About the Agency of work and employment of the population

According to article 12 of the Constitutional law of the Republic of Tajikistan "About the Government of the Republic of Tajikistan" and in pursuance of the Presidential decree of the Republic of Tajikistan of November 19, 2013, No. 12 "About enhancement of structure of the central executive bodies of the Republic of Tajikistan", the Government of the Republic of Tajikistan decides:

1. Approve the Provision, Structure of central office. Scheme of management and List of the organizations of system of the Agency of work and employment of the population (appendix 1, 2, 3 and 4).

2. Establish the extreme number of employees of the Agency of work and employment of the population in number of 389 (without service personnel) units, including central office in number of 50 units.

3. Permit the Agency of work and employment of the population to have two deputy directors, including one first.

4. Establish to the Agency of work and employment of the population limit of office cars in number of 5 units, including to central office of 3 units.

5. To perform financing of central office, the organizations specified in the Scheme of management of the Agency of work and employment of the population, except for the state unitary enterprises at the expense of means of the republican budget.

6. Declare invalid the order of the Government of the Republic of Tajikistan of March 3, 2007, No. 102 "About the State agency of social protection, employment of the population and migration".

Regulations on the Agency of work and employment of the population

1. General provisions

1. The agency of work and employment of the population (further - the Agency) is executive body of the government of the Republic of Tajikistan, performs tasks on rendering the state services in the established field of activity and performs work in this direction under direct management of the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan.

2. The agency is included into the Scheme of management of the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan.

3. The agency in the activities is guided by the Constitution of the Republic of Tajikistan, the laws of the Republic of Tajikistan, decisions of Majlisi Oli of the Republic of Tajikistan, decrees and orders of the President of the Republic of Tajikistan, the orders of the Government of the Republic of Tajikistan, orders of the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan, the international legal acts recognized by the Republic of Tajikistan and this Provision.

4. The agency performs the activities in interaction with local executive bodies of the government, the international, public and other organizations.

2. Functions

5. The agency performs the following functions in the established field of activity:

a) in the field of employment relationships;

- ensuring sustainable development of social partnership by signing of industry agreements, collective agreements and labor decisions in the companies, organizations and the organizations in the territory of areas, the cities, areas;

- registration of the industry (tariff) agreements signed by different executive bodies of the government of areas, the cities, areas and collective agreements signed by the organizations and the companies in the territory of areas, the cities, areas;

- cooperation with Federation of independent labor unions of Tajikistan, Merging of employers of Tajikistan, structures of the central executive bodies of the government in areas, the cities and areas according to the solution of questions of regulation of employment relationships;

- permanent carrying out the analysis of the questions concerning employment relationships and level of living of the population in the companies and the organizations in the territory of areas, the cities, areas and provision of data in authorized bodies;

- submission of the detailed information about elimination available in the field of problems;

- implementation of state policy in the direction of employment relationships and level of living of the population in the companies and the organizations in the territory of areas, the cities and areas;

- studying of tendencies and questions of further development of application of labor guarantees to the population of areas, cities, areas and submission to higher authorized bodies;

- rendering the methodical and practical help to the organizations and companies in the territory of areas, the cities and areas for application of regulatory legal acts of rather employment relationships and level of living of the population;

- on the basis of the questions considered at the levels of areas, cities and areas, provision of offers on enhancement and development of the legislation of industry to higher authorized bodies;

- ensuring timely accomplishment of acts, instructions and orders of higher authorized bodies of rather employment relationships and level of living of the population;

b) in the field of assistance of employment of the population:

- creates permanent monitoring system of the labor market at the republican, regional, city and district levels taking into account condition of the foreign and domestic market of work;

- for the purpose of market analysis of work, determination of the demand and supply on labor power, effective use of labor power in economy industries, takes measures for work market situation research;

- provides in accordance with the established procedure collection and timely provision of statistical market information of work and realizes measures for introduction of new types of the statistical data reflecting real market situation of work;

- annually publishes the newsletter on market situation of work and employment of the population, informs the interested bodies and the organizations on its condition;

- holds events for the purpose of adjustment of the mechanism of social partnership for creation, preserving and recovery of workplaces, and also professional training, retraining and advanced training of personnel and specialists;

- together with the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan, executive local authorities of the government, with involvement of other relevant organs takes part in project development of the state, regional and industry programs of assistance of employment of the population, including target programs of assistance of employment for separate categories of the population, taking into account market situation of work, the employment level and unemployment on the basis of the analysis of condition of manpower, provides their accomplishment within the powers;

- develops and submits for consideration to executive local authorities of the government of the offer on establishment of quota for employment of the persons requiring social protection and experiencing difficulties in employment on the companies, organizations and the organizations irrespective of forms of their property and provides their execution within the powers;

- promotes educational, professional training and retraining of persons physically challenged;

- records free workplaces (vacancies), determines offers on the existing free workplaces and demand in labor power, creates databank on vacancies in the external and internal labor markets;

- provides open entry to databank on vacancies and offers of labor power for citizens and employers, gives help to the unemployed in matching of suitable work, and to employers in matching of necessary workers;

- realizes measures for professional training of labor migrants, assistance to their employment behind repartitions of the country;

- by means of the edition of booklets, posters and preparation of newsletters and stands, and also the organizations of telebroadcasts are informed by the population on work market situation, on implementable measures for assistance of employment of the population, the legislation in this sphere;

- takes part in the organization and carrying out social jobs;

- helps individual employment of jobless citizens by means of rendering consulting services, the organization and holding trainings and seminars, financial support and gives help in the organization of new workplaces for the unemployed and the small enterprises which are looking for work as the way of creation on production and rendering services, and also subsidiary farms:

- provides promotion of occupation with entrepreneurship among the jobless citizens registered in local authorities of the agency;

- develops and realizes measures for active assistance of employment of jobless citizens by means of creation of Items of hiring of labor power, employment exchanges, organizations on external employment and other specialized business entities;

- regularly with participation of employers holds territorial and industry fair of free workplaces;

- provides services in professional orientation and consultation to the jobless and looking for work citizens;

- by means of fairs conducts sociological surveys;

- together with authorized state bodies will organize and coordinates activities of education system of adults in the Republic of Tajikistan, develops and submits state standards of education system of adults for approval of the Ministry of Labour of migration and employment of the population of the Republic of Tajikistan;

- in cooperation with authorized state bodies develops and approves training programs by training of adults, provides services in the organization of education of adults;

- is directly involved in development of standards of national professions;

- determines the need for training, creates system of training centers by training of adults, in coordination with authorized state bodies implements modular, innovative and other modern training methods;

- organizes professional training, retraining and advanced training of the unemployed and the citizens who are looking for work, solves together with local executive bodies of the government and employers questions of their employment after training completion;

- conducts regular researches for determination of demand of pas labor skills;

- will organize professional training, advanced training and retraining of the unemployed and the citizens who are looking for work, together with local executive bodies state the authorities and employers promotes employment of graduates of educational institutions on professional training;

- establishes procedure for professional training, advanced training and certification of professional skills of the unemployed who are looking for work of citizens and labor migrants by self-financing;

- will organize methodical management of system of professional training of adults;

- develops and realizes measures for development of procedure for social partnership in process of education and training of adults;

- in accordance with the established procedure will organize work on determination and recognition of the status of the unemployed of citizens, to destination and allowance payment on unemployment, and also payment of grants during training in the direction of local authorities of the agency;

- in accordance with the established procedure makes decisions on suspension or the termination of allowance payment on unemployment, and also payment of grants during training;

- prepares and sends to local executive bodies of the government of the offer on need of establishment of surcharge to unemployment benefit or to grant to the jobless citizens having disabled dependents aged up to 15 years;

- carries out social expertize of the developed state target and investing programs on creation of new workplaces;

- draws the conclusions about need of attraction by business entities from zarubezh of labor power to the republic.

The agency along with the listed powers within implementation of international treaties of the Republic of Tajikistan on cooperation performs coordination of mutual deliveries by the organizations relating to the established field of activity and the Agencies, determination and approval of lists of such mutual deliveries:

- holds in accordance with the established procedure competitions and signs public contracts, on order placement on delivery of goods, performance of works, rendering services, to carrying out research, developmental and technological works for the state needs in the established field of activity, including for ensuring needs of the Agency;

- performs functions of the state customer of target scientific and technical and investing programs and projects in the established field of activity of the Agency;

- interacts in accordance with the established procedure with public authorities of foreign states, the international and foreign organizations in the established field of activity of the Agency;

- performs reception of citizens, provides timely and complete examination of oral and written addresses of citizens, adoption on them of decisions and the direction to applicants of answers in the terms established by the legislation of the Republic of Tajikistan;

- provides protection of the data which are the state secret within the competence;

- provides mobilization preparation of central office of the Agency, and also control and coordination of activities of the organizations for mobilization preparation which are under its authority;

- will organize professional training, retraining, advanced training and training of employees of the Agency;

- performs according to the legislation of the Republic of Tajikistan work on completing, storage, accounting and use of the archive documents formed in the course of activities of the Agency;

- performs functions of the main manager and the receiver of means of the republican budget and other financial sources provided for content of the Agency;

- will organize the congresses, conferences, seminars, exhibitions and other actions in the established field of activity of the Agency.

7. The agency for the purpose of realization of powers in the established field of activity has the right:

- make to legal entities and physical persons explanations on the questions carried to the established field of activity;

- attract scientific and other organizations, scientists and specialists to study of questions of the established field of activity;

- perform the organization of works and management of activities of subordinated structures;

- The agency has no right to perform normative legal regulation in the established field of activity and function on control and supervision, except the cases established by presidential decrees of the Republic of Tajikistan of pla the orders of the Government of the Republic of Tajikistan. These restrictions of powers of the Agency do not extend to powers of the head of the Agency according to the solution of personnel problems and questions of the organization of activities of the Agency, control of activities of its structural divisions.

3. Organization of activities

8. The agency is headed by the director appointed to position and dismissed by the Government of the Republic of Tajikistan on representation of the Minister of work, migration and employment of the population of the Republic of Tajikistan.

The director of the Agency bears the personal responsibility for accomplishment of the functions assigned to the Agency.

The director of the Agency has the first deputy and the deputy appointed to position and dismissed by the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan on representation of the director of the Agency.

The number of deputy directors of the Agency is determined by the Government of the Republic of Tajikistan.

9. Director of the Agency:

- submits for consideration of the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan the project of the Provision, the Scheme of management, extreme number of employees of central office of the Agency for the subsequent approval by the Government of the Republic of Tajikistan;

- represents to the Ministry of Labour, migrations and employment of the population of the Republic of Tajikistan the annual plan and indicators of activities of the Agency, and also the report on their execution;

- represents to the Ministry of Labour, migrations and employment of the population of the Republic of Tajikistan offers on position assignment and on dismissal of deputy directors and the chief accountant of the Agency, heads regional and Dushanbe the city Agencies of bodies;

- approves with the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan position assignment and dismissal of heads of the organization of system of the Agency;

- appoints to position and dismisses deputy managers and chief accountants Dushanbe city and regional bodies, and also the organizations of system of the Agency on representation of their heads;

- in coordination with local executive bodies of the government of the cities and areas appoints to position and dismisses heads of city and district bodies of the Agency, and also chief accountants of bodies of the Agency on representation of their management;

- within, approved by the Government of the Republic of Tajikistan, the number of workers, salary fund and the staff list of central office of the Agency according to standard requirements, and also expense budget on its content in limits by the Government of the Republic of Tajikistan established regulations represents to the Ministry of Labour, migrations and employment of the population of the Republic of Tajikistan for approval number;

- distributes obligations between the deputies and heads of structural divisions of Central office of the Agency;

- approves regulations on structural divisions of central office, and also in accordance with the established procedure provisions and charters of the organizations of system of the Agency;

- makes the decision on the announcement of tenders on holding the posts in central office of the Agency, in local authorities and the organizations of system, appoints to position and dismisses employees of central office (except management) the Agencies;

- according to the procedure approved with the Ministry of Finance of the Republic of Tajikistan performs financing of maintenance costs of Central office of the Agency and the bodies provided in its scheme of management at the expense of means of the republican budget, and also at the expense of special means;

- in the limits set by the Government of the Republic of Tajikistan of regulations approves the number of employees of structure of Central office of the Agency, salary fund, the staff list of local authorities and organizations of system of the Agency according to standard requirements, and also expense budget on their contents of budgetary funds for the corresponding period:

- issues orders and orders, approves instructions, regulations, the rules and standards obligatory for execution by all employees of central office, local authorities and the organizations of system of the Agency, and also provides control of their execution;

- approves the work plan and indicators of activities of local authorities and organizations of system of the Agency, and also hears reports on their activities;

- represents to the Ministry of Labour, migrations and employment of the population of the Republic of Tajikistan offers on creation, reorganization and liquidation of the organizations of system of the Agency for the subsequent submission to the Government of the Republic of Tajikistan;

- gives instructions to the organizations of system of the Agency and controls their accomplishment;

- cancels contradicting the legislation and the established regulations of the decision of bodies and organizations of system of the Agency if other procedure for cancellation of decisions is not established by the law;

- resolves issues of financial incentive of employees of the Agency, heads of local authorities and the organizations of system, represents in accordance with the established procedure for labor progress and achievements of workers to the state awards of the Republic of Tajikistan.

10. For consideration of questions of activities and submission of recommendations under the Agency coordinating bodies (councils, the commissions, working groups), including cross-industry are in accordance with the established procedure created.

11. The agency, for the purpose of accomplishment of the tasks assigned to it, in accordance with the established procedure performs the edition of bulletins, magazines and other printing editions.

12. The agency is legal entity, has seal with the image of the State Emblem of the Republic of Tajikistan with the name in the state and Russian languages, the corresponding seals, stamps, forms and is financed from Head department of the Central Treasury of the Ministry of Finance of the Republic of Tajikistan.
