About approval of Instructions for use natural gas for legal entities

According to Article 4 of Ukraine "About the principles of functioning of the natural gas market", the subitem 5 of item 4 of the Regulations on the National commission which performs state regulation in the field of power, No. approved by the Presidential decree of Ukraine of November 23, 2011 1059, the National commission which performs the state regulation in the field of the power DECIDES:

1. Approve Instructions for use by natural gas for legal entities who are applied.

2. In accordance with the established procedure to provide to management of regulation of oil and gas complex provision of this resolution on state registration in the Ministry of Justice of Ukraine.

3. This resolution becomes effective from the date of its official publication.

Instructions for use natural gas for legal entities

І. General provisions

1.1. These rules govern the relations which arise between gas supplying, gas-distributing, gas transmission companies and consumers of natural gas (except the population).

1.2. Action of these rules extends to legal entities and physical persons entrepreneurs.

1.3. The terms provided in these rules are used in such value:

advance payment - partial payment by money (in the amount of, caused by the agreement) the amount of natural gas declared for the next settlement period which is performed by the beginning of settlement period;

the gas supplying company (further - the supplier) - subject of managing which based on the license performs supply of natural gas directly to consumers according to the signed agreements;

the gas-distributing company - subject of managing which based on the license performs transportation of natural gas by gas distribution networks directly to consumers in property or in use of which there are gas distribution networks and other production facilities and which performs concerning them functions on operational technologically management;

the gas transmission company - subject of managing which based on the license performs transportation of natural gas by trunk gas pipelines which are in its property or use and performs concerning them functions on operational technologically management;

the guaranteed supplier - it is determined according to the procedure, established by the Cabinet of Ministers of Ukraine, the gas supplying company which has no right to refuse to the consumer the conclusion of the contract for supply of natural gas;

standard daily rate - average daily regulation of consumption of natural gas which is determined by division of the monthly confirmed gas amount on the number of days of the corresponding month;

the delivery agreement of natural gas on regulated rate - the agreement of two parties (the supplier of natural gas on regulated rate and the consumer) which contents is determined in the Standard agreement on supply of natural gas on regulated rate approved by the resolution NKRE of September 22, 2011 No. 1580, registered in the Ministry of Justice of Ukraine on October 7, 2011 for No. 1155/19893;

the delivery agreement of natural gas on unregulated rate (the delivery agreement of gas) - the agreement of two parties (the supplier of natural gas on unregulated rate and the consumer) which establishes content and regulates legal relationship between the parties during supply with the supplier on unregulated rate of natural gas to the consumer at the price approved by the parties which does not exceed the limit of the price established by the National commission which performs the state regulation in the field of power, for the corresponding category of consumers;

the agreement on technical supply by gas of object of gas consumption of the subconsumer - the agreement of two parties (the main consumer and the subconsumer) who establishes content and regulates legal relationship between the parties during technical supply of transfer of the gas ordered by the subconsumer, networks of the main consumer;

the permitted capacity of object of gas consumption - the maximum size of capacity which газорапределительное / the gas transmission company allowed the consumer based on regulating documents in accordance with the terms of the contract for accession to gas networks, specifications and/or the project documentation;

duplicative metering station - the metering station intended for control of amount of natural gas which is considered by the metering station;

means of the measuring equipment (further - SIT) - the technical tool which is used during measurements and has the normalized metrological characteristics;

the skilled consumer - the consumer whose skill level corresponds to the degree determined by the National commission which performs the state regulation in the field of power and which has the right freely to buy gas from any supplier;

the gas metering station - metering station which is applied to carrying out commercial calculations when implementing transportation, distribution and supply of natural gas;

commercial accounting of gas - determination in point of commercial accounting of gas of amount of the transferred (accepted) gas for registration by agreement parties (the technical agreement) of acts of acceptance transfer (provision of services, the reporting) for carrying out commercial settlement;

control survey of metering station - accomplishment of complex of works with the purpose of visual inspection of integrity of SIT (the case, glass, fixture, connection, and so forth), the integrity established, according to the act of sealing of seals and availability of prints of their brands, removal of displays of ZVT, and also for the purpose of identification without use of special technical means and/or partial dismantle of building constructions or the equipping materials of unauthorized connections;

the proofreader of amount of gas - set of means of the measuring equipment which takes pressure and temperature of gas which proceeds in the measuring pipeline and turns initial signals from the counter of gas and calculates gas amount under standard conditions;

use of natural gas - consumption of natural gas with observance by the consumer of the payment terms of the used natural gas and services in its distribution and transportation defined by the relevant agreements for receipt of contractual amounts of natural gas;

the gas counter - means of the measuring equipment which is used for measurement, storing and display of amount of gas which passes through it;

limit of balance sheet accessory of gas pipelines - point of differentiation of gas networks between adjacent owners of objects of gas supply system (gas consumption) behind property right signs, either use, or complete economic maintaining;
