About approval of the Regulations on All-Ukrainian student council under the Ministry of Education and Science of Ukraine

According to article 18 of the Law of Ukraine "About the higher education", and for the purpose of providing effective solution of problems of students, to realization of state policy in the field of science and education, and also development of student's self-government in higher educational institutions I ORDER:

1. Approve Regulations on All-Ukrainian student council under the Ministry of Education and Science of Ukraine which is applied.

2. To department of the higher education (Korovaychenko Yu. M.) provide in accordance with the established procedure submission of this order to the Ministry of Justice of Ukraine on state registration, and also placement on the official website of the Ministry (www.mon.gov.ua).

3. To impose control over the implementation of the order on the first deputy Minister Sulima E. M.

4. This order becomes effective from the date of its official publication.

Regulations on All-Ukrainian student council under the Ministry of Education and Science of Ukraine

I. General provisions

1. This Provision regulates activities of All-Ukrainian student council under the Ministry of Education and Science of Ukraine (further - Council) which is formed for the purpose of forming and realization of state policy in the field of science and education and development of student's self-government in higher educational institutions of Ukraine.

2. Council is permanent advisory advisory body of the Ministry of Education and Science of Ukraine (further - MON of Ukraine).

3. Bodies of student's self-government of higher educational institutions of Ukraine on a voluntary basis are part of Council.

4. Council operates on the principles of democratic character, voluntariness, equality of all his members, self-government, legality and publicity.

5. Council in the activities is guided by the Constitution and the laws of Ukraine, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, other acts of the legislation and this Provision.

6. Each person who studies in higher educational institution of Ukraine has the right to be elected to bodies of Council.

7. MON of Ukraine comprehensively promotes creation of proper conditions for activities of Council.

II. Purpose and tasks of Council

1. The purpose of activities of Council is assistance to creation of conditions for self-realization of the identity of students, to increase in their social activity, forming at students of organizing skills, leadership skills, to increase in responsibility for result of the work, and also enhancement of educational process, training improvement of quality, ensuring education of spirituality and culture of students.

2. The main objectives of Council are:

comprehensive assistance to creation and development of student's self-government in higher educational institutions;

assistance to providing continuous communication and coordination of actions between MON of Ukraine, other public authorities, local government bodies and bodies of student's self-government of higher educational institutions according to the problem resolution of students, and also in case of development and accomplishment of state programs in the field of the higher education, science, social formation and development of student's youth;

studying and the analysis of public processes in the field of the higher education, science, social formation and development of student's youth, development and introduction by results of such analysis of relevant proposals MON of Ukraine and to other public authorities and local self-government;

preparation of offers on forming and realization of state policy in the field of the higher education, science, sport and youth policy, and also offers concerning ways, mechanisms and methods of the solution of social and economic problems of students;

assistance to creation of conditions for free development of the identity of the student by attraction it to various types of creative activities, in particular research, professional, cultural, public, sports;

representation at the international and nation-wide levels of interests of the Ukrainian students;

participation in preparation of offers on project development of regulatory legal acts and programs for the most important questions of public life, legal and social protection of students;

participation in preparation and the projects implementation directed to the solution of social and economic, legal, educational, cultural and other problems of student's youth;

assistance:

to expansion of regional, All-Ukrainian and international cooperation in the field of the higher education, science, youth, social formation and development of student's youth;

to forming of legal civil society, national civic stand of the student, education of political, economic, legal culture, forming of the specialist of new generation, the intellectual, owner in the state;

to all-round harmonious development of students, their spiritual and physical enhancement, education at them of patriotism, respect for Ukraine, and also feelings of national consciousness and advantage, etc.;

to employment of graduates of higher educational institutions and students in non-study time;

participation in preparation and implementation of the actions directed to involvement of students to social and economic, cultural life of society, increase in social growth and scientific activity of students;

development of interrelations, implementation of exchange of delegations and other types of cooperation with the companies, organizations and organizations of all patterns of ownership and citizens.

3. Council according to the tasks assigned to it has the right:

take part in project development of regulatory legal acts on the questions which are within its competence, in particular the higher education;

receive in accordance with the established procedure from the central and local authorities of the government, local government bodies, the companies, organizations and the organizations information necessary for accomplishment of the tasks assigned to Council;

recruit in the work representatives of the central and local authorities of the government, local government bodies, the companies, organizations and the organizations (in coordination with their heads), and also independent experts (under approval);

exercise public control over accomplishment of the Law of Ukraine "About the higher education", other acts of the legislation of Ukraine concerning the organization and ensuring activities of bodies of student's self-government, ensuring protection of the rights and interests of persons which study in higher educational institutions, concerning their participation in management of activities of higher educational institutions;

organize student's conferences, seminars, meetings of "round tables", meetings, public hearings, scientific, cultural and mass, sporting and other events on the questions which are within the competence of Council;

popularize the purpose and tasks of activities of Council among students;

develop the international student's cooperation on experience exchange;

light in mass media the line item on the most important questions of student's life;

appeal in the procedure established by the legislation in the instances of higher level of action of officials, administrations of higher educational institutions and bodies of student's self-government limiting the rights of students;

cooperate and coordinate the activities with other youth (student's) associations, cells, etc. which activities have no political or religious nature;

perform other actions following from the purpose of activities of Council and are not prohibited by the legislation of Ukraine.

4. Council shall:

give help to MON of Ukraine in accomplishment of the tasks directed to improvement of conditions and quality of training, and also conditions of life and rest of students, realization of their creative potential;

provide respect for constitutional rights and freedoms of students;

promote accomplishment by students of the obligations;

lift problems of students before MON of Ukraine;

inform students on innovations in the field of the higher education and on results of activities of Council;

approve in the procedure for change established by the legislation in the Provision and other questions requiring consideration at meeting of board of MON of Ukraine.

III. Membership in Council

1. The body of student's self-government of higher educational institution of Ukraine which can be the member of council:

it is elected students;

supports the purposes and tasks of Council.

2. For acquisition of membership in Council the body of student's self-government of higher educational institution shall give to the secretariat of Council:

the statement on the accession to Council;

the copy of regulations on student's self-government of the higher educational institution approved in the procedure established by the legislation;

the protocol of body of student's self-government with the decision on the accession to Council.

3. For exit from Council the body of student's self-government shall submit to the secretariat of Council the application and the minutes of body of student's self-government with the decision on exit from Council.

ІV. Governing bodies and persons of Council

1. The central governing bodies of Council are:

conference;

presidium.

The head of Council is the chairman.

2. Regional governing bodies of Council are:

republican (in the Autonomous Republic of Crimea), regional and city (in the cities of Kiev and Sevastopol) boards.

V. Conference

1. The supreme body of management of Council is the conference which gathers at least, than once a year.

2. On conference each of bodies of student's self-government of higher educational institutions which are members of council delegates one representative.

3. Powers of the delegate are confirmed by the minutes of body of student's self-government of the corresponding higher educational institution.

4. The secretariat informs bodies of student's self-government of higher educational institutions not later than month about day of its carrying out on the place and time of holding conference. Members of council shall notify the secretariat not later than two weeks before holding conference on receipt of the invitation and election of the delegate.

5. Extraordinary conferences are convened by presidium or according to the decision at least than one third of bodies of student's self-government of the higher educational institutions which are members of council.

6. The conference is considered competent if at it there are at least than two thirds of delegates.

7. Conference:

1) elects the chairman who directs work of conference, and the secretary of conference who takes the protocol and together with the chairman signs it;

2) is accepted by regulations of conference, make decisions on any questions following from the purpose and tasks of activities of Council;

3) elects the chairman of the board, hears the report and gives assessment to activities of the chairman and governing bodies of Council;

4) determines the main activities and developments of Council;

5) approves the program of activities of Council for the next period (year).

8. Decisions of conference are obligatory for accomplishment by all members of council.

VI. Presidium

1. The leading collegiate organ during the period between conferences is the presidium which is convoked by the secretariat at least once in three months. The secretariat informs members of presidium on time and the place of meeting not later than two weeks before its carrying out.

2. The chairman, vice-chairmen, the secretary and on one representative from the Autonomous Republic of Crimea, each area, the cities of Kiev and Sevastopol which are chosen at meetings republican (in the Autonomous Republic of Crimea), regional and city (in the cities of Kiev and Sevastopol) boards for a period of one year by secret vote are part of presidium. The citizen who on the election day is person who studies can be elected the member of presidium.

3. Form of work of presidium is the meeting. The meeting is conducted by the chairman, and in its absence - one of deputies. Preparation of materials for consideration at meetings of presidium is provided by the secretariat.

4. The meeting of presidium can be closed according to the decision of presidium.

5. The meeting of presidium is competent if at it there are at least than two thirds of his members. Decisions are made by a simple majority vote the members who are present at meeting.

6. At meetings of presidium the chairman, vice-chairmen, the secretary and members of presidium have the right to vote.

7. Presidium:

submits offer conferences concerning perspectives of activities of Council;

provides accomplishment of decisions of conference, in particular, develops the actions plan and submits the report on their accomplishment;

determines date and elects organizing committee of conference;

submits for consideration to MON of Ukraine proposals concerning the organization of educational process, ensuring social, improving and cultural needs of students;

prepares and submits for consideration to MON of Ukraine proposals on the organization of consultations with bodies of student's self-government;

on representation of the chairman elects vice-chairmen and the secretary, and also heads of departments, departments, the centers, sectors and other structural divisions which form the secretariat;

approves structure and the regulations of the secretariat;

forms the permanent and temporary commissions;

makes the decision on holding extraordinary conference. The decision is made by at least than two thirds of voices of the members who are present at meeting;

resolves other issues following from the purposes and tasks of activities of Council.

8. Decisions of presidium are drawn up in the form of the minutes which are signed by the chairman and the secretary. Copies of the protocol are sent to all members of presidium and MON of Ukraine.

9. The member of presidium who is not supporting its decision can state in writing the special opinion which is applied to the minutes.

10. Powers of the member of presidium can be stopped ahead of schedule:

for failure to carry out or inadequate accomplishment of the obligations or in case of absence without reasonable excuse at two meetings (according to the decision of presidium which is made by at least than two thirds of voices of the members who are present at meeting; with the obligatory preliminary written warning of the member of presidium of consideration of the matter at meeting);

according to the decision of board from which the member of presidium is elected;

based on the application in person of the member of presidium.

11. Executive body of Council is the secretariat which is headed by the chairman. The chairman, vice-chairmen, the secretary and heads of structural divisions (departments, departments, the centers, sectors, etc.) is part of the secretariat.

12. Secretariat:

will organize accomplishment of the current and perspective plans of activities of Council;

provides accomplishment of decisions of conference, presidium, the chairman;

keeps documentation of Council;

ensures functioning of presidium and other bodies of Council;

performs other functions assigned to it by conference, presidium, the chairman.

13. Meetings of the secretariat are held at least once a month.

14. Each meeting of the secretariat is drawn up by the protocol which is signed by the chairman (vice-chairman) and the secretary. Copies of the protocol go to all members of presidium. Upon the demand of presidium the chairman reports on work of the secretariat.

15. The secretary keeps protocols of meetings, accounting of accomplishment of decisions, is responsible for document flow and storage of documentation of Council.

16. Structural divisions (departments, departments, the centers, sectors, etc.) are associations on activity of students.

17. Work of structural division is directed by the head of the relevant structural division (department, department, the center, the sector, etc.).

18. The staff of structural division is determined by the head of the relevant structural division and affirms the chairman.

19. The work plan of structural division for academic year is the arranged list of actions with the detailed description and reasons for need of their carrying out which is developed by the relevant structural division and affirms the chairman.

20. The work plan of structural division is provided to the chairman by the head within two weeks after appointment, for forming of the general plan of work of the secretariat for academic year.

VII. Powers of the chairman

1. Council is headed by the chairman who is elected to conferences for a period of one year. Person who on the election day reached 18 years can be elected the chairman and is person who studies. Vote on elections is secret. Vote for other persons, and also transfer of voting power to any other person are prohibited.

2. Chairman:

performs the common directorship and represents Council in public authorities, local government bodies, and also at the companies, in organizations and the organizations;

is responsible for the organization of effective implementation by Council of the tasks and functions;

will organize accomplishment of decisions of conference and presidium;

coordinates implementation by bodies of Council of their powers;

submits in accordance with the established procedure for consideration of MON of Ukraine drafts of regulatory legal acts which developer is Council;

can be part of board of MON of Ukraine and participate in work of other joint working bodies and commissions of MON of Ukraine;

delegates the powers to vice-chairmen and distributes obligations between them;

approves programs and work plans of the secretariat, considers and approves the report on their accomplishment;

signs acts of Council;

reports at meetings of MON of Ukraine on the questions which are within the competence of Council;

gives for consideration of presidium of the candidate for positions of vice-chairmen and the secretary, and also heads of departments, departments, the centers, sectors and other structural divisions which form the secretariat. During the period between meetings of presidium has the right in case of need to appoint the acting as vice-chairmen, the secretary, heads of departments, departments, the centers, sectors and other structural divisions;

initiates holding extraordinary conference or emergency meeting of presidium;

performs other powers according to the legislation of Ukraine.

3. The secretariat declares holding conference on questions of election of the chairman not later than month before its carrying out. Registration of candidates for position of the chairman is performed by the secretariat based on the application in person of the candidate or representation of student's collectives (are drawn up by the protocol) which move no later than two weeks before elections then the secretariat informs all bodies of student's self-government of higher educational institutions which are members of council, about the registered candidates for the chairman's position.

4. The same person cannot be chairman more than two terms in a row.

5. In case of impossibility of accomplishment by the chairman of the obligations of its obligation one of vice-chairmen carries out.

6. Powers of the chairman stop ahead of schedule in case:

the application in person about resignation;

impossibility to carry out the powers for health reasons;

discharges from position if at conference at least than a half of delegates of structure of conference voted for it (vote is secret).

In case of early termination of powers of the chairman of its function the vice-chairman carries out. In this case within two months it shall be held conferences on election of the new chairman.

VIII. Board of the Autonomous Republic of Crimea, area, cities of Kiev and Sevastopol

1. Are part of board the member of presidium from the respective region and on one representative from each body of student's self-government of higher educational institution which is the member of council in the respective region.

2. The meeting of board is competent if at it there are at least than two thirds of her members. Decisions are made by a simple majority vote the members who are present at meeting.

3. Form of work of board is the meeting. The meeting is conducted by the member of presidium. Decisions of board are drawn up in the form of the minutes which are signed by the member of presidium and the secretary. Copies of the protocol go to all members of board and the chairman.

4. The decision of board of the region can be appealed in presidium.

5. The board elects the member of presidium from the respective region for a period of one year by secret vote.

6. The member of presidium will organize timely informing bodies of student's self-government of higher educational institutions of the Autonomous Republic of Crimea, the respective area, cities of Kiev and Sevastopol concerning upcoming events and the current activities of bodies of Council and attracts new members in its structure.

7. The member of presidium convenes meeting of board of the respective region at least once in three months.

8. For accomplishment of the current tasks by board the relevant regional secretariat can be created.

9. When implementing the powers the board can cooperate and coordinate the activities with Councils of rectors (directors) of higher educational institutions of the respective region, local executive bodies, local government bodies, regional youth (student's) associations, cells, etc.

IX. Ensuring activities of Council

Organizational, information, material logistics of activities of Council performs MON of Ukraine.

X. International activities of Council

1. Council can cooperate with bodies of student's self-government of higher educational institutions of foreign states, the international student's organizations and their associations within certain powers.

2. The conclusion of agreements, holding joint actions of the international level are performed in coordination with MON of Ukraine.

3. The international activities of Council shall promote forming of positive image of Council and state.
