According to requirements of the Law of Ukraine "About labor protection" and the Regulations on the Ministry of emergency situations of Ukraine approved by the Presidential decree of Ukraine of April 06, 2011 No. 402, I ORDER:

1. Approve Industrial safety rules during crushing and sorting, mineral processing and okomkovaniye of ores and concentrates which are applied.

2. With entry into force of this order to consider such which are not applied in the territory of Ukraine, the Single safety rules when crushing, sorting, mineral processing and okomkovaniye of ores and concentrates approved by Gosgortekhnadzor of the USSR on August 09, 1977.

3. To public service of mountain supervision and industrial safety of Ukraine (Hokhotva O. I.):

3.1. Provide submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3.2. In accordance with the established procedure to enter changes in the State register of regulatory legal acts concerning labor protection.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the Chairman of Public service of mountain supervision and industrial safety of Ukraine Hokhotva O. I.

Industrial safety rules during crushing and sorting, mineral processing and okomkovaniye of ores and concentrates

I. Scope

1.1. These rules extend to the companies, organizations, the organizations (further - the companies) irrespective of patterns of ownership and type of activity which are engaged in designing, production, installation, adjustment, repair, inspection, technical diagnosing and operation of the equipment at crushing, crushing and sorting, enrichment, agglomerative factories and factories of okomkovaniye (further - factories).

1.2. These rules establish requirements for labor protection to service personnel, its admission to work, availability of necessary instructions for labor protection and fire safety and the main requirements for questions of labor protection to engineering procedure, production rooms and platforms in the open air, to initial materials and raw materials, production equipment and its placement, the organization of workplaces, methods of storage and transportation of initial materials, finished goods, application of individual and collective remedies.

Rules are obligatory for all subjects of managing using wage labor which is connected with designing, reconstruction, production, installation, adjustment, repair, inspection and operation of the equipment in case of accomplishment of processes of crushing, sorting, mineral processing and okomkovaniye of ores and concentrates on sites, in departments and workshops of factories.

1.3. These rules do not extend to the companies of the uranium mining and uranium-processing industry.

II. Determination of terms

2.1. In these rules terms are used in values which are determined by the Law of Ukraine "About labor protection", state standard "Labor protection. Terms and determinations of the basic concepts" (DSTU 2293-99), construction regulations and rules "Heating, Ventilation and Conditioning" (CONSTRUCTION NORMS AND REGULATIONS 2.04.05-91), interstate standard "System of Maintenance and Repair of Equipment" (GOST 18322-78).

2.2. Other terms are used in such values:

agglomeration - thermal process of okuskovaniye of small materials (ore, ore concentrates, etc.) which are components of metallurgical furnace charge, slag, their agglomeration for the purpose of giving of form and properties (chemical composition, structure) that is necessary for melting;

crushing - process of destruction of pieces of solid material for reduction of their sizes;

sorting (classification) - separation of small materials into separate classes of fineness with use of difference of parts which are divided, in sizes, form and according to other characteristics.

ІІІ. Designations and reducings

Maximum allowable concentration - threshold limit value;

GOST - the interstate standard;

DBN - the state construction regulations;

ДСанПиН - the state health regulations and regulations;

DSN - the state sanitary standards;

DSTU - state standard of Ukraine;

КВПиА - instrumentations and devices;

NAPB - the regulation on fire safety of Ukraine;

NPAOP - the regulatory legal act on labor protection;

NRB - Regulations of radiation safety;

TIME - the project of the organization of works;

PTEES - User Rules for Operating Electrical Equipment;

PUE - Regulations for electrical installation;

RUTI of USSR - the republican standard;

SSBT - Occupational safety standards system.

ІV. General requirements

4.1. Acceptance in operation of the constructed and reconstructed factories and workshops needs to be performed according to the Procedure for acceptance in operation ended by construction of facilities, to No. 461 approved by the resolution of the Cabinet of Ministers of Ukraine of April 13, 2011.

On these objects all works provided by the project documentation shall be performed, the equipment is mounted and tested, and also safe conditions for work of production personnel and stay of people are created.

4.2. Buildings, constructions, transport, energy and other engineering communications in the territory of factories shall answer the project documentation approved in certain procedure and also the Health regulations for the companies for production and enrichment of ore, nonmetallic loose minerals approved by the order of the Ministry of Health of the USSR of June 28, 1985 No. 3905.

Operation of objects which do not answer the project documentation, the state construction regulations, standards and rules is not allowed.

4.3. At factories it is necessary to inspect buildings, constructions and engineering networks according to the Regulations on safe and reliable operation of factory buildings and constructions approved by the order of the State committee of construction, architecture and housing policies of Ukraine, the State committee of Ukraine on supervision of labor protection of November 27, 1997 No. 32/288, the Rules of inspections, assessment of technical condition and certification of factory buildings and constructions approved by the order of the State committee of construction, architecture and housing policies of Ukraine, the State committee of Ukraine on supervision of labor protection of November 27, 1997 No. 32/288, the Rules of inspections, assessment of technical condition registered in the Ministry of Justice of Ukraine on July 06, 1998 for No. 423/2863, registered in the Ministry of Justice of Ukraine on July 06, 1998 for No. 424/2864, certification and carrying out scheduled preventive maintenance of gas pipelines and constructions on them, approved by the order of the State committee of construction, architecture and housing policies of Ukraine of June 09, 1998 No. 124, registered in the Ministry of Justice of Ukraine on November 13, 1998 for No. 723/3163.

4.4. Machines, mechanisms, the equipment, vehicles which implement at factories shall have the certificate of conformity if they are brought in the List of products which are subject to obligatory certification in Ukraine, No. approved by the order of the State committee of Ukraine concerning technical regulation and consumer policy of February 01, 2005 28, registered in the Ministry of Justice of Ukraine on May 04, 2005 for No. 466/10746.

4.5. Acceptance in operation of machines, mechanisms and the equipment of the increased danger, implementation of new technologies shall be performed according to Procedure for issue of permissions to performance of works of the increased danger and on operation (application) of machines, mechanisms, the equipment of the increased danger, the approved resolution of the Cabinet of Ministers of Ukraine of October 26, 2011 No. 1107.

4.6. Make changes to design of the operating capital equipment, technological schemes, processes, and also to their parameters without approval of the project organization or the manufacturing plant, of state supervision bodies behind labor protection, organizations of sanitary and epidemiologic service of the Ministry of Health of Ukraine do not allowed.

4.7. At factories investigation and accounting of accidents, occupational diseases and accidents according to the Procedure for conducting investigation and accounting of accidents, occupational diseases and accidents on production approved by the resolution of the Cabinet of Ministers of Ukraine of November 30, 2011 No. 1232 shall be organized.

4.8. The procedure for carrying out training, instructing, examinations on labor protection and fire safety, and also the admission of personnel to independent work are determined by the Standard regulations on procedure for carrying out training and examination concerning labor protection approved by the order of the State committee of Ukraine on supervision of labor protection of January 26, 2005 No. 15, registered in the Ministry of Justice of Ukraine on February 15, 2005 for No. 231/10511 (NPAOP 0.00-4.1205), and Standard regulations on instructing, special training and examination concerning fire safety at the companies, in organizations and the organizations of Ukraine, the approved order of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash against September 29, 2003 No. 368, registered in the Ministry of Justice of Ukraine on December 11, 2003 for No. 1148/8469 (NAPB B.02.005-2003).

The workers and officials occupied at works with the increased danger, the works with the increased danger determined in the List, No. approved by the order of the State committee of Ukraine on supervision of labor protection of January 26, 2005 15, registered in the Ministry of Justice of Ukraine on February 15, 2005 for No. 232/10512 (further - NPAOP 0.00-2.01-05), and also the works determined in the List of works where there is need for the professional selection approved by the order of the Ministry of Health of Ukraine, the State committee of Ukraine on supervision of labor protection of September 23, 1994 No. 263/121, registered in the Ministry of Justice of Ukraine on January 25, 1995 for No. 18/554, shall undergo annual special training and examination of the relevant normative legal acts in labor protection, and in fire safety - according to requirements of the List of positions, in case of appointment to which faces shall undergo training and examination concerning fire safety, and procedure for their organization, the Ministry of Ukraine approved by the order for emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash against September 29, 2003 No. 368, registered in the Ministry of Justice of Ukraine on December 11, 2003 for No. 1147/8468 (NAPB B.06.001-2003).

The admission to work of workers who did not undergo training and examination in labor protection and fire safety is not allowed.

4.9. The employer shall organize performing preliminary and periodic medical examinations of workers which are engaged at hard work, works with harmful or dangerous working conditions, and also annual survey of persons aged till 21 year.

The list of workers who are subject to medical examination is determined according to the Procedure for performing medical examinations of workers of certain categories approved by the order of the Ministry of Health of Ukraine of May 21, 2007 No. 246, registered in the Ministry of Justice of Ukraine on July 23, 2007 for No. 846/14113.

4.10. It is not allowed to apply work of women at the works specified in the List of hard work and works with harmful and dangerous working conditions on which application of work of women, No. approved by the order of the Ministry of Health of Ukraine of December 29, 1993 256, registered in the Ministry of Justice of Ukraine on March 30, 1994 for No. 51/260 is forbidden.

The raising and cargo transfer manually are permitted by women within Limit rates of raising and movement of the heavy things by women approved by the order of the Ministry of Health of Ukraine of December 10, 1993 No. 241, registered in the Ministry of Justice of Ukraine on December 22, 1993 for No. 194.

4.11. It is not allowed to apply work of minors at the works specified in the List of hard work and works with harmful and dangerous working conditions on which application of work of minors, No. approved by the order of the Ministry of Health of Ukraine of March 31, 1994 46, registered in the Ministry of Justice of Ukraine on July 28, 1994 for No. 176/385 is forbidden.

The raising and movement of heavy things by minors are permitted within Limit rates of raising and movement of the heavy things by minors approved by the order of the Ministry of Health of Ukraine of March 22, 1996 No. 59, registered in the Ministry of Justice of Ukraine on April 16, 1996 for No. 183/1208.

4.12. The employer shall create in workplaces in each structural division of working condition according to requirements of the acting normative legal acts, and also provide observance of requirements of the legislation concerning the rights of workers in labor protection industry.

In each workshop of factory the employer shall have the approved lists of gas dangerous places and gas dangerous works, and also works of the increased danger according to NPAOP 0.00-2.01-05.

4.13. Works of the increased danger need to be carried out according to the work permit of certain form. It is necessary to perform these works crew at least from two workers, and in devices, plank beds, gas flues and other similar places - crew it is at least from three workers. To place of employment the official responsible for performance of works of the increased danger, or the responsible person of the subordinate organization shall accompany crew. On site works it is necessary to hang out the plate "Work here!".

In the work permit issued on work of the increased danger the complete amount of organizational and technical measures which acceptance will provide safe work in specific conditions shall be specified.

The list of positions of heads and specialists who have the right to issue work permits affirms the employer.

4.14. The organization of works of the subordinate of the organization shall meet the requirements of Item 8 of the Section ІІІ Industrial safety rules during repair of the equipment at the companies of ferrous metallurgy approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of August 20, 2008 No. 183, registered in the Ministry of Justice of Ukraine on September 16, 2008 for No. 863/15554 (further - NPAOP 27.1-1.06-08).

4.15. At each factory and in its workshops liquidation plans of accidents according to the Provision concerning plan development of localization and liquidation of emergencies and accidents approved by the order of Committee on supervision of labor protection of Ukraine of the Ministry of Labour and Social Policy of Ukraine of June 17, 1999 No. 112, registered in the Ministry of Justice of Ukraine on June 30, 1999 for No. 424/3717 shall be constituted (NPAOP 0.00-4.33-99).

The admission to work of the workers and officials who are not informed of the liquidation plan of accidents is not allowed.

4.16. The employer shall provide all workers of workshops of factory with overalls, special footwear, individual protection equipment and safety devices according to the Regulations of free issue of special clothes, special footwear and other individual protection equipment to workers of the mining industry approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of August 21, 2008 No. 184, registered in the Ministry of Justice of Ukraine on September 10, 2008 for No. 832/15523 (further - NPAOP 0.00-3.10-08).
