Procedure for registration of contracts (agreements) and agreements in customs authorities of the Republic of Uzbekistan

This Procedure according to presidential decrees of the Republic of Uzbekistan of April 11, 1995 No. UP-1096 "About Additional Measures for Streamlining of Export-import Transactions", of October 10, 1997 No. UP-1871 "About Additional Measures for Commodity Export Stimulation (Works, Services)", of February 18, 1998 No. UP-1930 "About Additional Measures for Streamlining of Import Transactions", and also resolutions of the Cabinet of Ministers of the Republic of Uzbekistan of March 13, 1996 No. 95 "About measures for enhancement of control of use of means in foreign currency when implementing the foreign trade transactions", of August 13, 1996 No. 280 "About measures for reducing export-import transactions on barter basis", of April 15, 1999 No. 174 "About measures for increase in efficiency of stock and fair trade", of May 6, 1999 No. 223 "About measures for further enhancement of stock and fair trade in the Republic of Uzbekistan", of September 30, 2003 No. 416 "About measures for further enhancement of monitoring of export-import transactions" is directed to the organization of registration of contracts in foreign trade in customs authorities of the Republic of Uzbekistan.

I. General provisions

1. The contracts in foreign trade specified in Items 5 and 6 of this procedure in which movement of goods through customs border of the Republic of Uzbekistan, and also supplementary agreements which are their integral part is provided are subject to registration in customs authorities.

2. According to contracts in foreign trade, the electronic database with entering in the relevant magazines on their accounting is created.

3. In this Procedure the following concepts are applied:

the export contract - the contract signed on commodity exportation out of limits of customs area without obligation of their return import;

the paragraph third is excluded according to the Resolution registered by the Ministry of Justice of the Republic of Uzbekistan of 21.12.2012 No. 832-7

the consignment export contract - the contract signed between the export consignor and the consignee on sales of goods through the consignee when the property right to the goods which arrived on the consignee's warehouse remains for the export consignor until sale of goods to the buyer;

the consignment contract - the contract signed between the consignor and the consignee for sales of goods through the consignee when the property right to the goods which arrived on the consignee's warehouse remains for the consignor until sale of goods to the buyer;

the exchange (fair) contract - the contract signed at the exchange (fair) biddings, payment and the calculation by which it is provided both in national currency of the Republic of Uzbekistan of "bags", and in freely convertible currency registered by the exchange (fair);

the agreement (protocol) - the foundation agreement (charter), the protocol of intentions, the contract signed on import (export) of goods for forming of authorized fund of the legal entity;

the barter contract - the contract providing exchange of certain quantity of one goods (or several types of goods) on others without implementation of settlement in money.;

Combination of the leasing recipient and producer in one person is allowed if the lessor acquires property at future user or when the lessor finances the producer for the purpose of acquisition of property at it for the subsequent delivery it on leasing to the same person.

the contract according to the intergovernmental agreement - the contract on mutual offsetting of counter monetary claims in delivery type of different goods, the obligation fulfillments before each other arising in foreign trade signed on the basis of the intergovernmental agreement (protocol).

II. Procedure for registration of contracts in customs authorities of the Republic of Uzbekistan

4. Registration in customs authorities of contracts in foreign trade (including supplementary agreements), signed by business entities, is performed after their registration in authorized bodies (if such registration is necessary) within 2 working days from receipt date of the statement in customs authorities.

5. The State Customs Committee of the Republic of Uzbekistan is registered:

the export contracts for the goods provided in appendices No. No. 1, 2 and 4 to the Presidential decree of the Republic of Uzbekistan of October 10, 1997 No. UP-1871 "About Additional Measures for Commodity Export Stimulation (Works, Services)", exported from the Republic of Uzbekistan in centralized procedure;

the barter contracts signed according to intergovernmental agreements and orders of the Cabinet of Ministers of the Republic of Uzbekistan, registered in accordance with the established procedure in the Ministry of Foreign Economic Relations, Investments and Trades of the Republic of Uzbekistan;

the exchange and fair contracts registered according to appendices No. No. 2 and 3 to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of April 15, 1999 No. 174 and appendix No. 1 to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of May 6, 1999 No. 223, on which is provided shipment of the highly liquid and quota goods, and also shipment on which is made from several areas;

the contract according to the intergovernmental agreement.

6. Territorial administrations of the State Customs Committee of the Republic of Uzbekistan are registered:

export contracts (including consignment export contracts) on the goods provided in appendices No. No. 1, 2 and 4 to the Presidential decree of the Republic of Uzbekistan of October 10, 1997 No. UP-1871 "About Additional Measures for Commodity Export Stimulation (Works, Services)";

the barter contracts registered in accordance with the established procedure in territorial authorities the Ministry of Foreign Economic Relations, Investments and Trades of the Republic of Uzbekistan according to requirements of the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of August 13, 1996 No. 280 "About measures for reducing export-import transactions on barter basis";

the exchange and fair contracts signed at the exchanges and fairs located in the location of the relevant territorial customs authorities;

The contracts in foreign trade signed in the conversion mode are determined by other provision.

7. Business entities with use of the digital signature shall enter into the Single electronic information system of the foreign trade transactions (further - EEISVO) data:

according to the contracts in foreign trade and supplementary agreements which are subject to registration in customs authorities before filing of application about registration of the contract;

according to other contracts in foreign trade and supplementary agreements, and also agreements (protocols) or contracts on a grant basis, before submission of the cargo customs declaration in customs authority.

III. The list of the documents necessary for registration of contracts in customs authorities of the Republic of Uzbekistan

8. For registration of contracts (agreements) of agreements the following documents are submitted to customs authorities:

1) statement for registration of the contract;

3) ceased to be valid according to the Resolution registered by the Ministry of Justice of the Republic of Uzbekistan of 20.10.2015 No. 832-9

5) the Original of the contract registered and which is drawn up by authorized bodies (if such registration is necessary) and its copy;

6) ceased to be valid according to the Resolution registered by the Ministry of Justice of the Republic of Uzbekistan of 20.10.2015 No. 832-9

7) ceased to be valid according to the Resolution registered by the Ministry of Justice of the Republic of Uzbekistan of 20.10.2015 No. 832-9

8) ceased to be valid according to the Resolution registered by the Ministry of Justice of the Republic of Uzbekistan of 27.08.2014 No. 832-8

9) the resolution, the order of the Cabinet of Ministers of the Republic of Uzbekistan which are the basis for the conclusion of the contract (agreement), the agreement in the cases established by the legislation;

10) ceased to be valid according to the Resolution registered by the Ministry of Justice of the Republic of Uzbekistan of 20.10.2015 No. 832-9

11) the legal conclusion of the Cabinet of Ministers of the Republic of Uzbekistan, on delivery of goods within the technical or humanitarian assistance, on a grant basis.

9. Ceased to be valid according to the Resolution registered by the Ministry of Justice of the Republic of Uzbekistan of 12.01.2017 No. 832-10

10. The contract in foreign trade, and also necessary documents attached to it submitted with violation of established procedure return to the applicant in writing with indication of the reasons. In case of elimination of all reasons of their return specified in the letter the contract is subject to obligatory registration.

IV. Monitoring of execution of contracts in foreign trade in customs authorities

11. The contracts in foreign trade providing movement of goods through customs border of the Republic of Uzbekistan, concluded between residents and nonresidents of the Republic of Uzbekistan are subject to monitoring in customs authorities through EEISVO.

12. Information containing in EEISVO is confidential and is not subject to disclosure.

13. Declare invalid the "Procedure for registration of contracts (agreements) and agreements in customs authorities of the Republic of Uzbekistan" registered by the Ministry of Justice of October 20, 1998 No. 507.
