About approval of the Technical regulation concerning rules of marking of foodstuff

According to article 1 of the Law of Ukraine "About carelessness and quality of foodstuff" I ORDER:

1. Approve the Technical regulation concerning rules of marking of foodstuff which is attached.

2. To provide to management of technical regulation provision of this order on state registration in the Ministry of Justice of Ukraine in the procedure established by the legislation.

3. Permit subjects of managing to use the packaging materials and labels executed without requirements of the Technical regulation within 18 months from the date of its introduction in force.

Which food, packaging materials and labels are executed without requirements of the Technical regulation, made and/or introduced into circulation not later than in 9 months from the date of entry into force of the Technical regulation, remain in market circulation of Ukraine before the termination of expiration date of such products.

4. To the state company "Ukrainian Research and Training Center of Problems of Standardization, Certification and Quality":

4.1. Review the national GSTU 4518:2008 standard "Foodstuff. Marking for consumers. General rules".

4.2. Provide publication of this order in the next edition of the monthly information index "Standards".

4.3. Bring this order to technical committees of standardization and the organizations developers of national standards on food products.

5. To technical committees of standardization and the organizations developers of national standards on food products to bring the regulating documents into accord with requirements of the Technical regulation.

6. To confer responsibility for accomplishment of this order on the vice-chairman Goncharenko V. V.

7. This order becomes effective from the date of its official publication.

8. I reserve control over the implementation of this order.

The technical regulation concerning rules of marking of foodstuff

1. This Technical regulation developed according to requirements of the Laws of Ukraine "About safety and quality of foodstuff", "About consumer protection", and also provisions of the Directive of the European Parliament and Council of March 20, 2000 N 2000/13/EC about approach of the legislation of state members on etiketirovka, registration and advertizing of food and Directives of the Commission of January 30, 2008 N 2008/5/EC of rather obligatory specifying on the label of certain food of some detailed information, except that which is provided in the Directive 2000/13/EU of the European Parliament and Council determines general requirements to marking (etiketirovka) of packaged foodstuff which is introduced into circulation in Ukraine.

2. Requirements of this Technical regulation extend to marking (etiketirovka) (daley - marking) packaged food which are implemented to the final consumer through wholesale or retail retail chain stores, and also to institutions of restaurant economy (restaurants, dining rooms, hospitals and other similar institutions).

For separate types of packaged foodstuff by the corresponding legal acts details of their marking, except those which are provided by this Technical regulation can be established (in particular marking of alcoholic beverages and tobacco products).

Requirements of this Technical regulation do not extend to marking of alcoholic beverages which is performed according to the legislation.

3. In this Technical regulation terms are used in such value:

ingredient (component) - any substance, including nutritional supplement and enzyme which it is used during production or preparation of foodstuff and remains in final foodstuff even in the changed form;

marking - all words, descriptions, signs for goods and services, the names of brand, the image or the symbols concerning some foodstuff and placed on any packaging, the label (sticker), consumer pack, the counterlabel, kolyeretka, label, stopper, leaf insert, the document, the message, other elements of packaging which accompany or belong to this type of foodstuff;

packaged foodstuff - separate unit of foodstuff which is implemented to the final consumer and institutions of restaurant economy in separate consumer packaging in such a way that its content cannot be changed, without having opened or without having damaged packaging (further - foodstuff).

Other terms are used in the value given in the Laws of Ukraine "About safety and quality of foodstuff", "About consumer protection", "About milk and dairy products".

4. Marking of foodstuff is carried out in Ukrainian, and in case of need in addition can be put also in other languages.
