Based on the Law on technical regulation N 420-XVI of December 22, 2006. (The official monitor of the Republic of Moldova, 2007, N 36-38, Art. 141), with subsequent changes and amendments, the Law on assessment of conformity of products N 186-XV of April 24, 2003. (The official monitor of the Republic of Moldova, 2003, N 141-145, Art. 566), with subsequent changes and amendments, DECIDES: the Government

1. Approve the Technical regulation "The Equipment Working under Pressure" it (is applied).

2. This resolution becomes effective after 24 months from the date of publication in the Official monitor of the Republic of Moldova.

3. In case of entry into force of the Technical regulation "The Equipment Working under Pressure" from the List of products which are subject to obligatory certification of conformity in the regulated area approved by the Order of the Government N 1469 of December 30, 2004. (The official monitor of the Republic of Moldova, 2005, N 1-4, Art. 14), with subsequent changes and amendments, are excluded codes of products of the 7309th 00, the 7311th 00, 7613 00 000, 8403 and from 8404 (serial line items of 163,164, 170, of 173, of 174).

Technical regulation "The Equipment Working under Pressure"

The technical regulation "The Equipment Working under Pressure" (further - the Technical regulation) is developed for the purpose of harmonization of the national legal system in the field with the Directive of the European Parliament and Council 97/23/SE of May 29, 1997 for approximation of laws of EU member states concerning the equipment working under pressure, published in the Official magazine N L 181 of July 9, 1997, item 1-55.

I. Scope

1. This Technical regulation establishes requirements to placement in the market of the equipment working under pressure, and upon the assembly units containing the equipment working under pressure.

2. Requirements of this Technical regulation are applied in case of the designing, production and assessment of conformity of the equipment and assembly units working under pressure, intended for placement in the market or put into operation namely the equipment:

new, not operated earlier, irrespective of country of source;

the modification of its design put into operation and modernized in the way;

imported into the Republic of Moldova, being in operation.

3. Requirements of this Technical regulation extend to the equipment working under pressure and the assembly units working with the most admissible pressure of PS exceeding 0,5 of bars.

4. Requirements of this Technical regulation do not extend on:

1) the pipelines assembled from pipes or system of pipes, intended for transportation of the fluid circle or substances to coastal or coastal installation or from it since the last blocked device inclusive located within installation including all service equipment which is specially intended for these pipelines. This exception does not belong to the equipment working under the standard pressure which is at stations of regulation of pressure or at compressor stations;

2) networks for giving, distribution and discharge of water and the service equipment, and also the bringing conduits, such as pressure head conduits, pressure head tunnels, pressure head mines for hydroelectric installations and their special assembly units;

3) simple vessels under pressure;

4) the equipment with aerosol sprayers;

5) the equipment intended for functioning of vehicles (cars and trail cars, wheel agricultural or forestry and landscape tractors, two - or three-wheeled cars);

6) the equipment which according to provisions of Item 29 of this Technical regulation can be referred only to category I;

7) the equipment which is subject of production or sale of weapon, ammunition or military objects;

8) the equipment, specially projectible for use in the nuclear equipment which defect can lead to emission of radioactive materials;

9) the equipment for control of the wells intended for industrial exploration and production of deposits of oil, natural gas or geothermal shooting of natural heat, and also the underground storage warehouses intended for content and/or regulation of pressure in wells such as: gushing armature of oil wells, protivovybrosovy preventers, manifolds, and also their equipment located above on current;

10) the equipment which is turning on cameras or machines for which determination of the sizes, the choice of material and production rules are based, first of all, on requirements of ensuring mechanical durability, rigidity and stability of this equipment for satisfaction of static and dynamic production loads or other technical characteristics, and for which pressure is not the essential parameter for designing. Can be carried to such equipment:

a) engines, including turbines and internal combustion engines;

b) steam-engines, gas/steam turbines, turbogenerators, compressors, pumps and executive mechanisms;

11) blast furnaces, including cooling systems, recuperators of hot blasting, dust arresters and scrubbers of flue gas of the blast furnace and cupola of direct reduction, including furnace cooling system, gas converters and coppers for melting, melting, decontamination and casting of steel and non-ferrous metals;

12) the barriers for the high-voltage electric equipment, such as connecting devices controlling devices, transformers and the rotating electrical machines;

13) pressure head pipes for placement of systems of transfer, for example, for electric and telephone cables;

14) portable sea platforms, the ships, rockets and aircrafts, and also the equipment which is specially intended for installation on them or intended for their reduction in movement;

15) the equipment working under pressure, consisting of elastic cover, for example, the tires, airbags, balls used for sports, inflatable aircraft and the other similar equipment working under pressure;

16) mufflers of noise of exhaust or absorption;

17) bottles or siphons for the carbonated drinks intended for final consumption;

18) the vessels intended for transportation and distribution of drinks, the important PS x V no more than 500 bars x liter and the most admissible pressure which is not exceeding 7 bars;

19) the equipment intended for civil aviation;

20) the equipment intended for transportation of dangerous products by road transport;

21) the equipment intended for transportation of dangerous products by rail;

22) the equipment intended for transportation of dangerous products by sea transport;

23) radiators and pipes for heating systems warm water;

24) the vessels intended for content of liquids with pressure of gas is higher than liquid no more 0,5 of bars.

II. Terminology

5. The following terms used in this Technical regulation mean:

the equipment working under pressure - the vessels, pipelines, safety accessories and accessories working under pressure. In cases where it is applicable, the equipment working under pressure includes the elements attached to the pressurized details, such as flanges, nozzles, unions, connecting couplings, support, lifting brackets, etc.;

vessel - the case designed and manufactured for content of fluid circles under pressure including all parts which are directly attached to it to the device intended for its connection with other equipment. The vessel can consist of one or more cameras;

the pipeline - the components of pipes intended for transportation of fluid circles when they are connected together for consolidation in system under pressure. The pipeline includes, in particular, the pipe or system of pipes, pipe binding, fitting compensating joints, hoses or other components, steady against pressure, in process of feasibility. The heat exchangers consisting of pipes for the purposes of heating or chilling of air should be considered as the pipeline;

safety accessories - the devices intended for protection of the equipment working under pressure against exceeding of admissible limits. Such devices include:

devices for direct restriction of pressure, such as safety valves, safety devices with explosive membrane, the bent cores, regulated security systems;

the devices limiting pressure, temperature and level of fluid which or enact means for adjustment or provide cut-off or cut-off and blocking, such as relay of pressure or temperature switches or float-operated switches, and also the control and measuring and control devices connected with safety;

accessories to regulation of pressure - devices with working function which have vessel for superpressure;

assembly units - the group of the equipment working under pressure, which is brought together by the producer for the purpose of creation integrated and functional whole;

pressure - pressure of rather atmospheric pressure 1, Mbar, i.e. the measured pressure; pressure in the field of vacuum is designated as negative value;

the most admissible pressure of PS - means the maximum pressure for which the equipment under pressure set by the manufacturer is designed.

This pressure is determined in the place of the equipment specified by the manufacturer which shall be the place of connection of safety and/or restrictive devices or the highest point of the equipment or if this place is not acceptable, any other place specified by the manufacturer;

most/minimum admissible temperature Tsmaksimalnye/minimum of temperature for which the equipment is designed as it is specified by the manufacturer;

amount of V - unobstructed capacity of the camera, including amount of nozzles to the first connection or welding and excepting amount of constant internal components;

the nominal DN size - numerical designation of the size which is general for all components in system of the pipeline, except the components specified on outer diameters or by the carving size.

It represents, conditionally, convenient integer for the help purposes and is approximately equal to the production sizes. The nominal size is designated by symbol of DN which numerical size follows;

fluid circles - gases, liquids and vapors in net phase, and also their mix. The fluid circle may contain particles of solid substances in suspension;

one-piece connections - connections which can be disconnected only by means of destruction methods.

III. Placement conditions in the market

6. It is allowed to place in the market and to put into operation the equipment and assembly units working under pressure according to provisions of Item 5 of this Technical regulation only if they are properly established, are serviced and used for their purpose, do not pose threat for health and safety of people and, proceeding from circumstances, animals or property, the environment.

7. Competent authorities can issue if necessary technical regulations which establish specific requirements for ensuring protection of people, in particular workers who use the equipment or assembly units working under pressure. These technical regulations will not establish the requirement to the equipment or assembly units which contradict provisions of this Technical regulation.

8. At trade fairs, exhibitions or demonstrations the equipment or assembly units which are not corresponding to provisions of this Technical regulation can be exposed provided that their discrepancy and unfitness for sale is specified by visible marking until they are not brought into accord by the manufacturer or his authorized representative with the location in the Republic of Moldova. During demonstrations it is necessary to take necessary security measures for ensuring protection of health and physical integrity of people.

9. It is supposed that the main safety requirements established in the appendix N1 to this Technical regulation and also other requirements of this Technical regulation are observed and placement in the market and commissioning of the equipment working under pressure or assembly units is allowed if they are marked by the national mark of conformity of SM provided in the appendix N 2 to the Order of the Government N 395 of April 17, 2006. "About rules of implementation of assessment procedures of compliance of industrial output from the regulated area and application of national mark of conformity of SM". The national mark of conformity of SM is put with the manufacturer or his authorized representative with the location in the Republic of Moldova and specifies products compliance to requirements of this Technical regulation, including to assessment procedures of compliance for which the declaration of conformity, according to provisions of the appendix N 2 to this Technical regulation was constituted.

10. It is supposed that the equipment or assembly units working under pressure conform to the main safety requirements established in the appendix N1 to this Technical regulation if they conform to requirements of the national interconnected standards and requirements which provide compliance presumption with the main requirements of this Technical regulation.

11. The list of the national interconnected standards applied to the equipment or assembly units working under pressure which accept (approve) the European harmonized standards, is approved with National authority on standardization, affirms the body responsible for regulation in the field, and is published in the Official monitor of the Republic of Moldova. This list will be periodically staticized.

12. In case the harmonized European standards are in the field not accepted in full as national standards, the existing national standards established as considerable or determining for the corresponding implementation of the main safety requirements established in the appendix N1 to this Technical regulation are published in the list of the national interconnected standards.

13. It is impossible to prohibit, to limit or interfere, proceeding from risk in connection with pressure, placement in the market or commissioning according to the conditions set by the manufacturer, the equipment or assembly units working under pressure which correspond to this Technical regulation and which are marked by national mark of conformity of SM that specifies that they were exposed to the assessment procedures of compliance established in Item 33 of this Technical regulation.

14. It is impossible to prohibit, to limit or interfere, proceeding from risk conditions owing to pressure, placement in the market or commissioning under the conditions set by the manufacturer, the equipment or assembly units working under pressure which conform to requirements of Item 26 of this Technical regulation.
