The government of the Republic of Kazakhstan DECIDES:

1. Bring the following changes and amendments in some decisions of the Government of the Republic of Kazakhstan:

1) in the order of the Government of the Republic of Kazakhstan of October 18, 2010 No. 1070 "About approval of Rules of certification and issue of the air operator certificate of civil aircrafts" (SAPP of the Republic of Kazakhstan, 2010 No. 56, the Art. 535):

The rules of certification and issue of the air operator certificate of civil aircrafts (further - Rules) approved by the specified resolution to be reworded as follows according to appendix 1 to this resolution;

2) ceased to be valid according to the Order of the Government of the Republic of Kazakhstan of 25.04.2014 No. 400

2. This resolution becomes effective after ten calendar days after day of its first official publication, except for Item 5 of Rules, Item 1 of appendix 2 to Rules, paragraphs of the fifth, sixth, seventh, eighth, ninth, tenth, eleventh, twelfth, thirteenth, fourteenth, fifteenth and eighteenth subitem 2) of Item 1 of this resolution which become effective since January 1, 2014.

Rules of certification and issue of the air operator certificate of civil aircrafts

1. General provisions

1. These rules of certification and issue of the air operator certificate of civil aircrafts (further - Rules) appendices 6 to the Convention on international civil aviation are developed according to requirements of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (Chicago, 1944).

2. These rules determine procedure for certification, issue, suspension and withdrawal of the air operator certificate of civil aircrafts (further - the Air operator certificate) to the physical persons or legal entities performing commercial air transportations.

3. The air operator certificate is issued for a period of 2 years with indication of area and effective period and is not subject to transfer to other person.

4. The physical person or legal entity of the Republic of Kazakhstan which for the first time received the air operator certificate of civil aircrafts is registered in International Civil Aviation Organization (ICAO) where the trigram code and conditional telephone call sign is assigned for it. Registration is performed by means of the inquiry sent by authorized body civil aviation to International Civil Aviation Organization (ICAO).

5. For certification of the operator of civil aircrafts collection according to the procedure and the size, by the determined Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" the Republic of Kazakhstan is levied. Certification of the operator of civil aircrafts is performed after payment in the government budget of the specified collection.

6. In Rules the following terms and determinations are used:

1) the request - the written appeal of the applicant to authorized body in the field of civil aviation for passing of the procedure of certification;

2) the applicant - the legal entity of the Republic of Kazakhstan who addressed to authorized body in the field of civil aviation for receipt of the air operator certificate of civil aircrafts;

3) certified inspection - the check of means, the equipment, operational procedures, engineering procedures performed by authorized body in the field of civil aviation, documentation, organizational structure, competence of administrative, flight and land personnel of the applicant on compliance to certified requirements;

4) certified requirements - the requirements established by regulatory legal acts in the field of certification of civil aviation;

5) management on production of flights - the document containing rules, instructions and recommendations for use by operational personnel in case of accomplishment of the obligations;

6) the operator's management on maintenance regulation - the document containing the description of procedures of the operator which provide possibility of management of timely and satisfactory accomplishment of all planned and not planned works on maintenance of aircrafts of this operator;

7) the program (regulations) of maintenance - the document approved by authorized body in the field of civil aviation containing the description, frequency of planned works and procedures for maintenance of the aircrafts registered in the State register of civil aircrafts of the Republic of Kazakhstan.
