About the republican budget for 2013-2015

Article 1. Approve the republican budget for 2013-2015 according to appendices 1, 2 and 3 respectively, including for 2013 in the following amounts:

1) the income - 5 152 711 777 thousand tenges, including on:

to tax revenues - 3 511 723 367 thousand tenges;

to non-tax receipts - 88 890 504 thousand tenges;

to sales proceeds of fixed capital - 7 700 000 thousand tenges;

to receipts of transfers - 1 544 397 906 thousand tenges;

2) costs - 5 743 716 813 thousand tenges;

3) net budget crediting - 40 831 419 thousand tenges, including:

budget credits - 122 125 013 thousand tenges;

repayment of budget credits - 81 293 594 thousand tenges;

4) balance on transactions with financial assets - 158 721 629 thousand tenges, including:

acquisition of financial assets - 167 531 629 thousand tenges;

sales proceeds of financial assets of the state - 8 810 000 thousand tenges;

5) deficit-790 558 084 thousand tenges, or percent 2,3 to country gross domestic product;

6) budget deficit financing - 790 558 084 thousand tenges.

Article 2. Provide in the republican budget for 2013 of receipt of the rents for use of the Russian Federation of the Baikonur complex in the amount 17 480 000 thousand tenges and proving grounds in the amount of 3 767 472 thousand tenges."

Article 3. Approve amounts of the receipts in the budget for 2013 directed to National fund of the Republic of Kazakhstan according to appendix 4.

Article 4. Determine that are enlisted in the income of the relevant budget:

1) by the "Severance tax" code of classification of the income of single budget classification - debt of subsoil users on royalty, and also royalty on contracts for subsurface use in which guarantees of stability of tax regime remain;

2) by the Social tax code of classification of the income single budget klassifikatsiizadolzhennost on the fees which were earlier listed in the Pension fund, the State center for pension payment, Fund of compulsory medical insurance, Fund of the national social insurance, Fund of assistance of employment, and also the expels of users of highways which were earlier arriving in Road fund.

At the same time the taxpayers performing activities for contracts for subsurface use in whom guarantees of stability of tax regime remain reduce the above-stated assignments or the social tax by the amount of contributions to the State Social Insurance Fund estimated according to the Law of the Republic of Kazakhstan "About compulsory social insurance";

3) by the "Gasoline (Except for Aviation) Self-produced, Realized by Producers Wholesale" code - debt on the collection from gasoline which was earlier arriving in Road fund;

4) by the "Self-produced Diesel Fuel Realized by Producers Wholesale" code - debt on the collection from diesel fuel which was earlier arriving in Road fund.

Article 5. The negative balance formed as of December 31, 1998 as a result of exceeding of the amounts of the temporary disability benefits added by employers, to pregnancy and childbirth, in case of the child's birth, on burial, paid from Fund of the national social insurance, over the added amount of contributions to the specified fund, is monthly set off on account of payment of the social tax within 4 percent from salary fund.

Article 6. Provide in the republican budget for 2013 amounts of budget withdrawals from regional budgets, city budget of Almaty in the republican budget in the amount of 121 056 185 thousand tenges, including:

Atyrau - 44 225 473 thousand tenges;

Mangystau - 24 607 177 thousand tenges;

the city of Almaty - 52 223 535 thousand tenges.

Article 7. Provide in the republican budget for 2013 of receipt of transfers from regional budgets, budgets of the cities of Astana and Almaty in connection with transfer:

1) functions and powers:

on carrying out the state technical inspection of vehicles - 55 913 thousand tenges;

in the field of population shift - 6 650 thousand tenges;

2) divisions of special purpose of Arlan - 889 999 thousand tenges;

3) special rapid response unit - 1 457 943 thousand tenges;

4) functions on production of blood, its components and medicines for the state organizations of health care of republican value - 908 556 thousand tenges;

5) powers of local executive bodies on:

to questions of the state architectural construction supervision and licensing - 754 640 thousand tenges;

to questions of advanced training of pedagogical workers - 1 567 317 thousand tenges;

the organizations of activities of service centers of the population - 10 500 859 thousand tenges.

Receipts in the republican budget of the specified amounts of transfers from regional budgets, budgets of the cities of Astana and Almaty are determined based on the decision of the Government of the Republic of Kazakhstan.

Article 7-1. Provide in the republican budget for 2013 of receipt of transfers from regional budgets of the Almaty, Aktyubinsk East Kazakhstan, Southern Kazakhstan regions in the amount 1 699 844 thousand tenges in connection with transfer of the expenses provided on implementation of educational process in the organizations of secondary education according to the state obligatory standards of education for carrying out approbation on implementation of per capita financing on average education.

Article 8. Provide in the republican budget for 2013 the size of the guaranteed transfer from National fund of the Republic of Kazakhstan in the amount of 1380 000 000 thousand tenges.

Article 8-1. Provide in the republican budget for 2013 target transfer from National fund of the Republic of Kazakhstan on development of transport infrastructure in the amount of 25 500 000 thousand tenges.

Article 9. Establish since January 1, 2013:

1) the minimum size of the salary - 18 660 tenges;

2) the size of the state base retirement benefit - 9 330 tenges;

3) the minimum size of pension - 19 066 tenges;

4) monthly settlement indicator for calculation of benefits and other social payments, and also for application of penalties, taxes and other payments according to the legislation of the Republic of Kazakhstan - 1731 tenges;

5) the size of subsistence minimum for calculation of the sizes of basic social vyplat18 660 tenges.

Article 10. Accomplishment of guarantees of the state to receivers of retirement benefits on safety of compulsory pension contributions in the single accumulation pension fund in the amount of actually brought compulsory pension contributions taking into account the rate of inflation at the time of acquisition of right by the receiver of the right to retirement benefits is performed according to the republican budget program 002 "Social security of separate categories of citizens" of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan according to the procedure, determined by the Government of the Republic of Kazakhstan.

Article 12. Provide in the republican budget for 2013 amounts of the subventions transferred from the republican budget to regional budgets, city budget of Astana in the amount of 865 844 050 thousand tenges, including:

Akmola - 53 074 025 thousand tenges;

Aktyubinsk - 32 805 572 thousand tenges;

Almaty - 103 465 940 thousand tenges;

East Kazakhstan - 89 281 704 thousand tenges;

Jambyl - 87 075 850 thousand tenges;

The West Kazakhstan - 13 485 381 thousand tenges;

Karaganda - 58 562 240 thousand tenges;

Kostanay - 51 166 230 thousand tenges;

Kyzylorda - 71 143 181 thousand tenges;

Pavlodar - 27 722 239 thousand tenges;

The North Kazakhstan - 50 819 740 thousand tenges;

The southern Kazakhstan - 220 321 863 thousand tenges;

the city of Astana - 6 920 085 thousand tenges.

Article 13. Distribution and (or) procedure for use of target current transfers regional budgets, budgets of the cities of Astana and Almaty for 2013 are determined based on the decision of the Government of the Republic of Kazakhstan:

1) on content, material equipping of the additional number of staff of migratory police;

2) on content and material equipping of the center of temporary accommodation of oralmans and the center of adaptation and integration of oralmans;

3) in connection with transfer of the number of staff of pedagogical employees of comprehensive schools of public institutions of criminal executive system;

4) on traffic safety;

5) on content of the number of staff performing servicing of sensitive strategic sites;

6) on increase in the amount of surcharges for special ranks to the staff of the law-enforcement bodies containing at the expense of means of local budgets;

7) on holding antiepizootic actions;

8) on seed farming support;

9) on material equipment of the state veterinary organizations;

10) on development of livestock production;

10-1) on reduction in cost to agricultural producers of cost of bioagents (entomophages) and biological products intended for processing of crops for the purpose of protection of plants;

10-2) on increase in goods availability, works and services for subjects of agro-industrial complex;

11) on provision of special social services;

11-1) on increase in the number of staff of local executive bodies;

12) on capital and average repair of highways of regional, district value and streets of settlements;

13) on subsidizing of passenger traffic by the subway;

14) on seizure of land for the state needs;

15) on implementation of measures for assistance to economic development of regions within the Development of Regions Program;

16) on implementation of measures of social support of specialists;

17) on support of private entrepreneurship in regions within the Road Map of Business-2020 Program;

18) on implementation of the state educational order in the preschool organizations of education;

19) on implementation of the State program of development of education of the Republic of Kazakhstan for 2011-2020;

20) on monthly payment of money to guardians (custodians) on content of the orphan child (orphan children) and child(children), without parental support;

21) on updating and re-equipment of industrial practice workshops, laboratories of educational institutions of technical and professional education;

22) on increase in the amount of surcharge for qualification category to teachers of schools and tutors of the preschool organizations of education;

23) on establishment of surcharge for the organization of inservice training to training officers of the organizations of technical and professional education;

24) on work pay increase to the teachers who underwent advanced training on three-level system;

25) on rendering social support to students in the organizations of technical and professional education;

26) on payment of wage differential to teachers (teachers) of the organizations of technical and professional education;

27) on increase in the state educational order at training of specialists in the organizations of technical and professional education;

27-1) on content of again entered objects of education;

27-2) on approbation of per capita financing of primary, main secondary and general secondary education;

28) on providing and expansion of the guaranteed amount of free medical care;

28-1) on content of again entered health care facilities;

29) on material equipment of the medical organizations of health care at the local level;

30) on realization of nature protection actions;

31) on subsidizing of cost of services in supply of drinking water from especially important group and local water supply systems which are uncontested sources of drinking water supply;

32) on content of again entered sport objects;

33) on increase in the amount of surcharge for qualification category to teachers of shkolinternat for the children presented in sport.

Article 14. Distribution and (or) procedure for use of the means realized in the following directions are determined based on the decision of the Government of the Republic of Kazakhstan:

1) the subitem 1) of Article 14 is excluded according to the Law of the Republic of Kazakhstan of 24.06.2013 No. 110-V ZRK

2) compensation of rate of remuneration on the credits (leasing) for support of agricultural industry;

3) reduction in cost of interest rates of remuneration on the credits (leasing) of agricultural machinery;

3-1) subsidizing of rates of remuneration according to credit and leasing obligations of subjects of agro-industrial complex for financial improvement;

4) development of professional standards and carrying out researches within social upgrade of the Republic of Kazakhstan;

5) compensation of damage to workers of the liquidated mines transferred to Republican state specialized enterprise "Karagandalikvidshakht".

Article 15. Distribution and (or) procedure for use of the means within the Affordable housing-2020 Program realized in the following directions are determined based on the decision of the Government of the Republic of Kazakhstan:

1) crediting of regional budgets, budgets of the cities of Astana and Almaty for designing, construction and (or) acquisition of housing through system of housing construction savings;

2) the subitem 2) of Article 15 is excluded according to the Law of the Republic of Kazakhstan of 24.06.2013 No. 110-V ZRK

3) designing, development, arrangement and (or) acquisition of inzhenernokommunikatsionny infrastructure;

4) designing, construction and (or) acquisition of housing of utility housing stock.

Article 16. Distribution and (or) procedure for use of means within the Development program of the monotowns for 2012-2020 realized in the following directions are determined based on the decision of the Government of the Republic of Kazakhstan:

1) crediting of regional budgets for microcredit of entrepreneurship;

2) subsidizing of loan interest rate of banks for projects implementation;

3) provision of grants on development of new productions;

4) assistance to development of entrepreneurship - training in entrepreneurship;

5) provision of subsidy for moving;

6) current arrangement.

Article 17. Distribution and (or) procedure for use of funds for implementation of the Road map of employment of 2020 are determined based on the decision of the Government of the Republic of Kazakhstan.

Article 18. Distribution of funds for realization of intersectoral and interdepartmental interaction concerning protection of public health for 2013 is determined based on the decision of the Government of the Republic of Kazakhstan.

Article 19. Distribution of means is determined by basic financing of subjects of scientific and (or) scientific and technical activities based on the decision of the Government of the Republic of Kazakhstan.

Article 20. Approve reserve of the Government of the Republic of Kazakhstan for 2013 in the amount of 53 291 686 thousand tenges.

Article 21. Provide in the republican budget for 2013 payment of donor fee of Kazakhstan in Asian Development Fund in the amount of 780 000 thousand tenges.

Article 22.  Article 22 is excluded according to the Law of the Republic of Kazakhstan of 24.06.2013 No. 110-V ZRK

Article 23. Consider that as a part of costs of the Ministry of Emergency Situations of the Republic of Kazakhstan funds for forming and storage of the state material reserve are provided in the amount of 11638 230 thousand tenges with reflection in the income of the republican budget of means from realization of the material values issued according to the procedure of refreshening in the amount of 800 000 thousand tenges.

Article 24. Determine that since January 1, 2013 requirements of the Government of the Republic of Kazakhstan for the public educational and student's credits in case of the death of the borrower or the announcement his dead stop.

Article 25. Determine that since January 1, 2013 requirements of the Government of the Republic of Kazakhstan to the legal entities liquidated as of January 1, 2013 according to the legislation of the Republic of Kazakhstan on the credits and funds allocated for obligation fulfillment on the state guarantees, according to the list of legal entities and amounts of debt determined by the Government of the Republic of Kazakhstan stop.

Article 32. Approve the list of the republican budget programs which are not subject to the sequester in the course of execution of the republican budget for 2013 according to appendix 5.

Determine that in the course of execution of local budgets for 2013 local budget programs according to appendix 6 are not subject to the sequester.

Article 33. This Law becomes effective since January 1, 2013.
