For the purpose of ensuring accomplishment of intergovernmental agreements about production and scientific and technical cooperation of the companies and organizations of defense industries, according to resolutions of the Cabinet of Ministers of Ukraine of January 16, 2003 "About procedure for deliveries of products within the Agreement between the Government of Ukraine and the Government of the Russian Federation on production and scientific and technical cooperation of the companies of defense industries of November 18, 1993" and of September 26, 2005 No. 984 "About procedure for deliveries of products within the Agreement between the Cabinet of Ministers of Ukraine and the Government of the Republic of Belarus on production and scientific and technical cooperation of the companies and organizations of defense industries" I ORDER to No. 41:

1. Approve the Procedure for forming of inventories which are delivered mutually within agreements on production and nauchnotekhnichesky cooperation of the companies and the organizations of defense industries it (is applied).

2. To provide to department of industrial policy (Maystrenko V. S.) in accordance with the established procedure this order on state registration to the Ministry of Justice of Ukraine.

3. To impose control over the implementation of this order on the First Deputy Minister of Economic Development and Trade of Ukraine Kopylov V. A.

4. This order becomes effective from the date of its official publication

Procedure for forming of inventories which are delivered mutually within agreements on production and scientific and technical cooperation of the companies and the organizations of defense industries

1. This Procedure determines the procedure of representation by the companies and organizations of defense industries (further - the companies and the organizations) offers for forming of inventories which are delivered mutually within the Agreement between the Government of Ukraine and the Government of the Russian Federation on production and scientific and technical cooperation of the companies of defense industries of November 18, 1993 of the Agreement between the Cabinet of Ministers of Ukraine and the Government of the Republic of Belarus on production and scientific and technical cooperation of the companies and organizations of defense industries of June 25, 2001 and other intergovernmental agreements with the CIS countries about production cooperation of the companies of defense industries (further - lists).

2. The company or the organization which is interested in export and/or commodity import within intergovernmental agreements in production and scientific and technical cooperation of the companies and organizations of defense industries (daleezayavitel) creates offers concerning the nomenclature and amounts of mutual supply of raw materials, materials, components (daleezayavka) and annually gives them to the Ministry of Economic Development and Trade of Ukraine (further - the Ministry of Economic Development) till September 30 of year which precedes declared, together with the cover letter signed by the director or the organization - the applicant in form according to appendices to this Procedure, namely:

concerning military goods according to the resolution of the Cabinet of Ministers of Ukraine of November 20, 2003 No. 1807 "About approval of the Procedure of the state control of the international transfers of military goods" (further - the resolution of the Cabinet of Ministers of Ukraine of November 20, 2003 No. 1807) - in form 1 (appendix 1);

concerning goods of double use according to the resolution of the Cabinet of Ministers of Ukraine of January 28, 2004 No. 86 "About approval of the Procedure of the state control of the international transfers of goods of double use" (daleepostanovleniye of the Cabinet of Ministers of Ukraine of January 28, 2004 No. 86) in form 2 (appendix 2);

concerning goods which are not subject to the state export control, - in form 3 (appendix 3);

concerning goods of all categories the form 4 is in addition filled (appendix 4).

3. The request is filled in in Russian and moves in paper and electronic options.

4. In case of need entering of amendments into lists the application is submitted according to Item 2 presents of the Procedure for further inclusion of such amendments in lists within year.

5. Together with the request such documents are filed:

the copy of the Certificate of registration of the subject of managing as subject of implementation of the international transfers of goods in Public service of export control of Ukraine together with examination conclusions concerning classification of goods of the subject of managing;

the copy of the Certificate on the state certification of the system of intra-corporate export control created by the subject of implementation of the international transfers of goods (in case of availability);
