Based on the paragraph of the fifth of article 9 of the Law of the Republic of Belarus of June 21, 2002 "About precious metals and gemstones" the Council of Ministers of the Republic of Belarus DECIDES: No. 110-Z

1. Approve Regulations on the state assay supervision in the Republic of Belarus it (is applied).

2. Recognize to invalid:

the resolution of Council of Ministers of the Republic of Belarus of November 25, 1999 No. 1838 "About approval of Rules of transactions with precious metals and stones" (The national register of legal acts of the Republic of Belarus, 1999, No. 94, 5/2115);

the resolution of Council of Ministers of the Republic of Belarus of December 31, 2002 No. 1858 "About criteria and procedure for reference of natural diamonds to unsuitable for production of jewelry and their accounting" (The national register of legal acts of the Republic of Belarus, 2003, No. 7, 5/11776);

the resolution of Council of Ministers of the Republic of Belarus of January 2, 2003 No. 1 "About establishment of procedure for equating of unique natural amber educations with gemstones" (The national register of legal acts of the Republic of Belarus, 2003, No. 5, 5/11770);

the resolution of Council of Ministers of the Republic of Belarus of June 19, 2003 No. 815 "About decrease in the amount of payment for approbation and branding of the jewelry made by the diamond processing organizations of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2003, No. 73, 5/12643);

the resolution of Council of Ministers of the Republic of Belarus of June 29, 2010 No. 977 "About procedure of the state assay supervision in the territory of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2010, No. 159, 5/32102).

3. This resolution becomes effective since June 20, 2014.

Regulations on the state assay supervision in the Republic of Belarus

1. This Provision developed according to the Law of the Republic of Belarus of June 21, 2002 No. 110-Z "About precious metals and gemstones" determines procedure of the state assay supervision in the Republic of Belarus.

2. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus "About precious metals and gemstones" and also the following term and its determination are used:

the manufacturer – the legal entity of the Republic of Belarus, the individual entrepreneur registered in the Republic of Belarus performing production of jewelry and other products.

3. The state assay supervision in the Republic of Belarus is exercised by the Ministry of Finance (further – the Ministry of Finance) by means of:

3.1. establishments of tests for jewelry and other products;

3.2. No. 268 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 16.05.2025

3.3. carrying out assay works and services which include:

approbation, analysis and branding state assay brand of the Republic of Belarus of jewelry and other products;

examination of prints of the state assay brands of the Republic of Belarus;

examination of precious metals and diagnostics of the gemstones which are in the organizations subordinated to the Ministry of Culture and also in structural divisions of the local executive and administrative organs performing state powers of authority in the field of culture, and subordinated to them the organizations for transfer in cultural and historical fund of the State fund of precious metals and gemstones of the Republic of Belarus;

production of assay reactants for needs of the legal entities and individual entrepreneurs performing activities with precious metals and gemstones;

annual establishment and registration of marks and finishing them to manufacturers of jewelry and other products;

3.4. interactions with the law enforcement, judicial and controlling (supervising) agencies regarding provision of information and conducting checks;

3.5. interactions with the bodies of foreign states exercising assay supervision;

3.6. accomplishment of other functions according to the Law of the Republic of Belarus "About precious metals and gemstones", other acts of the legislation of the Republic of Belarus and international legal acts constituting the right of the Eurasian Economic Union, regulating questions of assay supervision.

4. For implementation of assay works and services in the list determined by the Ministry of Finance the payment according to the procedure and the sizes established by this Ministry is levied.

5. The jewelry and other products made in the Republic of Belarus, including by individual orders of citizens from the jewelry and other products and (or) scrap and waste of the jewelry and other products except for specified in Items 7 and 7-1 of this provision belonging to them, or the states imported into the Republic of Belarus for realization, or withdrawn, arrested, turned into the income in the procedure established by the legislation or on which collection on account of the unexecuted tax liability, unpaid penalty fee and subject to transfer for realization to Belyuvelirtorg open joint stock company is turned shall correspond to the established tests and to be provided to the Ministry of Finance for obligatory approbation, the analysis and branding by the state assay brand of the Republic of Belarus, except products (their parts) which are not subject to obligatory approbation, the analysis and branding according to appendix.

6. The jewelry and other products provided on approbation, the analysis and branding are subject only to approbation and the analysis in case of determination of technical impossibility of drawing the state assay brand of the Republic of Belarus by the Ministry of Finance without violation of integrity and trade dress of such products.

7. The jewelry and other products made in the Republic of Belarus and intended for export from the territory of the Republic of Belarus are subject to voluntary approbation, the analysis and branding.

Content of precious metals in the jewelry and other products which are not provided on voluntary approbation, the analysis and branding according to part one of this Item is guaranteed by the manufacturer.

7-1. The jewelry and other products made in the Republic of Belarus from silver weighing up to 3 grams inclusive are subject to voluntary branding (except for the products from silver made by individual orders of citizens of the jewelry and other products and (or) scrap and waste of jewelry and other products belonging to them). Such products are subject to obligatory approbation and the analysis according to the procedure, established by this Provision.

8. The manufacturer shall apply prints of the mark appropriated to him on all jewelry and other products made in the Republic of Belarus.

9. From citizens on approbation and branding the jewelry and other products having damaged or the polished prints of the state assay brands of the Republic of Belarus or the USSR, and also the jewelry and other products having the prints of foreign state assay brands or digital designation of test imported on customs area of the Eurasian Economic Union according to the procedure, established by the legal acts constituting the regulatory legal base of the Customs union and the Common economic space and (or) the right of the Eurasian Economic Union, regulating procedure for movement by physical persons of goods for private use are accepted.

10. The jewelry and other products which are subject to approbation, the analysis and branding according to this Provision shall not contain the parts made of non-noble metals, except for:

edges of knives, screw parts of corkscrews and similar parts of products which cannot be made of precious metals;

mechanisms of hours, lighters and similar products;

springs, axes of hinges, pins;

pins of brooches, badges and similar products.

The branding of the products representing combination of parts from precious and non-noble metals is made if parts from non-noble metals demountable and (or) separable or easily differ from parts from precious metals in the color, and also in the presence on visible parts from non-noble metals of prints of sign "mt" (metal) or similar ("нерж", "steel" and so forth) or special designation of the metal which is rapped out mechanically or engraved.

Nonmetallic parts shall not be covered (are plated) or painted so that to have similarity to precious metals. Filling with nonmetallic materials of jewelry and other products and (or) their parts in the quantities necessary for their fixing or fixing on (v) jewelry and other products and (or) their parts is allowed.

11. The products having test below the established minimum test for the corresponding precious metal and also the products made using non-noble metals and other materials except specified in Item 10 of this provision, are not subject to branding and realization as jewelry and other products. Such products shall not have the prints of brands on the appearance reminding prints of the state assay brands of the Republic of Belarus or tests of precious metals.

Appendix

to Regulations on the state assay supervision in the Republic of Belarus

The list of products (their parts) which are not subject to obligatory approbation, the analysis and branding

1. The jewelry and other products which are the material historical and cultural values or cultural values included in Museum fund of the Republic of Belarus in the presence of the conclusion about value assessment of cultural values.

2. The state awards, coins, remaining balance of jewelry and other products provided in different forms.

3. Small notches (incrustation) by platinum, gold, palladium and (or) silver on weapon, vases, dishes, caskets, objects of religious cult and similar objects from non-noble metals (materials).

4. Feathers from precious metals of handles from non-noble metals.

5. Plates for texts from precious metals or salaries from precious metals of books, albums, folders and similar products.
