About approval of Industrial safety rules in ferroalloy production

1. Approve Industrial safety rules in ferroalloy production (further - Rules) which are applied.

2. Declare invalid the order of the State committee of Ukraine on supervision of labor protection of 19.02.97 N 32 "About approval of Safety rules for ferroalloy production".

3. This order becomes effective from the date of its official publication.

4. To the head of department of the organization of the state supervision in metallurgy, the power engineering specialist, construction and boiler inspection Ivanchenko V. I. provide provision of this order on state registration in the Ministry of Justice of Ukraine.

5. To the head of department of normative and legal and legal providing Prokhorov V. V. to enter changes in the State register of regulatory legal acts concerning labor protection and to post this order on the website of Gosgorpromnadzor.

6. To the assistant department head of personnel, clerical work and special work Kravtsu V. Yu. provide publication of the order in mass media.

7. To impose control over the implementation of this order on the vice-chairman of Committee Dunas S. V.

Industrial safety rules in ferroalloy production

I. Scope

1. These rules extend to all subjects of housekeeping who are engaged in designing, construction, operation, reconstruction and repair of objects of ferroalloy production.

2. Requirements of these rules are obligatory for all workers under the organization and performance of works connected with designing, construction, operation, reconstruction, research, adjustment and repair of the equipment of the companies and trial workshops of ferroalloy production.

II. General provisions

1. Designing, construction and reconstruction of the ferroalloy companies and their equipment shall be performed according to construction regulations and rules "Construction Norms and Regulations 2.09.02-85 * Factory buildings", the State health regulations of planning and building of settlements approved by the order of the Ministry of Health of Ukraine of 19.06.96 N 173 (further - the chipboards 173-96) registered in the Ministry of Justice of Ukraine 24.07.96 behind N 379/1404, Fire safety regulations in Ukraine approved by the order of the Ministry of Ukraine concerning emergency situations of 19.10.2004 of N 126, registered in the Ministry of Justice of Ukraine 04.11.2004 for N 1410/10009 (further - NAPB A.01.001-2004), Regulations on procedure for conducting state examination (check) for the project documentation on construction and reconstruction of production facilities and production of means of production on compliance to their regulations about labor protection, the Cabinet of Ministers of Ukraine approved by the resolution of 23.06.94 N 431.

2. Acceptance in operation of the companies completed by construction (reconstruction) is performed according to requirements of the Procedure for acceptance in operation completed by construction of facilities, the Cabinet of Ministers of Ukraine approved by the resolution of 08.10.2008 N 923 (in edition of the resolution of the Cabinet of Ministers of Ukraine of 20.05.2009 N 534).

3. The company which begins (continues) performance of works the increased dangers or operation of objects, machines, mechanisms, the equipment of the increased danger, shall get permission according to Procedure for issue of permissions by the State committee on supervision of labor protection and its territorial authorities approved by the resolution of the Cabinet of Ministers of Ukraine of 15.10.2003 N 1631.

4. Make changes to design of the operating capital equipment, and also change technological schemes without approval of the project organization or manufacturing plant it is not allowed.

5. At the ferroalloy companies the employer develops and approves regulations on security service of work according to the Standard regulations on security service of work approved by the order of the State committee of Ukraine on supervision of labor protection of 15.11.2004 of N 255, registered in the Ministry of Justice of Ukraine 01.12.2004 for N 1526/10125 (further - NPAOP 0.00-4.21-04).

6. All companies shall have the instructions for labor protection approved by the employer.

Instructions for labor protection shall meet the requirements of the Regulations on development of instructions for labor protection approved by Gosnadzorokhrantrud's order of Ukraine of the Ministry of Labour and Social Policy of Ukraine of 29.01.98 of N 9, registered in the Ministry of Justice of Ukraine 07.04.98 for N 226/2666 (further - NPAOP 0.00-4.15-98), the Procedure for study and approval of the regulations by the owner about labor protection existing at the company, the State committee of Ukraine on supervision of labor protection approved by the order of 21.12.93 of N 132, registered in the Ministry of Justice of Ukraine 07.02.94 for N 20/229 (further - NPAOP 0.00-6.03-93).

7. The employer shall according to article 5 of the Law of Ukraine "About labor protection" during execution of an employment agreement acquaint workers behind the personal signature about working conditions at the company, availability on workplace where they will work, not eliminated dangerous and harmful production factors and possible effects of their influence on health, and also about their rights to privileges and compensations for work in such conditions.

8. The employer shall for the means provide financing and organize carrying out preliminary (during employment) and periodic (during labor activity) medical examinations of workers according to the procedure and terms established by the Procedure for performing medical examinations of workers of certain categories approved by the order of the Ministry of Health of Ukraine of 21.05.2007 of N 246, registered in the Ministry of Justice of Ukraine 23.07.2007 for N 846/14113.

9. Application of work of women at the works specified in the List of hard work and works with harmful and dangerous working conditions on which application of work of women is forbidden approved by the order of the Ministry of Health of Ukraine of 29.12.93 of N 256, registered in the Ministry of Justice of Ukraine 30.03.94 for N 51/260 is not allowed.

The raising and cargo transfer manually is allowed by women within Limit rates of raising and movement of the heavy things by women approved by the order of the Ministry of Health of Ukraine of 10.12.93 of N 241, registered in the Ministry of Justice of Ukraine 22.12.93 for N 194.

10. Application of work of minors at the works specified in the List of hard work and works with harmful and dangerous working conditions on which application of work of minors is forbidden approved by the order of the Ministry of Health of Ukraine of 31.03.94 of N 46, registered in the Ministry of Justice of Ukraine 28.07.94 for N 176/385 is not allowed.

The raising and movement of heavy things by minors is allowed within Limit rates of raising and movement of the heavy things by minors approved by the order of the Ministry of Health of Ukraine of 22.03.96 of N 59, registered in the Ministry of Justice of Ukraine 16.04.96 for N 183/1208.

11. Carrying out training and examination concerning labor protection is performed according to the Standard regulations on procedure for carrying out training and examination concerning labor protection approved by the order of the State committee of Ukraine on supervision of labor protection of 26.01.2005 of N 15, registered in the Ministry of Justice of Ukraine 15.02.2005 for N 231/10511 (further - NPAOP 0.00-4.12-05).

12. For all workers in case of employment and on place of employment it is necessary to provide passing of instructing in fire safety according to requirements of the Standard regulations on instructing, special training and examination concerning fire safety at the companies, in organizations and the organizations of Ukraine, the Ministry of Ukraine approved by the order concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash of 29.09.2003 of N 368, registered in the Ministry of Justice of Ukraine 11.12.2003 for N 1148/8469 (further - NAPB B.02.005-2003).

13. At the companies based on the List of works with the increased danger, the State committee of Ukraine on supervision of labor protection approved by the order of 26.01.2005 N 15, registered in the Ministry of Justice of Ukraine 15.02.2005 for N 232/10512 (further - NPAOP 0.00-8.24-05), taking into account specifics of production by the employer is developed and affirms the corresponding list of works with the increased danger for which carrying out special training and annual examination concerning labor protection are necessary.

14. Works of the increased danger need to be carried out according to the work permit of the established form. The work permit which is issued to the executive in charge of works before works of the increased danger shall be drawn up according to requirements of the current legislation.

In the work permit issued on work of the increased danger the complete amount of organizational and technical actions which use will provide safe work in specific conditions shall be specified.

The list of positions of the heads and specialists having the right to issue work permits shall affirm the authorized officer of the company.

15. In each ferroalloy workshop plans of localization and liquidation of emergencies and accidents according to requirements of the Provision concerning plan development of localization and liquidation of emergencies and accidents approved by the order of Committee on supervision of labor protection of Ukraine of the Ministry of Labour and Social Policy of Ukraine of 17.06.99 of N 112, registered in the Ministry of Justice of Ukraine 30.06.99 for N 424/3717 shall be constituted (further - NPAOP 0.00-4.33-99).

16. At the companies irrespective of patterns of ownership in case of approach of accident it is necessary to organize investigation and accounting of accidents, occupational diseases and accidents according to requirements of the Procedure for the investigation and accounting of accidents, occupational diseases and accidents on production approved by the resolution of the Cabinet of Ministers of Ukraine of 25.08.2004 N 1112.

17. The employer shall provide all workers with overalls, special footwear and other individual protection equipment, and also safety devices according to requirements of Regulations of free issue of special clothes, special footwear and other individual protection equipment to workers of metallurgical industry approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of 27.08.2008 of N 187, registered in the Ministry of Justice of Ukraine 01.10.2008 for N 918/15609 (further - NPAOP 27.0-3.01-08), and also the washing and neutralizing means according to regulations of the current legislation.

It is not allowed to allow to work of the workers who do not have the corresponding overalls, special footwear and other individual protection equipment.

18. The procedure for issue, storage and use of individual protection equipment shall meet the requirements of the Regulations on procedure for the providing workers with special clothes, special footwear and other individual protection equipment approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of 24.03.2008 of N 53, registered in the Ministry of Justice of Ukraine 21.05.2008 for N 446/15137 (further - NPAOP 0.00-4.01-08).

19. The workers occupied at works with harmful working conditions free of charge are provided with milk or other equivalent foodstuff according to regulations of regulatory legal acts.

III. General requirements concerning creation of safe working conditions

1. On electric furnaces, casting machines, vyzhigatelny furnaces and ladles the passports containing the main specifications and meeting the requirements of GSTU state standard specification 2.601-2006 "Uniform system of design documentation shall be constituted. Operational documents" (GSTU state standard specification 2.601-2006).
