About approval of Rules of transportations of passengers and baggage by road transport
According to the subitem 8) of article 12 of the Law of the Republic of Kazakhstan of July 4, 2003 "About road transport" the Government of the Republic of Kazakhstan DECIDES:
1. Approve the enclosed Rules of transportations of passengers and baggage by road transport.
2. This resolution becomes effective after ten calendar days from the date of the first official publication.

1. These rules of transportations of passengers and baggage by road transport (further - Rules) are developed according to the subitem 8) of article 12 of the law of the Republic of Kazakhstan of July 4, 2003 No. 476 "About road transport" and determine procedure for rules of transportations of passengers and baggage by road transport.
2. Rules act on all territory of the Republic of Kazakhstan and are obligatory for all physical persons and legal entities irrespective of patterns of ownership.
3. The basic concepts used in these rules:
the luggage receipt - the document confirming the conclusion of the agreement of motor transportation of baggage, and also acceptance of baggage by carrier on storage or for transportation in form according to appendix 1 to these rules;
the logbook - the numbered and strung together magazine, under seal carrier, being on the vehicle when implementing irregular transportations of passengers and baggage in which marks about passing of pretrip technical inspection of the vehicle and pretrip (prereplaceable) medical examination of the driver, in form according to appendix 2 to these rules are put down;
dispatching system - the system allowing to obtain continuously information in real time on movement of the vehicles performing regular transportations of passengers and baggage along the approved routes;
the operator of dispatching system - the physical persons or legal entities providing the organization and functioning of dispatching system;
the travel document (ticket) - the document in paper or electronic form by which execution the transportation agreement of the passenger is signed;
Item of landing and disembarkation of passengers (stopping point) - the site of roadside strip equipped according to requirements of these rules intended for stop of vehicles for the purpose of landing and disembarkation of passengers;
the schedule of movement - the document (the table, graphical display) containing data on the place and time of movement of buses, minibuses, trolleybuses on each stopping point of route of regular motor transportations of passengers and baggage;
dangerous sites - sections of highways, driving through which is integrated to the increased risk of involvement in the road accident or is connected with essential changes of the mode of movement;
route - the established transit of the bus, the minibus, the trolleybus between certain starting, intermediate and terminal stopping points;
the scheme of route - the graphical conditional representation of route with indication of stopping points, distances between them, and also characteristic reference points (road forks, intersections, railway crossings, bridges, and tunnels);
flight - way of the bus, the minibus, the trolleybus from route, initial to terminal point;
manual sink - wash of vehicles by manual method with use of high-pressure apparatuses of water supply, water supply systems and (or) waters from reservoirs;
the mechanized sink - the automatic wash of vehicles consisting of the moved mechanisms of arch type equipped with the devices for washing structure and water supply rotating and (or) the moving brushes, and also the device of obduv;
taximeter - the device intended for calculation of the cost (price) of transportation of passengers and baggage of taxi;
technical stop - the stop of buses and minibuses which is not providing disembarkation from route and landing to route of passengers.
4. On nature of the organization motor transportations of passengers and baggage are subdivided on regular and irregular.
5. Regular motor transportations of passengers and baggage - the transportations performed by carriers with use of buses, minibuses, trolleybuses on in advance approved routes, schedules of movement with the established starting and terminal points, Items of landing and disembarkation of passengers.
Under the organization of regular motor transportations of passengers and baggage vehicles (buses, minibuses or trolleybuses) which will be used for implementation of transportations are determined in advance.
The variation along route when implementing regular motor transportations of passengers and baggage is not allowed.
6. When implementing regular motor transportations of passengers and baggage the carrier provides availability on the vehicle of the route sheet which is drawn up by carrier on change or flight, with marks about passing of pretrip (prereplaceable) medical examination of the driver and technical inspection of the vehicle in form according to appendix 3 to these rules.
7. Irregular motor transportations of passengers and baggage will be organized by carriers and performed with use of buses, the minibuses conforming to requirements of these rules.
8. Irregular transportations are subdivided on:
1) transportations by non-repeat orders (requests) of legal entities and physical persons. Treat such transportations: tourist, excursion, on servicing of activities.
One-time transportations can be performed on contractual basis during the certain period;
2) transportations of taxi.
9. The vehicles which had technical inspection according to requirements of the legislation of the Republic of Kazakhstan are allowed to motor transportations of passengers and baggage, and implementation of international carriages of passengers and baggage requires availability of the sanitary and epidemiologic conclusion.
The carriers performing motor transportations of passengers and baggage provide pretrip (prereplaceable) technical inspection and timely replacement of buses, minibuses, trolleybuses in case of their defect.
At the same time the buses, minibuses, trolleybuses used in case of motor transportations of passengers and baggage shall conform to requirements of the corresponding standards.
10. The buses and minibuses used in case of motor transportations of passengers and baggage shall conform to requirements of ST of RK 1040-2001 "Services motor transportation on passenger traffic", the Committee on standardization, metrology and certification of the Ministry of Economy and Trade of the Republic of Kazakhstan approved by the order of October 22, 2001 No. 378, at the same time:
1) on routes of regular city and suburban motor transportations use of the city buses (class I) having at least two passenger doors, minibuses, and also intercity buses (class II) on routes of regular suburban motor transportations is allowed;
2) on routes of regular long-distance interregional and international motor transportations intercity buses (class II) or buses of distant following shall be used (class III). At the extent of these routes to 300 km on roads of republican value it is allowed to use minibuses;
3) on routes of regular transportation of passengers by buses, minibuses in the international message the carriers having the license for the right of implementation of the specified type of transport are allowed;
4) the buses and minibuses used on routes regular long-distance interregional, international and city (in the city of republican value and the capital, and also in the regional centers) motor transportations of passengers and baggage, are equipped with devices of continuous data transmission on communication channels in real time when implementing transportations.
11. The buses and minibuses used for transportation of passengers and baggage on regular and irregular long-distance and international automobile communications more than 300 km long on roads of republican value shall have soft sitting with folding backs.
This requirement does not extend on interdistrict (long-distance intraregional) transportations which route lies on the mountain roads having serpentines and small radiuses of turns or ferry crossing.
11-1. At the extent of route more than 500 km in inside of the bus the place for the driver relief is provided.
12. On mountain routes buses with run more than 500 thousand kilometers or being exposed to capital repairs are not used.
The buses used on mountain routes are equipped with front fog lights and auxiliary headlights of backing, and height of the drawing of protector of tires shall be at least 3,0 - mm.
13. Buses, minibuses, trolleybuses are completed:
1) the medical first-aid kit (motor transportation) with necessary set of drugs and medical means;
2) sign of emergency stop;
3) operational fire extinguishing means;
4) the corresponding devices of the emergency opening of emergency hatches and information plates to them, doors, windows and removal of glasses in case of the road accident;
5) antiretractable devices.
14. The buses, minibuses, trolleybuses used in case of motor transportations of passengers and baggage shall have:
1) doors of passenger salon and emergency hatches which are opening and closed without any hindrances. Doors shall not have ledges, sharp or far remote from their surface;
2) roof, emergency hatches and windows which in the closed condition completely prevent hit of atmospheric precipitation in cabin of the driver and passenger salon;
3) firmly the fixed hand-rail and sitting;
4) net and without rushes of covering of seats and backs of chairs for passengers;
5) equal, without speakers or loose details, footboards and floor of salon.
Floor covering of salon is made of continuous material without rushes;
6) the transparent glasses of windows purified of dust, dirt, paint and other objects reducing visibility through them. It is forbidden to close window opening information or promotional materials more than for 30%;
7) the passenger salon heated in cold and ventilated in hot season, which is not encumbered with the tool and spare parts.
15. Wet cleaning of insides of the buses, minibuses and trolleybuses used in case of regular motor transportations of passengers and baggage is carried out at least once to change and in process of pollution using washing and disinfectants.
The outside sink of body is carried out after the end of change.
16. The buses and minibuses used on routes of long-distance interregional and international motor transportations of passengers and baggage shall have luggage compartments out of inside of the bus.
17. Tachographs the buses and minibuses used when implementing are subject to the equipment:
1) international motor transportations of passengers and baggage;
2) long-distance interregional regular motor transportations of passengers and baggage;
3) long-distance interregional, interdistrict (long-distance intraregional) irregular motor transportations of passengers and baggage.
18. In inside of buses, minibuses and trolleybuses near cabin (place) of the driver information containing is had:
1) full name of carrier;2) numbers of contact telephone numbers of carrier, organizer of transportations;
3) phone numbers of territorial authorities of road traffic police, transport control and health service;
4) copy of the scheme of route;
For regular routes (except for city routes) the table of fare and conveyance depending on trip distance is submitted;
6) size of penalty for unpaid journey and/or conveyance;
7) rights and obligations of passengers.
The buses, minibuses and trolleybuses used in case of regular city (rural) motor transportations of passengers and baggage shall be equipped with loud-speaking installation, in case of functioning of automated control system (further - ACS) the control unit behind work on the line.
For irregular motor transportations of passengers and baggage action of subitems 4), 5) and 6) of this Item do not extend.
19. In the front and back parties of buses, the minibuses used in case of regular city and suburban motor transportations of passengers and baggage cliches with indication of number of route are established.
Number of route is drawn up in black color font at least 120 mm high on light yellow background. In case of implementation of express transportations on cliche at number of route the text "Express" of red color font at least 60 mm high is drawn up.
20. On the right side of the buses, minibuses and trolleybuses used on city (rural) routes regular motor transportations of passengers and baggage near one of passenger doors of salon the cliche with number and the short description of route (the name of intermediate and final stops, the main streets on which there passes the route, socially significant places) is located on the state and Russian languages.
21. Buses and minibuses of long-distance interregional and international routes are drawn up front and side (on the right side) by cliche with indication of initial, final and large intermediate points of following on state and Russian, and if necessary, and in other languages.
22. Front and back cliches have illumination in night-time.

24. On the front and back parties of the vehicles used when transporting passengers and baggage by custom buses, minibuses and cars cliches with text "Custom" are established.

25. Places for disabled people, pensioners, expectant mothers and passengers with children of preschool age are provided in front part of inside of the buses and trolleybuses used in case of regular motor transportations of passengers and baggage. 26. The taxi is equipped with the identification mark located on roof and well distinguishable from distance to 500 - m. The identification mark has text of "T" (taxi) and/or characteristic checkerboard belt and is highlighted in night-time.
27. The taxi is external drawn up in single color scale, by drawing on lateral faces of the car which color of body is determined by carrier of taxi, the belt consisting of the black and (or) yellow squares located in chessboard order, at least 10 centimeters high, and at least 100 centimeters long in total total length.

29. The taxi is equipped with operational taximeter or cash register.
30. In salon of taxi in sight of passengers the business card of the driver with the photo, specifying of surname, name, middle name, and also information display is established with indication of:
1) official name of carrier, its address and phone number;
2) fares to 1 km, and also fares for the subsequent distance of trip in the presence of taximeter.
31. As initiators of opening of routes of regular motor transportations of passengers and baggage authorized body in the field of road transport, local executive bodies, physical persons and legal entities can act.
32. On opening of routes of regular motor transportations of passengers and baggage the initiator develops the scheme of route and the schedule of movement for the solution of questions on it and sends them to organizers of transportations:
along routes of regular international, long-distance interregional - in authorized body in the field of road transport;
along routes regular interdistrict (long-distance intraregional) and in the cities of republican value, the capital - city and suburban motor transportations of passengers and baggage - in local executive bodies of area, the cities of republican value, the capital;
along routes of regular city (rural), suburban and raionwide motor transportations of passengers and baggage - in local executive bodies of areas, cities of republican value.
33. New routes of regular transportations of passengers and baggage are organized if:
1) highway capability allows to perform regular movement of buses, along certain routes;
2) the condition of highways and their arrangement conform to safety requirements of traffic;
3) the conditions specified in Item 36 of these rules are satisfied.
34. When forming route network of regular transportations of passengers and baggage by road transport local executive bodies are guided by communication priority between settlements, auls (villages) with the district centers, and between the district centers with the regional center and other nearby cities of regional value.
35. No. 231 is excluded according to the Order of the Government of the Republic of Kazakhstan of 12.03.2014
36. The created route network (except the international, city and suburban routes) corresponds to the following conditions:
The planned interval of movement between buses of duplicative routes constitutes 1) on time:
more than 1 hour at the extent of duplication up to 150 km;
more than 2 hours at the extent of duplication up to 350 km;
more than 3 hours at the extent of duplication up to 500 km;
more than 4 hours at the extent of duplication over 500 km;
2) in case of average use of capacity of buses on sites of duplication more than seventy five percent the difference on time is reduced:
up to 10 minutes on duplication extent to 150 km;
up to 15 minutes on duplication extent to 350 km;
up to 20 minutes on duplication extent over 350 km.
37. On routes of regular transportations of passengers and baggage (except the international messages) in case of annual average fillability of buses throughout all route more than seventy five percent the organizer of transportations according to the appeal of carriers or passengers makes the decision on introduction of additional schedules of movement. The decision on introduction of additional schedules of movement is made by authorized body in the field of road transport in coordination with local executive bodies of areas on long-distance interregional routes, the city of republican value, the capital.
The right of servicing of additional schedules of movement is transferred to the carrier servicing route.
In cases of refusal of carrier of servicing of additional schedules of movement or servicing of route by two and more carriers (on the one hand), local executive bodies distribute this schedule of movement on competitive basis on the duration of the agreement on servicing of this route.
37-1. On regular long-distance interregional routes up to 300 km long authorized body in the field of road transport in coordination with local executive bodies of the respective areas, the cities of republican value, the capital affirm schedules of movement with indication of the regular period of implementation of transportations of passengers and baggage on free movement of buses, minibuses. The right of servicing of transportation of passengers and baggage on free movement of buses, minibuses is transferred to the carrier servicing route.
38. When opening new intra republican routes approval is performed according to the following hierarchy:
long-distance interregional;
interdistrict (long-distance intraregional);
suburban and raionwide.
39. Local executive bodies when opening new interdistrict (long-distance intraregional) routes for studying of amount of transportations determine carrier who services this route two months.
Following the results of studying the decision on carrying out the corresponding tender on the right of servicing of this route in the terms established by these rules is made.
40. In case of positive approval of area of schedules of movements by local executive bodies along routes regular interdistrict (long-distance intraregional) and suburban motor transportations of passengers and baggage data on route join in the corresponding register, according to Item 41 of these rules.
41. For the purpose of planning of the organization and accounting of routes maintaining the register is performed:
Authorized body in the field of road transport - routes of regular international and long-distance interregional motor transportations of passengers and baggage;
local executive bodies of areas, cities of republican value, the capital - routes regular interdistrict (long-distance intraregional), in the cities of republican value, the capital - city and suburban motor transportations of passengers and baggage;
local executive bodies of areas, cities of regional value - routes of regular city (rural), suburban and raionwide motor transportations of passengers and baggage.
42. Registers contain the following main characteristics of routes:
number and the name of route on starting and terminal point of following;
quantity and names of intermediate points on route in the direct and return directions;
route extent in the direct and return directions;
average operational speed of movement on route in the direct and return directions;
period of servicing of route: year-round, additional (acting in certain days and the periods of days (days off, holidays or in hours "peak" of city routes), seasonal (acting during predefined period (during the country period, for the period of functioning of rest areas, the period of the raised passenger traffic);
passenger traffic and passenger turnover;
class of buses, minibuses and passport capacity of buses on route in places for sitting of passengers and general (taking into account the capacity of accumulative platforms);
information about carrier (the name, the address, surname, name, middle name, phone of the head and person responsible for the organization of transportations) and the period of action of the allowing documents issued to it.

44. The carrier provides passing by drivers of pretrip (prereplaceable) medical examination by the health worker.

2) identification and consideration of the shown claims, durations of intertrip (interreplaceable) rest and dream;
3) measurement and assessment of arterial pressure, frequency and quality characteristics of pulse, measurement of body temperature, survey of pharynx, palpation of lymph nodes, stomach, determination of stability in Romberg's pose, accomplishment accuracy finger - nasal and other coordination tests. In the presence of arterial hypertension in the anamnesis of disease of the driver in the individual card of pretrip (prereplaceable) medical examination admissible parameters of the main functional indicators of the driver are noted.

49. Persons concerning whom reasons to believe are had that they are in condition of alcoholic, drug, inhalant intoxication (alcohol smell from mouth, instability of pose, violation of the speech, the expressed trembling of fingers, change of coloring of integuments) are not allowed to control of vehicles.
In case of disagreement with this conclusion, these persons go for survey in the nearest medical organization, authorized to carry out medical examination, for factual determination of the use of psychoactive agent and state of intoxication according to the current legislation of the Republic of Kazakhstan.
