About transfer to tax authorities of requirements for obligatory payments regarding administrative punishments in the form of penalties

According to article 33 of the Law of the Republic of Belarus of July 13, 2012 "About economic insolvency (bankruptcy)" the Council of Ministers of the Republic of Belarus DECIDES:

1. Determine that:

1.1. the state body performing functions of the creditor in case on economic insolvency (bankruptcy) of the debtor on obligatory payments regarding administrative punishments in the form of the penalties which are subject to payment based on resolutions of the courts considering economic cases if such resolution is not performed or performed partially, the tax authority in the place of registration of the debtor concerning which the court considering economic cases initiates proceeedings about economic insolvency (bankruptcy) (further – tax authority) is;

1.2. the court which is considering economic cases, issued the decree on imposing of administrative punishment in the form of penalty if such resolution is not performed or performed partially, no later than 20 working days from the date of opening concerning the debtor of bankruptcy proceedings sends to tax authority the transfer notice of requirements for obligatory payments regarding administrative punishments in the form of penalties in form according to appendix to this resolution.

Shall be applied to the notification:

the copy of the resolution on imposing of administrative punishment in the form of penalty;

the copy of the act of impossibility of performance of the executive document (in the presence of such act);

the data on property of the debtor received by the legal executive during enforcement proceeding (in the presence of such data);
