The government of the Republic of Kazakhstan DECIDES:

1. Bring the following changes in some decisions of the Government of the Republic of Kazakhstan:

1) in the order of the Government of the Republic of Kazakhstan of October 7, 2010 No. 1036 "About approval of standards of the state services and entering of amendment into the order of the Government of the Republic of Kazakhstan of July 20, 2010 No. 745" (SAPP of the Republic of Kazakhstan, 2010, No. 54, the Art. 521):

to be reworded as follows the standard of the state service "Licensing, Renewal, Issue of the Duplicate of the License for Project Activities" approved by the specified resolution according to appendix 1 to this resolution;

to be reworded as follows the standard of the state service "Licensing, Renewal, Issue of Duplicates of the License for Installation and Construction Works" approved by the specified resolution according to appendix 2 to this resolution;

2) in the order of the Government of the Republic of Kazakhstan of August 31, 2012 No. 1128 "About approval of standards of the state services "Issue of the Reference by Determination of the Address of Real Estate Objects in the Territory of the Republic of Kazakhstan", "Issue of Architectural and Planning Task", "Licensing, Renewal, Issue of the Duplicate of the License for Prospecting Activities", "Licensing, Renewal, Issue of Duplicates of the License for Activities for the Organization of Construction of Residential Buildings due to Fund Raising of Shareholders" and modification of the orders of the Government of the Republic of Kazakhstan of October 7, 2010 No. 1036 "About approval of standards of the state services and entering of amendment into the order of the Government of the Republic of Kazakhstan of July 20, 2010 No. 745 and of April 7, 2011 No. 394 "About approval of standards of the state services in the field of social protection, rendered by local executive bodies" (SAPP of the Republic of Kazakhstan, 2012, No. 68, the Art. 990):

to be reworded as follows the standard of the state service "Licensing, Renewal, Issue of the Duplicate of the License for Prospecting Activities" approved by the specified resolution according to appendix 3 to this resolution;

to be reworded as follows the standard of the state service "Licensing, Renewal, Issue of Duplicates of the License for Activities for the Organization of Construction of Residential Buildings due to Fund Raising of Shareholders" approved by the specified resolution according to appendix 4 to this resolution;

3) in the order of the Government of the Republic of Kazakhstan of December 4, 2012 No. 1530 "About some questions of licensing of activities for the organization of construction of residential buildings due to fund raising of shareholders and modification and amendments in some decisions of the Government of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan 2013, No. 2, the Art. 24):

state Item 2 in the following edition:

"2. Determine the licensor by implementation of activities for the organization of construction of residential buildings due to fund raising of shareholders Committee on cases of construction and housing and communal services of the Ministry of regional development of the Republic of Kazakhstan.";

4) ceased to be valid according to the Order of the Government of the Republic of Kazakhstan of 18.02.2015 No. 69

2. This resolution becomes effective after twenty one calendar days after the first official publication.

Standard of the state service "Licensing, Renewal, Issue of the Duplicate of the License for Project Activities"

1. General provisions

1. Name of the state service: "Licensing, renewal, issue of the duplicate of the license for project activities" (further - the state service).

2. The name of the central state body developing the standard of the state service: Ministry of regional development of the Republic of Kazakhstan.

3. Name of the service provider: Committee on cases of construction and housing and communal services of the Ministry of regional development of the Republic of Kazakhstan and Departments of State Architectural and Construction Control and licensing of areas, cities of Astana and Almaty (further - the service provider) through the Republican state company on the right of economic maintaining "Service center of the population" of Committee on control of automation of the state services and coordination of activities of service centers of the population of the Ministry of Transport and Communications of the Republic of Kazakhstan (further - the center) which addresses and working schedules are specified in appendix 1 to this standard, and also the web portal of "the electronic government": www.e.gov.kz or the E-litsenzirovaniye web portal of www.elicense.kz (further - the portal).

2. Procedure for rendering the state service

4. Terms of rendering the state service:

1) from the moment of delivery of document package in the center or the portal is constituted by fifteen working days for issue and renewal of the license, and two working days for issue of the duplicate of the license (day of acceptance and day of issue of documents does not enter rendering the state service in time);

2) the most allowed time of expectation before receipt of the state service - no more than 20 minutes;

3) the most allowed time of servicing of uslugopoluchatel in day of the address - no more than 20 minutes.

5. Form of the rendered state service: electronic (partially automated).

The rendered state service issue on the portal of the license, renewal and issue of duplicates of the license for project activities, in electronic form, signed by the digital signature (further - the EDS) is result of the authorized person of the service provider or the motivated answer about refusal in provision of the state service in electronic form in case of submission of the address in electronic form, or on paper in case of submission of the address in paper form to the terms established in the subitem 1) of Item 5 of this standard. 8. Working schedule:

1) the center - the state service is rendered daily Monday through Saturday inclusive, except for days off and holidays, according to the labor law according to the established working schedule from 9:00 to 20:00 o'clock without interruption.

Acceptance is performed according to the procedure of "electronic queue" without the accelerated servicing. In case of desire of uslugopoluchatel "booking" of electronic queue by means of the portal is possible.

Mobile branches of the centers perform documents acceptance according to the schedule approved together with territorial administrations of migratory police and local executive bodies but at least six working hours in one settlement;

9. For receipt of the state service the uslugopoluchatel represents the list of documents:

1) in the center in case of receipt of the license:

the statement in the established form for legal entity and physical person according to appendices 2 and 3 of this standard;

the copy of the charter (notarially attested in case of non-presentation of originals for reconciliation) and the certificate of state registration (re-registration) of the legal entity of the applicant - for the legal entity;

the copy of the identity document, - for physical person;

the copy of the certificate on state registration of the applicant as the individual entrepreneur (notarially attested in case of non-presentation of the original for reconciliation) - for the individual entrepreneur;

the copy of the certificate on statement of the applicant on accounting in tax authority (notarially attested in case of non-presentation of the original for reconciliation);

the copy of the document confirming payment in the budget of the license fee for the occupation right with separate types of activity, except as specified payments through payment gateway of "the electronic government";

form of data on compliance to qualification requirements according to appendix 4 presents of the standard;

in case of the address of the foreign person, in need of receipt of the license І or ІІ categories, the copy of the license or the relevant allowing document of the foreign state having the corresponding assurance for foreign persons on project activities;

2) in the center in case of renewal of the license for the reasons of change of surname, name, middle name of physical person, re-registration of the individual entrepreneur, change of its name and the address, reorganization of the legal entity in the form of merge, accession, allocation or transformation, change of the name and (or) legal address of the legal entity:

the statement in the established form for legal entity and physical person, according to appendices 5 and 6 of this standard;

the identity document - for reconciliation;

copies of the license and appendix to the license (in case of lack of data on the license in the state information systems);

copies of the document confirming payment in the budget of the license fee for the occupation right with separate types of activity, except as specified payments through payment gateway of "the electronic government";

3) in the center in case of renewal of the license because of assignment of category:

the statement in the established form for legal entity and physical person according to appendices 5 and 6 of this standard;

the copy of the identity document, - for physical person;

copies of the license and appendix to the license (in case of lack of data on the license in the state information systems);

the copy of the document confirming payment in the budget of the license fee for the occupation right with separate types of activity, except as specified payments through payment gateway of "the electronic government";

form of data on compliance to qualification requirements according to appendix 4 presents of the standard;

4) in the center in case of issue of the duplicate of the license:

the statement in the established form for legal entity and physical person according to appendices 7 and 8 of this standard;

the identity document - for reconciliation;

copies of the license and appendix to the license (in case of lack of data on the license in the state information systems);

the copy of the document confirming payment in the budget of the license fee for the occupation right with separate types of activity, except as specified payments through payment gateway of "the electronic government".

Data of identity documents; about state registration of the legal entity; about state registration of the individual entrepreneur; the data on the license which are the state electronic information resources, the employee of the center receives independently from the corresponding state information systems through the portal in the form of the electronic documents signed by the EDS of authorized persons of state bodies:

5) on the portal in case of receipt of the license:

the request in electronic form signed by the EDS of uslugopoluchatel in the established form for legal entity and physical person, according to appendices 2 and 3 to this standard;

copies of the license and appendix to the license (it is attached in the form of the scanned copy, in case of lack of data on the license in the state information systems);

the scanned copy of the document confirming payment in the budget of the license fee for the occupation right with separate types of activity, except as specified payments through payment gateway of "the electronic government";

form of data on compliance to qualification requirements according to appendix 4 presents of the standard which in the form of the electronic copy is attached to electronic request;

in case of the address of the foreign person for receipt of the license І or ІІ categories - the copy of the license or the relevant allowing document of the foreign state having the corresponding assurance for foreign persons on project activities which in the form of the electronic copy are attached to electronic request;

6) on the portal in case of renewal of the license for the reasons of change of surname, name, middle name of physical person, re-registration of the individual entrepreneur, change of its name and the address, reorganization of the legal entity in the form of merge, accession, allocation or transformation, change of the name and (or) legal address of the legal entity:

the request in electronic form signed by the EDS of the receiver of the state service in the established form for legal entity and physical person, according to appendices 5 and 6 of this standard;

copies of the license and appendix to the license (it is attached in the form of the scanned copy, in case of lack of data on the license in the state information systems);

the scanned copy of the document confirming payment in the budget of the license fee for the occupation right with separate types of activity, except as specified payments through payment gateway of "the electronic government";

7) on the portal in case of renewal of the license because of assignment of category:

the request in electronic form signed by the EDS of the receiver of the state service in the established form for legal entity and physical person, according to appendices 5 and 6 of this standard;

copies of the license and appendix to the license (it is attached in the form of the scanned copy, in case of lack of data on the license in the state information systems);

data and documents according to qualification requirements, according to appendix 4 presents of the standard which in the form of electronic copies of documents are attached to electronic request.

10. In provision of the state service refuses in cases if:

1) occupation type of activity is forbidden by the laws of the Republic of Kazakhstan for this category of subjects;

2) the license fee for the occupation right by separate types of activity in case of filing of application on licensing by sight of activities is not brought;

3) the uslugopoluchatel does not conform to qualification requirements;

4) concerning the applicant there is court verdict which took legal effect prohibiting to it to be engaged in separate type of activity;

5) court based on representation of the legal executive the uslugopoluchatel is forbidden to obtain licenses;

In case of refusal in documents acceptance by the employee of the center the receipt with indication of missing documents is issued to uslugopoluchatel.

3. Procedure for appeal

11. Claims, in disagreement cases with result of the rendered state service, go at the choice of uslugopoluchatel by the address:

1) to the head of the service provider, the schedule of reception of citizens is placed on Internet resource of the service provider to the address: www.ads.gov.kz;

2) on "telephone hotline" of the service provider according to numbers 8 (7172) 74-22-43, 74-19-45;

3) in the Section "questions-answers" of Internet resource of the service provider: www.ads.gov.kz;

16. Features of rendering the state service to the faces carried to socially vulnerable segments of the population taking into account lack of possibility of their corporal appearance to the service provider and (or) in service center of the population are absent;

17. Addresses of places of rendering the state service are placed on Internet resources of the service provider of kds.gov.kz and state body which developed the standard of the state service minregion.gov.kz;

18. In case of the address of uslugopoluchatel through the web portal of "the electronic government" or the E-litsenzirovaniye web portal the request in electronic form signed by the EDS of uslugopoluchatel is sent;

19. The possibility of receipt of information on the status of rendering the state service in the mode of remote access is performed through "personal account" of uslugopluchatel;

20. Number of Single contact center concerning rendering the state services: 1414.
