Based on provision of Art. 8 of the Law on geodesy, cartography and geoinformatics No. 778-XV of December 27, 2001. (The official monitor of the Republic of Moldova, 2002, Art. No. 29-31, 160), with subsequent changes and amendments, and Art. 14 of the Law on the central branch public management No. 98 of May 4, 2012. (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537) DECIDES: the Government

1. Approve:

Regulations on the organization and activities of the State inspectorate for geodetic, technical supervision and the mode, according to appendix No. 1;

structure of the State inspectorate for geodetic, technical supervision and the mode, according to appendix No. 2.

2. Establish the extreme number of staff of the State inspectorate for geodetic, technical supervision and the mode in number of 8 units, with the annual salary fund according to the current legislation.

3. In Item 2 of the order of the Government No. 383 of May 12, 2010 "About approval of regulations on the organization and functioning of the Agency of land relations and the inventory, structure and the extreme number of staff of its central office" (Official monitor of the Republic of Moldova, 2010, Art. No. 75-77, 453), with subsequent changes and amendments, to replace figure "3" with figure "8".

4. Recognize invalid the orders of the Government, according to appendix No. 3.

Regulations on the organization and activities of the State inspectorate for geodetic, technical supervision and mode, its structure and extreme number of staff

Chapter I. General provisions

1. The regulations on the organization and activities of the State inspectorate for geodetic, technical supervision and the mode (further - the Provision) establish legal position of the State inspectorate for geodetic, technical supervision and the mode subordinated to the Agency of land relations and inventory (further - Inspection), tasks, the main functions, the main rights and obligations, and also procedure for its organization and activities.

2. Inspection is the administrative authority submitting to the Agency of land relations and inventory which exercises supervision and the state control of compliance with law in the field of geodesy, cartography and geoinformatics.

3. Inspection is the legal entity of the public law financed by the money allocated from the government budget has seal with the State Emblem of the Republic of Moldova, the treasurer account, financial and appliances, and also other attributes necessary for normal work.

4. Inspection performs the activities according to the Constitution of the Republic of Moldova, the laws and resolutions of Parliament, presidential decrees of the Republic of Moldova, ordinances, resolutions and orders of the Government, orders of the Agency of land relations and the inventory, regulations and normative and technical documents, international agreements and conventions which party the Republic of Moldova is, and also this Provision.

Chapter II. Tasks, main functions, obligations and rights of Inspection

5. The task of Inspection consists in protection of interests of the state in the field of geodesy, cartography and geoinformatics by implementation, according to the principles of transparency and legality, supervision and control of geodetic, cartographic and geoinformatichesky activities.

6. For accomplishment of tasks in the field of geodesy, cartography and geoinformatics the following main functions are assigned to Inspection:

1) ensuring compliance with the legislation in the field of geodesy, cartography and geoinformatics;

2) control and supervision of topographical, geodetic, photogrammetric, aero photofilm-making, gravimetric, cartographic, geoinformatichesky works and their accounting, geodetic and cartographic works of special (industry) purpose, surveys of the engineering communications, that is the underground communications and spaces (further – land and cartographic works) which are carried out by the physical persons and legal entities having the license in the field, except for being within the competence of the Ministry of Defence;

3) supervision of observance of the mode and method of creation, use, reproduction, preserving, transfer and accounting of special materials within accomplishment of land and cartographic works by the state companies and public organizations;

4) supervision of correctness of demarcation of frontier of the Republic of Moldova;

5) metrological supervision of geodetic measuring means.

7. The main objectives of Inspection in the field of geodetic, cartographic and geoinformatichesky supervision:

1) control of method of application of national systems of coordinating of land and cartographic works;

2) supervision of technological level and quality of the land and cartographic works performed by physical persons and legal entities concerning implementation of works and compliance with law in the field of geodesy and cartography, state standards and other regulations;

3) control of observance of established procedure of creation by physical persons and legal entities and edition (reproduction) of plans, cards and atlases;

4) supervision of the correct graphical tracing on the published cards and in atlases of frontier of the Republic of Moldova and borders of foreign states, borders of the administrative territories and other characteristic elements of cards and atlases, and also behind the correct specifying of names and transcription of names of settlements and geographical objects;

5) accounting and the state acceptance of the land and cartographic works which are carried out in the territory of the Republic of Moldova;

6) accounting of physical persons and legal entities which perform land and cartographic works;

7) verification of engineering designs (programs) for land and cartographic works with the purpose of establishment of compliance of the applied techniques and technologies to modern technological level and use of the data obtained from the authorized sources;

8) control over the implementation of actions for ensuring safety and to recovery of Items of the state geodetic networks, and also their accounting in the territory of the Republic of Moldova;

9) observance of control procedure and accounting of checks according to Law No. 131 provisions of June 8, 2012 "About the state control of business activity".

8. Inspection is given the following basic rights:

1) to state offenses and to constitute protocols based on materials of check (control) in compliance with the legislation;

2) to notify Licensed chamber on the violations found in activities of owners of the license in topogeodezichesky and cartographic area, submitting supporting documents;

3) to consider materials (cases) in connection with violations of the law in the field of geodesy, cartography and geoinformatics and to transfer to criminal prosecution authorities and other law enforcement agencies these materials for studying and involvement of guilty persons to administrative or criminal liability, on circumstances;

To receive 4) from the ministries and public organizations perspective plans of land and cartographic works in order to avoid their parallelism and duplication;

5) to demand from the state companies and public organizations of timely representation of cartograms, data and materials about the performed works for accounting and the land analysis of the territory, and also for completing of National fund of geospatial data;

6) to publish instructions according to Law No. 131 provisions of June 8, 2012 on the state control of predprinimatelny activities for the heads and persons responsible for carrying out land and cartographic works, about remedial action and the mistakes revealed during control;

To attract 7) with the consent of heads of the state companies of specialists of these companies to implementation of the state acceptance of complete land and cartographic works.

Chapter III. Organization of activities of Inspection

9. Management of Inspection is performed of her chief. Position assignment, change, suspension and the termination of the office relations of the chief of Inspection are made by the CEO of the Agency of land relations and the inventory according to the law.

10. In the absence of the chief of Inspection of its obligation one of division managers appointed by the order carries out.

11. The chief of Inspection carries out the following obligations:

1) will be organized by activities and bear responsibility for ensuring proper management;

2) is provided by accomplishment of the laws, presidential decrees of the Republic of Moldova, resolutions of Parliament, ordinances, resolutions and orders of the Government, orders of the director of the Agency of land relations and the inventory, and also accomplishment of the tasks following from this provision and other regulations;

3) distributes tasks and obligations, establishes responsibility of the deputy chief and personnel of Inspection;

4) in writing delegates the obligations to the deputy chief and personnel of Inspection;

5) constitutes protocols;

6) signs also other documents entering competence of Inspection;

7) approves job descriptions for the state positions, individual tasks of activities, and also indicators of effectiveness of government employees;

8) approves the program of activities;

Cancels 9) or changes the statements of inspection which are drawn up as a result of supervision (control) executed by Inspection if they contradict the legislation;

10) directs personnel policy and manages human resources of Inspection;

11) appoints to positions, changes, stops and stops the office relations of government employees in inspection according to the law, employs and stops employment relationships of the personnel of Inspection working at contractual basis within the labor law;

12) is provided by systematic and planned process of professional development of government employees;

13) approves the staff list of Inspection and the scheme of its filling;

14) issues the orders connected with competence of Inspection;

15) sends for consideration Boards of the Agency of land relations and the inventory questions, work-related Inspections;

16) coordinates the relations with public bodies of the Republic of Moldova and the international organizations for the questions connected with accomplishment of functions of Inspection;

17) carries out other powers, stipulated by the legislation.

12. Correspondence of Inspection is signed by the chief of Inspection and/or his deputy. Signatures on official documents of Inspection are appended by the chief/deputy chief of Inspection in the following forms: personal signature in writing, digital signature.

13. In spheres of the activities the Inspectorate cooperates (within the commissions and working groups) with the central industry bodies of the central public management and bodies of local public authority, civil society, and also with the international organizations.

14. The property of Inspection consists of fixed assets and current assets, and also other material values.

15. In Inspection government employees whose office relations are governed by the Law No. 158-XVI of July 4, 2008 on the state position and the status of the government employee, and personnel on contractual basis which office relations are governed by the labor law work.

Chapter IV. Special provisions

16. The procedure for education, reorganization and liquidation of Inspection is regulated according to the Law No. 98 of May 4, 2012 on the central branch public management.

17. Orders of Inspection are obligatory for all physical persons and legal entities, and also the economic agents performing activities in the field of geodesy, cartography and geoinformatics.

18. Control acts and orders of Inspection can be disputed in the Agency of land relations and inventory and in degrees of jurisdiction.
