About licensing of activities for suppression of the fires in settlements, on production facilities and infrastructure facilities

In compliance the Federal Law "About Licensing of Separate Types of Activity" Government of the Russian Federation decides:

1. Approve the enclosed Regulations on licensing of activities for suppression of the fires in settlements, on production facilities and infrastructure facilities.

2. Recognize to invalid:

the order of the Government of the Russian Federation of October 25, 2006 No. 625 "About licensing of activities in the field of fire safety" (The Russian Federation Code, 2006, N 44, the Art. 4599);

the order of the Government of the Russian Federation of May 5, 2007 No. 269 "About modification of orders of the Government of the Russian Federation of January 26, 2006 No. 45 and of October 25, 2006 No. 625" (The Russian Federation Code, 2007, No. 20, the Art. 2433);

the order of the Government of the Russian Federation of October 31, 2009 No. 875 "About modification of the Regulations on licensing of activities for suppression of the fires" (The Russian Federation Code, 2009, No. 45 the Art. 5348);

Item of 22 changes which are made to acts of the Government of the Russian Federation concerning the state control (supervision), approved by the order of the Government of the Russian Federation of April 21, 2010 No. 268 (The Russian Federation Code, 2010, No. 19, the Art. 2316);

Item of 23 changes which are made to orders of the Government of the Russian Federation concerning the state fee, approved by the order of the Government of the Russian Federation of September 24, 2010 No. 749 (The Russian Federation Code, 2010, No. 40, the Art. 5076).

Regulations on licensing of activities for suppression of the fires in settlements, on production facilities and infrastructure facilities

1. This Provision determines procedure for licensing of activities for suppression of the fires in settlements, on production facilities and infrastructure facilities, performed by legal entities and individual entrepreneurs.

2. Licensing of activities for suppression of the fires in settlements, on production facilities and infrastructure facilities (further - the licensed type of activity) performs the Ministry of the Russian Federation for civil defense, to emergency situations and natural disaster response.

3. Licensed requirements when implementing activities for suppression of the fires in settlements, on production facilities and infrastructure facilities are:

a) availability at the license applicant (licensee) of the buildings, rooms and constructions according to article 76 of the Federal law "The Technical Regulation about Requirements of Fire Safety" belonging to it on the property right or other legal cause;

b) availability at the license applicant (licensee) necessary for implementation of the licensed type of activity of the fire fighting equipment (primary and mobile fire extinguishing means), the fire-fighting substances, means of communication, the equipment, overalls, the tool and technical documentation belonging to it on the property right or other legal cause and conforming to the established requirements;

c) availability at the license applicant (licensee):

the legal entity - the specialist responsible for implementation of the licensed type of activity having the document confirming receipt of the higher education or secondary professional education in "fire safety", or the document confirming receipt of other higher education or secondary professional education and availability of length of service in the Public fire service on executive positions at least 3 years or the document confirming passing of professional training in the organizations performing educational activities for the educational program of fire and technical profile;

the individual entrepreneur - the document confirming receipt of the higher education or secondary professional education in "fire safety", or the document confirming receipt of other higher education or secondary professional education and availability of length of service in the Public fire service on executive positions at least 3 years or the document confirming passing of professional training in the organizations performing educational activities for the educational program of fire and technical profile;

d) availability at the fires of workers of the license applicant (licensee) participating in actions for suppression - the legal entity of the professional education (the qualification supported by the document on passing of professional training) corresponding to their job responsibilities;

e) lack of medical contraindications for execution of job responsibilities at persons specified in subitems "v" and "g" of this Item;

e) advanced training of persons specified in subitems "v" and "g" of this Item in the field of the licensed type of activity at least 1 time in 5 years;

g) accomplishment by the licensee of requirements imposed to activities for suppression of the fires in settlements on the production facilities and infrastructure facilities established by regulatory legal acts and regulating documents on fire safety;

h) application by the licensee when implementing of the licensed type of activity of products which compliance to normative requirements is confirmed with the declaration of conformity or the certificate of conformity;

i) observance by the licensee of requirements imposed to provision of information for the state statistical recording of the fires and their effects according to article 27 of the Federal law "About Fire Safety".

5. To gross violations of licensed requirements when implementing activities for suppression of the fires in settlements, on production facilities and infrastructure facilities and activities for suppression of the fires violations of the requirements provided respectively by subitems "a", "b" and "z" of Item 3 this provision who entailed the effects established by part 11 of article 19 of the Federal law "About Licensing of Separate Types of Activity" belong.

6. For receipt of the license the license applicant directs or submits the application and documents (the copy of documents) specified in part 1 and item 4 of part 3 of article 13 of the Federal law "About Licensing of Separate Types of Activity" to the licensing body and also:

a) copies of the documents confirming qualification:

the workers (including the specialist specified in the subitem "v" of Item 3 this provision) performing the licensed type of activity for the legal entity;

the license applicant performing the licensed type of activity - for the individual entrepreneur;

b) copies of documents or statements certified in accordance with the established procedure from the documents confirming length of service of the workers performing the licensed type of activity - for the legal entity;

c) copies of the documents confirming availability at the license applicant belonging to it on the property right or other legal cause of buildings, rooms and constructions, the rights to which are not registered in the Unified State Register of Rights on real estate and transactions with it (if such rights are registered in the specified register, data on these buildings, rooms and constructions);

d) copies of the documents confirming availability at the license applicant belonging to it on the property right or other legal cause and necessary for implementation of the licensed type of activity:

fire fighting equipment (primary and mobile fire extinguishing means), fire-fighting substances, means of communication, equipment, overalls, tool and technical documentation;

the paragraph third ceased to be valid according to the Order of the Government of the Russian Federation of 28.04.2015 No. 403

e) copies of the documents confirming absence at workers of the license applicant (licensee) of medical contraindications for execution of job responsibilities.

7. Submission by the license applicant of the statement and the documents necessary for receipt of the license, their acceptance by the licensing body, decision making about provision of the license (about refusal in provision of the license), renewal of the license (about refusal in renewal of the license), suspension, renewal, cancellation of the license and about cancellation of the license, issue of the duplicate, copy of the license, and also maintaining information resource and the register of licenses, provision of the data containing in information resource and the register of licenses are performed according to the procedure, established by the Federal Law "About Licensing of Separate Types of Activity".

9. In case of intention to perform the licensed type of activity to the address of the place of its implementation which is not specified in the license, the licensee sends to the licensing body which provided the license, the statement for renewal of the license in which this address and the following data is specified:

a) details of the documents confirming availability at the licensee belonging to it on the property right or other legal cause of the buildings, rooms and constructions located in the place of implementation of the licensed type of activity, the rights to which are not registered in the Unified State Register of Rights on real estate and transactions with it (if such rights are registered in the specified register, data on these buildings, rooms and constructions);

b) data on availability at the licensee necessary for implementation of the licensed type of activity of the fire fighting equipment (primary and mobile fire extinguishing means), the fire-fighting substances, means of communication, the equipment, overalls, the tool and technical documentation belonging to it on the property right or other legal cause;

c) the data confirming qualification of workers in the field of the licensed type of activity.

11. When conducting verification of the data containing in the documents submitted by the license applicant (licensee) observance by the license applicant (licensee) of licensed requirements the licensing body requests necessary for provision of the state services in the field of licensing of the data, being at the disposal of the bodies providing the state services, the bodies providing municipal services, other state bodies, local government bodies or the organizations subordinated to them, according to the procedure, established by the Federal Law "About the Organization of Provision of the State and Municipal Services".

12. Information containing the data provided by parts 1 and 2 of article 21 of the Federal law "About Licensing of Separate Types of Activity" is placed the licensing body in the official electronic or printing mass media, and also at information stands in premises of the licensing body within 10 days from the date of:

a) official publication of the regulatory legal acts establishing mandatory requirements to the licensed type of activity;

b) acceptances by the licensing body of the decision on provision, renewal of the license, suspension and renewal of action of the license;

c) obtaining from the Federal Tax Service of data on liquidation of the legal entity or the termination of its activities as a result of reorganization, about the termination of activities by physical person as the individual entrepreneur;

d) introductions in legal force of the judgment about cancellation of the license.

13. Licensed control is exercised according to the Federal Law "About Protection of the Rights of Legal Entities and Individual Entrepreneurs when Implementing the State Control (Supervision) and Municipal Control" taking into account features of the organization and conducting the checks established by the Federal Law "About Licensing of Separate Types of Activity".

14. The state fee in sizes and procedure which are established by the legislation of the Russian Federation on taxes and fees is paid for provision by the licensing body of the license, renewal of the license, issue of the duplicate of the license.
