According to provisions of the Law on technical regulation No. 420-XVI of December 22, 2006 (The official monitor of the Republic of Moldova, 2007, No. 36-38, of the Art. 141), with subsequent changes and amendments, article 17 of the Law on production and turnover of ethyl alcohol and alcoholic products No. 1100-XIV of June 30, 2000 (repeated publication: The official monitor of the Republic of Moldova, 2010, No. 9899, the Art. 293), with the subsequent amendments, article 25 of the Law on grapes and wine No. 57-XVI of March 10, 2006 (The official monitor of the Republic of Moldova, 2006, No. 7578, the Art. 314), with subsequent changes and amendments, DECIDES: the Government

1. Approve Requirements to determination, the description, representation and labeling of alcoholic beverages it (is applied).

2. Requirements to determination, the description, representation and labeling of alcoholic beverages become effective in three months after its publication in the Official monitor of the Republic of Moldova.

3. To impose control over the implementation of this Resolution on the Ministry of Agriculture, regional development and the environment.

Requirements to determination, description, representation and labeling of alcoholic beverages

Requirements to determination, the description, representation and labeling of alcoholic beverages (further - Requirements) No. 110/2008 of the European Parliament and Council of January 15, 2008 about determination, the description, representation, labeling and protection of geographical instructions of alcoholic drinks and cancellation of Regulations of Council of EEC No. 1576/89, of the European Union (JO) No. L 39 published in the Official magazine of February 13, 2008 creates necessary basis for application of Regulations (EU).

I. Scope

1. Requirements establish general rules of determination, the description, representation and labeling of alcoholic beverages for the purpose of the prevention of their falsification, ensuring high level of protection and informing consumers, and also concerning use of alcohol of ethyl agricultural origin rectified and/or distillates of agricultural origin in production of alcoholic beverages.

2. Requirements extend to the groups of products described in appendix No. 1, delivered for the domestic sale made in the Republic of Moldova or imported, falling under action of tariff line item 2208 Combined the commodity nomenclature, according to the table provided below:

II. Terminology

3. For the purpose of Requirements the used terms mean the following:

1) alcoholic drink - the alcoholic products intended for consumption by the person, with special organoleptic characteristics and volume fraction of ethyl alcohol at least 15%, received or from distillate of agricultural origin or alcohol of the ethyl agricultural origin rectified, or their blending, with addition or without addition of juice, infusions, fruit drinks, extracts, sacchariferous products, natural aromas or aromatic substances, other ingredients and the prepared water, or from one natural ingredients;

2) ethyl alcohol of agricultural origin rectified - the ethyl alcohol received by rectification of alcohol raw and/or the fermented sacchariferous liquids received from agricultural raw materials of plant origin;

3) distillate of agricultural origin - the product received by the fractioned distillation of the fermented agricultural raw materials of plant origin, the having aroma and the taste characteristic to the used raw materials:

4) distillate for diwine - the distillate of agricultural origin received by the fractioned distillation of wine material raw dry, the permitted grades prepared only from grapes which are grown up in grape and wine-making area of the Republic of Moldova;

5) distillate wine - the distillate of agricultural origin received by the fractioned distillation of wine material raw dry or alcoholized by distillate wine;

6) distillate from grape pressing - the distillate of agricultural origin received by the fractioned distillation of the fermented grape pressing or the fermented picket with addition or without addition of wine yeast at the rate of no more than 25 kg on 100 kg of pressing provided that the amount of alcohol received from yeast does not exceed 35% of amount of alcohol in finished goods;

7) distillate from wine yeast - the distillate of agricultural origin received by the fractioned distillation of wine yeast;

8) distillate fruit - the distillate of agricultural origin received by exclusively spirit fermentation and the fractioned distillation of fleshy fruits or musta from such fruits, berries or vegetables with stones or without;

9) distillate from fruit pressing - the distillate of agricultural origin received by exclusively spirit fermentation and the fractioned distillation of fruit residue;

10) distillate from cider apple or from cider pear - the distillate of agricultural origin received by exclusively fractioned distillation of cider apple or cider pear;

11) distillate grain - the distillate of agricultural origin received by the fractioned distillation of the fermented must of tselnozernisty cereals;

12) fruit pressing - the product received from fresh fruits, and also fruits which are at the different stages of maturing and fermenting crushed or integral with stones or without, including remaining balance of the crushed fruits unsuitable for preparation of jams, jam, etc.;

13) cider apple or pear for distillation - the product with volume fraction of ethyl alcohol at least 4% received by complete spirit fermentation of fresh juice apple or pear;
