3) the order of the Minister of Education and Science of the Republic of Kazakhstan of June 17, 2011 No. 258 "About modification of the order of the Minister of Education and Science of the Republic of Kazakhstan of February 7, 2011 No. 41 "About approval of coefficients of allowances to official pay rates of rectors of higher educational institutions";
4) the order of the Minister of Education and Science of the Republic of Kazakhstan of March 27, 2012 No. 126 "About introduction of amendments to the order of the Minister of Education and Science of the Republic of Kazakhstan of February 7, 2011 No. 41 "About approval of coefficients of allowances to official pay rates of rectors of higher educational institutions".

1. The procedure for determination of the salary fund, payment terms of work, awarding of leading employees of the state companies on the right of economic maintaining (further - the Procedure) is developed based on article 138 of the Law of the Republic of Kazakhstan "About state-owned property", the Labor code of the Republic of Kazakhstan for the purpose of ensuring single approaches in questions of determination of the salary fund, payment terms of work, awarding of leading employees of the state companies on the right of economic maintaining (further - the companies).
2. The basic concepts used in this Procedure:
1) the salary fund - the money intended for compensation of employees of the company according to the wages system developed by the company and material stimulation and this Procedure;
2) compensation - system of the relations connected with ensuring obligatory payment to the worker of remuneration for its work according to the Labor code of the Republic of Kazakhstan and this Procedure;
3) leading employees are the workers holding the positions specified in Item 3 of article 138 of the Law "About State-owned Property";
4) official pay rate - the fixed amount of compensation of the worker in month for accomplishment of regulations of work (labor obligations) taking into account qualifications of the worker, complexity, quantity, quality and conditions of the performed work;
5) remuneration following the results of work in year - the award paid to leading employees of the companies once a year depending on results of work for the purpose of financial incentive of the achieved success and increase in overall performance.
Remuneration following the results of work in year has no permanent character.
3. Compensation and awarding of leading employees of the companies is made at the expense of the means provided on compensation in the development plan, approved by the Ministry of Education and Science of the Republic of Kazakhstan (further - MAUN RK).
4. The salary fund of the company shall not exceed 70 percent from the income of the company (the grant does not join).
5. The size of the salary of leading employees is determined differentially taking into account complexity and amount of the performed work, feature and scales of activities and the related risks, specifics of work.
6. Compensation of leading employees of the companies is performed in the following sizes:

* - in compensation of leading employees of the state higher educational institutions in form of business of the state companies on the right of economic maintaining having special status the raising 1,75 coefficient is considered.
7. Payment of remuneration (awards) following the results of work in year is made for strengthening of material interest of leading employees of the company in increase in production efficiency and quality of work.
8. Remuneration following the results of work (award) in year is paid to leading employees by results of financial year after approval in accordance with the established procedure of results of financial and economic activities (development plan) of the company on the basis of the audited financial reporting.
9. The compulsory provision for payment of remuneration following the results of work (awards) to leading employees of the company are respect for financial discipline, licensed requirements, high-quality accomplishment of authorized activities of the company and job responsibilities.
10. Amount of remuneration following the results of work for year (awards) to leading employees is determined on the basis of assessment of activities of each worker and depends on qualitative and quantitative indices of accomplishment of the development plan for the company and there cannot be more than four monthly sizes of official pay rate.
11. Remuneration following the results of financial year is not made in the presence of authority punishments in the expired year. In the presence of authority punishment in the current year by results of the previous financial year in results of the current year it is not considered.
12. Individual amount of remuneration following the results of work for year (awards) to leading employees of the company is determined by the order my RK.
13. MAUN RK has the right in addition to award leading employees.
14. Rendering financial support to the leading employee, on condition of availability of appropriate means (but no more than two monthly official pay rates), can be performed in connection with difficult financial position in cases:
1) marriages;
2) births of the child, adoption or adoption of children;
3) the treatment requiring additional finance costs (stationary or out-patient treatment lasting more than ten calendar days, except sanatorium);
4) causings property harm to the leading employee owing to making concerning its illegal actions (robbery, theft), and also natural disasters (the fire, flood, earthquake);
5) retirement;
6) the death of members of his family, close relatives (the parents, spouses, brothers, sisters, children, adoptive parents adopted grandfathers, grandmothers, grandsons).
15. In case of the death of the leading employee the lump-sum allowance in the amount of two monthly official pay rates is paid to members of his family.
16. By provision of annual paid labor leave the benefit for improvement to labor leave in the amount of one monthly official pay rate is paid to the leading employee.
17. Payment of financial support and benefit for improvement to heads is performed according to the order to MAUN RK, deputies, the chief accountant - the order of the head of the organization of education.
18. Calculation of the average salary of the leading employee is made according to the procedure, established by the legislation of the Republic of Kazakhstan, without remuneration following the results of work in year.
