set of data which supplement records BR and are necessary for reproduction and processing of PI according to task.
Special situation - situation which arises during flight because of influence of dangerous factors or their set leading to decrease in BP. Carry to special situations: complication of flight conditions, difficult, emergency and catastrophic situations:
complication of flight conditions is characterized by insignificant decrease in level of safety of flight and requires actions of the crew members who are not going beyond them opportunities. Complications of flight conditions can include, for example, insignificant decrease in level of safety or functional capability, insignificant increase in load of crew, such as change of regular flight plan or certain inconveniences for passengers;
the difficult situation is characterized by decrease in functionality of AF or capability of crew to cope with adverse operating conditions to such level which can lead for example, to considerable decrease in level of safety or functional capability, significant increase in load of crew or to the conditions reducing overall performance of crew or discomfort of passengers, including damage of AF;
the emergency is characterized by decrease in functionality of AF or capability of crew to cope with adverse operating conditions to the level which causes:
a) considerable decrease in level of safety or functional capability;
b) physical sufferings or so considerable overload that can make impossible exact and full implementation by crew of the tasks;
c) serious critical damages of rather small amount of passengers;
the catastrophic situation is characterized by conditions which exclude possibility of long safe flight and landing.
The expected service conditions - conditions which include values of the calculated parameters, operational restrictions, and also the modes of flight recommended and established for AF of this type.
Incident which poses or can pose threat for safety of flights (incident on safety) - breakdown of service, defect, mistake or other non-standard circumstance which affected or could affect safety of flights and which are not consequence of aviation incident or serious incident as it is determined by Rules of investigation of aviation incidents and incidents with civil aircrafts in Ukraine.
Flight information, flight data - parametrical and speech information which is reproduced from records BR, and also information from obligatory reports and voluntary messages of crews of AF.
Pilot error - unintentional variation in actions of the pilot from requirements of regulating documents concerning operation of AF.
"Flight portrait" - the arranged set of parameter values which characterize functioning of shopping Mall VS-ekipazhsreda in characteristic points of flight.
Violation - intentional variation in actions of the pilot from requirements of regulating documents concerning operation of AF.
The program for safety of flights - the single complex governed also types of activity, BP directed to increase.
The recommended flight modes - the modes covering values which are determined by the operational restrictions set by RLE of AF for accomplishment of flights.
Representative set - set of observed incidents which assessment of probable characteristics practically does not change in case of increase in number of observations.
Risk - the estimated potential of adverse effects because of impact of factors of danger.
Environment - set of factors of influence of condition of airspace, the atmospheric phenomena, service qualities of ANS, Department of Internal Affairs, and also airfield ensuring flights on functioning of shopping Mall VS-ekipazhsreda.
Serious incident - incident which circumstances demonstrate that there was nearly Apostle.
The following signs are characteristic of serious incidents:
exit of AF out of limits of the expected service conditions;
emergence of considerable harmful effects on crew or passengers;
substantial increase of operational load on crew;
crew disability during flight;
considerable deteriorations in flight and technical characteristics and complication in management of AF.
Certification - the procedure of establishment of compliance of subjects and objects of civil aviation to the demands made to them.
System - set of the interconnected or interacting elements.
Safety management system of flights - system approach concerning management of BP, including necessary organizational structure, hierarchy of responsibility, the guidelines and procedures.
Systems of collection and data processing about BP (SDCPS) information and analytical systems of different hierarchical levels (interstate, national, corporate) which include:
a) the records concerning investigation of AP and incidents, provided by Section 5 of Rules of investigation of the aviation incidents and incidents with civil aircrafts in Ukraine (with changes) approved by the order of State aviaservice of 13.12.2005 of N 943, registered in the Ministry of Justice of Ukraine 29.12.2005 for N 1588/11868 (further - PRAPIU), and Chapter 5 of Appendix 13 to the Convention on international civil aviation;
b) the systems of the obligatory report on incidents provided by the Section 7 PRAPIU and Chapter 8 of appendix 13 to the Convention on international civil aviation;
c) the systems of voluntary messages on incidents provided by the Section 8 PRAPIU and Chapter 8 of Appendix 13 to the Convention on international civil aviation;
d) records of the onboard automated systems of registration of flight data, reports, voluntary messages of crews of AF and other aviation specialists, including the data collection systems provided by Chapter 3 of part 1 of Appendix 6 and Amendment E Appendices 13 to the Convention on international civil aviation.
The subject of safety management of flights (the subject of management) personnel, structural divisions, specially created bodies which influence safety management system of flights for the purpose of ensuring its functioning.
Factor - the essential circumstance influencing emergence of dangerous situation (risk).
The cyclogram of parameters - the list of parameters which are registered on AF, with indication of addresses (numbers of channels) of registration, structure of shot of information, and also numbers of the bits used for record of parameters.
1.8. The purpose of these Rules is increase in the BP level by introduction of system of the obligatory report and ensuring process of provision of information on safety properly in relevant organs, systematization, entering into the database, protection (use only for the purpose of these Rules) and distribution among users as a part of SUBP.
The single purpose of information support of SUBP is the prevention of AP and incidents. The data obtained during information support of SUBP cannot be used for establishment of someone's fault or responsibility.
1.9. The organization of collection, estimation, processing, storage and distribution of information on incidents on safety and recommendations about the prevention of AP is provided by UNRAP.
1.10. Operators of AF and suppliers of servicing control safety indicators for the purpose of identification of flights of factors, dangerous to accomplishment. The main sources of information concerning identification of such factors are:
records of onboard parametrical and speech registrars;
obligatory report of officials of subjects of automatic telephone exchange;
voluntary messages of aviation personnel;
materials of land means of objective control.
Control on indicators of safety and identification of dangerous factors does not exclude, and supplements obligations of subjects of automatic telephone exchange concerning observance of the normative requirements established by national aviation rules.
1.11. Treat officials and personnel which shall provide surely information on incidents on safety:
the head of the operator and the commander (crew members) of any civil aircraft entered in the state register of civil aircrafts;
the corresponding personnel of the subject certified by State aviaadministration which perform activities for designing, development, production, repair or modification of gas and turbojet civil aircrafts or any equipment or its parts;
the corresponding personnel of the subject certified by State aviaadministration which sign forms and other documentation connected with maintenance of gas and turbojet civil aircrafts or any equipment or its parts;
dispatchers of servicing of air traffic and flight and information servicing;
heads (managers) of the civil airports (airfields);
the corresponding personnel of the subject certified by State aviaadministration which perform activities for production, repair, modification, maintenance, testing, control of technical means of air navigation and Department of Internal Affairs;
the corresponding personnel of the subject certified by State aviaadministration which perform activities for land servicing of AF, including filling, servicing on the platform, loading, the prevention of ice accretion and towage of AF.
The list of officials who shall provide information on incidents on safety of flights is determined by the head (owner). Job descriptions of the specified officials shall contain requirements concerning provision of the obligatory report by them.
1.12. Records of onboard registrars are used by operators of AF and the approved organizations on THAT which object of activity are the airplanes equipped with parametrical registrars of types I, IA, II and IIA and the helicopters equipped with registrars of types IV, IVA and V.
1.13. To the obligatory report crews of AF, officials and specialists of the organizations on THAT AF, Department of Internal Affairs and airfields is subject information on shortcomings:
a) during execution of flights;
b) concerning AT condition during execution of flights;
c) during aeronautical ensuring flights, in particular Department of Internal Affairs;
d) during airfield servicing of AF during preparation and accomplishment of flights;
?) in time THAT AF.
1.14. All subjects of automatic telephone exchange provide information security from systems of collection and data processing of onboard registrars and messages of aviation personnel from their inadequate use according to these Rules.
1.15. Information on aviation incidents and incidents which occurred with civil aircrafts is provided according to requirements of PRAPIU.
Information on incidents on safety is provided in UNRAP by officials and personnel of the air enterprises, organizations, organizations, institutions, their branches and structural divisions in formats which are determined by the corresponding regulatory legal acts by safety issues of flights, and is signed by the sender with indication of contact address and phone number of the sender.
For the purpose of acceleration of transfer by personnel of the air enterprises of information on safety she can be constituted and be presented in any form.
1.16. Information on incidents on safety is entered in the UNRAP information and analytical base and stored together with information on aviation incidents and serious incidents.
1.17. Irrespective of classification of incident and type of information by safety names, addresses and other personal information of participants of incident not to be entered in the information and analytical database.
1.18. The list of the conditions, necessary for safe operation of AF, requiring obligatory observance of normative requirements and supervision is given in appendix 1.
1.19. Data on discrepancy of airline to normative requirements are represented in the form given in appendix 2.
1.20. The list of incidents during operation of AF which are subject to the reporting is given in appendix 3. This list is not exhaustive. About any other incidents which are considered such, in case of which safety of operation could worsen, it shall be also reported.
Identification codes of incidents use during creation and operation of computerized information systems about BP and in reports of operators which shall be transferred to State aviaadministration. Use of identification codes in reports and messages of crews of AF and other categories of aviation specialists is not obligatory.
1.21. The state aviaadministration creates industry SDCPS of incidents, rather adverse for BP, and establishes procedure for access for operators of AF, other subjects of automatic telephone exchange to the database industry SDCPS.
1.22. The BP acceptable levels for the AF park of Ukraine, for operators of AF and other subjects of automatic telephone exchange which activities are connected with providing BP (the companies on THAT, Department of Internal Affairs, operation of airfields) are determined by State aviaadministration.
1.23. SUBP of each subject of aviation activities and the set level of safety are approved by State aviaadministration.
1.24. The state aviaadministration creates favorable conditions for introduction of system of voluntary and confidential messages on factors, dangerous to operation of AF.
1.25. Incident on safety, as a rule, is investigated by the subject of automatic telephone exchange. UNRAP can make the decision concerning carrying out by own forces of investigation of any incident which is not classified according to PRAPIU as AP or incident.
1.26. The state aviaadministration controls safety of flights according to national and international regulating documents which establish procedure and procedures of control, namely:
operational inspection, certification and constant surveillance over unconditional accomplishment by operators of AF and suppliers of servicing of the normative requirements established by aviation rules of Ukraine;
independent investigation of aviation incidents and incidents according to PRAPIU;
investigations of incidents on safety which are performed by operators of AF, airfields, airports and providers on Department of Internal Affairs;
establishment by these Rules of procedure of supervision of indicators of safety of subjects of automatic telephone exchange which are or can be danger factors during execution of flights.
1.27. The state aviaadministration exercises supervision of accomplishment by subjects of automatic telephone exchange of the established requirements concerning creation of corporate SDCPS and behind provision of reports on factors, adverse for operation of AF, and provides control of investigation of incidents on safety which are performed by subjects of automatic telephone exchange.
2.1. Each operator of AF adopts the program of monitoring of flight data as component of its management system of BP and creates conditions for its realization. The MPD program provides:
a) identification of the actual and potential risks for BP;
b) implementation of corrective actions for the purpose of maintenance of the set BP level;
c) performance monitoring of procedures of management of BP by comparison of the observed and set BP levels;
d) maintenance of strict procedure for the reporting of the operator of AF before State aviaadministration about all incidents taking place in use of the AF park of the operator;
?) availability of information on BP to the operational personnel connected with implementation of air transportation and also to specialists who participate in conducting investigation of AP and incidents;
e) informing service providers to commercial air carrier (the organizations on THAT, Department of Internal Affairs, operators of airfields) about special situations which took place during execution of flights and which belong to the sphere of their responsibility;
e) control of use of information on BP only for the purpose of timely acceptance of proper preventive measures concerning the prevention of the Apostle.
2.2. Operators of AF according to the MPD program provide processing at least than 90% of the records BR AF equipped with parametrical registrars of types I, IA, II, IV, IVA, V and also at least than 90% of landings to the airfields of permanent or temporary basing of AF equipped with registrars like IIA.
2.3. Work of the operator of AF on ensuring functioning and enhancement of the MPD program, and also on use of its results for the purpose of the prevention of AP is headed by the program manager of MPD (further - the Program manager).
2.4. The program manager is the adviser to the head of airline (airline) concerning safety of flights during operation of AF. The program manager determines the directions, controls and coordinates functioning of the program of information support of SUBP of the operator.
2.5. The program manager submits directly to the head of airline.
2.6. The candidacy of the Program manager shall be approved by State aviaadministration.
2.7. The candidate for position of the Program manager shall have the higher aviation education, experience of practical work on operation of AF is at least five years and preparation according to the program approved by State aviaadministration and to improve the skills once in 4 years on professional development course according to the program approved by State aviaadministration.
2.8. The program manager organizes collection, processing and the analysis of flight data with the purpose of identification of situations, adverse for operation of AF, information on which contains in records of onboard registrars, reports and voluntary messages of crews of AF and other professional categories of the operator, and provides informing officials of the operator who make the decision concerning management of BP, on the dangerous situations which are within their competence and on the categories of risk created by such situations.
2.9. The program manager of MPD informs on incidents and situations, adverse for BP, heads of the relevant services of the operator of AF to whose obligations accomplishment of active actions for reduction of risk belongs, and provides reports on results of accomplishment by the operator of the program of monitoring of flight data in UNRAP.
2.10. End product of the MPD program is information which characterizes BP condition, and also quality and efficiency of functioning of management system of BP by reduction of risk degree for operation of AF.
2.11. The MPD program of the operator contains single complex of the rules and types of activity of the operator of AF directed on:
a) creation of enterprise system of control of work of onboard registrars which provides identification of dangerous variations and special situations during execution of flights of AF;
b) introduction of system of obligatory reports of crews of AF on all special situations taking place during execution of flights of AF;
c) creating favorable conditions for provision by aviation specialists of voluntary messages on dangerous factors;
d) implementation of identification of variations which brought or can be led to emergence of special situation, and assessment of risk degree, created by them;
?) information security from use for the purposes which differ from the purposes of ensuring safe operation of AF;
e) ensuring confidentiality of information and protection of its sources against administrative influence;
e) ensuring safety and use of these rather special situations;
є) introduction of procedure for data transmission about special situations in State aviaadministration for the purpose of creation of industry SDCPS;
g) ensuring storage and transfer of originals and copies of records of onboard registrars which contain information on aviation incidents.
2.12. The operator creates the control system behind work of onboard registrars. The control system behind work of onboard registrars is intended for receipt of the objective information about quality of functioning in flight of shopping Mall VS-ekipazh-sreda.
2.13. Functioning of the control system behind work of onboard registrars is provided by flight, technical services and service MPD of the operator. Activities of services of the operator concerning ensuring functioning of this system control and the program manager of MPD coordinates.
2.14. Within the approved SUBP the operator establishes order of interaction of the divisions and officials responsible for the organization and quality of functioning of the control system behind work of onboard registrars.
2.15. The flight service provides accomplishment by crews of AF of requirements to exploitation of onboard registrars who are listed in Items 5.22-5.27 of these Rules.
2.16. Each crew member shall report on the commander of AF:
a) about any mistakes, in particular during execution of compulsory procedures, refusals, failures or defects which, in his opinion, do harm to flight suitability or safe operation of AF;
b) about any incident which threatens or can threaten safe operation of AF.
Messages of crew members on cases, adverse for BP, shall be transmitted through the onboard intercom and be fixed by CVR.
2.17. The flight service shall take timely measures concerning management of BP for the purpose of parrying or reduction to tolerant risk level for operation of AF in all cases relating to her competence.
2.18. The TS of the operator provides:
a) compliance of the onboard registrars established on the operator's AF to the requirements stated in Items 5.1-5.7 (for FDR) and 5.8-5.13 (for CVR) these Rules;
b) operational suitability of onboard registrars by performance of works on maintenance according to the rules stated in Items 5.14-5.21 of these Rules.
2.19. The TS of the operator carries out obligations concerning replacement of carriers of flight data (or concerning creation of electronic copies of records of onboard registrars) and ensuring their transportation to division of MPD of the operator according to the requirements stated in Items 5.27 - 5.30 of these Rules if it is provided by the user manual of AT. Contents of the form of task for removal of the carrier PI FDR and CVR are given in appendix 4.
2.20. The CU of the operator in accordance with the established procedure uses results of processing and the analysis of records of onboard registrars about quality of functioning of the equipment and the AF systems.
2.21. Within the operator's SUBP the solution of the following tasks is assigned to division of MPD:
a) reproduction of flight data from the records CVR and FDR and forming on their basis of "flight portrait";
b) identification of dangerous variations of quality of functioning of shopping Mall VS-ekipazh-sreda and identification of the special situations corresponding to them;
c) variance analysis and special situations for the purpose of determination of risk degree for BP;
d) creation of base of data on variations and special situations which are used in SUBP;
?) interaction with flight and engineering and aviation services of the operator of AF concerning questions of functioning of the control system behind work of onboard registrars and information support of management system of BP;
e) interaction with State aviaadministration concerning creation of industry SDCPS;
e) preserving and use of these rather special situations.
2.22. Shall be part of division of MPD of the operator:
a) group of operational servicing of onboard registrars which provides replacement of carriers and/or creation of electronic copies of records of onboard registrars, and also communication of carriers of flight information;
b) group of computer processing of records of onboard registrars which provides reproduction of the determining flight parameters from the records FDR and speech messages from the records CVR and uses for this purpose information technologies, including the software certified by State aviaadministration;
c) the expert group which analyzes the variations revealed as a result of computer processing of records of onboard registrars considers adverse latent conditions for BP, identifies special situations and risk degree which is brought by them;
d) the keeper of information on BP - person or group of persons who perform support of base of corporate SDCPS control procedure for access to it for the aviation personnel which are taking part in management of BP and perform protection of the data containing in base for prevention of their use on purpose which differs from the purpose of increase in BP.
2.23. The engineering and administrative board of division of MPD shall have the certificate of the termination of qualification rates. Certificate effective period - is no more than 4 years.
2.24. The quantitative structure of division of MPD is determined by the operator of AF and depends on amount of the work performed by it.
In airlines which have the AF limited park in coordination with State aviaadministration it is allowed:
a) assign functions of group of operational servicing of onboard registrars to engineering air service of the operator of AF;
b) combine positions of the program manager of MPD and the keeper of information on BP;
c) involve on expert evaluation of dangerous variations of the most qualified specialists of flight, engineering and aviation services and inspectorate for BP which have special preparation;
d) transfer on contractual basis functions on computer processing of records of onboard registrars to the companies of flight information of any pattern of ownership certified by State aviaadministration and licensed on accomplishment of the corresponding work types. At the same time the shared responsibility for quality of functioning of control systems behind work of onboard registrars remains for the operator of AF.
2.25. Records of onboard registrars use for receipt of quantitative estimates of the parameters characterizing functioning of shopping Mall VS-ekipazh-sreda, and their variations from the values established by regulating documents which arise owing to:
a) mistakes and violations which are made by operators of this complex;
b) functional equipment failures and systems of technological complex.
2.26. Parameters which register modern FDR during flight are used in safety management system during the analysis of the incidents given in appendix 3.
2.27. Together with the control system behind work of onboard registrars use system of the report on special situations and incidents, in particular:
a) system of the report on AP and incidents according to PRAPIU;
b) systems of the reports containing data on adverse conditions which can lead to aviation incident or incident, according to appendix 3.
2.28. Use of information which contains in reports of crews of AF does not exclude accomplishment of the report and messages of other groups and categories of aviation specialists.
2.29. The system of obligatory reports provides information collection about certain types of incidents and special situations and is implemented according to the instruction which is in detail developed by the operator about form and content of reports.
2.30. The operator develops the corporate catalog of reports of crews on dangerous incidents and flight situations (for AF which he operates) according to the list given in appendix 3. Identification numbers of incidents in the catalog shall not differ from the corresponding numbers specified in appendix 3.
2.31. The operator can initiate entering into the list approved by State aviaadministration, additional incidents which, in his opinion, constitute danger to operation of AF and to bring these incidents in the corporate catalog of reports of crews. Identification numbers of such incidents are approved with State aviaadministration.
2.32. Flight reports of crews of AF are fixed in logbooks, and also in special reports which form is established by State aviaadministration.
Standard forms of reports are given in appendices 5-8.
2.33. The operator can enter additional corporate forms of obligatory reports of crews of AF and other categories of aviation specialists about dangerous variations and special situations which are provided by the catalog of reports.
2.34. For the purpose of amendment of information obtained from system of obligatory reports, the operator shall use system of voluntary messages.
In such systems aviation specialists without administrative coercion provide messages on incidents which, in their opinion, constitute danger to operation of AF.
Information which arrived shall not be used against her author, i.e. such system shall not be retaliatory.
The sample of form of the voluntary message is given in appendix 9.

b) the crew of AF shall provide in service MPD of the operator of the report on all dangerous incidents and situations provided by the corporate catalog of incidents within no more than 72 hours since the moment when this incident was registered;
c) the program manager of MPD informs the HP management on cases of concealment by crews of AF of data of rather dangerous variations as about the special situation taking place during execution of flight;
d) confidentiality is guaranteed during transfer of the report (message);
?) adoption of administrative and other sanctions against authors of messages is not allowed if it is not proved that unreasonable, conscious violation of statutory rules of operation of AF is the reason of special situation;
e) for the purposes of providing and maintenance of flight suitability use only deidentifitsirovanny reports and messages;
e) use of nedeidentifitsirovanny reports and messages is allowed for the purposes of enterprise system of management of BP in exceptional cases or with the consent of the author of the message;
є) the management of the operator takes measures concerning creation in collective of the atmosphere of trust about what issues the relevant order (memorandum).
2.36. Safety management of operation of AF is exercised on the basis of determination of categories of risk, on each of which adequate preventive measures are taken.
2.37. Service MPD of the operator performs information processing, containing in entries of onboard registrars, obligatory reports and in voluntary messages of crews of AF and other categories of aviation specialists, for the purpose of identification of special situations and determination of categories of risk. Identification and identification of risk in system means increase in level of knowledge of danger that promotes adoption of the correct decisions concerning safety.
2.38. The decision on content of management processes of BP and professional actions for their realization is accepted by the relevant services of the operator: flight, engineering, airfield, air traffic management.
2.39. The category of risk characterizes degree of danger to the operator, reality (frequency) of its origin or recurrence, urgency and scales of preventive actions, priority in allocation of resources on its reduction to the level, acceptable for the operator.
2.40. Functioning of management system of BP requires identification of all variations which create risk during operation of AF.
On nature of influence on BP allocate two groups of variations:
a) active variations which directly influence quality of functioning of shopping Mall VS-ekipazh-sreda (functional refusals or variations in work of systems and the equipment of AF and suppliers of servicing of their flights, mistake and violation of technology of work of AF as crews and other operators of automatic telephone exchange);
