About use of the simple digital signature when rendering the state and municipal services

According to part 1 of article 21.2 of the Federal law "About the Organization of Provision of the State and Municipal Services" Government of the Russian Federation decides:

1. Approve enclosed:

Rules of use of the simple digital signature when rendering the state and municipal services;

changes which are made to the requirements to the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically" approved by the order of the Government of the Russian Federation of November 28, 2011 No. 977 "About the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically" (The Russian Federation Code, 2011, No. 49, Art. 7284; 2012, No. 39, Art. 5269).

2. Determine that:

before approval of requirements to forms of statements, the stipulated in Item 17 Rules approved by this resolution, the application can be submitted in a free form on condition of accomplishment of provisions of paragraphs of the first or the second specified Item;

the persons which were registered by the federal state information system "Single Portal of the State and Municipal Services (Functions)" before entry into force of the Rules approved by this resolution, having the right to use for the request for receipt of the state and municipal services as key of the simple digital signature the insurance number of the individual ledger account and the password created in case of the specified registration.

Rules of use of the simple digital signature when rendering the state and municipal services

I. General provisions

1. These rules establish procedure for use of the simple digital signature by any persons (further - applicants) in case of the request for receipt of the state and municipal services electronically rendered by federal executive bodies, the state corporations which according to the Federal Law are given authority on provision of the state services in the established field of activity, bodies of state non-budgetary funds, executive bodies of subjects of the Russian Federation, local government bodies, and also behind receipt of services which list is established by the Government of the Russian Federation and which are provided by the public and local government offices and other organizations in which the state task (order) or municipal task (order) for provision of such services is placed (further respectively - services, contractors of services).

2. The simple digital signature is the digital signature which by means of use of key idle time of the digital signature (further - key) confirms the fact of forming of the digital signature by the specific applicant.

3. Key is the combination of 2 elements - the identifier and the password of key. The identifier is the insurance number of the individual ledger account of the applicant - physical person or the head or other official of the applicant authorized by it - the legal entity (further - the authorized person), and the password of key - the sequence of symbols created according to these rules.

In case of use of the simple digital signature in case of design of the personified card for visit of sports competition the applicant's identifiers - physical person are the subscriber number allocated with the operator of mobile radiotelephone communication (for foreign citizens and stateless persons - in the presence), and the e-mail address.

4. Use by the applicant of the simple digital signature, including by means of the subscriber device of mobile radiotelephone communication, for receipt of the state or municipal service and the order result of provision of the state or municipal service, including for transfer of result of service to the third parties, is allowed if the Federal Laws or other regulatory legal acts do not establish use for this purpose of other type of the digital signature.

Use of the simple digital signature for receipt of the state or municipal service and the order result of such service is performed with use of the infrastructure providing information and technological interaction of the information systems used for provision of the state and municipal services and execution of the state and municipal functions electronically.

In case of use of the subscriber device of mobile radiotelephone communication for use of the simple digital signature the subscriber number allocated with the operator of mobile radiotelephone communication shall be confirmed by the user in the corresponding register of the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically" (further - single system of identification and authentication).

4(1). Signing by the applicant of information electronically with use of key of the simple digital signature for receipt of the state and municipal service and (or) transfer of its result to the third parties by means of the subscriber device of mobile radiotelephone communication is performed by the direction with use of the specified device of responses of the applicant to the requests about committed actions created and directed by the operator of the federal state information system "Single Portal of the State and Municipal Services (Functions)" according to the requirements established by the Ministry of digital development, communication and mass communications of the Russian Federation.

Signing by the applicant of information electronically with use of key of the simple digital signature for making with use of single system of identification and authentication of significant actions which list affirms the Government of the Russian Federation according to Item 14 of article 46 of the Federal law "About Communication" is performed at the choice of the applicant by use by the applicant of confirmation code of making of the significant action directed to it to the user equipment (the terminal equipment) incorporating the identification module including in the form of the short text message or by use of single system of identification and authentication and single biometric system.

5. The address of applicants - legal entities behind receipt of the state and municipal services is performed by signing of the address by the authorized person with use of the simple digital signature.

6. For use of the simple digital signature the applicant according to these rules shall be registered in single system of identification and authentication, except for uses of the simple digital signature in case of design of the personified card for visit of sports competition, on condition of entering by such applicant into single system of identification and authentication of information about the of surname, name, middle name (in the presence), and also the subscriber number allocated with the operator of mobile radiotelephone communication (for foreign citizens and stateless persons - in the presence), and e-mail addresses.

II. Rules of creation and issue of keys

7. The right of creation (replacement) and issue of key for the purpose of rendering the state and municipal services the bodies and the organizations connected to the infrastructure providing information and technological interaction of the information systems used for provision of the state and municipal services electronically have (further - operators of issue of key), including:

a) the bodies specified in Item 1 of article 2 of the Federal law "About the Organization of Provision of the State and Municipal Services", providing the state services in case of the address for which obtaining allows use of the simple digital signature;

b) the bodies providing municipal services in case of the address for which obtaining allows use of the simple digital signature;

c) the organizations participating in provision of the state and municipal services according to part 2 of article 1 of the Federal law "About the Organization of Provision of the State and Municipal Services" in case of the address for which obtaining allows use of the simple digital signature;

d) the organizations organizing provision of the state and municipal services in case of the address for which obtaining allows use of the simple digital signature;

e) banks;

e) other bodies and the organizations in the cases provided by acts of the Government of the Russian Federation.

8. Creation (replacement) of key is performed with use of service of generation of key of single system of identification and authentication. Service of generation of key of single system of identification and authentication creates the password of key with use of the cryptography (cryptographic) tool which underwent assessment procedure of compliance in Federal Security Service of the Russian Federation on class not below than KC2.

The applicant has the right to self-construct replacement of the key with use of service of generation of key of single system of identification and authentication with use of the federal state information system "Single Portal of the State and Municipal Services (Functions)", and also with use of regional portals of the state or municipal services if technically possible of accomplishment of such transactions in the specified information systems.

In case of use of the simple digital signature in case of design of the personified card for visit of sports competition the applicant has the right to create independently key with use of service of generation of key of single system of identification and authentication with use of the federal state information system "Single Portal of the State and Municipal Services (Functions)".

9. The created password of key shall conform to the following requirements:

a) contain at least 8 symbols;

b) contain alphabetic and (or) digital symbols;

c) not contain symbols "*" or "#".

10. Creation (replacement) and issue of key for use for the purpose of receipt of the state and municipal services is performed gratuitously.

11. Operators of issue of key shall provide confidentiality of key.

12. When using the simple digital signature the applicant shall be informed by the operator of issue of key of rules of use of the simple digital signature.

13. The applicant - the owner of key shall:

a) keep in secret key, take all feasible measures preventing violation of its confidentiality;

b) create the simple digital signature with use of the key received according to the procedure, established by these rules;

c) in case of violation of confidentiality of key or its loss without delay to notify on it the operator of issue of key or the operator of single system of identification and authentication.

14. Civil responsibility for the negative effects which were caused non-compliance by the applicant with obligations, stipulated in Item 13 these rules is born by the applicant.

15. The applicant independently performs the choice of the operator of issue of key which he addresses for creation (replacement) and issue of key.

The operators of issue of key specified in subitems "an" and "b" of Item 7 of these rules and also the multipurpose centers of provision of the state and municipal services shall provide to the applicant filing of application in case of personal acceptance.

In case of the address of the applicant to other operators of issue of key the method of the address specified by the paragraph to the second this Item can be used only if organizational and technical features of activities of the operator of issue of key can provide its realization. The operator of issue of key places data on such opportunities or their absence on the Internet, including on the single portal.

The applicant has the right to submit the application electronically in case of the address to any operator of issue of key specified in these rules.

16. In case of the applicant's appearance on personal acceptance creation (replacement) and issue of key are performed by the operator of issue of key in day of the address based on the written application in case of presentation of the main identity document of the citizen of the Russian Federation, or the identity document of the foreign citizen or stateless person, and for the authorized person - besides, the document confirming its right to act on behalf of the legal entity.

16(1). In case of the applicant's appearance on personal acceptance creation (replacement) and issue of key of the simple digital signature based on the written application are performed by the operator of issue of key after obtaining from the applicant - physical person of the answer directed with use of the subscriber device of mobile radiotelephone communication to the inquiry sent by the operator of single system of identification and authentication the requirements established by the Ministry of digital development, communication and mass communications of the Russian Federation of the subscriber number allocated with the operator of mobile radiotelephone communication, specified in the application on issue of the simple digital signature submitted to the operator of issue of key.

17. In the application submitted by the applicant - physical person, surname, the name, middle name (in the presence), the insurance number of the individual ledger account, floor, birth date, details of the main identity document of the citizen of the Russian Federation, or the identity document of the foreign citizen or stateless person, data on nationality (in the presence), identification taxpayer number (in the presence), the residential address (registration), the subscriber number allocated with the operator of mobile radiotelephone communication (for foreign citizens and stateless persons - in the presence), the e-mail address, consent to processing of personal data shall be entered.

In the application submitted by the applicant - the legal entity or accredited branch, representation of foreign legal entities, the information about person provided by paragraph one of this Item, being sole executive body of the legal entity or the head of accredited branch, representation of the foreign legal entity, the name and the location of the legal entity or accredited branch, representation of the foreign legal entity, identification taxpayer number - the legal entity or accredited branch, representation of the foreign legal entity, the primary state registration number of the legal entity or number of record about accreditation of accredited branch, representation of the foreign legal entity shall be specified.

18. The operator of issue of key has no right to authorize other legal entity on creation (replacement) and issue of key.

If in the course of issue of key the operator of issue of key made mistake in case of identification of the applicant, civil responsibility, and in the cases established by the Federal Laws, other responsibility for the adverse effects which were caused the made mistake for participants of the relations is born by the operator of issue of key who made such mistake.

19. In case of receipt of key by filing of application electronically the operator of issue of key provides to the applicant possibility of implementation of independent registration in single system of identification and authentication with use of the corresponding service of single system of identification and authentication.

20. Independent registration of the applicant in single system of identification and authentication is performed according to the procedure, the provided Rules of use of the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically" approved by the order of the Government of the Russian Federation of July 10, 2013 No. 584 "About use of the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically".

The key idle time of the digital signature is issued to the applicant by methods and with observance of the conditions provided by Items 21 and 22 of these rules after registration of the applicant in single system of identification and authentication.

The application can be submitted with use of regional portals of the state and municipal services if other is not provided by regulatory legal acts of subjects of the Russian Federation.

21. In case of filing of application electronically the applicant has the right to specify in him one of the following of methods of receipt of key, available at operators of issue of key:

a) directly at the operator of issue of key;

b) by the direction the operator of issue of key of the registered mailing with the assurance of receipt;

c) by use of the individual means of communication of the applicant providing possibility of receipt of key by e-mail of the applicant or by means of the short text message on the subscriber number allocated with the operator of mobile radiotelephone communication, the applicant.

If organizational and technical features of activities of the operator of issue of key do not allow it to perform issue of key to the applicant directly at the operator of issue of key and (or) by the direction the operator of issue of key of the registered mailing with the assurance of receipt, the operator of issue of key places information on it on the Internet, including on the single portal, and in places of issue of key (in case of their availability).

21(1). Forms of the statements provided by these rules affirm operators of issue of key according to the requirements approved by the Ministry of digital development, communication and mass communications of the Russian Federation.

22. The operator of issue of key in case of receipt of key directly at it shall identify the applicant's personality - the physical person or the authorized person which addressed for receipt of key.

Paragraph two of ceased to be valid according to the Order of the Government of the Russian Federation of 13.08.2016 No. 789

Identification of the applicant can be performed one their following methods:

presentation by the applicant of the main identity document of the citizen of the Russian Federation, or the identity document of the foreign citizen or stateless person, and the authorized person - also the document confirming its right to act on behalf of the legal entity (in case of filing of application in case of personal acceptance);

confirmation of the data provided by the applicant by use of individual means of communication of the applicant (e-mail or the device of mobile radiotelephone communication of the applicant). In this case identification of the applicant is made by the operator of issue of key by comparison of information provided by the applicant to information containing in the state and (or) municipal information systems and receipt of positive result of such comparison.

The operator of issue of key enters into single system identifications and authentications of the data on method of identification of the applicant according to the regulations on the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically" approved by the Ministry of digital development, communication and mass communications of the Russian Federation.

23. Check of authenticity of the simple digital signature which signs the appeal is performed by the contractor of service with use of the corresponding service of single system of identification and authentication.

24. The operator of single system of identification and authentication provides to bodies (organizations) specified in article 1 of the Federal law "About the Organization of Provision of the State and Municipal Services", automatic information access containing in single system of identification and authentication for the purpose of check of authenticity of the simple digital signature.

The procedure for information access, the identification containing in single system and authentication, for the specified purposes establishes the Ministry of digital development, connection and mass communications of the Russian Federation.

25. Person, whose right was violated, has the right to file personally to the operator of issue of key the statement of fact of use of the simple digital signature of the specified person by inadequate person for recovery of the violated right personally or through the authorized person.

In case of the address of the applicant (authorized person) the operator of issue of key cancels the password of the simple digital signature within one day from the date of receipt of the specified statement.

Changes which are made to requirements to the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically"

1. Add Item 5 with subitems "d" and "e" of the following content:

"e) creation of the password of key of the simple digital signature on the basis of the initial key information provided by Federal Security Service of the Russian Federation for physical persons and legal entities for the purpose of the request for receipt of the state and municipal services electronically rendered by federal executive bodies, bodies of state non-budgetary funds, executive bodies of subjects of the Russian Federation and local government bodies and also for receipt of services which list is established by the Government of the Russian Federation and which are provided by the public and local government offices and other organizations in which the state task (order) or municipal task (order) for provision of such services is placed;

e) automatic provision at the request of the bodies and the organizations having the right to creation (replacement) and issue of keys of the simple digital signature for the purpose of rendering the state and municipal services, the password of key of the simple digital signature for physical person or legal entity.".

2. Add Item 6 with the subitem "e" of the following content:

"e) the register of the bodies and organizations having the right of creation (replacement) and issue of key of the simple digital signature for the purpose of rendering the state and municipal services.".
