About approval of some technical regulations

Based on the Law of the Republic of Moldova "About technical regulation" No. 420-XVI of 22.12.2006, and also for the purpose of accomplishment of the Order of the Government "About Some Actions for Implementation of National Strategy of Creation of Information Society "Electronic Moldova" for 2007" No. 606 of 1.06.2007 and the Order of the Government "About Approval of Distribution of Fund of Implementation of the National Program for Development of Technical Regulations" No. 564 of 21.05.2007. I order:

1. Approve technical regulations:

a) Accounting treatment for electronic public services (according to appendix No. 1)

b) Provision of electronic public services. Technical requirements (according to appendix No. 2)

c) Ensuring information security by provision of electronic public services. Technical requirements (according to appendix No. 3)

d) Cost determination of development and deployment of the automated information systems. Standard rates and assessment of labor costs (according to appendix No. 4)

2. The technical regulations specified in the first Item become effective within three months from the date of publication in the Official monitor of the Republic of Moldova.

3. To impose control over execution of this order on the director of head department of development of information society Mr. Pavel Shinkaryuk.

Technical regulation Accounting Treatment for Electronic Public Services

1. Scope

These regulations determine appointment, the purposes, the principles and procedure for carrying out accounting and registration of electronic public services.

Electronic public services (further - public services) are integral part of activities of any bodies of the public power, the state organizations and companies.

Considerable part of public services contains the information arrays and products provided by means of electronic means and reflecting results of activities of these organizations in this or that sphere. Control of public services shall be exercised directly in the course of activities of bodies of the public power.

In process of management of public services it is necessary to provide achievement of the following tasks:

- completeness of creation of primary and derivative information arrays and products constituting public services;

- reliable storage and protection of public services;

- open entry of citizens and the organizations to the public services which are not containing the data constituting the state, trade, official or personal secret;

- creation of conditions for effective use of public services in activities of bodies of public management.

Providing objectives requires introduction of single rules and accounting treatment.

Provision of public services is aimed at ensuring access to official information to the population and business environment, improvement of quality of public services, increase in level of participation of citizens in the course of provision of services.

With respect thereto participants of process of provision of public services are:

- public organizations of local and central level;

- citizens;

- business sector.

Suppliers of public services are the bodies of the public power, public institutions or the organizations executing the state order on provision of certain type of service within their competence and functional obligations.

Consumers of public services are citizens or the organizations which addressed directly, and also through the representative to the supplier of public service for realization of the rights or legitimate interests or execution of the obligations assigned by regulatory legal acts.

2. Regulatory framework

These regulations are developed on the basis of the following legal acts of the Republic of Moldova:

- The law of the Republic of Moldova "About copyright and the related rights" No. 293-XIII of 23.11.1994;

- The law of the Republic of Moldova "About information access" No. 982-XIV of 11.05.2000;

- The law of the Republic of Moldova "About informatization and the state information resources" No. 467-XV of 21.11.2003;

- The law of the Republic of Moldova "About the electronic document and the digital signature" No. 264-XV of 15.07.2004;

- The law of the Republic of Moldova "About electronic trading" No. 284-XV of 22.07.2004;

- The law of the Republic of Moldova "About technical regulation" No. 420-XVI of 22.12.2006;

- The law of the Republic of Moldova "About personal data protection" No. 17-XVI of 15.02.2007;

- The law of the Republic of Moldova "About registers" No. 71-XVI of 22.03.2007;

- The law of the Republic of Moldova "About the state secret" No. 245 of 27.11.2008.

3. Terminology

In these regulations the following terms are applied:

Accounting data - the data of certain structure on identifiable faces, objects and/or the phenomena of the different nature which are accounting subject.

The state accounting - accounting as which organizer bodies of the public power act.

Electronic accounting - accounting, part or all data set of which can exist and be used (including for determination of the rights and obligations of persons and consequence in law) exclusively electronically.

The organizer of accounting - the person which is performing accounting of public services independently or authorized or obliged someone on implementation of these activities fully or partially in its interests.

The owner of information - the subject performing ownership and use of information resources and systems, technologies and means of their providing and realizing powers of the order in the limits set by the current legislation.

The registrar - person performing accounting fully or partially for the benefit of the organizer of accounting based on the powers received from it or owing to obligation.

Information resource of limited access - the information resource containing information on the state secrets and confidential information or information, access to which is limited by owners of information resources.

System of accounting - set of the means providing accounting of public services including the means of clerical work, the technical equipment and information and communication computer appendices realizing logic of accounting, and also source texts, system and user documentation of these computer appendices.

4. Purposes and tasks

The purpose of these regulations is the description of procedure and accounting principles of public services in national information space.

Public services include all set of information resources and services of bodies of the public power. Provision of public services is followed by the state information and communication infrastructure by means of network of the centers of request, the centers of public access, and also by means of the Internet, digital television, mobile phones.

For the purpose of achievement of effective use of public services distribution of information resources and control over their use are provided. Accounting of all public services serves as the tool for the effective organization of works for timely satisfaction of new requirements of bodies of the public power, and also for timely and quick response to the appearing opportunities.

The purpose of the organization of accounting of public services in national information space is also increase in efficiency, controllability, coordination of activities of all structural divisions of bodies of the public power.

Accounting of public services is performed for achievement of the following tasks:

- collection, classification and use of complete, urgent and authentic data on the created, functioning and liquidated public services;

- monitoring of condition of system of provision of public services;

- efficiency evaluation of creation and use of public services;

- identification of demand of public services from users;

- ensuring openness and transparency of data on activities of bodies of the public power connected with forming and use of information containing in public services;

- determination of tendencies and directions of development of public services.

These regulations establish accounting treatment for public services from the point of view of registration and updating of data.

Public services of bodies of the public power, other public services, newly created, created, acquired and (or) functioning on own means or with attraction of financial resources of the government budget, and also the separate bases (banks) of data acquired or transferred for use by bodies of the public power are subject to obligatory accounting.

5. Provision of public services

5.1. Classification of public services

Signs of public services are:

- provision of services in the field of valid orientation;

- availability of unrestricted circle of the subjects using the mentioned services;

- implementation of activities for provision of public services is direct to bodies of the public power or indirectly other subjects (on the basis of the formalized agreement on attraction of third party to certain list of actions for provision of public services by electronic means);

- electronic means both the public, and private property can constitute legal basis of provision of services.

Provision of electronic public services is performed by means of interaction of three main categories of participants:

- "The government - the citizen" - provision of electronic public services is based on interaction of the citizen and the Government most of which part is performed online. The main electronic public services rendered to citizens are:

1) payment of taxes;

2) services in search of place of employment by means of the job placement bureau;

3) receipt of the public assistance;

4) execution of personal papers;

5) registration of transport;

6) registration of the real estate;

7) filing of applications and receipt of construction licenses;

8) filing of applications in police;

9) services of public libraries;

10) registration of acts of record of civil status (the certificate of birth, about scrap, filing of applications about change of the residence etc.);

11) receipt in higher educational institutions;

12) assistance of public safety;

13) health care services;

- "The government - business" - provision of electronic public services is based on interaction of public administration and business community. The main public services of this category are:

1) social and pension expels of workers and employers;

2) payment of taxes by the organizations;

3) registration of the new companies;

4) data transmission to statistical bodies;

5) filling and submission of customs declarations;

6) receipt of the permissions connected with environmental protection;

7) filing of applications and receipt of construction licenses;

8) implementation of public procurements.

- "The government - the Government" - provision of electronic public services is based on interaction of bodies of the public power and public institutions via electronic means of communication.

From function point of sight, public services are subdivided into the following classes of services:

- provision of valid public services;

- provision of services in the field of the business and commercial information;

- provision of services in the field of registration of land and cadastral relations;

- provision of services in the field of financial and bank system;

- provision of information services in education - implementation and use of new information and communication technologies in educational process;

- provision of information services in the field of science;

- provision of information services in the field of health care;

- provision of information services in the field of legal information;

- provision of information services in the field of social security;

- provision of information services on safety issues;

- provision of information services in the field of cultural heritage;

- provision of information services in the field of human rights;

- provision of information services in the field of tourism.

Public services in sign of target orientation are divided into the following categories:

- external public services:

1) social and economic development;

2) science and knowledge;

3) environment protection;

4) health care;

5) right protection, democratic rights and human rights;

6) social policy;

7) culture;

8) education;

9) public safety;

10) judicial system;

11) homeland security and defense;

12) natural resources;

- internal public services:

1) public regulation, planning and management of services;

2) human resources management;

3) management of finance;

4) information management and technologies;

5) fund management, resources;

6) management of communications;

7) supply management;

8) administration;

9) professional services.

Public services in method of access are subdivided on:

- open, public information;

- information of limited access: state secret, trade secret, personal data.

Public services are classified by paid nature sign on:

- paid public services;

- free public services.

Public services in extent of personification are subdivided on:

- individual;

- collective.

Provision of public services is possible on different levels of complexity:

Level 1 - Informing.

This level includes provision of information on the following:

- public services;

- activities of bodies of the public power;

- services in information servicing;

- information search;

- information processing;

- issue of these (documents);

- storage of information.

Level 2 - Interaction.

This level allows provision of the following services:

- copying of forms from the Internet;

- processing of forms, including their authentication;

- implementation of electronic document management system;

- services in use of the Internet, information systems, databases, networks;

- consulting services;

- services in information transfer;

- services in Internet access;

- services in use of e-mail and forming of the websites.

Level 3 - Transactions.

This level allows provision of the following services:

- information transfer;

- decision making and provision of goods and/or services (including implementation of payments with use of electronic means).

Level 4 - Transformation.

This level allows to redefine the act of management.

5.2. Process of provision of public services

Process of provision of public services is performed by electronic means by means of single point of the dostupapravitelstvenny portal.

Provision of public services is performed on the basis of the existing or created information resources of the and systems (S) and, thus, shall cover the following processes of lifecycle of IS functioning within information system management and technologies:

1) planning - preproject works - is required development of system concept and business offering on provision of public services;

2) development - development of information system of provision of public services - is required to determine, analyze, develop, create, to test and, if necessary, to estimate mechanisms of interaction of program elements and organizational structures, and also to determine requirements to hardware, the user's infrastructure, training and maintenance. It is necessary to develop the specification, the engineering design, the version of program system, technical documentation, the protocol of qualified testing, the deed of conveyance in trial operation;

3) implementation - implementation of information system of provision of public services - it is necessary to perform preparation of infrastructure of the user and the equipment of rooms in which functioning of software product, check of operability of software product in actual practice of operation will be performed, and also to organize personnel training to work with software product or its components;

4) operation - operation of information system of provision of public services - shall include processes which are connected with use of software products for provision of services, and also control of functioning, identification and documentation of the arising problems;

5) support and maintenance - maintenance of information system of provision of public services - it is necessary to exercise control of work of software product, registration of problems for the analysis, acceptance of the warning and corrective actions, and also actions for adaptation and enhancement of software product;

6) monitoring and decisions on upgrade information sistemutilization of information system of provision public uslugdolzhno to be provided withdrawal from operation of software product and the related program subsystems and auxiliary software processes.

Within processes of management of information technologies the information systems and resources of provision of public services designed to support effective functioning of bodies of the public government and to provide achievement of strategic and tactical tasks by them are created.

The system of provision of public services shall include the following types of information resources:

- the state information resources - information resources, the property right to which belongs to the state and which are subdivided into territorial, departmental and basic information resources;

- the information systems which are subsystems of electronic board;

- websites and domains of bodies of the public power;

- qualifiers, information objects and information services;

- technical documentation, registration certificates of domains and certification of information systems.

These information systems and resources shall be carried to specific class and category of public services.

6. Accounting of public services

Accounting of public services represents accounting of components of information resources where functions and accounting principles, forming of public services, and also their legal regime shall reveal.

Accounting of provision of public services shall cover the following stages of lifecycle of public services:

- initial statement of public service on accounting assumes its registration in the register;

- updating of data on public service shall be carried out in the register by means of change of registration record if:

1) the organization rendering services changes;

2) the service changes;

3) service provision conditions change;

4) documentation issued when rendering services changes;

5) IS which is service, basic for implementation, changes.

In case of the termination of process of provision of public service all data on this service shall be cancelled.

The system of accounting of public services covers:

- regulatory framework;

- the documents of all levels regulating accounting;

- the organizations performing accounting;

- the paper and electronic media and information systems which are used when accounting public services.

6.1. Functions of system of accounting of public services

The system of accounting of public services shall perform the following functions:

- collection, accumulating, processing, storage and updating of these public services;

- providing at the national level of single accounting of public services;

- providing public power with operational and statistical information of bodies;

- ensuring exchange of information between bodies of the public power, and also with similar bodies of other countries;

- control over observance of accounting treatment for public services, development and implementation of measures of timely response to negative tendencies and manifestations;

- organizational, normative and methodical support of activities of the bodies of the public power which are directly performing functions of accounting of public services;

- ensuring functioning of the authorized software and hardware complex and information networks used within system of accounting of public services.

In case of development of public services it is necessary to apply the following implementation methods of functions of accounting:

- enhancement of normative and legal and methodical ensuring management of public services;

- enhancement of the organizational structures connected with forming and use of public services;

- organization of accounting of public services and development of criteria and techniques of assessment of their cost;

- development of the principles and creation of system of financial and economic ensuring activities for forming and use of public services;

- development and deployment of the unified technologies of use of telecommunication networks for coordination of management of public services;

- organization and implementation of the state control of functioning of public services.

6.2. Basic principles of accounting of public services

Accounting of public services shall be carried out according to the basic principles:

- legality - provides during creation, acquisition, use and the order public services compliance to their existing national legal system;

- the combination of publicity and confidentiality - provides publication of public information, except for information, acknowledged confidential, according to the procedure, established by the existing national legal system;

- efficiency and economy - means that acquisition of the information resources used for providing continuity of process of provision of public services is performed proceeding from need of satisfaction of information requirements and reducing budgeted expenses;

- the combination of the paid nature and free of charge provision informatsiioznachat that information acquired at the expense of means of the government budget is provided to bodies of the public power on a grant basis. Transfer of information stated above to other users happens for certain payment if other is not established by the legislation;

- the sequence - provides that creation, acquisition, use and the order public services is carried out step by step;

- integrity - means that the system of provision of public services shall be one of the main subsystems of the integrated state information system;

- justification - provides use of documentary information in system of provision of public services;

- scalability - provides possibility of expansion and building-up of components of system of accounting of public services;

- the unity of information space - provides use of single system of the interconnected qualifiers, formats of data, protocols of information exchange, standards, regulating and methodical documents that is necessary condition for forming of common information space of system of provision of public services;

- personal data protection - provides creation and operation of system of accounting of public services according to international treaties and agreements, and also the existing national legal system in the field of human rights protection;

- single identification - provides that all information objects of accounting shall have unique identification number;

- control - provides control of the measures providing quality, reliability of information resources and systems, and also their storage and rational use;

- safety - provides security of system of provision of public services from different impacts breaking continuity of process of provision of services.

6.3. Organization of accounting of public services

The provided public services are subject to obligatory accounting.

Accounting of public services are performed for the purpose of:

- information support of bodies of the public power;

- informing citizens and organizations on public services, and also on procedure for access to them.

Forming of the public services this on accounting shall be made by body of the public power in the register which shall include information on public services, and also the corresponding state information systems and resources which are basis for provision of public service according to the existing national legal system.

Registers, magazines, cases, cards, books, accounts, records belong to forms of accounting of public services, and when using information technologies files of spreadsheets, databases, systems of text files and other means of the organization of digital data belong to forms of accounting as well.

Forms of provision of accounting data shall be determined by the following factors:

- accounting form;

- the technical means providing accounting;

- organization of accounting data;

- methods of bringing accounting data to interested persons.

Treat forms of provision of accounting data:

- certification, reports, statements, references, certificates;

- voice notification;

- publications in mass media;

- disclosure through computer networks public.

6.4. Legal regime of public services

The legal regime of public services shall include:

- procedure and sources of forming of public services;

- procedure for documentation of information;

- property right to separate documents and separate document files;

- procedure for legal protection and use of public services;

- order of registration and inclusions of public services in economic circulation;

- other elements of legal regime of public services, including determination of category of access to public services.

6.4.1. Procedure and sources of forming of public services

Public services shall be created by the relevant organs of the public power responsible for forming of public services according to the powers conferred to them.

Forming of public services shall be made in the register, including the list of data on public services, systems, and also about websites and domains of bodies of the public power, according to the existing national legal system.

Public services shall include information provided by bodies of the public power, citizens, the organizations and public associations performing the activities in the territory of the Republic of Moldova according to the procedure, established by the current legislation.

Responsibility for reliability of data on public services is born by owners of public services.

Procedure, conditions of representation and contents of documentary information for forming of public services are established according to the laws of the Republic of Moldova "About registers" No. 71-XVI of 22.03.2007 and "About information access" No. 982-XIV 11.05.2000.

As a result of forming of public services the following information shall be determined:

- detailed description of public services and necessary components;

- methods of implementation and provision of public services;

- control procedures of the required quality level of public services.

6.4.2. Procedure for documentation of information

Public services shall be created based on documentary information. Documentary information is object of the property right and acts in the form of the separate document or set of the documents fixed on the data carrier with the corresponding details including in the form of the electronic document.

The structure of information provided to potential users of public services includes in independence of category of public services:

- data on the list of public services;

- general information about the supplier, the representative to provide certain type of public services;

- the information about the officials who are directly providing public services to users;

- the description of the provided public services according to the list of public services.

The description of the provided public services represents the document intended for users of public services, explaining procedure for receipt of this or that public service.

The description of the provided public service includes the following information:

- purpose of public service;

- service dates of receipt;

- documents necessary for receipt of service;

- contact information of employees of bodies of public management which it is possible to address for receipt of this service;

- data on the conditions and requirements imposed to users of services;

- procedure for receipt of service in electronic form;

- information on service payment if service payment is provided;

- the additional services accompanying receipt of service;

- key indicators of service quality: timeliness, availability, continuity and process of appeal.

Concerning separate types of public services the features of their legal regime in particular following from functional purpose of such public services or owing to reference of public services to certain category of access to them can be established.

Documentation of information is the compulsory provision of inclusion of information in public services. Documentary information in public services shall be systematized, classified and provided with the corresponding details.

The main details of documentary information are:

- name of the document;

- owner of information;

- information source;

- date and time of emergence and documentation;

- procedure for use;

- other details necessary for systematization and classification.

In case of inclusion of information in structure of public services the possibility of its search taking into account classification and by the established details shall be provided. The data containing in Central Bank of the register include details and information according to the current legislation.

Information on public services can be provided in text, graphical, sound, video and multimedia (combination of text, graphical, sound and video formats) forms.

The document received from information system, and also stored, processed and transmitted by means of information and telecommunication systems acquires legal force according to the procedure, established by the current legislation.

6.4.3. Property right to separate documents and separate document files

The property right to separate documents and separate document files is determined by the Law of the Republic of Moldova "About copyright and the related rights" No. 293-XIII of 23.11.1994. According to provisions of this regulation the property right to the state information resources belongs to the state.

The responsibility for violation of the property rights is regulated by the specified law and other existing regulations.

6.4.4. Procedure for legal protection and use of public services

Public services are provided to users according to:

- legislation of the Republic of Moldova;

- Agreement on the level of services;

- on the basis of request;

- on other bases.

The legal relations connected with rendering public services are regulated by the existing national legal system and agreements signed with users of public services. In case of violation of arrangements from any party the breaking party bears responsibility according to provisions of the Agreement on the level of services, and also according to the current legislation.

The agreement on the level of services represents the agreement between the supplier and the user of public services in which the provided services in language, clear for the user, the right and obligation of both parties in provision of public services, and also responsibility of the parties in case of failure to carry out of the obligations are in detail described.

Persons guilty of disclosure, change or destruction of information on public services bear disciplinary, civil, administrative or criminal liability according to the current legislation.

6.4.5. Order of registration and inclusions of public services in economic circulation

The status of public services is considered ready for their registration only after input of system in operation and after carrying out post-implementation substantive audit within internal requirements and provisions of the legislation.

The owner of information shall prepare all necessary documentation according to procedure for documentation then in the register necessary data are entered.

For registration of public service in the register it is necessary to enter the following information:

- code of public service;

- type of public service;

- functionality of public service;

- target orientation;

- start date and term of rendering service;

- quantity of objects of the information resources included in service;

- the list of the information resources included in service;

- type of confidentiality of the information resources included in service;

- versions of the software used in case of provision of services;

- body of public management responsible for service provision;

- owner of service;

- the organization exercising control over service provision;

- the organization performing safety of service and the information resources included in service;

- the organization performing the concept "three And" (authentication, authorization, administration);

- the status of service (according to lifecycle);

- means of rendering service;

- category like subjects;

- category of the user;

- category of the paid nature;

- the officials providing service.

All information which is stored in the register shall allow to receive the latests version of documentation on the provided public service. The data containing in the register shall be reviewed periodically at least once in three years or in the following cases:

- changes of procedure for provision of public services;

- changes of the available data on condition of documentary confirmation of accuracy of the data by the owner;

- changes of the provisions of the current legislation connected with provision of public services.

Persons responsible for entering of data into the register shall assume liability on nondisclosure of this information. The obligation on nondisclosure of information remains in force and after the termination of activities for provision of public services according to the law.

After registration of public service date of start of process of provision of this service therefore the public service is considered included in economic circulation is formally determined.

6.4.6. Determination of category of access to public services

The procedure for access to public services is determined depending on degree of privacy of information placed in it and from its appointment.

Public services are open and public. The exception is constituted by the documentary information referred according to the current legislation to category of limited access.

Access to public public services shall be provided without authentication and accounting of the user. Accounting of actions, identification and authentication of the user are obligatory in case of access to public services of limited access.

Public services of limited access under the terms of their legal regime are subdivided into the public services containing information carried to the state secret and the public services containing confidential information. Reference of information to the state secret is performed according to the Law of the Republic of Moldova "About the state secret" No. 245 of 27.11.2008.

Process of provision of public services of limited access is subject to protection. For ensuring access to public services of limited access mechanisms of the digital signature and specialized information system are used. The procedure for use of mechanisms of the digital signature is determined by provisions of the existing national legal system.

The organizations having licenses for the work right in the field of cryptographic or technical information security and also the safety certificate according to the current legislation are involved in works on ensuring protection of process of provision of public services of limited access. For information processing of limited access and its protection the technical means certified in accordance with the established procedure shall be used.

The mode of use of information referred to the category of limited access which is not relating to the state secret is determined by the Law of the Republic of Moldova "About information access" No. 982-XIV of 11.05.2000.

Bodies of the public power shall provide equal access for all interested subjects (citizens, the organizations, bodies of the public power) to public public services and official information on questions of activities of bodies of the public power.

Only bodies of the public power according to degree of privacy of data have the right to use of public services of limited access.

For protection against malicious or unintentional misstatement of information by provision of public services it is necessary to fulfill the following requirements:

- maintaining the list of the users working with system and the accounting information about them;

- ensuring reliable protection of accounting information about users against unauthorized access;

- maintaining register (audit) access for users to information resources.

6.5. Electronic accounting of public services

Electronic accounting of public services represents such accounting in which at least part of accounting data is used and provided to users exclusively electronically. The system of electronic accounting of public services is intended for:

- confirmations of holding due accounting procedures by the participants of administrative processes authorized on it;

- ensuring the legal importance of electronic accounting data.

The system of electronic accounting of public services shall include the following subsystems:

- providing trust for digital signatures (confirmation of identity of authorized persons);

- electronic confirmation (confirmation of time of making of accounting records);

- external archiving (ensuring preserving accounting data);

- disclosures of information (ensuring open access to accounting data);

- registration of systems of electronic state accounting.

For systems of the state accounting of public services permanent readiness for transition to the non-staff mode of functioning without use of electronic technologies for what paper accounting shall duplicate electronic accounting in real time (shall be maintained without prejudice to the legal importance of electronic accounting).

Are among the most important systems of the state accounting of public services:

- "The state register of the population";

- "The state register of legal units";

- "National geographical information system";

- "Information resources of bodies of the public power";

- "Information resources of the social sphere";

- "Information resources of the financial and economic sphere";

- "Inventories of natural resources and technogenic potential".

Systems of electronic state accounting shall provide possibility of implementation of different types of control of their use, including implementation of internal control, external control and carrying out information audit on compliance to requirements imposed to these systems.

Objects of control and audit are the hardware and software systems providing conducting electronic accounting of public services:

- computing and telecommunication equipment;

- communication channels;

7. Ensuring information security

The procedure for accumulating, processing, use of information referred to category confidential for the rule of its protection and procedure for access to it are regulated according to the existing national legal system.

Ensuring information security of system of accounting of public services requires accomplishment of the following requirements:

- identification of threats of information security in selection process and acquisitions of equipment rooms and software, creation and operation of information systems, their prevention and the prevention, and also liquidation of adverse effects in case of their approach, including compensation of material damage;

- observance of storage conditions and protection of the electronic and other documents providing preserving the attributes identifying them;

- observance of statutory rules of use of means of cryptographic protection.

Software and hardware of protection of system of accounting of public services shall provide:

- integrity of data when forming, using, processing, provision of public services;

- protection against unauthorized access, introduction of amendments and changes in public services;

- system of reservation and recovery of data;

- control of integrity and operability of system of ensuring information security;

- identification of the protected public services;

- authentication of the protected public services and users;

- authenticated data exchange;

- differentiation of access for users to data;

- registration of actions on entrance of users to system and leaving the system and violations of access rights to the protected public services.

Technical requirements

1. Scope

These regulations establish general requirements to process of provision of electronic public services (further - public services).

In these regulations requirements to the organization of process of provision of public services are determined and the obligatory components of process of provision of public services providing quality, transparency and efficiency of functioning of process are given.

These regulations establish set of the processes, works and tasks intended for the organization and process control of provision of public services.

The purpose of regulations is determination of the requirements providing effective access to official information, provision of public services to citizens, business community and bodies of public management with use of electronic means, improvement of quality of public services, increase in efficiency of activities of public administration, ensuring transparency of activities of bodies of public management; development of the legal base of implementation of electronic board and electronic democracy.

These regulations are intended for: customers and users of the automated information systems (IS), software products and services; suppliers; developers; IS administrators; project managers; the managers who are responsible for quality and users of software products who are participants of process of provision of public services to citizens, business community, bodies of public management by means of use of electronic means.

2. Regulatory framework

These regulations are developed on the basis of the following legal acts of the Republic of Moldova:

- The law of the Republic of Moldova "About information access" No. 982-XIV of 11.05.2000;

- The law of the Republic of Moldova "About informatization and the state information resources" No. 467-XV of 21.11.2003;

- The law of the Republic of Moldova "About the electronic document and the digital signature" No. 264-XV of 15.07.2004;

- The law of the Republic of Moldova "About electronic trading" No. 284-XV of 22.07.2004;

- The law of the Republic of Moldova "About technical regulation" No. 420-XVI of 22.12.2006;

- The law of the Republic of Moldova "About personal data protection" No. 17-XVI of 15.02.2007;

- The law of the Republic of Moldova "About registers" No. 71-XVI of 22.03.2007.

3. Terminology

In these regulations the following terms are applied:

The agreement on the level of services - the written agreement between the service provider and the customer (customers) which describes the approved service levels on any service.

The internal contour of electronic board - includes the information systems servicing processes in system of public administration (G2G) including provision of internal services (G2E) to structures and employees of management, both on central, and on local levels.

Delta release - the partial release including only those accounting elements within release unit which were changed, or new accounting elements from the moment of the last complete or delta release.

Configuration documentation - documentation which determines requirements to accounting element, system design, assembly, production and check of accounting element.

Accounting element - infrastructure component which is under control of management of configurations (including hardware both the software and documentation).
