About approval of the Regulations on Management of militia of migratory control of the Ministry of Internal Affairs of Ukraine

According to Article 3 of the Presidential decree of Ukraine of April 6, 2011 No. 405 "Questions of the Public migratory service of Ukraine", for the purpose of ensuring accomplishment of the tasks assigned to the Public migratory service of Ukraine on realization of state policy in the field of counteraction of illegal migration I ORDER:

1. Approve Regulations on Management of militia of migratory control of the Ministry of Internal Affairs of Ukraine which are applied.

2. In 20-day time from the date of official publication of this order to Department of staffing of the Ministry of Internal Affairs of Ukraine (Dyvak M. M.) according to offers of GMS of Ukraine to develop structure of divisions of militia of migratory control and the project of the staff of Management of militia of migratory control of the Ministry of Internal Affairs of Ukraine.

3. In five-day time after signing of the order to provide to the First Deputy Chairman of the Public migratory service of Ukraine with V.V.'s Sheybut its submission on state registration to the Ministry of Justice of Ukraine.

4. To impose control over the implementation of this order on the deputy minister of internal affairs of Ukraine militia major general Ratushnyak V. I. and First Deputy Chairman of the Public migratory service of Ukraine Sheybut V. V.

5. Direct the order on accessory.

6. The order becomes effective from the date of its official publication.

Regulations on Management of militia of migratory control of the Ministry of Internal Affairs of Ukraine

1. Management of militia of migratory control (further - Management) functions in system of the Ministry of Internal Affairs of Ukraine, is functionally subordinated to the Public migratory service of Ukraine, is accountable and under control to the Minister of Internal Affairs of Ukraine.

Management is the leading division in system of divisions of militia of migratory control.

2. Management in the activities is guided by the Constitution and the laws of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, orders of the Ministry of Internal Affairs and other acts of the legislation of Ukraine, orders of the President of Ukraine and the Minister, and also this Provision.

3. The main objectives of Management are ensuring accomplishment of the tasks assigned to GMS of Ukraine on realization of state policy in the field of counteraction of illegal migration, and also administrative prosecution for violation of the law in the field of registration of physical persons, issues of identity documents and confirming nationality.

4. Management according to the tasks assigned to it:

1) exercises according to the law control of compliance with law in the field of migration, including counteractions of illegal migration, nationality, registration of physical persons, refugees and other categories of migrants determined by the legislation;

2) applies the actions of ensuring implementation for cases on administrative offenses provided by the law;

3) prepares offers on reducing term of stay of foreigners and stateless persons in Ukraine, their forced return, exclusion, and also prohibition of entry into Ukraine;

4) provides protection of Items of temporary stay of foreigners and stateless persons which illegally are in Ukraine;

5) prepares information and analytical materials and other documents on questions which belong to its competence, for representation in accordance with the established procedure for consideration of relevant organs;

6) takes part in forming of other data which are necessary for accomplishment of the tasks assigned to Management;

7) interacts with the relevant divisions central and local executive bodies and local government bodies;

8) acts as the coordinator of contact analytical center of exchange of statistical and analytical information concerning which the legislation does not set restrictions concerning its creation, collection, obtaining, storage, use and distribution, concerning counteraction of illegal migration;

Performs 9) according to the law of action for prevention of counteraction of illegal migration, to other violations of the migratory legislation;

Provides 10) and exercises control of observance of the state secret in Management, and also in its territorial subdivisions;

11) is performed by consideration of requests and addresses of citizens on questions which belong to its competence;

12) is provided within powers by implementation of actions for prevention of corruption and control of their carrying out in territorial subdivisions;

13) performs other powers, stipulated by the legislation Ukraine.

5. Exercises control the powers directly and through the territorial subdivisions of militia of migratory control of head departments, the Departments of MIA of Ukraine formed in accordance with the established procedure in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol, including interdistrict divisions of militia of migratory control.

6. The management has the right:

1) in accordance with the established procedure to receive from central and local executive bodies information necessary for accomplishment of the tasks assigned to it;

2) to use the relevant information bases of the Ministry of Internal Affairs of Ukraine, state, including governmental, communication systems and communications, networks of special communication and other technical means;

To attract 3) in consent and in accordance with the established procedure specialists of structural divisions of the Ministry of Internal Affairs of Ukraine, central and local executive bodies to consideration of questions which belong to its competence;

4) to take in competence limits part in international cooperation concerning realization of rights and freedoms of man and citizen, and also accomplishment of the corresponding international obligations of Ukraine;

5) to check observance by executive bodies, citizens, the companies, organizations and organizations of requirements of the legislation in the field of migration, nationality, registration of physical persons, refugees and other categories of migrants determined by the legislation and to make offers concerning elimination of the reasons of their violation;

5) to perform other powers according to the legislation of Ukraine.

7. Management is headed by the chief who is appointed to position and is dismissed by the Minister of Internal Affairs of Ukraine in coordination with the Chairman of the Public migratory service of Ukraine.

The head of department has deputies who are appointed to positions and are dismissed by the Minister of Internal Affairs of Ukraine in coordination with the Chairman of the Public migratory service of Ukraine.

Other employees of Management are appointed the deputy minister internal delrukovoditel of the device on provision of the head of department.

8. Head of department:

performs management of activities of Management, answers to the Chairman of the Public migratory service of Ukraine and the Minister of Internal Affairs for accomplishment of the tasks assigned to Management;

prepares offers concerning education, changes of regular structure and liquidation of territorial subdivisions of militia of migratory control;

provides management of activities of territorial subdivisions of militia of migratory control;

prepares in coordination with Department of financial provision and financial accounting of the Ministry of Internal Affairs of Ukraine offers concerning establishment for employees of Management of official pay rates, allowances, surcharges and awards within the approved salary fund;

represents Management in state bodies and local government bodies;

prepares documents concerning appointment to positions and releases from positions of the deputies and employees of Management;

represents faces of ordinary and bossy structure to assignment to employees of Management of special ranks, rewarding with differences of the Ministry of Internal Affairs, GMS, makes offers concerning celebration of workers the state awards;

performs distribution of obligations between the deputies;

approves functional obligations of employees of Management;

is responsible for condition of office discipline, fulfillment of requirements of this provision and shall control them constantly.

9. The structure, the state and expense budget of Management affirms the Minister of Internal Affairs of Ukraine in coordination with the Chairman of the Public migratory service of Ukraine.

10. Position assignment and dismissal of heads of territorial subdivisions is performed by the Minister of Internal Affairs in coordination with the Chairman of the Public migratory service of Ukraine.

Deputy managers and other employees of territorial subdivisions of militia of migratory control are appointed by orders of chiefs of head departments, Departments of MIA of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol on provision of heads of territorial subdivisions of militia of migratory control.

11. Management contains at the expense of the means provided in the government budget for the corresponding year for implementation of actions for counteraction of illegal (illegal) migration, and also other means which are provided for the Public migratory service of Ukraine.

12. Faces of ordinary and bossy structure of Management serve according to Regulations on service by the ordinary and bossy structure of law-enforcement bodies approved by the resolution of the USSR Cabinet of Ministers of July 29, 1991 No. 114, have all rights and fulfill duties according to the Law of Ukraine "About militia".

13. Compensation of employees of Management is performed according to the legislation which extends to persons of bossy structure of law-enforcement bodies and workers who have no special ranks of bossy structure.
