About approval of Licensed conditions of implementation of economic activity concerning work on land management, zemleotsenochny works
According to articles 6 and 9 of the Law of Ukraine "About licensing of certain types of economic activity", the resolution of the Cabinet of Ministers of Ukraine of 14.11.2000 N 1698 "About approval of the list of bodies of licensing" I ORDER:
1. Approve Licensed conditions of implementation of economic activity concerning work on land management, zemleotsenochny works (are applied).
2. To management of state examination of land management documentation and Goskomzem (Gulko V. O.) licensing:
2.1. In accordance with the established procedure to provide provision of this order on state registration in the Ministry of Justice of Ukraine.
2.2. Provide the publication of this order in mass media.
3. To the licensees performing economic activity based on current licenses on carrying out land management works, licenses for work on land management, licenses for carrying out zemleotsenochny works to bring the activities into accord with requirements of the Licensed conditions approved by this order, till 01.01.2010.
4. This order becomes effective in 10 days after its official publication.
5. To impose control over the implementation of this order on the vice-chairman Goskomzem Belchik S. V.

1.1. These Licensed conditions are developed according to the Land code of Ukraine, the Laws of Ukraine "About licensing of certain types of economic activity", "About assessment of lands", "About land management".
1.2. Body of licensing on implementation of economic activity concerning work on land management, zemleotsenochny works is the State committee of Ukraine on land resources.
1.3. These Licensed conditions establish organizational, qualification, production and other requirements concerning implementation of works on land management, zemleotsenochny works.
1.4. The subject of housekeeping shall perform economic activity concerning work on land management, zemleotsenochny works according to these Licensed conditions.
1.5. These Licensed conditions are obligatory for all subjects of housekeeping which carry out or intend to carry out works on land management, zemleotsenochny works in the territory of Ukraine irrespective of their form of business and pattern of ownership.
1.6. The subject of housekeeping which intends to perform economic activity concerning work on land management of zemleotsenochny works, personally or through the body authorized by it or person files in body of licensing petition for licensing for work on land management, zemleotsenochny works (appendix 1).
If the subject of housekeeping plans to perform economic activity on land management, zemleotsenochny works not in full, and partially (or on separate work types), then these work types are specified in the statement for licensing.
1.7. Documents are enclosed to the application for licensing:
the copy of the certificate on state registration of the subject of business activity or the copy of the certificate of entering into the Unified state register of the companies and the organizations of Ukraine certified notarially or the body which issued the original document;
signed by the applicant's head - the subject of housekeeping of the data on availability at it of the material and technical resources necessary for implementation of the corresponding type of economic activity;
the copy of the certificate of competency of the appraiser certified in accordance with the established procedure on expert money value of the parcels of land (in case of receipt of the license for carrying out zemleotsenochny works) and extraction from the State register of appraisers on expert money value of the parcels of land.
1.8. The statement for licensing (about issue of the copy of the license, about renewal of the license, about issue of the duplicate of the license) and documents which are attached to it are accepted on lists of documents which are enclosed to the application for licensing (the copy of the license, the duplicate of the license, renewal of the license) for implementation of economic activity concerning work on land management, zemleotsenochny works (appendix 2). The copy of the inventory is issued to the applicant with mark about date of documents acceptance by Goskomzem and the signature of the responsible person.
1.9. Statements for issue of the copy of the license, renewal of the license, issue of the duplicate of the license move subjects of housekeeping in the forms given in appendices 3-5.
1.10. The statement for licensing remains without consideration if it is given (signed) by person which does not have on it powers, and/or documents are processed with violation of requirements of article 10 of the Law of Ukraine "About licensing of certain types of economic activity". Without consideration the applicant is informed on leaving of the statement for licensing in writing with indication of the bases of leaving of the statement for licensing without consideration in the terms provided for licensing.
After elimination of the reasons which were the basis for decision about leaving of the statement for licensing without consideration the applicant can repeatedly submit the application for licensing which is considered according to the procedure, established by the Law of Ukraine "About licensing of certain types of economic activity".
1.11. Goskomzem by results of consideration of the documents filed by the applicant for receipt of the license within ten working days from receipt date of the statement for licensing makes the decision on licensing or on refusal in its issue and within three working days from acceptance date of such decision reports to the applicant about it in writing. In the decision on refusal in licensing the bases of such refusal are specified.
The bases for decision making about refusal in licensing are:
unauthenticity of data in the documents filed by the applicant for receipt of the license;
discrepancy of the applicant according to the filed documents to these Licensed conditions.
1.12. For each branch, each separate division of the licensee which will perform economic activity based on the license obtained by it Goskomzem issues to the licensee the copies of the license certified by it. The copy of the license certified by Goskomzem is the document confirming the right of branch or other separate division of the licensee to implementation of certain type of economic activity based on the obtained license.
1.13. The procedure for issue of the copy of the license, duplicate of the license and its cancellation is provided by Articles 10, of 11, of 14, of 18, of 21 Law of Ukraine "About licensing of certain types of economic activity". In the presence of the bases, the stipulated in Article 16 Laws of Ukraine "About licensing of certain types of economic activity", the licensee shall submit within ten working days to Goskomzem the application for renewal of the license together with the license which is subject to renewal and the relevant documents or their notarially attested copies confirming corresponding changes.
1.14. The licensee under the law of Ukraine "About state examination of land management documentation" shall submit to Goskomzem (to territorial authorities of Goskomzem in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol) documentation on land management and reports on expert money value of the parcels of land for carrying out obligatory, selective and voluntary forms of state examination.
1.15. The licensee performing economic activities concerning performance of works for land management shall represent results of the specified works in electronic form to territorial subdivisions of the State company "Center of the State Land Cadastre" according to the requirements approved by Goskomzem.
1.16. Documentation on land management developed by legal entities and reports on expert money value of the parcels of land are signed by the head of the licensee and person designated responsible for observance of requirements of the legislation in case of performance of works which are licensed.
1.17. The job title and professions in the staff list of the licensee (legal entity) shall correspond to the National qualifier of Ukraine "The qualifier of professions" of recreation center 003:2005, approved by Gospotrebstandart's order of Ukraine of 26.12.2005 N 375.
1.18. Job descriptions of workers of all positions specified in the staff list of the licensee shall be developed according to the Reference book of qualification characteristics of professions of workers approved by the head of the licensee.
1.19. About amounts of completed work on land management, zemleotsenochny works licensees inform Goskomzem till January 15 of the following for reporting years in the form given in appendix 6.
2.1. The subject of housekeeping - the legal entity when implementing economic activity concerning work on land management shall fulfill such requirements:
2.1.1. Organizational requirements:
availability in property or in use of the licensee of the geodetic equipment (the high-precision or exact electronic tacheometer, other measuring device), computer, multiplying facilities, necessary, for implementation of production process of the software;
availability of information support of process of development of the project documentation on land management (information and legal and methodical providing);
availability as a part of the licensee of the structural division providing work on land management;
ensuring check of accomplishment of documentation on land management, checks of completeness and quality of accomplishment of the actions provided by this documentation according to the Law of Ukraine "About land management";
the licensee shall observe requirements of the Law of Ukraine "About licensing of certain types of economic activity";
the licensee shall observe the procedure for acceptance and registration of citizens established by the current legislation for work according to Chapter III of the Labor code of Ukraine (execution of an employment agreement with hired employee).
2.1.2. Qualification requirements:
availability as a part of the specialist's licensee (on principle place of employment) which finished higher educational institution in "land management", "zemleuporyadochivaniye and the inventory" or "land management and the inventory" on educational qualification level the specialist, the master, and has length of service in the specialty at least than three years;
appointment of this specialist responsible for observance of requirements of the land legislation, standards, regulations and rules, in case of performance of works on land management.
Legislations, responsible for observance of requirements, in case of performance of works which are licensed shall at least once in three years improve skills of the engineer land surveyor on professional development course in educational institutions which signed the agreement on cooperation with Goskomzem.
For date of appointment of the specialist responsible behind observance of requirements of the legislation in case of performance of works on land management the period when it did not work as "engineer land surveyor", shall not exceed five years. In case of exceeding of the specified term such person shall improve skills on professional development course of the engineer land surveyor in the educational institutions which signed the agreement on cooperation with Goskomzem.
For the purpose of quality assurance of performance of works on land management responsible for observance of requirements of the legislation cannot perform the specified function in other legal entity.
For separate work types on land management Item 3.2 of Licensed conditions establishes additional qualification requirements.
2.1.3. Production requirements:
perform works on land management according to the legislation of Ukraine, including state standards, regulations and rules in the field of land management;
it is free to contribute one copy of developed documentation on land management to the State fund of documentation on land management;
provide storage of the copy of copy of developed documentation on land management according to the legislation;
fulfill requirements of the legislation on copyright when using materials of the State fund of documentation on land management;
provide information of rather licensed activities and the corresponding copy of technical documentation on land management upon the demand of body of licensing in case of control of observance of these Licensed conditions;
in case of liquidation of the legal entity the licensee shall provide transfer of developed documentation on land management in the State fund of documentation on land management;
the licensee shall satisfy terms of the contract concerning development of documentation on land management.
For separate work types on land management Item 3.2 of Licensed conditions establishes additional qualification requirements.
2.2. In case of development by licensees of separate types of documentation on land management the additional qualification requirements connected with need of attraction according to the employment contract of the following specialists are established:
2.2.1. For development nation-wide and regional (republican) programs of use and protection of lands, development of schemes of land management, and technical economic cases of use and protection of lands of administrative territorial educations - attraction to development of documentation on land management of the specialists who finished higher educational institution on specialties "economy of the company" or "economy of the company (by types of economic activity)", "agrochemistry and soil science", "town-planning".
2.2.2. For project development of land management concerning forming of lands of utility property of territorial societies and projects of differentiation of lands of the state-owned and utility property of settlements, projects of land management, concerning improvement of the territory of settlements - attraction to project development of the specialists who finished higher educational institution in "town-planning".
2.2.3. For project development of land management concerning the organization and establishment of borders of the territories of natural and reserved fund and other nature protection appointment, improving, recreational and historical cultural appointment - attraction to project development of the specialists who finished higher educational institution on specialties "ecology and environmental protection", "town-planning".
2.2.4. For project development of land management, providing ekologo-economic case of crop rotation and streamlining of grounds, developments of technical documentation, on site class determination of soil, development of working projects of land management concerning land reclamation, zemlevaniye of unproductive grounds, protection of lands against erosion, flooding, bogging, secondary salinization, siccation, landslides, consolidations, oxidations, pollution by industrial and other wastes, radioactive and chemicals, conservations of the degraded and unproductive lands, improvements of farmlands, increases in fertility of soils, - attraction to project development and technical documentation of the specialists who finished higher educational institution on specialties "agronomics", "agrochemistry and soil science".
2.2.5. For development of technical documentation on economic evaluation of lands, developments of technical documentation on normative money value of the parcels of land of agricultural purpose, development of technical documentation on normative money value of the parcels of land of nonagricultural appointment outside settlements - attraction to development of technical documentation of the specialists who finished higher educational institution in "economy of the company" or "economy of the company (by types of economic activity)".
2.2.6. For development of technical documentation on normative money value of the parcels of land of settlements - attraction to development of technical documentation of the specialists who finished higher educational institution on specialties "economy of the company" or "economy of the company (by types of economic activity)", "town-planning".
2.3. The subject of housekeeping - physical person entrepreneur when implementing economic activity concerning work on land management shall follow such requirements:
2.3.1. Organizational requirements:
availability in property or in use of the licensee of the geodetic equipment (the high-precision or exact electronic tacheometer, other measuring device), computer, multiplying facilities, production process of the software, necessary for implementation;
availability of information support of process of development of the project documentation on land management, opportunity operational modification of the project documentation;
the licensee shall observe requirements of the Law of Ukraine "About licensing of certain types of economic activity";
the licensee shall observe the procedure for acceptance and registration of citizens established by the current legislation for work according to Chapter III of the Labor code of Ukraine execution of an employment agreement with hired employee).
2.3.2. Qualification requirements:
diploma availability about the termination of higher educational institution on specialties "land management", "zemleuporyadochivaniye and inventory" or "land management and inventory" on educational qualification level the specialist, the master, and length of service in the specialty is at least three years;
it is at least to improve once in three years skills of the engineer land surveyor on professional development course in the educational institutions which signed the agreement on cooperation with Goskomzem.
2.3.3. Production requirements:
perform works on land management according to the legislation of Ukraine, and also state standards, regulations and rules in the field of land management;
to bezoplatno contribute one copy of developed documentation on land management to the State fund of documentation on land management;
provide storage of the copy of copy of developed documentation on land management according to the legislation;
fulfill requirements of the legislation on copyright when using materials of the State fund of documentation on land management;
provide information of rather licensed activities and the corresponding copy of technical documentation on land management upon the demand of body of licensing in case of control of observance of these Licensed conditions;
the licensee shall comply with terms of the contract concerning development of documentation on land management.
3.1. The subject of housekeeping - the legal entity when implementing economic activity concerning carrying out zemleotsenochny works shall fulfill such requirements:
3.1.1. Organizational requirements:
availability in property or in use of the licensee of computer, multiplying facilities necessary for implementation of production process of the software;
availability of information support of process of development of zemleotsenochny documentation (information and legal and methodical providing);
availability as a part of the licensee of the structural division providing carrying out zemleotsenochny works;
ensuring safety of documents, the zemleotsenochny job got during from the customer and other persons;
ensuring check of completeness and quality of accomplishment of zemleotsenochny documentation, accomplishment of the actions provided by this documentation according to the Law of Ukraine "About assessment of lands";
the licensee shall observe requirements of the Law of Ukraine "About licensing of certain types of economic activity";
the licensee shall observe the procedure for acceptance and registration of citizens established by the current legislation for work according to Chapter III of the Labor code of Ukraine (execution of an employment agreement with hired employee).
3.1.2. Qualification requirements:
availability as a part of subject of housekeeping of the specialist (on principle place of employment) which land assessment and real estate" on educational qualification level the specialist, the master finished higher educational institution on specialties of "land management", "zemleuporadochivaniye and the inventory", "land management and the inventory" or ", has length of service in the specialty at least than three years and which on functional obligations is responsible for observance of requirements of the land legislation, standards, regulations and rules, in case of accomplishment of zemleotsenochny works.
Legislations, responsible for observance of requirements, in case of performance of works which are licensed shall at least once in three years improve skills of the engineer land surveyor on rates advanced training in the educational institutions which signed the agreement on cooperation with Goskomzem.
For date of appointment of the specialist responsible for observance of requirements of the legislation in case of accomplishment of zemleotsenochny works the period when it did not work as "engineer land surveyor", shall not exceed five years. In case of exceeding of the specified term such person shall improve skills of the engineer land surveyor on professional development course in the educational institutions which signed the agreement on cooperation with Goskomzem.
For the purpose of quality assurance of accomplishment of zemleotsenochny works responsible behind observance of requirements of the legislation cannot perform the specified function in other legal entity;
availability in the state at least two specialists (on principle place of employment) who have the certificate of competency of the appraiser on expert money value of the parcels of land received according to the Laws of Ukraine "About assessment of lands", "About assessment of property, property rights and professional estimative activity in Ukraine", the statement from the State register of appraisers on expert money value of the parcels of land.
Appraisers on expert money value of the parcels of land shall at least once in two years improve skills according to the program of advanced training.
3.1.3. Production requirements:
to bezoplatno transfer one copy of the report on expert money value of the parcels of land to the State fund of documentation on land management;
provide storage of the copy of copy of the developed report on expert money value of the parcels of land according to the legislation;
fulfill requirements of the legislation on copyright when using materials of the State fund of documentation on land management;
provide information of rather licensed activities and the corresponding copy of the report on expert money value of the parcels of land upon the demand of body of licensing in case of control of observance of these Licensed conditions;
provide data (the statement from the report) about results of expert money value of the parcels of land in territorial authority of land resources in the place of its carrying out in three-day time after signing of the act of the performed works;
comply with terms of the contract about assessment.
3.2. The subject of housekeeping - physical the litsopredprinimatel performing activities concerning carrying out zemleotsenochny works shall fulfill the following requirements:
3.2.1. Organizational requirements:
availability in property or in use of the licensee of computer, multiplying facilities necessary for implementation of production process of the software;
ensuring safety of the documents received during evaluating from the customer and other persons;
availability of information support of process of development of reports on expert money value of the parcels of land, possibility of operational introduction of changes in them;
the licensee shall observe requirements of the Law of Ukraine "About licensing of certain types of economic activity";
the licensee shall observe the procedure for acceptance and registration of citizens established by the current legislation for work according to Chapter III of the Labor code of Ukraine (execution of an employment agreement with hired employee).
3.2.2. Qualification requirements:
diploma availability about the termination of higher educational institution on specialties "land management", "zemleuporyadochivaniye and inventory", "land management and inventory" or "land assessment and real estate" on educational qualification level the specialist, the master, and length of service in the specialty is at least three years;
availability of the certificate of competency of the appraiser on expert money value of the parcels of land received according to the Laws of Ukraine "About assessment of lands", "About assessment of property, property rights and professional estimative activity in Ukraine", statements from the State register of appraisers on expert money value of the parcels of land;
attraction based on the employment contract of the appraiser on expert money value of the parcels of land which has the certificate of competency of the appraiser on expert money value of the parcels of land received according to the Laws of Ukraine "About assessment of lands", "About assessment of property, property rights and professional estimative activity in Ukraine", the statement from the State register of appraisers on expert money value of the parcels of land.
The appraiser on expert money value of the parcels of land shall at least once in two years improve skills.
3.2.3. Production requirements:
it is free to transfer one copy of the report on expert money value of the parcels of land to the State fund of documentation on land management;
provide storage of the copy of copy of the report on expert money value of the parcels of land according to the legislation;
fulfill requirements of the legislation on copyright when using materials of the State fund of documentation on land management;
provide information and the corresponding copy of the report on expert money value of the parcels of land upon the demand of body of licensing in case of control of observance of these Licensed conditions;
provide data (the statement from the report) about results of expert money value of the parcels of land in territorial authorities of land resources in the place of its carrying out;
comply with terms of the contract about assessment.
