About approval of the Regulations on procedure for transfer, recovery and expel of students
Based on Item 10 of Article 21, of subitems 1.2-1.4 of Item 1 of Article 31, of Item 10 of Article 79 and Item 5 of article 80 of the Code of the Republic of Belarus on education the Council of Ministers of the Republic of Belarus DECIDES:
1. Approve the enclosed Regulations on procedure for transfer, recovery and expel of students.
2. Recognize to invalid:
the resolution of Council of Ministers of the Republic of Belarus of January 10, 2008 No. 17 "About approval of regulations on procedure and conditions of recovery of the students deducted from higher educational institutions and about procedure and conditions of provision of the academic leaves to students of higher educational institutions" (The national register of legal acts of the Republic of Belarus, 2008, No. 15, 5/26595);
subitem 1.16 of Item 1 of the resolution of Council of Ministers of the Republic of Belarus of July 23, 2010 No. 1095 "About entering of amendments and changes into some resolutions of Council of Ministers of the Republic of Belarus and recognition No. 40 which voided resolutions of Council of Ministers of the Republic of Belarus of January 13, 2006" (The national register of legal acts of the Republic of Belarus, 2010, No. 184, 5/32249).
3. This resolution becomes effective since September 1, 2011.

1. This Provision developed based on Item 10 of Article 21, of subitems 1.2-1.4 of Item 1 of Article 31, of Item 10 of Article 79 and Item 5 of article 80 of the Code of the Republic of Belarus on education determines procedure, the bases and conditions of transfer, recovery and expel of the students mastering educational programs of the higher education of I and II steps in internal or correspondence form of education (further, unless otherwise specified, - students). This resolution extends to institutions of higher education irrespective of their pattern of ownership and subordination, except for the institutions of higher education specified in part two of this Item.
Transfer, recovery and expel of the cadets and listeners getting education on specialties (the directions of specialties, specializations) for Armed Forces of the Republic of Belarus, other troops and military forming of the Republic of Belarus, the Investigative Committee, State committee of judicial examinations, law-enforcement bodies of the Republic of Belarus, bodies of financial investigations of the State Control Committee, bodies and divisions on emergency situations of the Republic of Belarus are performed in cases, stipulated by the legislation about passing of the relevant service, and according to the procedure, established by the relevant republican state body.
2. Transfer in other institution of higher education, transfer for education on other specialty (the direction of specialty, specialization), in other form of education, and also recovery for education in institution of higher education is performed not earlier than after the termination of the first academic year, as a rule, in the period of vacation for persons studying in education presentia, or during the period between examinations for persons, students in absentia of education, except as specified, specified in part two of this Item.
Transfer in other institution of higher education in case of liquidation of separate divisions, reorganization, the termination of activities of institution of higher education, cancellation, cancellation of special permission (license) for educational activities of institution of higher education (on its separate divisions, concerning one or several works and (or) services constituting educational activities), and also transfer in the presence of medical contraindications to work on the received specialty (the direction of specialty, specialization) can be performed academic year irrespective of year of training at any time.
3. Transfer conditions in other institution of higher education, transfer for education on other specialty (the direction of specialty, specialization), including in the presence of medical contraindications to work on the received specialty (the direction of specialty, specialization), in other form of education, and also recoveries for education in institution of higher education are:
availability of vacant positions within the number of students provided by special permission (license) for educational activities and (or) plans of training of specialists (within target figures of acceptance) on this specialty and on this rate;
possibility of successful continuation of training.
4. By consideration of documents on transfer or recovery of the student the head of institution of higher education or person authorized by it determines need of carrying out with it of interview and informs the student on time and form of its carrying out.
5. The interview is conducted according to the procedure, determined by institution of higher education, and is directed to determination of opportunity (impossibility) of the student to successfully continue training in institution of higher education taking into account discrepancies in curricula.
6. Transfer of the student on other specialty (the direction of specialty, specialization), including in the presence of medical contraindications to work on the received specialty (the direction of specialty, specialization), in other form of education within one institution of higher education is made for education based on the statement of the student, the petition of the dean of faculty, and also if necessary - the medical certificate about the state of health in the form established by the Ministry of Health (further - the medical certificate about the state of health). In case of transfer from one faculty into another the petition of the dean of faculty on which transfer is made will be approved with the dean of faculty from which transfer is made.
7. Transfer of the student from one institution of higher education in another is made with the consent of heads of both institutions of higher education.
8. The student wishing to be transferred to other institution of higher education submits the application addressed to his head with application of a copy of the record book certified by person authorized by the head of institution of higher education in which the student studies, and also if necessary represents the medical certificate about the state of health.
In the presence of consent to transfer expressed in writing by the head of institution of higher education to which the student wishes to be transferred the student submits addressed to the head of institution of higher education in which it studies the statement for contribution in connection with transfer to other institution of higher education with appendix of the corresponding letter of consent on transfer.
9. In case of the termination of activities of institution of higher education, cancellation, cancellation of special permission (license) for educational activities of institution of higher education (on its separate divisions, concerning one or several works and (or) services constituting educational activities) in the presence of the consent of students to continue training in other institution of higher education the founder of institution of higher education in two weeks reports in the Ministry of Education about the corresponding fact with indication of the number of students and other data on their preparation.
The Ministry of Education in two weeks will agree on issue of possible transfer of students with other institutions of higher education and reports to the founder of institution of higher education about the made decision.
10. Before acceptance by the head of institution of higher education of the decision on transfer in connection with transfer from other institution of higher education or transfer on the different bases within one institution of higher education the agreement on training of the specialist at the expense of means of the republican budget either on paid basis or about target training of the specialist is signed (further - the agreement) or corresponding changes are made to the current agreement. The conclusion or introduction of amendments to the agreement is performed according to the procedure, established by the legislation.
The decision of the head of institution of higher education on transfer in other institution of higher education is drawn up by the order on contribution in connection with transfer to other institution of higher education (in the order its name is specified).
Transfer of the student on training in connection with transfer is made by the order of the head of institution of higher education in which the term of liquidation of discrepancies in curricula shall be specified and (or) to the academic debt.
11. In case of recovery for receipt of the higher education person with whom the educational relations were ahead of schedule stopped has option of institution of higher education.
12. The basis for consideration of question of recovery for receipt of the higher education is the statement of person, except for persons listed in part one of article 80 of the Code of the Republic of Belarus about education.
Are enclosed the original document about the prior education level to the application, the medical certificate about the state of health and the certificate of training.
13. The head of institution of higher education considers the application of person for recovery in two weeks from the date of its receipt and determines semester on which person can be recovered, and also other conditions for recovery or tells person cause of failure in recovery.
14. The basis for refusal are:
absence in institution of higher education of vacant positions within the number of students provided by special permission (license) for educational activities and (or) plans of training of specialists (within target figures) on this specialty and on this rate;
availability of the academic debt and (or) discrepancies in curricula of institutions of higher education on specialties (the directions of specialties, specializations) which do not allow to continue successfully training in the curriculum of the corresponding specialty.
15. The basis for emergence of the educational relations in case of recovery for education in institution of higher education is the agreement.
After the conclusion of the agreement the institution of higher education makes transfer of the student by the publication of the order on recovery. The same order establishes the term of liquidation of the academic debt and (or) discrepancies in curricula of institutions of higher education on specialties (the directions of specialties, specializations).
16. In case of recovery for receipt of the higher education in the specialty on education profile "Health care" the contract for target training of the specialist signed in case of receipt resumes the action on former conditions (without break) if other is not established by the legislation of the Republic of Belarus.
17. Expel (the termination of the educational relations) of students is performed in the cases provided in Items 2-6 of article 79 of the Code of the Republic of Belarus on education.
18. If emergence of the educational relations requires the conclusion of the agreement, then in case of early termination of the educational relations at the initiative of the student the decision of the head of institution of higher education on assignment is preceded by agreement cancelation.
In case of early termination of the educational relations at the initiative of institution of higher education or on the circumstances which are not depending on will of the student and institution of higher education, the agreement is considered the head of institution of higher education terminated from the moment of decision making about assignment.
19. The decision on assignment is made by the head of institution of higher education by the publication of the order in which the bases for assignment are given.
After the publication of the order on contribution in connection with transfer to other institution of higher education the personal record of the student in five-day time is sent to institution of higher education in which transfer is made.
In institution of higher education in which the student studied earlier there is copy of its personal record.
20. Early contribution in case of transfer of the student to other institution of higher education, reorganization, the termination of activities of institution of higher education, cancellation, cancellation of special permission (license) for educational activities of institution of higher education (on its separate divisions, concerning one or several works and (or) services constituting educational activities) is performed with observance of the requirements provided in Items 2-10 of this provision, and according to the procedure, established in Items 17-19 of this provision.
21. Early assignment in case of liquidation of separate divisions of institution of higher education is made in the absence of the consent of the student to continuation of the educational relations on other specialty (the direction of specialty, specialization), in other form of education within this institution of higher education or in other institution of higher education.
22. The order of the head of institution of higher education on assignment at the initiative of institution of higher education is submitted for acquaintance to the student under list within three calendar days after its edition. The refusal of the student of acquaintance with the order or impossibility of such acquaintance is drawn up by the act which is signed by three persons from number of persons employed of institution of higher education and (or) the students of the same organization of education who reached eighteen-year age. Concerning the students who did not be for acquaintance with the order, their acquaintance is performed by the direction by institution of higher education of the copy of this order the registered mail during five-day term from the moment of its edition in the place of residence of the student specified in its personal record.
23. In case of early termination of the educational relations in five-day time the certificate of training and the original document of education, the this person who is stored in the personal record is issued to person (except for the case stipulated in part two of Item 19 of this provision).
In case of the termination of the educational relations in connection with education the diploma about the higher education or the diploma of the master and the original document about education which is stored in their personal record is issued to students. The copy of the education document certified by institution of higher education remains in the personal record of the student.
