According to the Law of the Republic of Uzbekistan "About mail service" (Collection of the legislation of the Republic of Uzbekistan, 2009, No. 17, the Art. 209), resolutions of the Cabinet of Ministers of the Republic of Uzbekistan of July 19, 2004 No. 339 "About enhancement of activities in the field of mail service" (Collection of the legislation of the Republic of Uzbekistan, 2004, No. 29, the Art. 330) and of December 19, 2012 No. 355 "About approval of regulations on the State committee of communication, informatization and telecommunication technologies of the Republic of Uzbekistan and about the State inspectorate for supervision in the field of communication, informatization and telecommunication technologies" (2012, No. 52, the Art. 589) the State committee of communication, informatization and telecommunication technologies of the Republic of Uzbekistan decides collection of the legislation of the Republic of Uzbekistan:

1. Approve Regulations on the state signs of post payment of the Republic of Uzbekistan, according to appendix.

2. Declare invalid the Order of the CEO of the Uzbek communication agency and informatization of September 19, 2005 No. 226 "About approval of the Regulations on the state signs of post payment and memorable special stamps of the Republic of Uzbekistan" (рег. No. 1516 of October 6, 2005) (Collection of the legislation of the Republic of Uzbekistan, 2005, No. 40, the Art. 314).

3. This Resolution becomes effective from the date of its official publication.

Regulations on the state signs of post payment of the Republic of Uzbekistan

This Provision determines procedure for the edition, issuance and withdrawal from it, the order, mailing and sale of stamps.

Chapter I. General provisions

1. This Provision regulates relations between the Ministry of digital technologies of the Republic of Uzbekistan (further - the Ministry), the national operator of mail service, operators, providers of mail service and users of services of mail service concerning the edition, issuance and withdrawal from it, the order, mailing and sale of stamps.

2. In this Provision the following basic concepts are applied:

internal written correspondence - written correspondence, acceptance and delivery (delivery) of which is performed in the territory of the Republic of Uzbekistan;

clearing - mark or other shtempelevanny sign of any type in stamp designating sending or receipt of the mailing, which is putting down manual stamp, by the shtempelevalny machine or ball pen for the purpose of suppression of reuse of stamp;

the state signs of post payment (SSPP) - the stamps and prints of cliche of franking machines put for payment confirmation of services of mail service on simple and the registered letters and parcels post, postcards sent through the national operator of mail service;

The catalog of stamps and prints of memorable special stamps of the Republic of Uzbekistan - the reference media representing the chronological list of stamps with additional data on them and prints of the memorable special stamps issued in connection with significant dates or outstanding events;  

brand of special release (kommemorativny) - the stamp issued to memorials, anniversaries or devoted to any events, subject;

the marked post envelope (card) - standard post envelope (standard postcard) with the typographical image on it (on it) stamp;

the international written correspondence - the written correspondence accepted in the territory of the Republic of Uzbekistan for delivery (delivery) out of limits of the Republic of Uzbekistan and arriving on its territory from foreign state or following en route;

overprint - any text or the drawing applied on the stamp face how it was printed and introduced into circulation, for designation of new nominal value or for change of other elements of brand;

the national operator of mail service - the operator of mail service to whom the Cabinet of Ministers of the Republic of Uzbekistan assigns functions on satisfaction of demand in the market of services of mail service, to obligatory provision of universal post services within the Republic of Uzbekistan and to accomplishment of the obligations following from acts of Universal Postal Union;

nominal value of stamp - the cost of services in transfer of the simple and registered letters and parcels post, postcards entering written correspondence specified on stamp by the Arab figures or Latin letters;

stamp sample - the printing project of stamp prepared by the organization having rights of production of forms of securities (further - the printing organization) on which the text "Sample", for check of its compliance to the sketch of stamp and the subsequent approval for printing is applied;

the operator of mail service - the legal entity owning network of mail service on the property rights or other corporeal rights and rendering services to mail service as core activity;

the original of stamp - the drawing which is initial basis for preparation of the sketch of stamp;

the memorable special stamp (MSS) - the stamp applied to special cancellation of postage stamps when holding the actions devoted to important state events, historical and memorable places, dates, exhibitions, etc.;

written correspondence - the simple and registered letters, postcards, parcels post, small packets, departures for blind people and sacks of "M";

the user of services of mail service (user) - the legal entity or physical person which is the consumer of services of mail service;

postcard - mailing type on the special form sent in open form which sizes are established by Rules of rendering services of mail service (рег. No. 2219 of April 18, 2011) (Collection of the legislation of the Republic of Uzbekistan, 2011, No. 16, the Art. 167);

the post block - one or several stamps printed in one and more ranks on special leaf and surrounded with wider than at brands, we weed;

stamp - the state sign of post payment produced by printing method with the art image, specifying of its nominal value and the country;

postage calendar stamp - the special stamp intended for cancellation of postage stamps and/or drawing on post, express departures, forms of postal money transfers and/or accompanying documents, receipts of the name of the corresponding object of mail service, direction of the mail van, date;

post envelope - squared paper cover of the established sizes with valves for zakleyka who serves for packaging of the written message;

provider of mail service - the legal entity rendering services to mail service through networks of operators of mail service;

series of stamps - number of the stamps devoted to single subject or certain event, having similar style of registration;

standard stamp - the stamp released in the mass edition and which is not memorable;

rate for services of mail service - the amount of payment for provision of services of mail service established by specially authorized body, the operator or provider of mail service according to the procedure, established by the legislation;

the thematic plan - the list of the series and separate stamps, the marked and philatelic products planned to release for certain period;

the franking machine - the machine intended for drawing on the simple and registered letters and parcels post, postcards of prints of the cliche confirming fee of mail service of the national operator of mail service, date of acceptance to given correspondence and other information entering written correspondence;

the art marked post envelope (card) - standard post envelope (standard postcard) with the typographical image on it (on it) stamp and art illustration;

the art marked post envelope (card) with original brand - the art marked post envelope (the art marked postcard) with the typographical image on it (on it) stamp which separately from this envelope (card) was not issued;

electronic brand - the stamp in the form of the bar post code identifier confirming fee of mail service, with the additional information pledged on it, intended for drawing on the non-registered and registered mail, postcards and parcels post;

the sketch of stamp - the drawing which is initial basis for preparation of sample of stamp.

3. GZPO according to the World post convention, the Regulations of the Convention, the Law of the Republic of Uzbekistan "About mail service", Rules of rendering services of mail service (рег. No. 2219 of April 28, 2011) are intended for fee of mail service, provided by the national operator of mail service on transfer of ordinary and registered internal and international written mail.

4. According to article 7 of the Law of the Republic of Uzbekistan "About mail service" approval of samples of GZPO, introduction of stamps in the address and their withdrawal from it, forming of the GZPO state collection, determination of procedure for production and use of memorable special stamps and determination of procedure for use of franking machines are performed by the Ministry.

5. The print of cliche of the franking machine confirming fee of mail service shall contain:

the name of the state Latin letters in state language - "O" zbekiston";

payment amount in the Arab figures or Latin letters;

registration number of the franking machine.

In optional procedure the print of cliche of the franking machine confirming fee of mail service is might contain by the word "Pochta" ("Mail").

6. For public review of GZPO published in the Republic of Uzbekistan, the Ministry creates the State collection of the state signs of post payment. The structure, appointment, procedure for forming, accounting and storage of the State collection of the state signs of post payment is determined by Regulations on the State collection of the state signs of post payment (рег. No. 2077 of February 4, 2010) (Collection of the legislation of the Republic of Uzbekistan, 2010, No. 5, the Art. 49).

Chapter II. Stamps

§ 1. Edition and issuance of stamps

7. Planning, the organization of the edition and supply with stamps, the marked post envelopes (cards), the art marked post envelopes (cards), including with original brands, is performed by the national operator of mail service (further - the national operator).

8. Stamps shall conform to requirements of the World post convention, the Constitution of the Republic of Uzbekistan, the laws and other regulatory legal acts.

Stamps shall reflect in the plots cultural and historical heritage of the people living in the territory of the Republic of Uzbekistan, flora and fauna, achievements in all knowledge domains, the main events of internal and international life and philately.

9. Stamps shall conform to requirements of O "z DSt 1129:2007" stamps. Specifications" and this provision.

10. The edition of stamps, the marked post envelopes (cards), the art marked post envelopes (cards), including with original brands, is made taking into account the most complete requirements satisfaction of the national operator, philatelists and users.

11. Order placement on production of stamps, the marked post envelopes (cards), the art marked post envelopes (cards), including with original brands is performed by the national operator.

12. Stamps, the marked post envelopes (cards), the art marked post envelopes (cards), including with original brands are printed in the printing organizations.

Stamps, the marked post envelopes (cards), the art marked post envelopes (cards), including with original brands can be printed abroad under the contracts which are drawn up according to the legislation.

13. Stamps, the art marked post envelopes (cards) with original brands are published based on the approved thematic plans of the edition of stamps, the marked and philatelic products and introduced into circulation by the Ministry of measure of their production.

Date of Introduction in the address of stamps, the art marked post envelopes (cards) with original brands is determined by the Ministry and brought by the national operator to the attention of the structural divisions, philatelists and users.

The marked post envelopes (cards), the art marked post envelopes (cards) are introduced into circulation by orders of the national operator in process of obtaining them from manufacturers.

The national operator conducts serial numbering (identification numbers) of the stamps introduced into circulation and post blocks. Identification number is appropriated to stamp and the post block by the Ministry of their introduction in the address.

14. The national operator issues the Catalogue of stamps and prints of memorable special stamps of the Republic of Uzbekistan and other advertizing products for philatelists and users.

The Catalogue of stamps and prints of memorable special stamps of the Republic of Uzbekistan joins the following additional data:

about stamps - date of issue, identification number, the name of series or event to which release, First name, middle initial, last name the artist or the designer, the short explanation of the image, chromaticity, seal method, paper type, the stamp size (the post block), quantity of stamps in leaf, information on perforation, nominal value, circulation and others is devoted;

about prints memorable special stamps - significant dates or events in connection with which the stamp, date and the venue of special clearing is issued are given the description of the drawing and print of stamp, identification number and the size of stamp, the information about the author.

Frequency of release of the Catalogue of stamps and prints of memorable special stamps of the Republic of Uzbekistan is determined by the national operator.

15. Practical work on release of stamps, the art marked post envelopes (cards) with original brands is based on the basis of perspective and annual thematic plans of the edition of stamps, the marked and philatelic products developed by the national operator with the assistance of the Commission on post issues and the Arts council created under the Ministry.

Enter tasks of the Commission on post issues:

determination of the general principles of emission policy;

consideration of thematic plans of the edition of stamps, the marked and philatelic products.

The commission on post issues is headed by one of deputy ministers of digital technologies, its structure can join specialists of the Ministry, the national operator, Ministry of Culture of the Republic of Uzbekistan and other relevant ministries, and departments, representatives of Society of philatelists of Uzbekistan.

Tasks of Arts council include determination of art level of the works prepared for the edition, on reflection of cultural and historical heritage of the people living in the territory of the Republic of Uzbekistan, flora and fauna, achievements in all knowledge domains, the main events of internal and international life in works of small printing form and also other tasks.

Arts council specialists of the Ministry, the national operator, the artists and art critics specializing in genre of small forms, specialists of the relevant ministries and departments, representatives of Society of philatelists of Uzbekistan can be included.

Regulations on the Commission on post issues and Arts council and their members affirm the minister of digital technologies in coordination with the relevant ministries and departments.

16. Practical work on release of the marked post envelopes (cards), the art marked post envelopes (cards) is performed on the basis of the perspective and annual thematic plans of the edition of the marked and philatelic products developed and approved by the national operator.

§ 2. Forming of thematic plans

17. When forming thematic plans the following principles are considered:

a) outstanding public and statesmen, scientists and cultures, arts can be represented on stamps, the art marked post envelopes (cards), including with original brands which are issued to anniversaries of birthday behind dates, to multiple 25 years, but not earlier than in 10 years after death.

In case of release of thematic series the variation from this requirement is allowed.

The image of persons specified in this subitem on stamps, the art marked post envelopes (cards), including with original brands, is made according to the legislation;

b) events of historical value, anniversaries of formation of the Republic of Karakalpakstan, the areas and cities which are part of the Republic of Uzbekistan, and also the organizations, including organizations, educational institutions can be displayed on stamps, the art marked post envelopes (cards), including with original brands by dates, multiple 50 years.

In case of release of thematic series the variation from this requirement is allowed;

c) production of overprints on stamps is made in exceptional cases according to the decision of the Ministry.

18. Forming of the thematic plan of the edition of stamps, the marked and philatelic products is performed by the national operator based on tasks of the Ministry, offers of the state and other organizations, Society of philatelists of Uzbekistan, physical persons, annually till March 1 of the year preceding planned.

19. Drafts of annual thematic plans of the edition of stamps, are represented to the marked and philatelic products after approval on Arts council by the national operator to the Commission on post issues till April 1 of the year previous planned.

After consideration by the Commission on post issues the draft of the thematic plan of the edition of stamps marked and philatelic products it is submitted for approval to the minister of digital technologies.

20. The thematic plan of the edition of stamps, the marked and philatelic products shall be approved till May 1 of the year preceding planned.

21. Stamps are issued in the form of standard brands and brands of special release (kommemorativny).

Brands of special release (kommemorativny) are made in the form of stamps, series, post blocks, small sheets, hitches and other philatelic products.

22. The edition of series of standard stamps is performed in the mass edition in case of change of rates for services of mail service, and also in case of change of plot of stamp at least once in 5 years.

In process of expenditure of brands of standard releases their dopechatka taking into account the available need of the national operator is made.

23. The edition of unplanned stamps, the art marked post envelopes (cards) with original brands is performed based on the decision of the Ministry according to this Provision.

Offers on release of unplanned stamps (including on production of overprints), the art marked post envelopes (cards) with original brands are taken cognizance not later than 6 months before the planned date of their issuance.

In exceptional cases the specified term can be reduced.

§ 3. Quantity of plots, nominal value and circulations

24. Annual thematic plans of the edition of stamps, the marked and philatelic products provide release to 50 plots of stamps (without standard releases), to 10 plots of the art marked post envelopes (cards) with original brands.

The quantity of plots of the marked post envelopes (cards), the art marked post envelopes (cards) is determined by annually national operator.

25. Nominal value of stamps corresponds to the rates for services of mail service operating in the territory of the Republic of Uzbekistan.

Nominal value of stamps is determined by the national operator.

26. Circulations of stamps are determined by the national operator taking into account own needs, needs of users and forming of necessary reserve.

The national operator is allowed to make part of circulation of stamps in extinguished type. Cancellation of postage stamps is made by calendar stamp with the engraving determined by the national operator and can be performed as typographical method, and using the shtempelevalny machine or manually. Circulation of stamps for release in extinguished type is determined by the national operator.

§ 4. Development of samples of stamps and their approval

27. After approval of thematic plans the national operator develops originals and sketches of the stamps planned to release, the art marked post envelopes (cards), including with original brands. For this purpose the artists having work experience in area of miniature are attracted, competitions on the best plots and drawings will be organized.

28. Originals and sketches of stamps, the art marked post envelopes (cards) with original brands are considered by Arts council, if necessary, are approved with this subject specialists.

 The sketches of stamps approved by Arts council, the art marked post envelopes (cards) with original brands are given in the printing organizations for preparation of samples of stamps, the art marked post envelopes (cards) with original brands.

29. Samples of stamps, the art marked post envelopes (cards) with original brands affirm the minister of digital technologies.

Samples of the marked post envelopes (cards), the art marked post envelopes (cards) the national operator claims.

30. Stamps shall contain the following information:

the name of the state Latin letters in state language - "O" zbekiston";

nominal value in the Arab figures or Latin letters;

year of release.

In optional procedure stamps may contain the word "Pochta" ("Mail").

The owner of exclusive copyright for the notification about the rights can use on stamps sign of protection of copyright which is located on each copy and consists of three elements:

Latin letter "C" in circle;

First name, middle initial, last name (names) of the owner of exclusive copyright;

years of the first publication of stamp.

Texts shall be accurately readable, their location on stamp is dictated by the composition solution of plot.

Exclusive copyright of use of the work on stamps, the art marked post envelopes (cards), including with original brands belongs to the national operator according to the legislation based on the signed contracts with the author of the work. The personal non-property rights remain for the author of the work.

31. For storage of the approved samples of stamps, the art marked post envelopes (cards) with original brands and all materials connected with development and their production (further - archive material), the national operator will organize Archive of stamps, the marked and philatelic products (further - Archive).

After issuance of stamps, the art marked post envelopes (cards) with original brands archive material, and also the stamps introduced into circulation, the art marked post envelopes (cards) with original brands in quantity on 300 copies of each type are transferred to storage to Archive.

Other circulation of stamps, the art marked post envelopes (cards) with original brands is stored in warehouse of the national operator. The procedure for issue of stamps from warehouse is established by the national operator.

32. After issuance of stamps the national operator according to provisions of Regulations of the Convention sends the official report to the International bureau of Universal Postal Union.

Information on the edition of stamps, the art marked post envelopes (cards), including with original brands goes to mass media, is posted on the websites of the Ministry, national operator and in the international catalogs.

§ 5. Order, mailing, sale and retirement of stamps

33. The national operator brings to the structural divisions the approved thematic plans of the edition of stamps, the marked and philatelic products the next year till July 1 of the current year.

Structural divisions of the national operator create requests for obtaining from the national operator of stamps, the marked post envelopes (cards), the art marked post envelopes (cards), including with original brands taking into account the most complete requirements satisfaction of users. The application is submitted the national operator no later than October 1 of the year preceding planned.

34. The order and mailing of stamps are performed by the national operator.

35. Sale of stamps is made by operators, providers of mail service, sales agents of stamps at par value from the date of their issuance.

36. Standard stamps, the marked post envelopes (cards), the art marked post envelopes (cards), including with original brands are on sale operators, providers of mail service, sales agents of stamps and are applied in the address before complete use of their inventories or retirement.

37. Brands of special release (kommemorativny) are on sale operators, providers of mail service, sales agents of stamps within three years from the date of their issuance. After the specified term of brand of special release (kommemorativny) the decision of the Ministry act from sale and are subject to return to the national operator established procedure after their removal from sale in a month.

The brands of special release removed from sale (kommemorativny) which are available for the population, the organizations are valid for fee on transfer of internal and international written correspondence according to applicable fares for services of mail service.

38. Sale of stamps with overprints is performed in the terms established in decisions of the Ministry of their issuance.

39. Retirement of stamps is made according to the decision of the Ministry.

The stamps withdrawn from circulation, for fee on transfer of internal and international written correspondence are invalid.

40. The stamps removed from sale or withdrawn from circulation are collection philatelic material and philatelic shops, sales agents on listed prices are implemented through structural divisions of the national operator.

Listed prices are established by the national operator according to the legislation.

41. Delivery of stamps to the foreign market is made by the national operator based on contracts (contracts) with foreign partners according to the legislation.

§ 6. Electronic brand

42. The electronic brand shall contain the following information:

unique identification number of electronic brand;

cost of transfer of the mailing;

the name of the sender and receiver (for citizens - First name, middle initial, last name, for legal entities - full name) and the location (postal address);

category of the mailing (simple, custom);

mailing weight.

The electronic brand may contain also mailing other information.

43. The electronic brand is acquired remotely via the Internet and unpacked on envelope (sheet of paper) by means of standard software directly at office or on the home computer of the user.

44. Distribution of electronic brands is performed by the national operator.

Chapter III. Memorable special stamp

§ 1. Forming of the plan of production of memorable special stamps

45. PSSh which are one of types of calendar postage stamps are applied to special cancellation of postage stamps when holding the actions devoted to important state events and historical memorable places and dates. They differ from stamps of standard sample in the external design (the additional text, the drawing), the purposes and method of their application.

46. PSSh are introduced into circulation by the decision of the Ministry and serve for special gasheniye of outgoing written correspondence in structural divisions of the national operator.

47. Direct planning and production of PSSh is assigned to the national operator.

48. PSSh are issued with fixed or translated calendar date.

49. Planning of production of PSSh is performed by the national operator in case of creation of thematic plans of the edition of stamps, the marked and philatelic products on the basis of offers of the state, public and other organizations, Society of philatelists of Uzbekistan.

The requests which arrived to the national operator till March 1 of the year preceding planned are taken cognizance.

50. Production of unplanned PSSh is performed based on the decision of the Ministry according to this Provision.

Offers on production of unplanned PSSh are taken cognizance not later than 4 months before date of their application.

51. Sketches of prints of PSSh are considered by Arts council, if necessary, are approved with this subject specialists.

The sketches of prints of PSSh approved by Arts council affirm the minister of digital technologies.

52. Production of PSSh is made according to the sketches of prints of PSSh approved by the minister of digital technologies.

In case of production of several copies of PSSh with one text and the drawing everyone shall have digital or alphabetic difference.

53. The name of structural divisions of the national operator is specified PSSh in state language Latin letters.

At the request of the customer the text about event or anniversary on PSSh can be executed in the state and/or other languages.

54. PSSh are introduced into circulation by the decision of the Ministry no later than 10 days before carrying out special clearing, in the decision the name PSSh, time and the place of its application, color of the used mastic, the short description of the drawing, the information about the author is specified.

55. The national operator in 1 month prior to carrying out special clearing informs the structural divisions on the place, terms of application of PSSh and stamps issued to special clearing, and also the accompanying philatelic materials.

The national operator conducts serial numbering (identification numbers the) of PSSh introduced into circulation. Identification number PSSh is assigned by the decision of the Ministry of its introduction in the address.

§ 2. Application of memorable special stamps

56. The national operator sends to PSSh to places of application, taking into account their obtaining by structural divisions, no later than three days before carrying out special gasheniye.

57. Use of PSSh is made only for special gasheniye by specific structural divisions of the national operator during the term determined by the decision of the Ministry.

In exceptional cases the Ministry can extend the term of carrying out special clearing.

58. PSSh are extinguished the stamps which are in circulation in the territory of the Republic of Uzbekistan. Special clearing of PSSh is made in case of acceptance to transfer of written correspondence.

Prints of PSSh are not put down on the stamps withdrawn from circulation, which earlier underwent special clearing, and also foreign philatelic material.

Putting down of prints of PSSh on envelopes without specifying of the address is allowed.

59. Structural divisions of the national operator to whom are carried out special clearing inform the population and Society of philatelists of Uzbekistan on terms and the place of application of PSSh through mass media or announcements on places.

60. In structural divisions of the national operator beforehand, before carrying out special clearing, special mailboxes for lowering in them the written correspondence which is subject to special clearing are established.

After special clearing written correspondence is distributed to addressees.

61. The structural division of the national operator shall proshtempelevat the written correspondence which arrived from other regions with request for special clearing.

Responsibility for the correct use and safety of PSSh is assigned to heads of structural divisions of the national operator to whom special clearing is carried out.

§ 3. Storage of memorable special stamps

62. PSSh are stored in structural divisions of the national operator in accordance with the established procedure and are subject to return no later than the next day after the end of special clearing.

63. After return of PSSh the national operator carries out special clearing of philatelic material by orders of Society of philatelists of Uzbekistan and philatelic shops, then on PSSh the notch is made, and they are given to storage to Archive.

Chapter IV. Final provisions

64. Persons guilty of production for the purpose of sale or in sale of counterfeit GZPO, and also in use of obviously counterfeit prints of cliche of franking machines, bear responsibility according to the procedure, established by the legislation.

64. This Provision is approved with the Ministry of cases of culture and sport of the Republic of Uzbekistan, the State committee of the Republic of Uzbekistan on privatization, demonopolization and development of the competition, the Agency of intellectual property of the Republic of Uzbekistan.
