According to Articles 5, "About state regulation in the field of utilities" the National commission which performs state regulation in the field of utilities DECIDES: 6 Laws of Ukraine
1. Approve the Procedure for control of observance by licensees of Licensed conditions of conducting economic activity on production of heat energy (except activities for production of heat energy on combined heat and power plants, thermal power plants, nuclear power plants and cogeneration installations and installations with use nonconventional or renewable energy resources), to transportation of heat energy by the high-level and local (distribution) thermal networks, supply of heat energy which is applied.
2. To provide to department of licensed control (Bondarenko G. V.) this resolution on state registration to the Ministry of Justice of Ukraine in the procedure established by the legislation.
3. This resolution becomes effective from the date of its official publication.

1.1. This Procedure is developed according to requirements of the Laws of Ukraine "About licensing of certain types of economic activity", "About the basic principles of the state supervision (control) in the field of economic activity", "About state regulation in the field of utilities", "About natural monopolies", resolutions of the Cabinet of Ministers of Ukraine of November 14, 2000 "About approval of the list of bodies of licensing" and of October 10, 2012 No. 919 "About approval of criteria by which the risk degree from implementation of the economic activity which is subject to licensing by the National commission, performing state regulation in the field of utilities is estimated and is determined No. 1698 frequency of holding planned actions of the state supervision (control)".
1.2. Action of this Procedure extends to all subjects of managing whose licensing of economic activity is performed by the National commission performing state regulation in the field of utilities (further - the Commission), Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations (further - control facility).
1.3. Control of observance by licensees of the Licensed conditions of implementation of economic activity on production of heat energy (except activities for production of heat energy on combined heat and power plants, thermal power plants, nuclear power plants and cogeneration installations and installations with use nonconventional or renewable energy resources) approved by the resolution of the Commission of August 10, 2012 No. 276, of the Licensed conditions of implementation of economic activity on transportation of heat energy by the high-level and local (distribution) thermal networks registered in the Ministry of Justice of Ukraine on August 31, 2012 for No. 1466/21778,, approved by the resolution of the Commission of August 10, 2012 No. 277, of the Licensed conditions of implementation of economic activity on delivery of heat energy registered in the Ministry of Justice of Ukraine on August 31, 2012 for No. 1467/21779, No. approved by the resolution of the Commission of August 10, 2012 278, registered in the Ministry of Justice of Ukraine on August 31, 2012 for No. 1475/21787 (further - licensed conditions), it is performed by control facility by the analysis of the obligatory reporting and documents received from licensees or other materials arriving in control facility by carrying out scheduled and unscheduled inspections according to this Procedure.
1.4. This Procedure establishes:
organization and carrying out scheduled and unscheduled inspections;
powers of the chairman and members of the commission on check;
rights and obligations of the licensee;
procedure for registration of results of checks;
document creation about application to licensees of sanctions for violation of licensed conditions;
control over the implementation by licensees of decisions of control facility.
2.1. The general organization of checks is performed by structural division of control facility which will organize implementation of the state supervision (control) (further - SPGN).
2.2. Scheduled and unscheduled inspections are performed according to requirements of the Laws of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" and "About licensing of certain types of economic activity".
2.3. Are performed in the place of implementation of licensed activities of the licensee or its separate divisions or in control facility in the cases provided by the law.
2.4. Scheduled inspections are carried out taking into account criteria by which the risk degree from implementation of economic activity and frequency of holding planned actions is estimated.
Scheduled inspections are performed according to annual or quarter plans which affirm control facility till December 1 of the year previous planned or to the 25th day of the last month of the quarter preceding planned.
The control facility will promulgate criteria and frequency of holding planned actions for implementation of the state supervision (control) by placement of information on the Internet according to the procedure, determined by the legislation.
The term of implementation of planned action cannot exceed fifteen working days, and for small business entities - five working days if other is not provided by the law.
Prolongation of term of implementation of planned action is not allowed.
2.5. Unscheduled inspections are performed in the presence of the bases determined by the Laws of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" and "About licensing of certain types of economic activity".
The term of implementation of unplanned action cannot exceed ten working days, and concerning small business entities - two working days if other is not provided by the law.
Prolongation of term of implementation of unplanned action is not allowed.
2.6. In case of receipt in control facility in writing of appeals of physical persons about violation by the subject of managing of requirements of the legislation and on condition of sufficiency of supporting documents or the facts about availability of violation of SPGN in accordance with the established procedure will organize unscheduled inspection according to provisions of this Section on which results notifies the applicant in the time established by the legislation.
2.7. In case of insufficiency of reasons concerning availability of violation of licensed conditions of SPGN sends to the licensee the written request on provision of necessary documents in which analysis result feasibility of carrying out unscheduled inspection is determined.
If absence from the licensee of violations of licensed conditions is confirmed by the documents provided on the corresponding request, SPGN prepares for the applicant the reasonable answer in the time established by the legislation.
2.8. For carrying out scheduled or unscheduled inspection of SPGN prepares necessary administrative documents:
the order on conducting check which shall contain the name of the subject of managing concerning which the action, and check subject will be performed;
the certificate on conducting check (appendix 1);
order on business trip of officials (if necessary).
2.9. For conducting check of the licensee according to the order of the head of control facility the commission on check as a part of at least three people who are specified in the certificate conducting check is created, and the commission chairman from their number is determined.
2.10. Based on the order on conducting check the certificate on conducting check which is signed by the head or the deputy manager of control facility (with indication of surname, name and middle name) is drawn up and makes sure seal.
In the certificate are specified conducting check:
the name of the control facility performing action;
the name of the subject of managing and/or its separate division or surname, name and middle name of the physical person - the entrepreneur concerning which activities check is performed;
the location of the subject of managing and/or its separate division concerning which activities check is performed;
number and date of the order in pursuance of which check is performed;
the list of the officials who are taking part in check implementation with indication of their positions, surnames, names and middle names;
start date and end date of check;
check type (planned or unplanned);
bases for check implementation;
check implementation subject;
information on implementation of the previous checks (type of check and term of its implementation).
2.11. The certificate on conducting check is registered in the book of registration of certificates for conducting check of observance by licensees of requirements of licensed conditions (appendix 2) which pages shall be numbered, stitched and under seal.
2.12. Before check implementation the chairman and members of the commission on check shall show to the head of the subject of managing or person authorized by it the original of the certificate on conducting check which is stored further in case of the licensee, and the official ID certifying the official of control facility and to provide to the subject of managing the copy of the certificate certified of the procedure established by the legislation on conducting check.
Authorized person of the licensee is the head or person having the power of attorney certified in accordance with the established procedure on the right to represent the licensee during check.
2.13. The chairman and members of the commission on check without certificate have no right to perform check of the subject of managing to conducting check and the official ID.
The licensee has the right not to allow the chairman and members of the commission on check to implementation of action if they did not show the documents provided by this Item.
2.14. In case of impossibility of the official included in structure of the commission on check for the reasonable reasons to take part in this check on condition of providing minimum necessary structure of the commission the new certificate on conducting check without change of term of implementation of check and questions of check is drawn up.
In case of exit of the official of control facility from among members of the commission on check during its carrying out that surely is confirmed by the relevant documents, implementation of check is prolonged by the available number of members of the commission on check (on condition of preserving in its structure at least two people).
2.15. At the beginning of check the chairman and members of the commission on check note in the magazine of registration of checks of the licensee (in case of its availability) the purpose, nature and review periods, date and number of the certificate on conducting check, position and surname of the chairman and members of this commission, number of official IDs and put down the signatures.
The refusal of the chairman or member of the commission on check from the signature in the magazine of registration of checks is the basis for its non-admission to conducting check.
2.16. Scheduled inspections are carried out according to lists of questions which are compound the statement which is drawn up by results of holding planned (unplanned) action of the state supervision (control) for observance by the subject of managing of requirements of licensed conditions of implementation of economic activity on production of heat energy (except activities for production of heat energy on combined heat and power plants, thermal power plants, nuclear power plants and cogeneration installations and installations with use nonconventional or renewable energy resources), to transportation of heat energy by the high-level and local (distribution) thermal networks, supply of heat energy (appendix 3) (further - the inspection statement).
2.17. During unplanned action only those questions which need of check became the basis for implementation of this action become clear.
Unscheduled inspection cannot be performed on the same questions for the period which was already checked, except as specified, if such check is performed in pursuance of the judgment, within pre-judicial production or for control over the implementation of the decision on elimination of violations of licensed conditions on the matter.
2.18. Scheduled inspections are performed on condition of the written notice of the licensee of holding planned action for the form given in appendix 4 to this Procedure, the mailing directed by the registered mail with the assurance of receipt or the telephone message or handed personally to the head or the authorized person of the licensee on receipt not later than ten calendar days about day of conducting check.
The message on holding action is signed by the authorized officer of control facility.
The licensee is not warned about carrying out unscheduled inspection in advance.
2.19. Scheduled or unscheduled inspections can be performed in a complex by several state supervision bodies (control) if their powers on implementation or participation in complex actions are provided by the law. Such events are held according to the joint decision of heads of relevant organs of the state supervision (control) which officials join in the commissions on check.
2.20. The decision on participation of officials of control facility in the checks which are carried out by other state supervision bodies (control) is accepted by the head of control facility.
2.21. Control facilities and subjects of managing have the right to fix process of implementation of scheduled or unscheduled inspection or each separate action by means of audio-and video equipment, without interfering with implementation of such check.
3.1. Before scheduled inspection the commission chairman on check together with the written notice of holding action sends to the licensee the list of documents which will serve as confirmation of observance by the subject of managing of requirements of the legislation, for check reasons.
3.2. The chairman and members of the commission on check within the powers provided by the law when implementing scheduled (unplanned) inspection have the right:
demand from the licensee of elimination of the revealed violations of requirements of the legislation;
require the termination of the actions interfering check implementation;
receive explanations, references, documents, materials, data on the questions arising when implementing scheduled (unplanned) inspection according to the law.
3.3. The chairman and members of the commission on check when conducting scheduled (unplanned) inspection perform survey of the objects, the equipment and the territories which are in property or in use of the licensee.
3.4. The chairman and members of the commission on check when implementing scheduled (unplanned) inspection can use documents, materials, the statistical and other information obtained by control facility according to its powers from central and local executive bodies, local government bodies.
3.5. The commission chairman on check during scheduled (unplanned) inspection has the right to constitute protocols on administrative offense in the procedure established by the legislation according to powers of control facility.
3.6. The chairman and members of the commission on check when implementing scheduled (unplanned) inspection shall:
it full, objectively and without prejudice to perform check within the powers provided by the law;
adhere to business ethics in relations with licensees;
not interfere and not interfere with implementation of economic activity when implementing check if it does not threaten life and human health, does not attract danger of emergence of technogenic situations and the fires;
provide nondisclosure of trade secret of the subject of managing which becomes available to officials during check implementation;
acquaint the head of the subject of managing, either his deputy, or person authorized by it with results of check in the terms provided by the law;
provide to the licensee the consulting help with check implementation.
4.1. The licensee has the right:
demand from the chairman and members of the commission on check of observance of requirements of the legislation;
check availability at the chairman and members of the commission on verification of the official ID and to receive copies of the certificate on conducting check;
not allow the chairman and members of the commission on check to check implementation if:
check is performed with violation of requirements concerning frequency of conducting the checks provided by the law;
the chairman or the member of the commission on check did not provide the copy of the documents provided by the law or if the provided documents do not conform to requirements of the law;
be present when implementing check;
require nondisclosure of information which is trade secret of the company;
receive and get acquainted with the inspection statement;
provide in writing the explanations, notes or objections to the inspection statement;
appeal wrongful acts of control facilities and their officials in the procedure established by the law.
4.2. The licensee shall:
allow the chairman and members of the commission on check to implementation of check on condition of observance of the procedure of checks provided by the law;
fulfill requirements of the chairman and members of the commission for check of elimination of the revealed violations of the law;
provide documents, explanations, references, data, materials on the questions arising during check implementation according to the law;
receive inspection statement copy by results of the carried-out scheduled or unscheduled inspection.
5.1. By results of the carried-out scheduled (unplanned) inspection the inspection statement in the form given in appendix 3 to this Procedure is drawn up.
5.2. The commission on check notes in the inspection statement condition of fulfillment of requirements of the legislation by the licensee, and in case of failure to carry out - the detailed description of the revealed violation with reference to the relevant requirement of the legislation.
The documents and explanations received from authorized and other persons of the licensee on questions which concern check subject join the inspection statement in the form of appendices.
5.3. In the last day checks two copies of the inspection statement are signed by the chairman and members of the commission on check and the authorized person of the licensee.
Each page of the inspection statement is vised by the commission chairman on check and the authorized person of the licensee.
5.4. If when checking further violation by the licensee of licensed conditions is revealed, the control facility draws up the statement of further violation by the licensee of licensed conditions (appendix 5).
5.5. If when checking false information in the documents filed by the subject of managing for receipt of the license is revealed, the control facility draws up the statement of detection of false information in the documents filed by the subject of managing for receipt of the license (appendix 5).
5.6. If during check established fact of transfer of the license or its copy to other legal entity or physical person for implementation of economic activity, the control facility draws up the statement of factual determination of transfer of the license or its copy to other legal entity or physical person for implementation of economic activity (appendix 5).
5.7. If when checking failure to carry out of the instruction about elimination of violations of licensed conditions is revealed, the control facility draws up the statement of failure to carry out of the order of elimination of violations of licensed conditions (appendix 5).
5.8. If when checking the impossibility of the licensee to provide accomplishment of licensed conditions is found, the control facility draws up the statement of impossibility of the licensee to provide accomplishment of licensed conditions (appendix 5).
5.9. In the last day checks two copies of the acts specified in Items 5.4 - 5.8 presents of the Section, in case of their availability are signed by the chairman and members of the commission on check.
5.10. Date of creation of the inspection statement and the acts specified in Items 5.4 - 5.8 presents of the Section, is the last day of check specified in the certificate conducting check.
5.11. One copy of the inspection statement and the acts specified in Items 5.4 - 5.8 presents of the Section, is provided to the authorized person of the licensee, another is stored in SPGN.
5.12. The inspection statement and acts specified in Items 5.4 - 5.8 presents of the Section, are registered officials of SPGN in the book of registration of acts of checks of observance by licensees of requirements of licensed conditions on the form given in appendix 6 to this Procedure which pages shall be numbered, stitched and under seal.
5.13. If the licensee does not agree with the inspection statement, it signs it with notes which are integral part of the act what it is told in this act about.
5.14. In case of refusal the licensee from signing of the inspection statement the commission chairman on check surely makes the corresponding record which makes sure signatures of all members of the commission on check in the act.
5.15. In case of refusal of the licensee in conducting check the chairman and members of the commission on check draw up in triplicate the statement of refusal in conducting check (appendix 7).
The refusal of the licensee in conducting check is considered:
absence of the licensee on its location specified in the corresponding license;
absence of the head (authorized person) of the licensee when conducting check;
not appointment as the licensee of the authorized person having the right to represent the licensee during conducting check;
refusal of the licensee in access of the commission on check to the territory, to buildings, constructions and other rooms of the licensee in which licensed economic activity is performed;
refusal of the licensee to provide all necessary documents and other explanations upon the demand of the chairman and members of the commission on check confirming observance of licensed conditions by it.
At the same time in the act of refusal in conducting check causes of failure are specified and the corresponding explanations of the head (officials) of the licensee are added (in case of their provision).
The act of refusal in conducting check is registered officials of SPGN in the book of registration of acts of checks of observance by licensees of requirements of licensed conditions.
Two copies of the act of refusal in conducting check with the warning of need of signing of the specified act go the registered mail with the assurance of receipt of the mailing on the location of the licensee in time that is specified in the license.
5.16. In case of non-return at the scheduled time sent to the licensee or return of the act of refusal which is not signed without valid excuse in conducting check in the third copy of the act entry about refusal of the licensee of its signing is made.
5.17. One copy of the inspection statement with conclusions about lack of violations of licensed conditions is filed the licensee which remains further in archive of control facility.
5.18. In case of elimination by the licensee SPGN in coordination with the head of control facility attaches the inspection statement in the personal record of the licensee which remains further in archive of control facility to consideration by control facility of violations of the licensed conditions revealed by check that surely is confirmed by the relevant documents.
5.19. In case of elimination by the licensee to consideration by control facility of separate violations of the licensed conditions revealed by check that surely is confirmed by the relevant documents only those violations which were not eliminated are submitted for consideration.
6.1. Based on the inspection statement with conclusions within five working days from the date of signing of the act control facility according to the powers provided by the law makes the decision on elimination of the violations revealed during check and/or on imposing of sanctions on violation of licensed conditions.
Consideration of the violations revealed during check and questions of decision making of their elimination and/or of imposing of sanctions is performed by control facility with the obligatory invitation of the licensee or his representative.
The control facility shall have confirmation about the fact of the message of the licensee about time and the place of consideration of the violations revealed during check and questions of decision making of their elimination and/or of imposing of sanctions.
In case of absence of the licensee or its authorized person for consideration of the violations revealed during check and questions of decision making of their elimination and/or of imposing of sanctions consideration is performed without their participation.
6.2. The decision of control facility on elimination of violations of licensed conditions and/or on imposing of sanctions is constituted in duplicate. One copy is stored in control facility, and another is handed to personally authorized person of the licensee or goes service of clerical work of control facility to the licensee the registered mail with the assurance of receipt of the mailing no later than five working days from the date of decision making of control facility about elimination of violations of licensed conditions and/or about imposing of sanctions.
On copy which remains in control facility the corresponding reference number and date of the direction are put down.
6.3. The decision on cancellation of the license is made by control facility within ten working days from the date of establishment of the bases for cancellation of the license determined by article 21 of the Law of Ukraine "About licensing of certain types of economic activity" and handed (goes) to the licensee with indication of the bases for cancellation no later than three working days from date of its acceptance.
Consideration of questions of cancellation of licenses is performed by control facility with the obligatory invitation of the licensee or his representative.
The control facility shall have data on confirmation of the timely notification of the licensee on time and the place of consideration of question of cancellation of the license.
In case of absence of the licensee or its authorized person consideration of questions of cancellation of the license is performed without their participation.
6.4. The bases for cancellation of the license by results of check are:
act of further violation by the licensee of licensed conditions;
the act of detection of false information in the documents filed by the subject of managing for receipt of the license;
the act of factual determination of transfer of the license, its copy to other legal entity or physical person for implementation of economic activity;
act of failure to carry out of the order of elimination of violations of licensed conditions;
the act of impossibility of the licensee to provide accomplishment of the licensed conditions established for certain type of economic activity;
the act of refusal of the licensee in conducting check by control facility.
6.5. The decision on cancellation of the license made by results of consideration of violations of the licensed conditions revealed when implementing check becomes effective in thirty days from the date of its acceptance.
If the licensee during this time makes the complaint in expert and appeal council, action of this decision of control facility stops before adoption of the relevant decision of specially authorized body concerning licensing.
6.6. Decisions of the Commission are drawn up in type:
instructions about elimination of violations of licensed conditions;
resolutions on imposing of penalty;
resolutions on cancellation of the license.
6.7. The decision of Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations are drawn up in type:
instructions about elimination of violations of licensed conditions;
orders about cancellation of the license.
6.8. Decisions of control facilities can be appealed in the procedure established by the legislation.
7.1. The licensee who received the decision of control facility on elimination of violations of licensed conditions and/or on imposing of sanctions shall execute it at the scheduled time what shall notify control facility in writing on.
7.2. Control of elimination by the licensee of violations of licensed conditions is exercised by relevant organ of control.
7.3. In case of elimination of violations of licensed conditions the licensee submits within the term established by the decision of control facility to relevant organ of control the written message with the necessary documents and materials which are drawn up properly, confirming elimination of violations.
In case of sufficiency of the explanations provided by the licensee the control facility behind representation of SPGN in accordance with the established procedure makes the decision on the termination of the procedure of consideration of violations by the licensee of licensed conditions what in writing reports to the licensee within three working days from the date of its acceptance about.
7.4. In case of not elimination by the licensee of violations in the time established by the decision of control facility for the objective reasons about what the licensee not later than ten working days before the termination of fixed term provides to control facility the written notice with reasons for need of prolongation of term of elimination of violations of licensed conditions, the control facility can make the decision on prolongation of term of elimination of violations of licensed conditions.
7.5. In case of non-presentation at the scheduled time of the written message with necessary documents and materials which confirm accomplishment by the licensee of requirements of the decision on elimination of violations of licensed conditions and/or about imposing of sanctions (except cancellation of the license) or provision unreasonable information on elimination of violations after the term specified in the decision the control facility will organize unscheduled inspection no later than thirty days from the date of the expiration of the control facility of term of elimination of violations of licensed conditions established by the decision in time or makes the decision on prolongation of term of elimination of violations of licensed conditions.
7.6. After the termination of the procedure of consideration of violation by the licensee of licensed conditions or in case of cancellation of the license all documents and materials join the personal record of the licensee which is stored in archive of control facility.
