About approval of Regulations of Admission and departure of international post Items of the international post exchange
According to the Customs code of Ukraine and the Law of Ukraine "About mail service", for the purpose of establishment of procedure for processing, peresylaniye, and also documentary execution of dispatches with mailings in Items of the international post exchange of Ukraine we ORDER:
1. Approve Regulations of Admission and departures of international post by Items of the international post exchange (further - Rules) which are applied.
2. To department of the strategy of development for mail service of the State Committee on Communications of Ukraine (Gavrish N. G.):
2.1. Provide provision of this order on registration in the Ministry of Justice of Ukraine.
2.2. Bring this order to the companies (operators) of mail service which in accordance with the established procedure provide services in peresylaniye of the international mailings.
3. To provide to the secretariat of State Customs Service of Ukraine bringing this order to customs authorities.
4. Consider such which are not applied in the territory of Ukraine, "Regulations of Admission and sendings international post by Items of the international post exchange of the USSR", the Ministries of Communications of the USSR approved by the Head post department, 1982.
5. To impose control of execution of this order on the vice-chairman of the State Committee on Communications of Ukraine Kolyadenko V. A., vice-chairman of State Customs Service of Ukraine Pashko P. V.

Approved by the Order of the state committee of communication and informatization of Ukraine, the State Customs Service of Ukraine of December 10, 2002 No. 235/688
These Rules developed according to the acts of Universal Postal Union and other regulatory legal acts regulating activities in the field of provision of services of mail service determine procedure for acceptance, sending and documentary execution of dispatches with mailings in Items of the international post exchange of Ukraine.
In these Rules terms are used in such value:
The dispatch - mail (sack or several sacks with written correspondence, periodicals, mail in large number, small packets, departures with the announced value, sending and empty sacks / or group of the sending which is not packed in post container/) which go along with the place of the international post exchange of one country to the appropriate foreign place of the international post exchange of other country according to the Management in the direction of international post on one written CN 31 or CN 32 card or the parcel CP 86 or CP 87 card.
The place of the international post exchange (further - MMPO) the production division of the operator of mail service performing processing of the international mailings (далееМПО), presentation to their customs authority for implementation of customs control and customs clearance and sending to destination.
PMPO customs - customs authority in which zone of activities PMPO is located.
Item of the international post exchange (further - PMPO) the production division of the operator of mail service performing direct exchange of dispatches with international post with foreign postal services.
2.1. PMPO are organized based on production divisions of the operators of mail service having MMPO in the structure on condition of approval of customs authority of Ukraine in which zone of activities opening of PMPO, State Customs Service and the State Committee on Communications is provided.
2.2. Exchange of dispatches with the foreign PMPO postal services can be performed through the traveling crews of mail vans of international routes subordinated to them or through services of the international messages of air, sea or road transport.
2.3. In productive activity of PMPO are guided by these Rules, acts of Universal Postal Union, Rules of provision of services of mail service approved by the resolution of the Cabinet of Ministers of Ukraine of 17.08.02 of N 1155, the Management in the direction of international post, plans of the direction of output, transit dispatches and empty sacks, the Regulations on customs control and customs clearance of the international mailings approved by the order of the State Customs Service of Ukraine and the State committee of communication and informatization of Ukraine of 27.10.99 N 680/108, registered in the Ministry of Justice 17.11.99 for N 791/4084 (with changes and amendments).
2.4. Such functions are assigned to PMPO:
acceptance of the dispatches with international post arriving the land, sea and aircraft transport with MMPO and PMPO of Ukraine;
transfer of dispatches to foreign postal services it is direct or to the transportation (forwarding) companies which provide services in transportation of international cargoes by aviation, sea, railway and road transport (daleeperevozchik) if dispatches are transported with their mediation;
acceptance of dispatches directly from foreign postal services or carriers;
sending to destination the entrance and transit dispatches arriving from foreign postal services;
creation of the international documentation on departure of dispatches abroad aviation, sea, road transport and mail vans;
inundated verification of output, entrance and transit dispatches, creation of accompanying documents, registration of the violations found in case of acceptance and verification of dispatches.
2.5. The dispatches with international post arriving in PMPO are checked (external condition of post objects and sending which are sent not packed in post container, and accompanying documents) and go to destination without their disclosure.
2.6. Workers of PMPO shall show dispatches with all types of mail and accompanying documents to divisions of customs for customs control and registration.
2.7. Customs control over movement of dispatches with international post on the territory of Ukraine is exercised by State Customs Service of Ukraine.
2.8. The basis for the omission of dispatches with international post through customs border of Ukraine is putting down by the official of PMPO customs of print of stamp "Under customs control" on delivery notes of delivery of CN 37, of CN 38, of CN 41 and delivery notes f.16 for entrance dispatches, stamp print "Under customs control" on delivery notes f.16 - for transit dispatches, print of personal number seal on delivery notes of delivery of CN 37, of CN 38, of CN 41 - for output dispatches.
2.9. If the peresylaniye of dispatches with the international mailings en route through the territory of Ukraine is performed without participation of operators of mail service, then control of movement of such dispatches is exercised according to the Regulations on procedure of control of cargo delivery in customs of appointment approved by the order of State Customs Service of 08.12.98 N 771 and registered in the Ministry of Justice of Ukraine 22.01.99 for N 42/3335 (with changes and amendments).
3.1. Dispatches are created with:
written correspondence (the non-registered and registered mail, post cards and parcels post, periodicals, small packets, departures with the announced value, sacks of "M", sekogramma, the international commercial correspondence with the answer (further - MKKV));
express letters;
sending;
by mail in large number;
departures of the international accelerated post (EMS);
the grouped mailings with the mark "Consignment";
empty container.
3.2. Dispatches are distributed on:
days off which are shipped by MMPO of Ukraine outward;
entrance which arrive from foreign postal services to Ukraine;
transit which are sent by transit through the territory of Ukraine.
3.3. International post which is shipped with MMPO of Ukraine outward shall arrive in PMPO in the sealed-up sacks, containers or other reservoirs with address labels. Sending which go to the countries, adjacent to Ukraine, in coordination with the relevant post Administration, can be sent not packed in reservoir.
Sending which go to foreign countries are sent in the sacks which are sealed up lead, and in the presence of the device which is closed, - plastic seals. Seals can be made of light metal or plastic material with legible specifying on them Latin letters of the name MMPO.
Bulky, brittle sending or that sending which nature requires it can be sent not packed in reservoir. For determination of the dispatch which they treat on such sending the label of CP 83 or CP 84 shall be pasted. Labels of sending with the announced value which are sent not packed in reservoir shall be designated by the letter "V". However sending which go by sea except for of bulky sending, shall be sent in reservoirs.
The mass of sacks with written correspondence which are shipped outward shall not exceed 30 kg, and the mass of sacks with shipments of EMS and with sending - 32 kg.
3.4. Sacks with international post shall arrive in PMPO with the address labels made of dense paper.
According to way of the direction of dispatches such forms of bag labels are established:
CN 34 (C 83) - for sacks with written correspondence (sending) of dispatches which goes land or sea transport;
CN 35 (CP 84) - for sacks with written correspondence, shipments of EMS, express letters, sending of dispatches which go the aircraft transport;
CN 36 (CP 85) - for sacks with written correspondence (sending) of dispatches of S.A.L. (land dispatches which are transported by the aircraft transport).
Depending on type and category of the mailings sent in sack, address labels are applied:
bright red color - for sacks with registered mails, departures with the announced value, express letters and written maps;
white color - for sacks with investment only of simple departures which are sent by land and air transport, and sacks with investment of newspapers which go in large number publishers or their representatives and which are sent only by the land transport, except for those which return to the sender. The marks "Journaux" ("Newspaper") or "JX" are put down on label of white color if only departures of this category are enclosed in sacks;
blue color - for sacks with investment of simple departures which are sent only by the land transport, sacks with periodicals, small packets and sekogramma. The mark "Ecrits periodiques" ("Periodicals") are put down on label of blue color if only departures of this category are enclosed in sacks;
green color - for empty sacks;
violet color - for sacks only with simple departures in large number;
yellow-red color - for sacks with sending;
white color with red-blue strips at the edges with the Emsdlya logo of sacks with shipments of EMS.
3.5. On address labels of dispatches with international post which are sent by the land transport it is specified: name MMPO of departure of dispatches, country of destination and name of foreign MMPO, number of the dispatch, date of its departure, weight, way of the direction. In case of peresylaniye of sacks with custom departures of written correspondence and sending, on address labels their quantity is specified. If the dispatch is sent by sea, then on address label the name of the vessel and debarkation port in addition is specified.
On address labels of dispatches with international post which are sent by the aircraft transport, besides, number of plane flight, the airport of unloading, and if necessary the airport of overload is specified. In the upper part of label the mark "Par avion" ("Avia") is specified.
On bag labels of aviadispatches with express letters the mark "Post Express" is put down.
If aviadispatches at the same airport are overloaded without participation of postal service, then labels of CN 42 of orange color with the mark "Transbordement direct" ("Direct overload") are also applied to sacks.
Address labels of dispatches which go S.A.L., are filled according to the procedure, provided for labels of dispatches which are sent by the aircraft transport, only with difference that in its upper part the mark "is specified to S.A.L. land, aviaway".
On labels of sacks with empty container the mark "Sacs vides" ("Empty sacks") is specified.
Address labels are filled with Latin letters and the Arab figures. Availability of the letter "F" on address labels of bright red, yellow-red colors and white color with red-blue strips on edge and the EMS logo is demonstrated that in this sack the written CN cards 31, CN 32 or the parcel CP cards 86, are sent CP 87. The sack with the letter "F" is called the main thing.
4.1. Dispatches about day off from Ukraine international post together with three copies of delivery notes of delivery of CN 37 (on which second and third copies there shall be stamp print "Under customs control" MMPO customs which allowed release of these dispatches) (appendix 1) arrive in PMPO with MMPO on delivery note ф. 16 (appendix 2) in which dispatches are attributed with indication of type of dispatches (LC/AO and CP), their numbers, MMPO of appointment, quantity of sacks of each dispatch, their weight and total quantity of sacks. Superimposed delivery of CN 37 are attributed by total quantity.
Dispatches with empty container and superimposed delivery of CN 47 arrive in PMPO on delivery note ф. 16. On superimposed CN 47 stamp print "Under customs control" MMPO customs which allowed release of dispatches is not put down.
4.2. Acceptance and verification of dispatches is performed by two workers of PMPO in the presence of the official of PMPO customs.
In case of acceptance of sacks with labels of bright red, yellow-red colors and white color with red-blue strips on edge and the EMS logo, and also postal parcels which are sent not packed in reservoir workers of PMPO verify them with hit delivery note back of CN 37. At the same time the external condition of sending (integrity of cover, sling, seals) and sacks (integrity of cover, seals, slings), and to label addresses - MMPO purpose of dispatches is checked.
Sacks with labels of white, blue, green and violet colors are accepted by joint account with check of their external condition and addressing.
Check according to dispatches of quantity of the accepted sacks with labels of white, blue, green and violet colors is performed after the end of exchange.
If for any reasons to check by name international post it is impossible, then it is accepted by joint account with careful survey of external condition of post objects, especially sacks with labels of bright red and yellow-red colors, and also postal parcels which are sent not packed in reservoir. After the end of exchange the received mail is checked by name.
The workers of PMPO participating in exchange of mail undersign for the accepted mail for delivery note ф. 16 with indication of the actual quantity (letters) of the been paid back sacks (sending), delivery notes in kind CN 37 and reception hours. Besides, on delivery note ф. 16 the print of calendar stamp is put down. First waybill copy ф. 16 it is applied to documents PMPO of Ukraine.
4.3. In case of short-reception of one or several sacks of the dispatches attributed to delivery note ф. 16, the statement ф is drawn up. 51-1 in triplicate. The first copy of the act f.51-1 is sent to the production division which handed over mail in PMPO, the second - to MMPO of Ukraine which created the dispatch, third is applied to documents PMPO.
On the actual quantity of mail the delivery note of delivery of CN 37 is constituted and the dispatch is transferred for sending to destination. The relevant production divisions in case of receipt of the act ф. 51-1 shall perform the facts stated in it and to report PMPO about results.
4.4. After verification of dispatches the official of PMPO customs puts down print of personal number seal on the second and third copies of delivery notes of delivery of CN 37.
Before transfer of dispatches to foreign postal services (carriers) they are stored in PMPO according to the procedure ensuring their safety.
4.5. Based on delivery notes of delivery of CN 37, of the dispatches constituted in MMPO of forming, PMPO constitutes general delivery note of delivery of CN 37, on which delivery of dispatches with international post to foreign postal service is performed. The employee of foreign postal service accepting mail specifies quantity (letters) of the been paid back sacks (sending), delivery notes in kind CN 37 and reception hours and appends the signature. The mark makes sure the signature and print of calendar stamp or stamp of its service.
4.6. In case of transportation of dispatches with international post by road transport of the operator of mail service the general delivery note of delivery is constituted in five copies:
the first copy of general superimposed delivery of CN 37 (with appendix of one copy of delivery notes of delivery of CN 37, constituted in MMPO of forming of the dispatch) goes with mail to foreign PMPO;
the second (with appendix of one copy of delivery notes of delivery of CN 37, constituted in MMPO of forming of the dispatch) is applied to documents PMPO;
third (with appendix of one copy of delivery notes of delivery of CN 37, constituted in MMPO of forming of the dispatch) is given to PMPO customs;
the fourth (with mark of foreign postal service about acceptance of mail) is applied to documents PMPO;
the fifth - is told to customs authority at the check point out of limits of customs area of Ukraine.
Upon the demand of customs authorities the number of copies of general superimposed delivery of CN 37 can be increased.
Bodies of cars which transport dispatches oplombirovyvatsya by the official of PMPO customs and the worker of PMPO. Numbers of seals are specified in general delivery note of delivery of CN 37, on which the official of PMPO customs puts down stamp print "Under customs control".
4.7. In case of transportation of dispatches by road transport by carrier the first waybill copy of delivery of CN 37 intends for foreign MMPO, on the second copy the mark of carrier about acceptance of mail is put down and it is applied to documents PMPO, the third copy with mark of foreign postal service is stored at carrier, the fourth - is told to PMPO customs, the fifth copy is transferred to customs authority in the check point out of limits of customs area of Ukraine.
4.8. If dispatches are transported by sea transport, then PMPO general delivery note of delivery of CN 37 (appendix 3) constitutes in five copies:
two waybill copies of delivery of CN 37 are sent together with mail in container, one of them with mark of foreign postal service about acceptance of dispatches returns PMPO;
two copies are transferred to PMPO customs (one remains in PMPO customs, the second - is sent to MMPO customs);
one (from print of personal number seal of the official of the PMPO customs which resolved release of mail abroad and mark of sea service of transportation about acceptance of dispatches) is applied to documents PMPO.
4.9. Departure abroad of dispatches about day off from Ukraine is performed by international post according to plans of the direction day off from Ukraine abroad of the international written correspondence and sending which are sent by the land transport.
5.1. Acceptance of dispatches with international post from foreign postal service (carrier) is performed on delivery notes of delivery of CN 37, which are provided in duplicate. The first waybill copy together with mail is intended to PMPO of Ukraine, the second - with mark PMPO about acceptance of mail returns to the foreign postal service which is handing over dispatches.
5.2. In case of transportation of dispatches with international post by road transport the official of PMPO customs checks integrity of sealing of body of the car which performs their transportation.
5.3. In case of lack of superimposed delivery of CN 37 PMPO, the performing acceptance of dispatches, shall constitute delivery note of delivery of CN 37 in triplicate on actually received mail. Two waybill copies of delivery of CN 37 together with the checking message CN 43 go to foreign MMPO of forming of dispatches from which one waybill copy of delivery of CN 37 after check and the corresponding confirmation by foreign MMPO returns PMPO.
5.4. Accepting sacks with labels of bright red, yellow-red colors and sending which are sent not packed in reservoir, workers of PMPO of Ukraine verify them CN 37 hit with record in delivery note back. At the same time the external condition of sacks or sending, integrity of seals, slings, MMPO of purpose of dispatches on address labels is checked.
Sacks with white, blue, violet and green labels are accepted by joint account with check of their external condition and addressing. After the end of exchange on delivery notes of delivery of CN 37 check of quantity of sacks in dispatches and the mass of all sacks is performed.
If the discrepancy of the actual mass of sack with the weight specified on labels of CN 34 or CP 83, 200 or less grams is established, then data of foreign MMPO are considered as correct. If the discrepancy of weight exceeds 200 grams, weight on label and in delivery note of delivery of CN 37 improves what foreign MMPO of submission of the dispatch is reported by the checking message CN 43 or CP about 78, which goes by e-mail (fax connection) or is sent by simple procedure in the most bystry way (air or land). In case of passing of dispatches en route through other countries the checking message CN 43 or CP 78 goes also to the last intermediate foreign post organization.
5.5. In case of receipt in PMPO sacks with labels of bright red and yellow-red color in defective condition or if there is assumption concerning damage of investment, the sack reveals for check then the sack with investment in that condition in which it arrived invests in other sack. Data from initial label are transferred to new label on which the print of calendar stamp and the mark "Remballe ' ' an" is put down (It is repacked in...). On the repacked dispatch the checking message CN 43 or CP 78 in four copies from which one invests in the repacked dispatch is constituted, two - go to foreign MMPO from where the dispatch is received, odinprilagatsya to documents PMPO. If sending dispatches was performed by the foreign organization of the international post exchange which is not MMPO of forming of dispatches, the checking message is constituted in five copies from which one goes also to this organization.
On delivery note of delivery of CN 37 the mark concerning receipt of the dispatch in the damaged condition is put down that makes sure signatures of workers of PMPO of Ukraine and the foreign postal service (carrier) participating in exchange of mail with putting down of prints of calendar stamps (stamps) of PMPO of Ukraine and this postal service (carrier).
In case of repacking of sacks with entrance international post of PMPO of Ukraine draws up the statement ф. 51-2 in duplicate which first copy together with repacked sacks goes to destination to the corresponding MMPO of Ukraine the second copy is applied to documents PMPO.
5.6. In case of discrepancy of actually received mail (shortage or excess of sacks), in delivery note of delivery of CN 37 the corresponding mark becomes. For example: "Twenty two sacks are accepted. There was no sack with written correspondence on the dispatch N 15 of Moscow of RSI-1". The mark makes sure signatures of workers of PMPO of Ukraine and foreign postal service (carrier) which performed exchange of mail, with putting down of prints of calendar stamps (stamps) of PMPO of Ukraine and this postal service (carrier).
5.7. Dispatches with the international written correspondence, entrance to Ukraine, and sending together with delivery notes of delivery of CN 37, constituted by foreign MMPO, are shown to PMPO customs for customs control.
On delivery notes of delivery of CN 37 the official of PMPO customs puts stamp print "Under customs control".
5.8. Superimposed delivery of CN 37 and the dispatch with international post, entrance to Ukraine, are attributed in PMPO to delivery notes ф. 16, which are addressed in the corresponding MMPO. In delivery note f.16 numbers of dispatches, type of dispatches (LC/AO, CP), appointment MMPO, quantity of sacks and boxes of each dispatch and total quantity of sacks, and also mass of each dispatch are specified. Superimposed delivery of CN 37 are attributed by total quantity.
Delivery notes ф. 16 are constituted in four copies. On each waybill copy ф. The 16th official of PMPO customs puts stamp print "Under customs control" then mail together with two waybill copies ф. 16, one of which is subject to transfer of MMPO customs to division, and superimposed delivery of CN 37 goes to MMPO. Third waybill copy ф. 16 it is transferred to the PMPO customs which resolved import of mail to Ukraine, the fourth - applied to documents PMPO.
5.9. Dispatches with the international written correspondence, entrance to Ukraine, sending, empty container with PMPO go to the corresponding MMPO of Ukraine according to the Plan of the direction of internal mail.
5.10. Before sending to destination dispatches with international post and accompanying documents are stored in PMPO according to the procedure ensuring their safety.
5.11. By transfer of dispatches in mail vans (cars) recalculation of their quantity is performed. At the same time accessory of each dispatch of sacks with labels of bright red, yellow-red color and sending which are sent not packed in reservoir is checked.
6.1. Transit dispatches with international post are accepted from foreign postal services (carriers) according to the procedure, determined in Items 5.1-5.6 of these Rules.
6.2. Transit dispatches which are sent on the territory of Ukraine shall be sealed up by foreign MMPO.
6.3. The transit dispatches accepted from foreign postal services (carriers) go after sight their PMPO customs and receipt of permission to peresylaniye on the territory of Ukraine to PMPO of Ukraine which performs exchange with the relevant foreign postal service, according to the Plan of the direction of transit dispatches.
6.4. Sending transit dispatches with PMPO of Ukraine, accepting dispatches, in PMPO to Ukraine, their handing over to the relevant foreign postal service, is performed on delivery notes ф. 16, which are constituted in four copies.
On all waybill copies ф. The 16th official of PMPO customs puts down stamp print "Under customs control".
Two waybill copies ф. 16 together with delivery note of delivery of CN 37 go together with dispatches to PMPO of Ukraine which is handing over mail to foreign postal service, third is applied to documents PMPO, accepted dispatches, the fourth - told to the PMPO customs which resolved their transfer on the territory of Ukraine.
6.5. Transfer of transit dispatches and delivery notes of delivery of CN 37 on the territory of Ukraine in final PMPO to Ukraine is performed according to the procedure, ensuring their safety.
6.6. PMPO of Ukraine which is handing over to the relevant postal service transit dispatches, based on delivery notes in kind of CN 37, been paid back from abroad, constitutes general delivery note of delivery of CN 37 (appendix 4) in triplicate.
The transit dispatches which arrived in PMPO Ukraine for transfer to foreign postal services (carriers), delivery notes ф. 16, superimposed delivery of CN 37, constituted by foreign MMPO, and general superimposed delivery of CN 37 are shown to PMPO customs on customs control.
PMPO customs in the presence on delivery notes f.16 print of stamp of the PMPO customs which resolved their peresyka on the territory of Ukraine, the unimpaired seals, seals, covers, slings on sacks and also if their quantity corresponds to CN specified in delivery notes of delivery 37, issues dispatches abroad. Permission to departure of dispatches abroad is drawn up by putting down on the second and third copies of general superimposed delivery of CN 37 of print of personal number seal of the official of PMPO customs. One copy of general superimposed delivery of CN 37 with print of personal number seal of the official of customs remains in PMPO customs.
6.7. Dispatches with empty container and superimposed delivery of CN 47 arrive in PMPO on delivery notes f.16. On delivery notes of delivery of CN 47 the print of personal number seal of the official of division of PMPO customs is not put down.
6.8. Delivery of the international transit post to foreign postal service is performed on general delivery note of delivery of CN 37 according to the procedure, specified in Item 4.5.
The delivery note of delivery of CN 37 can be constituted in four copies if dispatches between two corresponding MMPO are transported with mediation of carrier. In this case two waybill copies from which one is given to foreign postal service together with dispatches are transferred to carrier, foreign postal service, the second with mark, about acceptance of mail PMPO of Ukraine returns, the third waybill copy of delivery of CN 37 with mark of carrier about acceptance of mail is attached to documents PMPO of Ukraine, chetvertyyperedatsya to division of PMPO customs.
6.9. The violations found in case of acceptance of transit dispatches from foreign postal service (damage of sacks, shortage of the dispatch, sack) are drawn up according to the procedure, provided by Items 5.3-5.6 of these Rules.
7.1. Dispatches about day off from Ukraine international post, empty container which are sent by the aircraft transport, and dispatches of S.A.L. with MMPO arrive in PMPO on superimposed CN 38 (appendix 5), CN 41 (appendix 6), CN 47 with their addition to delivery note ф. 16 (appendix 7).
CN delivery notes 38, CN 41, are constituted by CN 47 in five copies for each airport of landing. On the second and third copies of superimposed CN 38, CN 41 shall be stamp print "Under customs control" the MMPO customs which resolved release of mail abroad. The stamp print "Under customs control" MMPO customs on delivery notes of delivery of CN of 47 dispatches with empty sacks is not put down.
7.2. Acceptance and verification of dispatches with international post is performed according to the procedure, stated in items 4. 2, 4.3 of these Rules. The international post aviadepartures shall be packed in sacks of blue color or in sacks with wide blue strip whom accurately Latin letters accessory of sacks (the name MMPO and the country) and the mark "Postes" ("Mail") is specified.
7.3. After customs control and putting down by the official of PMPO customs of print of personal number seal of the aviadispatch and the dispatch of S.A.L. 8.1.
